Present: Chair Lance Lagoni Cmmr. Wilbur Daniels Cmmr. Edna Krueger Cmmr. Janice Stolt Cmmr. Peter Wendt Staff- Femi Folarin Cmmr. Wendt made the motion, seconded by Cmmr. Krueger to adjourn the meeting to executive session at 6:13 p.m. to discuss personnel. The motion carried. The Commission returned to open session at 6:30 p.m. Cmmr. Krueger made the motion, seconded by Cmmr. Wendt to table the request to dismiss probationary employee Linda Hotten from the Water Meter Shop until the March meeting. The motion carried. Cmmr. Stolt made the motion, seconded by Cmmr. Krueger to return to executive session for oral interviews for the position of Crew Leader -Water Distribution at 6:35 p.m. The motion carried Adjournment The meeting was adjourned at 6:35 p.m. by Chair Lagoni to go into executive session for the purpose of conducting oral interviews. Respectfully Submitted, Approved: July 12, 1999 Sandra Taylor rak Recording Secretary • Civil Service Commission Executive Session Minutes February 8, 1999 The executive session of the Civil Service Commission of the City of Elgin, Illinois was held February 8, 1999 in the first floor conference room at 6:13 p.m. Members present: Chair Lance Lagoni Cmmr. Wilbur Daniels Cmmr. Edna Krueger Cmmr. Janice Stolt Cmmr. Peter Wendt Staff Femi Folarin The date of February 22, 1999 at 6:30 p.m. was set up for the following interviews to take place: 3 - Cement Finishers 5 -Equipment Operators Femi notified the Commissioners that the next candidate on the Community Service list was not hired due to spouse having a criminal record. There is a Police Department policy that states that anyone that associates with known felon can not be hired in the department. An Attorney from the Legal Department will come before the Commission to explain this policy and request to have the individual removed from the list. Cmmr. Krueger requested to have of copy of this policy available at the next meeting. Chair Lagoni informed the Commission that he had received a phone call from Fred Gould, (President of Union Local 73) regarding the termination of Water Meter Shop employee Linda Hotten. Fred indicated to him that he thought there were issues that had arisen, and that Linda should be given the opportunity to consult an attorney. At this point, Chair Lagoni indicated that he would entertain a motion to table this issue until the March 1st meeting. Chair Lagoni indicated that the termination process was not a hearing and therefore; the Commission was under no obligation to ask questions of the employee or supervisor. Femi indicated that the employee was advised that it would be in her best interest to resign than to be terminated. Cmmr. Wendt inquired if it would be unfair to have the employee resign, since she would not be able to collect unemployment. Femi indicated that the employee could resign in lieu of termination, and thus would be eligible for unemployment. It was indicated that the Employee rikhad a fair warning that this dismal procedure was going to take place. . , Civil Service Commission February 8, 199 Executive Session Minutes Page 2 The Commission requested that any additional information received regarding the termination of the probationary employee be forwarded for their review. Femi indicated that the Supervisor will be present at the next meeting and possibly the employee and her Attorney. Cmmr. Krueger made the motion, seconded by Cmmr. Wendt to table the dismal until the March 1, 1999 meeting to gain a better understanding of this issue. The motion carried. Cmmr. Krueger made the motion, seconded by Cmmr. Stolt that candidate Lisa Acevedo be removed from the list of candidates for the position of Community Service Officer, due to her spouse's criminal activity and convictions. The motion carried. Peter Wendt Absent: Cmmr Wilbur Daniels (excused - due to surgery) Staff: Femi Folarin Guests: Deputy Chief Burns, Police Mike Gehrman, Legal Department Mike explained the reasons why the Legal Department was approaching the Civil Service Commission to request the removal of Lisa Acevedo as a candidate from the Community Service Officer list. Due to her spouse having a criminal record and the Police Department's rule for not hiring individuals known to have a familia relationship with a known criminal and/or felon and the sensitivity of the position, the request is being made to remove her as a candidate from the Community Service Officer list. Deputy Burns indicated that Lisa did not divulge any information regarding her husband's criminal activities/convictions during her interview, but did however, acknowledge the information when confronted with the incidents. Femi indicated that once the candidate was removed from the list, a letter will be drafted and mailed to the candidate informing her that she has been removed from the Community Service Officer list. She will be encouraged to apply for another position within the city. However, once the candidate's name is removed from the list, she will have to re-test for a different position in order to be re-hired by the City. elak Civil Service Commission February 22, 1999 Executive Session Minutes Page 2 The Commission requested that a background check be done on a candidate's spouse and any family member(s) still living in the same household for all sensitive positions within the Police Department. Wendt made the motion, seconded by Cmmr. Krueger to approve the November 2, 1998 minutes with the following correction: Under the section approval of minutes change Cmmr. Wilbur to Cmmr. Daniels. The motion carried. Ms. Poloyac informed the Commission that she was representing Ms. Hotten and raised the following concerns regarding the request for dismissal of Ms. Linda Hotten. * The Civil Service Commission has no authority to grant extension provision within its rules. * The employee (Linda Hotten) did not agree to an extension * Employee has met standards except for minor exceptions and her performance has been rated satisfactory * Only female in Water Meter Service Department, and is not being held to a different standard r r- Civil Service Commission March 2, 1999 Minutes Page 2 Ms. Poloyac indicated that for the reasons stated, Linda Hotten should be certified because her six (6) months performance was satisfactory and her performance for her extended period was also satisfactory. Carl Freund, Water Meter Supervisor, only statement was that he apologized for not seeking dismissal after six(6) months of employment. Femi reinforced the fact that this is not a hearing and that the executive session was not open to the public. Executive Session Cmmr. Krueger made the motion, seconded by Cmmr. Wendt to go into executive session at 6:25 p.m. to review probationary report on employee dismal. The Commission returned to open session at 6:34 p.m. Cmmr. Krueger made the motion, seconded by Cmmr. Wendt to terminate Linda Hotten as an employee of the Water Department Meter Shop. The motion carried. Cmmr. Wendt made the motion, seconded by Cmmr. Krueger to return to executive session for the purpose of conducting interviews. The motion carried. Edna Krueger Cmmr. Janice Stolt Cmmr. Peter Wendt Member Absent: Cmmr. Wilbur Daniels Staff: Femi Folarin The Commission discussed the following personnel issues: Letter from Robert Carter After much discussion, it was decided that Mr. Carter should be informed that the questions used in the interview process are developed by the Department head and are approved by Human Resources. The questions deal directly with job requirements. The Commission as a whole decided it would be inappropriate to discuss the particulars of the interview process nor how the candidate or any candidate scored while undergoing the interview process. The Commission agreed as a whole that it would respond to Mr. Carter's letter. Chair Lagoni will draft a letter for approval by the Human Resources Director and the Corporation Counsel. Letter From Jean Castiglione After much discussion, the Commission as a whole agreed to have the Human Resources Director draft a response letter to Ms. Castiglione. The Commissioners indicated that they would like to have the following information included in the response letter: ► Questions are developed by the Department Head and are approved by Human Resources. Arturo Zamudio Termination of Employment After much discussion regarding the issue of employment for Claudia Lopez, the decision was made to terminate her employment. Extension of Probationary Period Femi informed the Commission that there will be a request forthcoming from the Chief of Police and the Fire Chief requesting that the probationary period for Communication Operators be six(6)months of training and six(6)months probation. Jan Cox,Communications Supervisor provided an explanation behind the request for a six(6)month extension on the probationary period for Communications Operator Nicole Gilarski. After much debate and discussion the decision was made to extend the probationary period for six(6)months with a review presented after three (3) months. Cmmr. Review of Probationary Period for Communications Operators Chief Miller presented an overview of reasons for requesting an extension of the probationary period for Communications Operators to a 12 month probationary period. rik SIR Civil Service Commission Minutes October 4, 1999 Page 2 Cmmr. Krueger inquired as to whether the collective bargaining unit had been notified of the extension request. Femi indicated the Clerical/Technical union officers have not been notified.In response to the Commission's question of whether the present Communications Operators are in agreement with the probation extension, Jan Cox indicated that they all were in agreement. Chief Miller stated that the extension of the probationary period would help to make a better decision on the continued employment status of the Operator. There is a need for more formalized training and an increase in personnel. Chief Miller indicated that there is a recommendation going to the City Manager requesting that two (2)Communications Operators be hired once current (2) Communications Operators come off of probation and that a Training Supervisor be hired to oversee the training of all new Communications Operators. Currently, routine overtime is mandatory for all Communications Operators and Supervisors. As part of the hiring process, there will be a 4 hour orientation in the communications center and psychological testing of each Candidate will be done since the position is very stressful. Lori Moses indicated that the loss of employees occurs during the first 18 months of employment. Once the extension of the probationary period is approved by the Commission, the new probationary period would apply to only new Candidates after that time period forward. Voting on the issue of extension of the probationary period was tabled until the November meeting. Executive Session Cmmr. Wendt made the motion, seconded by Cmmr.
