SPECIAL WORK SESSION
JUNE 3, 1992
The Special Committee of the Whole Work Session was called to
order by Mayor VanDeVoorde at 7 :00 p.m. in the Council
Conference Room. Present: Councilmembers Fox, Moylan,
Walters, Yearman, and Mayor VanDeVoorde. Absent:
Councilmembers Gilliam and Popple.
COMPREHENSIVE AMENDMENT TO THE ZONING ORDINANCE
Openinq Remarks
Planning Director Dahlstrom made opening remarks and stated that
this proposed ordinance is extremely different than the current
ordinance, and is more performance based. The amendment to the
ordinance is written in such a way that it establishes a series
of districts which developed at various times in the City' s
history. The reference to Supplementary Regulations (SR) which
appear throughout the ordinance is unique.
The following issues raised at the May 20, 1992, Public Review
meeting were then reviewed by the Council .
Recreational Vehicles
Because of all the interest and controversy surrounding that
portion of the proposed amendment to the zoning ordinance
regulating the parking and storage of recreational vehicles on
residential property, it was suggested to the Mayor that a
committee be appointed to review the issue of what regulations
should govern recreational vehicles for this community.
Councilman Walters made a motion, seconded by Councilwoman
Yearman, to appoint a committee, consisting of proponents and
opponents, to review that portion of the proposed comprehensive
amendment to the zoning ordinance that concerns the parking and
storage of recreational vehicles on residential property and to
bring a recommendation back to the City Council . Yeas :
Councilmembers Fox, Moylan, Walters, Yearman, and Mayor
VanDeVoorde. Nays : None.
The committee members are to be appointed by the Mayor with the
approval of the City Council . People interested in being on the
committee are to submit applications to the City Clerk.

Residence Conservation Districts
Mr. Dahlstrom stated that the Planning Committee has recommended
merging the proposed RC3 Residence Conservation Districts and
the proposed RC4 Residence Conservation District into a single
Central Residence Conservation District. All single family
homes that have been converted to multifamily would become
nonconforming use.
Mr. Dahlstrom stated that this proposal does not include the
more proactive approach of amortization or reversion at time of
sale. However, it would stop all additional conversions .
Further, there is an element of flexibility in that someone can
still request a conversion by going through the planned
development process .

Councilwoman Moylan made a motion, seconded by Councilman
Walters, that the Central Residence Conservation District be
established in the tan and brown areas of the proposed zoning
map. Yeas : Councilmembers Fox, Moylan, Walters, Yearman, and
Mayor VanDeVoorde. Nays : None.
HP Historic Preservation District
The Heritage Commission has proposed extending the HP Historic
Preservation District beyond the officially recognized Elgin
Historic District. It was pointed out that we already have an
ordinance that provides the means for expanding the Historic
Preservation District, and it is not necessary to do it in this
particular ordinance. The City Council was in consensus to
leave the Historic District as it is presently.
Planned Center City District
The Center City Corporation has expressed some concern regarding
the inability of a property owner to make changes without an
approval through the public hearing process under the Planned
Center City District as now proposed. Principal planner
Deering and Center City Director Turner have met and believe
they can develope two "standard" zoning districts .
The City Council approved the development of two standard
districts for the Center City by unanimous consensus .
Bed and Breakfast Inns
The Council discussed the suggestions made regarding changing
the proposed maximum length of stay and locational requirements
for bed and breakfast inns . The Council does not want the
ordinance to allow for the establishment of rooming houses .

It was the consensus of the Council to leave the provision
regarding bed and breakfast inns as set forth in the proposed
amendment except to change the maximum number of days from
four to seven for length of stay.
Landscaping
Mr. Deering stated that the suggestions that were made regarding
specifications for landscaping were good and will be
incorporated in the amendment to the ordinance.
Miscellaneous Text
Comments have been made regarding the definition of a family,
chainlink fences, the organization of the Planning and Land
Use Commission, expansion of nonconforming structures, and the
height of accessory buildings . The Planning and Land Use
Committees have already looked at the various comments and have
requested direction from the Council .
Definition of family - the last sentence of the definition of
"family" is to be deleted. The Council is very interested in
making occupancy limitations more stringent. However, it was
suggested that the property maintenance code might be a more
appropriate place in the Municipal Code to make that change.
Chain link fence - it was the consensus of the Council not to
make any changes to the proposed amendment in this regard.
412-454 Summit Street
The City Council directed staff to classify the property in an
appropriate residence district.
1219 Larkin Avenue
Principal Planner Deering was directed to contact the owner and
advise him that the Council would consider making this property
RB zoning and to obtain his input regarding this suggestion.
Mark Avenue Extended West
Mr.. Deering informed the Council that the proposed amendment to
the ordinance already substantially reduces the density from
what is allowed under the current ordinance, which is
considerably less than what was allowed when the multiple family
residences which are currently in Eagle Heights were built.
Mr. Deering was directed to furnish that information, in
writing, to the Eagle Heights Residents Association.

25 Hawthorne Avenue
Councilman Fox made a motion, seconded by Councilwoman Yearman,
to change the zoning to GI . Yeas : Councilmembers Fox,
Moylan, Walters, and Yearman. Nays: None. Abstain: Mayor
VanDeVoorde.
1155 and 1175 Summit Street
It was the consensus of the Council to leave this residential as
it is currently.
South State Street
It was the consensus of the Council to include the property
located on the west side of South State Street between
approximately Locust and Standish in the Residence
Conservation District.
Miscellaneous
It was the consensus of the Council to have Mr. Deering complete
the review of the comprehensive amendment to the zoning
ordinance and to summarize the design standard elements
encompassed in the amendment at the next Committee of the Whole
meeting on June 10, 1992 .
Adjournment
Councilwoman Yearman made a motion, seconded by Councilman
Walters, to adjourn the meeting. Yeas : Councilmembers Fox,
Moylan, Walters, Yearman, and Mayor VanDeVoorde. Nays : None.
