3. Old Business
• Open Meetings Act Training Update — all commissioners have completed the
training.
• Brochure Review—This project has been postponed until after the I-Fest. Janice
will provide photos w/captions for the webpage. The HRC webpage should link
to the Agendas and Minutes page of the city's website, if possible.
• International Festival Update — Cash and commitments total $19,500 to date,
including Sherman Hospital, ECC, and Sam's Club. At least $4,000 will go to the
NFP's who have participated. A very culturally diverse group of entertainers has
been lined up, including a semi-finalist in America's Got Talent. Children's
activities, food vendors and entertainment are on board. More parade
participants are needed.
• MLK Update — Vice Chair Hare is getting bids for the breakfast location and
caterer. Either 250 or 500 calendars will be printed. The committee is meeting
August 19 to create a tentative budget. The event may span 4 days again this
year. The MLK committee sent a letter to Chair lqbal who asked that the HRC
hold off on voting whether to expend funds. He would like Shaan and Rose to
join us to discuss the budget. Chair lqbal also observed that the breakfast
attendees were a homogenous group and wondered how to get that and the
public program a more diverse audience. Vice Chair Hare said that personal
invitations work. Discussion whether the HRC would invite/sponsor the IFest
Committee or Image Commission to the MLK events.
4. New Business
• Legal Opinions — The legal department provided an opinion that stated the HRC
does not have the authority to join not for profit organizations. The legal
department also provided an opinion that stated IFest, MLK and other similar

of a quorum of commissioners is an open meeting and must be publicly posted.
Staff Liaison Cohen will be alerted of such meetings and send an agenda to the
City Clerk.
• Participation In Diversity Council — HRC members were invited to participate in
the City's Diversity Council. The Diversity Council will develop components of a
diversity strategy for employment and contracts with the city. The
commissioners requested a little more information before committing to the
project.
5. Adjournment
There being no further business, Commissioner Ortega-Ehreth made a motion to
adjourn, seconded by Vice Chair Hare. Meeting adjourned at 7:38 pm.

Chamber of Commerce Issue
Commissioner lqbal reported that he and Commissioner Ortega-Ehreth met with
Carol, Dan and Don to discuss the concern raised in Jo Ann Armenta's email. lqbal
indicated that the concerns were refuted by the Chamber and EALA.
A discussion ensued as to the format and content of a proper response to the email.
Commissioner Habun pointed out that the email did not allege any discrimination on
the part of any organization but rather raised a larger concern about diversity and
outreach. The HRC was being asked to discuss whether the city should require not
for profits receiving city funds to demonstrate diversity and inclusion in its staff and
boards of directors. Habun indicated the HRC should have a conversation about
outreach, not perform any investigations because that was not the issue at hand.
Commissioner Wars agreed that the email was not a formal complaint.
Carol Gieske provided background information on the Elgin Area Leadership
Academy. The EALA has been inclusive since its inception in 1991. Dan and Don are
volunteers and the program receives no funds from the city, directly or indirectly.
The EALA has a volunteer board and the program is run by volunteers. The EALA
r
makes strong effects to include many segments of society into its program. The
EALA has asked for assistance in recruitment of the Hispanic population and has
offered scholarships. The EALA would love to have the HRC and/or Jo Ann help
them recruit additional minorities to their program.
Commissioner Habun made a motion that a letter be written in response to the
email to reflect:
1. The EALA receives no funds from the city
2. The EALA has reached out affirmatively to the Hispanic community since its
inception in 1991 and continues in its efforts to engage the diversity of the Elgin
area community
3. If there are any questions, please contact either the HRC or the Chamber of
Commerce

FROM: Gail Cohen, Staff Liaison
RE: Housing Discrimination Complaint—Linden Ave
DATE: November 6, 2012
I received a complaint from a resident alleging that she was rented an apartment due to the fact her two
children would be staying with her on weekend.
The complainant stated that she and her boyfriend were shown an apartment on Linden Avenue. The
apartment was advertised on Craig's List as a one bedroom apartment. The complainant claimed that
although the apartment was listed as a one bedroom, it was actually a two bedroom.
The landlord asked the complainant if she had children and when told she did, inquired of the ages. The
complainant's children are currently 16(son) and 11(daughter). Hearing this, the landlord allegedly said
"I'm sorry but I can't rent [the apartment] to you. I am looking for two single adults."
I called the landlord who readily agreed that she did not want children in that apartment because the
building was old and sound travelled to the other apartments and that the apartment had only one
(Ph'. bedroom.
I called the Community Development Director who informed me that the city's code requires 50 square
feet per person in areas used for sleeping. The rental license application, that identified the apartment
as a one bedroom, has 159 square feet, sufficient for three people. A code inspector went to the
property and confirmed that it was a one bedroom apartment. At the insistence of the complainant, I
also went to the apartment and confirmed that it was a one bedroom apartment. The "second
bedroom"the complainant referred to was the living room that had neither a door nor closet and would
provide no privacy for an occupant.
Finally, I spoke to the Code Enforcement Manager who told me that due to the building's zoning
designation, it could not be changed from a one bedroom to a two bedroom even if the living room
were appropriate.
I concluded that the apartment was correctly not rented to the complainant. The complainant was not
happy with this determination and I offered to help her file a complaint with the Illinois Department of
Human Rights. The complainant works in Woodstock and does not get off until 7:00pm but I offered to
meet her at city hall on Monday, October 24th in the evening. She cancelled at 7:05pm when I texted
her to confirm she would be meeting me.
The complainant has another complaint about an apartment that was not rented to her earlier in the
summer. The landlord rented to a single man who would be fixing up the apartment. Based on this
account, I do not see any evidence of discrimination but I will call the landlord regarding the complaint
and will report on this matter at the December meeting.
