( D) Adjournment 1 ELGIN LIQUOR COMMISSION MEETING January 27, 1982 A special meeting of the Elgin Liquor Commission was called to order at 9:45 p.m. by Board President Verbic. ROLL CALL Roll call was answered by Board Members Schmidt and Waters and Board President Verbic. Also present: Andrea Paetsch, Acting City Clerk. Issuance of Class B License to Oak Brook Beverage Centers, Inc. , d/b/a Osco Drug at 820 Summit Street. A motion was made by Board Member Schmidt and seconded by Board Member Waters to issue a Class B Liquor License to Oak Brook Beverage Centers, Inc. , d/b/a Osco Drug. (2) Consideration of transferring liquor license for Leitner ' s from Paul Toufexis to Nick Toufexis ( D) Adjournment r eft Elgin Liquor Commission Meeting February 10, 1982 A special meeting of the Elgin Liquor Commission was called to order at 4: 07 p.m. , by Board President Verbic. ROLL CALL Roll call was answered by Board Member Schmidt and Board President Verbic. Absent : Board Member Waters . Also present : Marie Yearman, City Clerk Transfer of license for Conner ' s Tavern from 22 North Grove to 17 North Grove (Formerly Paul ' s Tap) . Corporation Counsel Jentsch stated that several months ago the question was raised as to whether or not the site of Paul ' s Tap could be used as a liquor establishment. At that time Attorney Jentsch advised the Commission that the Statute ( Ill . Rev . Stat . , Ch . 43, 156) prohibits the issuance of a license for premises where a license has been revoked , for a period of one year after revocation. Attorney Jentsch indicated in the case of Paul ' s Tap the year ' s period of time would not end until December, 1982 . Attorney Jentsch further stated that he had communicated with the Illinois Liquor Commission in Chicago and they indicated they considered the statutory requirement only directive and they would look at the issuance of a license for the premises if same were issued by the local authorities . They would investigate to see if the new parties were implicated in the cause for revocation of the previous license . Attorney Jentsch stated the Commission could take the same position as the State Board, but that it might have to be defended. Mayor Verbic stated that when he discussed the matter with the State Board they advised him they had never been challenged in the past and it was their position that only the owner of the license should be penalized . Jack Conner stated that the bank is planning to tear down the building which presently houses his establishment for a parking lot and he is more or less on a month to month tenancy. Mr. Conner said he planned to carry on the same type of operation that he has had for over 30 years and as the record would reflect there have been no problems with his business operation. Board Member Schmidt made a motion, seconded by Board President Verbic to approve the transfer of the Conner ' s Tavern license to 17 North Grove subject to the presentation of the proper documents to the city subject Yeas : Board Member Schmidt and Board President Verbic. Nays : None . Elgin Liquor Commission Meeting February 10, 1982 Page 2 Transfer of liquor license from Paul Toufexis , d/b/a Leitner' s , to Nick Toufexis . Mayor Verbic advised the Commission that Nick Toufexis had informed him that he and his brother were no longer partners in the operation of the Leitner ' s establishment . Nick Toufexis represented that at the time of the purchase of said business he had contributed 100% of the funds necessary to complete the purchase and up to the present time he was the sole financial contributor. Board President Verbic and Board Member Schmidt indicated they would have no objection to the transfer of the license to Nick Toufexis . The City Clerk advised the Board President that it would be necessary for Nick Toufexis to re-apply for the license and to furnish evidence from Paul Toufexis of his willingness to the transfer of the license . Nick Toufexis was present and acknowledged that he would furnish the City Clerk the requested documents . Board Member Schmidt made a motion, seconded by Board President to tentatively approve the transfer of the subject license, after the necessary documents are received and reviewed by the Commission. Yeas : Board Member Schmidt and Board President Verbic. Nays : None. ADJOURNMENT There being no further business to come before the Elgin Liquor Commission, Board Member Schmidt made a motion, seconded by Board President Verbic, to adjourn the meeting. Notes - Comparative Statement of Liquor License Fees St. Charles - An additional fee of $300 per year is charged establishments with musical entertainment remaining open until 2:00 A.M. Sunday. East Dundee - A $1,500 per year fee is charged for "On-premise" consumption and original package sales for outdoor consumption and entertainment, Saturday and Sunday only. (This class is basically set up for Beer Garden operations.) East Dundee also has a limitation by ordinance on the number of each class of licenses that can be issued. West Dundee - Restaurants, lounges, and bowling lanes that serve liquor before noon (Sunday brunch) pay the following fees: $2,100 for the first bar; $400 for the second bar; $300 each bar in excess of two. Hanover Park - An additional fee of $500 per year is charged establishments with on or off consumption and package sales of liquor with a late late hours provision. Civic organizations may purchase an annual license to cover various fund- raisers throughout the year for a $75.00 annual fee. Elgin Liquor Commission Meeting April 8, 1982 A special meeting of the Elgin Liquor Commission was called to order at 4:35 p.m. , by Board President Verbic. ROLL CALL Roll call was answered by Board Member Schmidt and Waters , and Board President Verbic. Absent : None. Also present : Marie Yearman and Dan Blondin Consideration of 1982-83 Liquor License Fees. The Commission reviewed a comparative statement of liquor license fees for surrounding communities prepared by the Finance Department, together with a statement of recommended increases submitted by Board Member Waters . Board Member Schmidt stated he felt it was not an appropriate time to increase the fees because of the present economy. Mr. Schmidt also pointed out that additional revenue had been generated by reason of the increase in the B licenses . Mr. Schmidt suggested that the fees remain the same at this time, with a review of same in a year . Board President Verbic stated that he had visited ten establishments and in each instance he was informed that business is down and the present economy is hitting them pretty hard . Mr. Verbic suggest no change at this time and a further review of the fees at budget time. Board Member Waters stated that he could understand that no body would welcome an increase and the problem with the economy, but on the other hand the city is experiencing difficulty and there is a need for additional revenue. Mr. Waters stated that the comparisons reflected in his report indicated that the city is on the low side on six of the liquor license classifications , and the city could at least charge what other communities are charging. Board Member Schmidt made a motion, seconded by Board Member Waters, that there would be no increase in the license fees at this time . Yeas : Board Member Schmidt and Board President Verbic. (5) Adjournment r r 4 Elgin Liquor Commission Meeting July 14, 1982 A meeting of the Elgin Liquor Commission was called to order at 6: 25 p.m. , in the Council Conference Room of City Hall . Roll call was answered by Board Member Schmidt and Board President Verbic. Absent : Board Member Waters . Consideration of bartender ' s permit application by David West . The Commission reviewed a letter sent to Mr. West by Assistant Corporation Counsel Blondin, which read in part: "On you application you attested that you had not been convicted of any offense in the previous 10 years . Our records indicate that on June 12, 1979 and August 22, 1978 you were convicted of misdemeanor thefts . On you application you falsely certified that your answers were true when in fact they were not ." The City Clerk advised the Commission that based on the above information a letter denying this application was sent to Mr. West . Mr. West requested that his request for a bartender ' s permit be reviewed by the Liquor Commission. A letter was sent to Mr. West advising him that his matter would be reviewed by the Commission this evening and he was invited to attend. (Mr. West was not present) Board Member Schmidt made a motion, seconded by Board President Verbic to uphold Attorney Blondin ' s decision and deny Mr. West ' s permit . Yeas : Board Member Schmidt and Board President Verbic. Nays : None. Consideration of Chuck' s Family Inn request for a beer and wine license. Board President Verbic suggested that staff seek information from other communities who presently have a beer and wine license in order to ascertain what restrictions and license fees they have in connection with this type license. Board Member Schmidt made a motion, seconded by Board President Verbic for staff to bring this matter back with the requested information. Yeas: Board Member Schmidt and Board President Verbic. The Commission reviewed an application for a Class E license made by Faye Jaynes, Robert Spayne and Victor Jaynes to operate a restaurant/cocktail lounge at 11 Douglas Avenue. (6) Adjournment r Elgin Liquor Commission Meeting October 13, 1982 A meeting of the Elgin Liquor Commission was called to order at 6: 05 p.m. , in the Council Conference Room of City Hall . Members present : Board Member Hansen and Nelson, and Board President Verbic. Discussion of FBI User Fee Program for all future liquor license applicants. The Commission was advised that effective October 1 , 1982, liquor license applicant fingerprint cards would have to be processed through the FBI for record checks and the fee for this service would be $ 12.00. Board Member Hansen made a motion, seconded by Board Member Nelson that the Commission recommend to the Council that the City Code be amended to provide for payment by the applicant for a license in the amount of $ 12.00. Further discussion of a beer and wine license. eft The City Clerk advised the Commission that at the present time Chuck' s Family Inn was the only establishment interested in a beer and wine license, but in the past there had been several other inquiries from establishments that are no longer in business. The Commission reviewed a survey which reflected that both Dundee and South Elgin have such a license available. Board Member Nelson made a motion, seconded by Board Member Hansen that the Commission recommend to the Council that the City Code be amended to provide for a Beer and Wine License. The service of same would be from a service bar only and the yearly cost of said license would be $750.00. Yeas : Board Member Hansen, Nelson and Board President Verbic. Review of bartender ' s permit application by Vern Womac. Assistant Corporation Counsel Blondin advised the Commission that First Stop Liquors, where Vern Womac is employed, has had two incidents involving the sale of liquor to minors . Mr. Blondin stated that at this time he did not have the police department reports but that he would secure same for the Commission ' s review. Review of Leitner ' s 1982-83 Liquor License Renewal Application The Commission was advised by the City Clerk and Assistant Corporation Counsel that Mr. Paul Tofexis had informed them that he had not signed the renewal liquor application for Leitner ' s for the year 1981 or 1982 and that in fact his signature had been forged. The Assistant Corporation Counsel suggested that a formal hearing be set for this matter in order that all parties concerned could be present. Board Member Nelson made a motion, seconded by Board Member Hansen to set a hearing for November 18, 1982 at 4 :00 p.m. Yeas : Board Member Hansen, Nelson and Board President Verbic. Nays : None. Review of liquor violations at First Stop Liquors The Commission reviewed reports covering the sale of liquor to minors on two separate occasions. Both reports indicated that Vern Womack was found guilty of these charges in court. The Commission asked that this matter also be brought to the hearing on November 18th, and that Lee Womack and Vern Womack be present . Review of health and safety violations at Leitner ' s and Apollo Restaurants. The Commission requested that this matter also be set for a formal hearing on November 18th.
