Approval of the Minutes Tabled until the next meeting. Change to the Meeting Time and Date 'hair McMullin said that the motion passed in December meeting that the new time is officially been fanged to the first Thursday of each month at 6:00 p.m. Executive Session Cmmr Lloyd made a motion, seconded by Cmmr Khan to move into Executive Session at 5:35 p.m. The motion carried 3-0. The Commission returned to open session at 7:33 p.m. Cmmr. Khan made the motion to approve the voluntary demotion of Mark McQueen, seconded by Cmmr Lloyd. Motion carried 3-0. Adjournment There being no further business to discuss, Chair McMullin called for a motion to adjourn. Cmmr. Lloyd made the motion, seconded by Cmmr. Khan to approve the May 1, 2008 minutes. Motion carried 4-0. July 3rd Meeting hair McMullin made the recommendation that the meeting for July 3, 2008, be moved to July 10, _308. Cmmr. Zapata made the motion, seconded by Cmmr. Khan to move meeting date for July to July 10th. Motion carried 4-0. Meeting moved to July 10, 2008. Executive Session Cmmr. Zapata made a motion, seconded by Cmmr. Khan to move into Executive Session at 6:10 p.m. for the purpose of reviewing recommendations for dismissal of Civil Service Employees. The motion carried 4-0. The Commission returned to open session at 6:23 p.m. Cmmr. Bowman made the motion, seconded by Cmmr. Khan to recommend termination of probationary employee Dennis Dunn. Motion carried 4-0. Cmmr. Bowman made the motion, seconded by Cmmr. Khan to allow Gerard Dziuba's additional time to improve on his performance and the Commission will review his performance again at the July 10th meeting. Motion carried 4-0. Cmmr. Zapata made a motion, seconded by Cmmr. Bowman to move into Executive Session at 6:36 p.m. for the purpose of conducting interviews. Connie Zapata Absent: Cmmr. Mary Lloyd Staff: Tim Bennett Jerry Dearing, Community Development Director Matthew Fitzgibbons, Asst. Community Development Director Tim brought before the Commission two requests for termination of probationary employees. The first request was for Dennis Dunn, a Code Enforcement Officer. Jerry Dearing and Matthew Fitzgibbon gave a detailed background of the reasons for termination. They believed that Dennis did not fulfill perform his basic tasks of the position well. Management had numerous discussions with Dennis about his performance and his performance did not improve. The Commission asked questions about his performance and agreed with the recommendation. The second request for termination was for Gerard Dziuba, a Land Management Laborer. The Public Works Department sent a brief outline for the reasons they felt Gerard should be released and not certified. The Commission asked numerous questions of Tim and the process that the Public Works follows for documenting and counseling of employees. After discussion on the information they had and the processes that would like to have had in place, the Commission decided to request more information from the Public Works Department before making any final decision. They requested that the Public Works Department do more documenting and coaching for Gerard and the Commission would re-evaluate Gerard's performance at the next meeting. Cmmr. Lloyd made the motion, seconded by Cmmr. Khan to approve the August 7, 2008 minutes. Motion carried 3-0. Discussion of Council Approval of Probationary Terminations im gave an update on the approval by City Council to remove the termination of probationary mployee process from the Civil Service Commission. The new process allows the City Manager to terminate a probationary employee based on a recommendation from the hiring department without having to go before the Civil Service Commission. A new rule will need to be approved to change the Civil Service rules. Tim will have legal draft the language. Executive Session Cmmr. Lloyd made a motion, seconded by Cmmr. Lloyd made the motion, seconded by Cmmr. Khan to approve the September 4, 2008 minutes. Motion carried 3-0 Approval of Proposed Language to Termination Rule Tim requested that the Commission approve the language change that was drafted by Corporation Councel regarding the termination rule for probationary employees. Cmmr. Khan inquired if motion could be tabled until Chair McMullin could be present. Tim indicated that the ordinance was approved on August 13, 2008 for the language change indicating that the City Manager has the sole discretion of probationary termination. In light of this information, the Commission agreed to approve the new language. Cmmr Khan made the motion, seconded by Cmmr Lloyd to accept the proposed language to the termination rule for probationary employees. The approval was agreed upon under duress. r • Executive Session Cmmr Lloyd made the motion, seconded by Cmmr. Kahn to adjourn to executive session at 6:16 for the purpose of conducting interviews for the positions of Public Safety Telecommunicator and Code Enforcement Officer.
