June 9 , 1987
Mayor Van De Voorde called the meeting to order at 6 : 30 p.m. ,
in the Council Conference Room. Members present : Councilmen
Fox, Moylan, Popple, Shales , Walters and Mayor Van De Voorde.
Councilman Gilliam arrived at 6 :50 p.m. Absent : None.
Further consideration of psychological and polygraph examinations
of Board of Fire and Police Commissioners .
The City Council reviewed the testing procedures with Richard
T. O'Brien, Dr. Beach and Dr. Goedert , associates with Public
Personnel Institute.
Mr. O'Brien gave each Council member a copy of the questions
used in testing an applicant . Mayor Van De Voorde asked if the
applicant is advised as to the testing result . Mr. O'Brien
stated they are and this is governed by law. Councilman Walters
asked if there was any criteria to justify taking the test again,
should the applicant fail the first time. Mr. O'Brien stated
this was not their decision, the Board would decide if the
applicant should be retested. Mr. O'Brien stated an interview
with the applicant precedes the test to see if the applicant
is under any stress which might effect the test . The testing
takes approximately one hour per individual. Mr. O'Brien further
stated his firm cannot make any recommendations as to the
hiring of any tested applicant , this is covered by Statute .
Mr. Cook stated that one of the recommendations from the Human
Relations Commission was to develop a numerical grades for
psychological tests . Dr. Goedert stated a rank order could be
used. Mr. Cook pointed out that one of the staff recommendations
was to allow Police and Fire Chiefs access to applicant psychological
and polygraph testing date for training and supervisory evaluation,
particularly during the probationary period. Dr. Beach stated
they donot have a survey of cities who do allow this , but
it could be done and the information used as a developmental
tool. However, the release of this information may be abused
and the applicant prejudged based on said information.

Councilwoman Shales suggested a summary should be prepared
by the testing firm and passed back to be shared with supervisory
staff.
Councilwoman Shales made a motion, seconded by Councilman
Walters for have this firm prepare a summary to develop training
needs. Yeas : Councilmen Fox Gilliam Mo lan, Po PP le, Shales ,

Further consideration of parking restriction on Jefferson.
Councilman Fox stated he did not see why there was any concern
over this project , he visited the site and did not see where
there would be any problems with the parking restriction.
Councilman Fox made a motion, seconded by Councilwoman Popple
that a 6:00 a.m. to 6: 00 p.m. , Monday through Saturday parking
restriction be implemented adjacent to 443 Jefferson Avenue.
Yeas : Councilmen Fox, Moylan, Popple, Shales , Walters and
Mayor Van De Voorde. Nays : None.
Consideration of a request from the Gifford Park Association
to save architectural features.
Councilman Gilliam made a motion, seconded by Councilwoman
Popple to grant this request . Yeas: Councilmen Fox, Gilliam,
Moylan, Popple , Shales, Walters and Mayor Van De Voorde. Nays:
None.
Consideration of a report on apartment licensing and inspecting.
During the 1987 Community Block Grant hearings , one proposal
for funding suggested the establishment of an apartment inspection
program. Staff has contacted communities with such programs
and obtained copies of the relevant ordinances. For example,
Oak Park has operated an apartment licensing and inspection
program for 23 years. Aurora has operated a similar program
for 5 years . Joliet operates a systematic residential rental
property inspection program but does not license buildings .

An inspection and/or licensing program for rental properties
is a long term policy and financial commitment . Of the community
programs reviewed, only Joliet had revenues cover expenditures.
Councilman Gilliam asked if these inspections would just deal
with code violations . Mr. Cook stated yes .
Councilwoman Popple asked if the inspections would include
public housing units. Mr. Cook stated it should include all
of them.
Councilman Fox stated the City needs this type of program,
but he was concerned about the cost , and he asked that staff
prepare a cost proposal.
Councilwoman Moylan stated she did not see the priority need
now, and the departments have been stretched with other priorities .
Councilwoman Shales stated we could be adding other problems
by doing this .

Councilman Walters felt the program should pay for itself.
Councilwoman Moylan said she could support the program if
it were self-supporting.
Councilman Gilliam stated it effects the quality of life and
it should help to improve the neighborhoods. Councilman Gilliam
further stated that he hoped this will not be a program that
gets bogged down in Court .
Mr. Cook stated he did not think this would happen because
the City would be going in with life threatening situtations .
Mayor Van De Voorde stated that he will reserve final judgement
until a public hearing is had and some public imput received.
Councilman Fox made a motion, seconded by Councilman Gilliam
to direct staff to prepare a proposal package. Yeas: Councilmen
Fox, Gilliam, Moylan, Popple, Shales , Walters and Mayor Van
De Voorde. Nays: None.
Consideration of a request from Kane County for the transfer
of maintenance responsibility on a section of Duncan Avenue.
Duncan Avenue from just north of River Bluff Road north to
Illinois Route 72 in East Dundee is a Kane County Highway.
It is the only Kane County highway on the east side of the
Fox River that is in the City of Elgin and extends to approximately
one-quarter of a mile north of Interstate 90.
Kane County by Statutes cannot have more than twenty five
percent of the rural public highway system in the county system.
Therefore, Kane County is attempting to transfer the maintenance
of some county highways to other governmental agencies. East
Dundee and the Township of Dundee have agreed to accept for
maintenance that portion of the highway within their respective
jurisdictions. The City of Elgin has accepted in the past
for maintenance South Street between Randall and Weld Road
and Highland Avenue between McLean Blvd. and Randall Road.
It is estimated that maintenance including snow plowing will
cost the City about $800 .00 annually. Staff is recommending
approval of this request .
Councilman Gilliam made a motion, seconded by Councilman Fox
to approve this request . Yeas: Councilmen Fox, Gilliam, Moylan,
Popple, Shales , Walters and Mayor Van De Voorde. Nays : None.
Consideration of a request for a street name change in Valley
Creek subdivision.
Councilman Gilliam made a motion, seconded by Councilwoman
Shales to direct staff to prepare a resolution renaming the
100 foot street segment from Beaver Land to Colorado Avenue.
Yeas : Councilmen Fox, Gilliam, Moylan, Popple, Shales , Walters
and Mayor Van De Voorde. Nays: None.

Consideration of a change order in the construction at Lord' s
Park Pool.
This change order is required in order to comply with Illinois
state law by having the specified deck painting. The lane
lines are required in order to allow for lap swimming at the
pool.
By reason of this change order No. 1 the contract will be
increased in the amount of $2 , 350. 00, for a total estimated
cost of $92 , 850. 00.
Councilman Gilliam made a motion, seconded by Councilman Walters
to approve this change order. Yeas : Councilmen Fox, Gilliam,
Moylan, Popple, Shales, Walters and Mayor Van De Voorde. Nays:
None.
Consideration of approval of an emergency repair for water
motor.
Councilman Gilliam made a motion, seconded by Councilwoman
Shales to approve payment to Dreisilker Electric Co, for $1, 798. 69
for this emergency repair. Yeas: Councilmen Fox, Gilliam,
Moylan, Popple, Shales , Walters and Mayor Van De Voorde. Nays :
None.
Consideration of a recommendation for participation in drainage
improvements at Kimball Avenue and the railroad.
Councilwoman Popple made a motion, seconded by Councilman
Fox that staff be directed to prepare the plans and specifications
necessary to complete this work. Yeas: Councilmen Fox, Gilliam,
Moylan, Popple, Shales , Waters and Mayor Van De Voorde. Nays :
None.
Consideration of acceptance of an easement in Highview Hills
for street light installation.
Councilwoman Popple made a motion, seconded by Councilman
Fox to accept the subject easement . Yeas: Councilmen Fox,
Gilliam, Moylan, Popple, Shales, Walters and Mayor Van De
Voorde. Nays: None.
Consideration of an amendment to the insurance requirements
for Stetson.
Councilman Gilliam made a motion, seconded by Councilwoman
Popple to approve staff recommendation to amend Article VI
1.C. of the Stetson Pool Agreement to have an umbrella policy
with an aggregate limit of $2 ,000, 000 covering all liability,
including lifeguards, at no change in the contract price.
Yeas : Councilman Fox, Gilliam, Moylan, Popple, Shales , Walters
and Mayor Van De Voorde. Nays: None.

Consideration of requiring signs to be placed for zoning changes .
A request has been made by Councilwoman Moylan to reconsider
an ordinance requiring the posting of signs for public hearings
conducted for zoning petitions.
The cost of processing the petition would be approximately
$350.00. As previously recommended by the Planning Committee
the ordinance amendment would require that the city provide
the notification signs and monitor placement on the site.
Costs associated with providing the signs and assigning staff
to verify placement and removal have not yet been determined.
Councilwoman Moylan made a motion, seconded by Councilwoman
Popple for staff to take this petition to the Planning Committee
for public hearing. Yeas: Councilmen Fox, Moylan, Popple,
Shales , Walters and Mayor Van De Voorde. Nays: Councilman
Gilliam.
Report on the 1987 tree planting program.
Status report on the subject program.
Report from Civil Service Commissioner attendance at seminar.

Report with regard to new Dial-A-Ride bus.

Consideration of a report regarding request for de-annexation
from Villa Olivia.
Councilman Gilliam made a motion, seconded by Councilwoman
Moylan directing the staff to work with Bartlett to effect
this de-annexation. Yeas: Councilmen Fox, Gilliam, Moylan,
Popple , Shales , Walters and Mayor Van De Voorde. Nays: None.
Consideration of a report of bids on the new PACE garage.
Status report .
Report on the cost of utility relocations on South McLean
Boulevard north of Route 20 bypass.
Staff advised Council the total cost to relocate the existing
Commonwealth Edison lines and services underground would be
j approximately $249 , 995. 00. Money has not been budgeted for
this work, and it will not be feasible at this time. However,
staff will continue to negotiate the project with Commonwealth
Edison.

towing of a garbage truck.
Councilman Gilliam made a motion, seconded by Councilwoman
Popple to approve the payment of $3 , 095 to Allen ' s Corner
Garage and Towing Service. Yeas : Councilmen Fox, Gilliam,
Moylan, Popple, Shales, Walters and Mayor Van De Voorde. Nays:
None.
Consideration of a recommendation for change order with regard
to the repairs on Congdon Water Tank.
Councilman Gilliam made a motion, seconded by Councilwoman
Moylan to approve Change Order No. 2 to provide the additional
$3 , 770 for needed work to the Congdon Avenue overhead storage
tank. Yeas: Councilmen Fox, Gilliam, Moylan, Popple, Shales ,
Walters and Mayor Van De Voorde. Nays: None.
Consideration of possible changes in permit and inspection
fees .
Councilman Walters made a motion, seconded by Councilwoman
Shales to approve the increased fee of $25 . 00 for new construction
and to keep the present fee for replacement construction.
Yeas: Councilmen Fox, Gilliam, Moylan, Popple, Shales, Walters
and Mayor Van De Voorde. Nays: None.
Consideration of reports on accidents at Liberty and Park
Street .
At a Committee of the Whole Meeting on September 8, 1986 ,
a resident from this area appeared before the Council with
a petition objecting to the installation of traffic lights
at this corner. The Council made a decision on September 22 ,
1986 to defer installation of the traffic signals and directed
the staff to remove the trees from the intersection area that
would have been removed as a part of the proposed project .
The staff was also directed to make a report to the Council
in the Spring of 1987 regarding current traffic conditions
at this intersection.
The trees were removed last winter. There have been 7 or 8
accidents each yeat at this intersection since 1979 , except
for 1984 when there were 6 , ' in 1985 there were 4 , in 1986
there were 3 and in 1987 there have been 5 already.
IDOT has this project on hold until the first of July when
they will begin dropping thos projects from the 1987 program
and reappropriate the money. Should the City Council wish
to reconsider their action and proceed with the project , we
would have to notify IDOT before July 1 to same the project
for 1987 .

Mr. Reid Lewis , 616 Park Street stated the residents were
still concerned that the installation of traffic signals at
this site would increase the traffic flow on Park Street .
Mr. Lewis stated there are many small children in this area
one of these children was hit by a car last week. Mr. Reid
further stated that it would be better to coordinate the lights
at Summit and cut down those trees which hamper the visibility
Councilman Gilliam made a motion, seconded by Councilman Fox
to deny the installation of traffic signals at this location.
Yeas : Councilmen Fox, Gilliam, Moylan, Shales and Mayor Van
De Voorde. Nays: Councilmen Popple and Walters.
Adjournment
Councilman Walters made a motion, seconded by Councilwoman
Shales to adjourn the Committee of the Whole Meeting to go
into Executive Session to discuss Personnel, acquisitio of
property and litigation. Yeas : Councilmen Fox, Gilliam, Moylan,
Popple, Shales , Walters and Mayor Van De Voorde. Nays: None.
The meeting adjourned at 9 :15 p.m.
