NOVEMBER 20, 1991
The rescheduled Committee of the Whole meeting was called to
order by Mayor VanDeVoorde at 6 :35 p.m. in the Council
Conference Room. Present: Councilmembers Fox, Gilliam,
Moylan, Popple, Walters, and Mayor Van DeVoorde. Absent: None.
Parkinq Problems on State Street

Mayor VanDeVoorde stated that he had received a call with
reference to the parking difficulties experienced by volunteers
at the St. Joseph Hospital free clinic located on State Street
between Highland Avenue and Chicago Street. The Mayor requested
that the staff look into the situation and attempt to resolve
the problems.
Appointment of new Parks and Recreation Director
City Manager Rice announced that Gregory A. Bayor, who is
currently the Parks and Recreation Director in Rockville,
Maryland, has been selected as the new Parks and Recreation
Director for Elgin and will join the staff sometime after the
first of the year.
Authorization to execute a permit with the Illinois State Toll
Highway Authority
A resolution will be presented at tonight' s Council meeting for
adoption by the City Council.
Application by the Cultural Arts Commission for a qrant from
the Illinois Arts Council
Councilwoman Popple made a motion, seconded by Councilman Fox,
j to approve the request of the commission to submit an
application for a needs assessment grant from the Illinois Arts
Council . Yeas : Councilmembers Fox, Gilliam, Moylan, Popple,
Walters, and Mayor VanDeVoorde. Nays : None.
Vacation of a portion of Gifford Street
Councilwoman Moylan made a motion, seconded by Councilman
Gilliam, to accept Jerry Bear's proposals as outlined in
paragraphs (a) , (b) , (c) , and (d) on the bottom half of page 3
and top of page 4 of Attorney Peter Bazos ' memo as follows :
(a) As originally discussed, Mr. Bear will acquire the
Cleaning Property and will immediately thereafter dedicate
the westerly 18 feet thereof to the City of Elgin.

(b) Simultaneously with that dedication, the City will
vacate the contemplated portion of Gifford Street up to the
south line of the Cleaning Property.
(c) As part of its vacation, the City will reserve to
itself (and for the benefit of any other companies having
existing utilities in the right of way) an easement to
maintain, repair, replace, etc. those existing utilities.
The easement would provide that if it became necessary for
the City (or private utility company, as the case may be)
to dig up the surface of the vacated property in order to
repair or replace any utility service, then the party
performing such work would be required to repair any paved
parking surface damaged in that process .
(d) Simultaneously with the vacation of Gifford Street,
Mr. Bear would pay the City the negotiated sum of $8,300.

Peter Bazos, attorney for Jerry Bear, advised the Council
Mr. Bear may not proceed with the proposal in that his request
for authorization to relocate signs in the setback area of his
property was not approved.
Reschedulinq of December 1991 City Council meetings
Councilman Walters made a motion, seconded by Councilman Fox, to
reschedule the first Committee of the Whole and City Council
meetings in December from December 11 to December 18 and to
cancel the December 25 meetings. Yeas: Councilmembers Fox,
Gilliam, Moylan, Popple, Walters, and Mayor VanDeVoorde. Nays :
None.
Schedule of 1992 City Council meetinqs
Councilman Walters made a motion, seconded by Councilwoman
Moylan, to authorize the adoption of the proposed resolution
setting forth the schedule of City Council meetings for 1992
with the following revisions:
Eliminate November 25, 1992, Committee of the Whole and
City Council meetings
Change the December Committee of the Whole and City Council
meetings from the second and fourth to the first and third
Wednesdays, i .e. , December 2 and 16, 1992
Yeas: Councilmembers Fox, Gilliam, Moylan, Popple, Walters, and
Mayor VanDeVoorde. Nays : None.

Request for additional compensation for Howard Needles Tammen &
Berqendoff for enqineerinq services for the Shales Parkway
elevated water tower
Councilwoman Popple made a motion, seconded by Councilman Fox,
to approve the aforementioned request for $8,600 additional
compensation. Yeas : Councilmembers Fox, Gilliam, Moylan,
Popple, Walters, and Mayor VanDeVoorde. Nays : None.
Consideration of additional well modifications at Slade Avenue
Councilwoman Moylan made a motion, seconded by Councilwoman
Popple, to authorize the recommended modifications. Yeas :
Councilmembers Fox, Gilliam, Moylan, Popple, Walters, and Mayor
VanDeVoorde. Nays: None.
Proposed chanqe in the liquor license ordinance for the Hemmens
Auditorium
Councilman Walters made a motion, seconded by Councilman Fox, to
approve the establishment of Class "L" liquor license and
allowing the holder of a Class "L" liquor license to serve
liquor outdoors. Yeas: Councilmembers Fox, Gilliam, Moylan,
Popple, Walters, and Mayor VanDeVoorde. Nays : None.
Purchase of a tax deed for 129 South State Street
Councilwoman Popple made a motion, seconded by Councilman Fox,
to authorize the aforementioned acquisition. Yeas :
Councilmembers Fox, Gilliam, Moylan, Popple, and Mayor
VanDeVoorde. Nays : Councilman Walters .
Change Order for enqineerinq services on North McLean Boulevard
Street improvements
Councilwoman Popple e made a motion seconded b Councilman

Walters, to authorize the aforementioned change order. Yeas :
Councilmembers Fox, Gilliam, Moylan, Popple, Walters, and Mayor
VanDeVoorde. Nays: None.
Proposed Chanqe Order No. 1 with Skender Construction for fire
station construction
Councilwoman Moylan made a motion, seconded by Councilman Fox,
to approve the aforementioned change order. Yeas :
Councilmembers Fox, Gilliam, Moylan, Popple, Walters, and Mayor
VanDeVoorde. Nays: None.

Adjournment
Councilwoman Moylan made a motion, seconded by Councilman
Gilliam, to adjourn the Committee of the Whole meeting and go
into Executive Session to discuss litigation and personnel .
Yeas : Councilmembers Fox, Gilliam, Moylan, Popple, Walters, and
Mayor VanDeVoorde. Nays: None.
