COMMITTEE OF THE WHOLE MEETING
September 23, 2015
The regular Committee of the Whole meeting was called to order by Mayor Kaptain at 6:00 p.m.
in the Council Chambers. Present: Councilmembers Dunne, Gavin, Martinez, Powell, Prigge,
Rauschenberger, Shaw, Steffen, and Mayor Kaptain. Absent: None.
Approval of Minutes
Councilmember Steffen made a motion, seconded by Councilmember Shaw, to approve the
minutes of the September 9, 2015, regular meeting. Upon a roll call vote: Yeas:
Councilmembers Gavin, Martinez, Powell, Prigge, Rauschenberger, Shaw, Steffen, and Mayor
Kaptain. Nays: None. Councilmember Dunne abstained.
Consideration of Development Agreement with Motorola Solutions, Inc.
Councilmember Gavin made a motion, seconded by Councilmember Martinez, to remove the
development agreement with Motorola Solutions, Inc. from the table for consideration at
tonight’s meeting. Upon a roll call vote: Yeas: Councilmembers Dunne, Gavin, Martinez,
Powell, Prigge, Rauschenberger, Shaw, Steffen, and Mayor Kaptain. Nays: None.
A resolution will be on the City Council agenda for further consideration.
Consideration of Renewal of the Liability, Crime, and Workers’ Compensation Insurance
Programs for the Period October 1, 2015 through September 30, 2016
There was discussion regarding the annual costs, the incidents of worker’s compensation claims,
what type of training and prevention programs are in place and other efforts to reduce the
number and severity of injuries on the job.
A resolution will be on the City Council agenda for further consideration.
Elgin Police Department Body Camera Presentation
The police department provided a presentation on a small-scale field trial of body cameras,
including how the body cameras will be worn and operate. Additional background on the
recently enacted Illinois law establishing standards on how police departments use body cameras
and when the public can view those recordings was provided. A copy of the presentation is on
file in the City Clerk’s office.

The council discussed the cost of the cameras, the terms of the grant, what models are being
tested, the policy on releasing video, and procedures to notify individuals being recorded.
Adjourn to the City Council Meeting
Councilmember Shaw made a motion, seconded by Councilmember Gavin, to adjourn and go
into the City Council meeting. Upon a roll call vote: Yeas: Councilmembers Dunne, Gavin,
Martinez, Powell, Prigge, Rauschenberger, Shaw, Steffen, and Mayor Kaptain. Nays: None.
Reconvene
Councilmember Shaw made a motion, seconded by Councilmember Dunne, to reconvene the
Committee of the Whole meeting. Upon a roll call vote: Yeas: Councilmembers Dunne, Gavin,
Martinez, Powell, Prigge, Rauschenberger, Shaw, Steffen, and Mayor Kaptain. Nays: None.
Consideration of Acceptance of Public Improvements within Remington at Providence
Subdivision
Councilmember Gavin made a motion, seconded by Councilmember Steffen, to approve the
acceptance of the public improvements for ownership and maintenance in Remington at
Providence Subdivision in order to fulfill the city’s obligation to maintain reliable infrastructure
for serving businesses and residents. Upon a roll call vote: Yeas: Councilmembers Dunne,
Gavin, Martinez, Powell, Prigge, Rauschenberger, Shaw, Steffen, and Mayor Kaptain. Nays:
None.

Subdivision
Councilmember Powell made a motion, seconded by Councilmember Dunne, to approve the
acceptance of the public improvements for ownership and maintenance in Remington
Meadows Subdivision in order to fulfill the city’s obligation to maintain reliable infrastructure
for serving businesses and residents. Upon a roll call vote: Yeas: Councilmembers Dunne,
Gavin, Martinez, Powell, Prigge, Rauschenberger, Shaw, Steffen, and Mayor Kaptain. Nays:
None.

Councilmember Gavin made a motion, seconded by Councilmember Martinez, to approve the
acceptance of the public improvements for ownership and maintenance in Waterford
Neighborhood 3 Subdivision in order to fulfill the city’s obligation to maintain reliable
infrastructure for serving businesses and residents. Upon a roll call vote: Yeas: Councilmembers
Dunne, Gavin, Martinez, Powell, Prigge, Rauschenberger, Shaw, Steffen, and Mayor Kaptain.
Nays: None.

Councilmember Steffen made a motion, seconded by Councilmember Shaw, to approve the
acceptance of the public improvements for ownership and maintenance in Waterford
Neighborhood 6 Subdivision in order to fulfill the city’s obligation to maintain reliable
infrastructure for serving businesses and residents. Upon a roll call vote: Yeas: Councilmembers
Dunne, Gavin, Martinez, Powell, Prigge, Rauschenberger, Shaw, Steffen, and Mayor Kaptain.

Consideration of Amendment No. 9 to Engineering Services Agreement with TranSystems,
Inc. for the 2015 Central Business District Streetscape Project
Councilmember Dunne made a motion, seconded by Councilmember Gavin, to approve
Amendment No. 9 with TranSystems, Inc. in the amount of $344,581 to provide construction
administration for pavement and streetscape improvements on Highland and Chicago Street
Bridges as well as the streets of Highland, Chicago and the frontage of State Street between State
Street and the Fox River. Upon a roll call vote: Yeas: Councilmembers Dunne, Gavin, Martinez,
Powell, Prigge, Rauschenberger, Shaw, Steffen, and Mayor Kaptain. Nays: None.

Consideration of Acceptance of Illinois Department of Transportation Sustained Traffic
Enforcement Program Grant for Occupant Protection and Impaired Driving Enforcement
There was discussion regarding the results of the program and if the state budget impasse would
impact the availability of the grant funds.
Councilmember Dunne made a motion, seconded by Councilmember Martinez, to approve an
agreement with the Illinois Department of Transportation to accept a grant award in the amount
of $100,668 that will provide funds to continue to provide safer roadways through occupant
protection and impaired driving enforcement. Upon a roll call vote: Yeas: Councilmembers
Dunne, Gavin, Martinez, Powell, Prigge, Rauschenberger, Shaw, Steffen, and Mayor Kaptain.
Nays: None.
Consideration of Professional Services Agreement with IXP Corporation for Dispatch
Consulting Services
Councilmember Dunne made a motion, seconded by Councilmember Martinez, to approve the
contract with IXP Corporation in the amount of $13,550 for consulting on dispatch services to
determine future staffing, equipment and other needs for the city’s emergency communications
center as well as a pricing model to provide dispatch services to other agencies. Upon a roll call
vote: Yeas: Councilmembers Dunne, Gavin, Martinez, Powell, Prigge, Rauschenberger, Shaw,
Steffen, and Mayor Kaptain. Nays: None.
Consideration of Ordinance Making the Possession of Cannabis under 30 Grams Illegal in
the City of Elgin
There was discussion regarding the level of penalty to be imposed, the different enforcement
laws between Kane and Cook Counties, and the laws at the state and federal levels regarding
possession of cannabis. Councilmember Steffen proposed a tiered penalty system, with amount
varying on the amount of cannabis and the number of offenses.
Councilmember Prigge made a motion, seconded by Councilmember Rauschenberger, to
approve moving forward with the cannabis possession ordinance in order to provide police
officers with an alternative to criminal charges when dealing with a person in possession of small
amounts of cannabis. Upon a roll call vote: Yeas: Councilmembers Gavin, Martinez, Powell,
Prigge, Rauschenberger, Shaw, Steffen, and Mayor Kaptain. Nays: Councilmember Dunne.

Consideration of Amendment No. 1 to Engineering Services Agreement with RK Johnson
and Associates, Inc. for 2015 Combined Sewer Overflow National Pollution Discharge
Elimination System Permit Compliance
Councilmember Powell made a motion, seconded by Councilmember Steffen, to approve
Amendment No. 1 with RK Johnson and Associates, Inc. in the amount of $81,840 to continue
the multi‐year agreement to assist the city with engineering services to comply with the Illinois
Environmental Protection Agency requirements of the National Pollution Discharge Elimination
System permit. Upon a roll call vote: Yeas: Councilmembers Dunne, Gavin, Martinez, Powell,
Prigge, Rauschenberger, Shaw, Steffen, and Ma yor Kaptain. Nays: None.
Consideration of Odd Even Parking Trial for Parkway, Stewart, Victor and Trout Avenues
Councilmember Shaw made a motion, seconded by Councilmember Martinez, to authorize a 90‐
day parking trial on Parkway, Stewart, Victor and Trout Avenues to improve the effectiveness of
public service delivery. Upon a roll call vote: Yeas: Councilmembers Dunne, Gavin, Martinez,
Powell, Prigge, Rauschenberger, Shaw, Steffen, and Mayor Kaptain. Nays: None.
Announcements from Council
Councilmember Prigge commented on the viral video of Sergeant Ken Ericson and commended
him for how he handled the situation.
Councilmember Powell commented on the success of the recent Fringe Festival held in
downtown Elgin.
Councilmember Dunne commented on the legionnaire’s situation at various U-46 buildings and
asked staff to follow up regarding the status of the city owned buildings.
Councilmember Gavin invited residents to attend the 28th Annual Cemetery walk at Bluff City
Cemetery being held on Sunday, September 27, 2015, from 11:00 a.m. – 3:00 p.m.
Announcements from Staff
Laura Valdez-Wilson, Management Analyst in the City Manager’s Office, announced upcoming
city events.

Councilmember Shaw made a motion, seconded by Councilmember Martinez, to adjourn and go
into the Executive Session for the purpose of discussing the following matters. Upon a roll call
vote: Yeas: Councilmembers Dunne, Gavin, Martinez, Powell, Prigge, Rauschenberger, Shaw,
Steffen, and Mayor Kaptain. Nays: None.
Selection of a Person to Fill a Public Office, Including a Vacancy in a Public
