Thank you. • Claims Service Agreement Addendum No. 1 to the Agreement Dated October 1, 2010, with The Travelers Indemnity Company Resolution No. 13-58 RESOLUTION AUTHORIZING EXECUTION OF A CLAIMS SERVICE AGREEMENT ADDENDUM NO. 1 TO THE AGREEMENT DATED OCTOBER 1, 2010, WITH THE TRAVELERS INDEMNITY COMPANY BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ELGIN,ILLINOIS,that Sean R.Stegall,City Manager,be and is hereby authorized and directed to execute a Claims Service Agreement Addendum No. 1 to the Agreement dated October 1,2010,with The Travelers Indemnity Company on behalf of the City of Elgin, a copy of which is attached hereto and made a part hereof by reference. s/David J. Kaptain, Mayor Presented: March 20, 2013 Adopted: March 20, 2013 Vote: Yeas: 7 Nays: 0 Attest: s/Kimberly Dewis Kimberly Dewis, City Clerk CLAIMS SERVICE AGREEMENT ADDENDUM NO. 1 TO THE AGREEMENT DATED OCTOBER 1,2010 THIS ADDENDUM No. 1 to the Claims Service Agreement dated October 1, 2010, ("Agreement") by and between the City of Elgin ("Client"), and the Travelers Indemnity Company, a Connecticut corporation ("Travelers") is entered into as of March 20 , 2013. The Agreement is hereby amended as follows: 1. Section A.8 is hereby amended to read as follows: "8. For the purposes of this agreement the discretionary authority limit, on a per claim basis, is an amount up to and including $20,000 on any self- insured retention period." 2. Section B.3 is hereby amended to read as follows: 443. Discretionary Authority Limit means the total amount of money, as set forth in Section A.8, for which Travelers is authorized to spend in payment or settlement of any claim, and, in the case of denial, the total Travelers projected money value of a claim for which Travelers is authorized to deny without first seeking approval from the Client. The payment or settlement of any claim shall require advance approval from the corporation counsel of the Client. The discretionary authority limit does not include allocated loss expense."
