COUNCIL-MANAGER FORM OF GOVERNMENT
REGULAR MEETING
The regular meeting of the Council of the City of Elgin, Illinois, was held on October 13, 2021,
in the Council Chambers. The meeting was called to order by Mayor Kaptain at 7:05 p.m. The
Pledge of Allegiance was led by Mayor David Kaptain.
ROLL CALL
Roll call was answered by Councilmembers Dixon, Good, Martinez, Powell, Rauschenberger,
Shaw, Steffen, Thoren, and Mayor Kaptain. Absent: None. Councilmembers Rauschenberger
and Steffen attended by electronic means.
MINUTES OF THE SEPTEMBER 22, 2021, COUNCIL MEETING APPROVED AS
DISTRIBUTED
Councilmember Shaw made a motion, seconded by Councilmember Martinez, to approve the
September 22, 2021, regular council meeting minutes as distributed. Upon a roll call vote: Yeas:
Councilmembers Dixon, Good, Martinez, Powell, Rauschenberger, Shaw, Steffen, and Mayor
Kaptain. Nays: None. Councilmember Thoren abstained.
COMMUNICATIONS
National Red Ribbon Week Proclamation
Mayor Kaptain read the following proclamation:
PROCLAMATION
WHEREAS, alcohol and drug abuse in this Nation have reached epidemic stages and it
is imperative that visible, unified prevention education efforts by community members be
launched to eliminate the demand for drugs; and
WHEREAS, the National Red Ribbon Campaign offers citizens the opportunity to
demonstrate their commitment to drug -free lifestyles; and
WHEREAS, the National Red Ribbon Campaign will be celebrated in every community
in America during Red Ribbon Week, October 23-31; and

WHEREAS, business, government, parents, law enforcement, media, medical
institutions, religious institutions, schools, senior citizens, service organizations, and youth will
demonstrate their commitment to healthy, drug -free lifestyles by wearing and displaying red

WHEREAS, the Coalition for a Safe & Healthy Elgin, the Boys Scouts of America
Three Fires Council and the Fox Valley Young Marines further commit their resources to ensure
the success of the Red Ribbon Campaign.
NOW, THEREFORE, I David Kaptain, Mayor of Elgin, do hereby proclaim October 23-
31, as RED RIBBON WEEK, and encourage all citizens to participate in drug prevention
education activities, not only during Red Ribbon Week, but all year long, making a visible
statement that we are strongly committed to a drug -free Elgin.

Rotary International Proclamation
Mayor Kaptain read the following proclamation:
PROCLAMATION
WHEREAS, Rotary is a global network of neighbors, friends, leaders and problem -
solvers who unite and take action to create lasting change in communities across the globe, and
the motto, Service Above Self, inspires members to provide humanitarian service, follow high
ethical standards and promote goodwill and peace in the world; and
WHEREAS, In 1985, Rotary launched PolioPlus and in 1988 helped establish the
Global Polio Eradication Initiative, which today includes the World Health Organization, U.S.
Centers for Disease Control and Prevention, UNICEF, the Bill & Melinda Gates Foundation and
Gavi, the Vaccine Alliance, to immunize the children of the world against polio, which cases
have dropped by 99.9 percent since 1988 and the world stands on the threshold of eradicating the
disease; and
WHEREAS, To date, Rotary has contributed more than $2.2 billion and countless
volunteer hours to protecting nearly 3 billion children in 122 countries and is working to raise an
additional $50 million per year, which would be leveraged for maximum impact by an additional
$100 million annually from the Bill & Melinda Gates Foundation and these efforts are providing
much -needed operational support, medical staff, laboratory equipment and educational materials
for health workers and parents; and

WHEREAS, In addition, Rotary has played a major role in decisions by donor
governments to contribute more than $10 billion to the effort; and
WHEREAS, There are over 1.2 million Rotary members in 36,000 clubs throughout the
world that sponsor service projects to address such critical issues as poverty, disease, hunger,
illiteracy and the environment in their local communities and abroad.
NOW, THEREFORE, I, David Kaptain, Mayor of the City of Elgin, Illinois, do hereby
proclaim October 24 as WORLD POLIO DAY and encourage all citizens to join me and rotary
International in the fight for a polio free world.

Crop Hunger Walk Day Proclamation
Mayor Kaptain read the following proclamation:
PROCLAMATION
WHEREAS, healthy food is essential to thriving, to growth and to a prosperous, long
life, but those without land to grow food or money to buy it are likely to suffer from hunger;
and
WHEREAS, 800 million people around the world are hungry, including 11 to 12
percent of Americans, 3.2 million children die from hunger each year and 66 million primary
school age children around the world go to school hungry, with one in five American
schoolchildren who risk going to school hungry; and
WHEREAS, the CROP Hunger Walk has been organizing cities and towns across
America to fight hunger around the world and in their communities for 50 years and Elgin has
been a part of the CROP Hunger Walk since 1983, raising over $649,000 in the fight against
hunger; and
WHEREAS, Ed Schock, the Honorary Chairman of the 2021 CROP Hunger Walk,
was the person who had the vision to connect local with global problems, and inspire people to
take action and be a part of the solution in the 1970 CROP Walk; and
WHEREAS, this year's CROP Hunger Walk will be a "virtual walk" in order to keep
individuals safe as they raise funds for Elgin's food pantries and soup kitchens as well as Church
World Service and by participating in the CROP Hunger Walk, attention can be drawn not only
to the problems of hunger, but also to solutions, improving the quality of life of all of our
neighbors, no matter where they live, and supporting thriving livelihoods for all people.

NOW, THEREFORE, I, David Kaptain, Mayor of the City of Elgin, Illinois, do hereby
proclaim Sunday, October 17, 2021 as CROP HUNGER WALK DAY in Elgin and encourage
all citizens to support observances that raise public awareness concerning hunger and poverty,
their causes and their solutions.

Noelle Garcia, via email, stated her concerns about transportation to school.
Sheri DeShazo provided her perspective on the anesthesiologist situation at Advocate Sherman
Hospital.
Dr. Justin Maccriola-Coad provided his perspective on the anesthesiologist situation at Advocate
Sherman Hospital.
Dr. Faizan Sahkeel provided his perspective on the anesthesiologist situation at Advocate
Sherman Hospital.
Cesar Mendez stated concerns about multilingual transparency and asked that the city look into
having translation services available for public meetings.
BID 21-045A AWARDED TO LITE CONSTRUCTION, INC. FOR BOWES CREEK
CLUBHOUSE PATIO IMPROVEMENTS
Councilmember Shaw made a motion, seconded by Councilmember Martinez, to reject all of the
bids from the original Bid 21-045 and award Bid 21-045A to Lite Construction, Inc. in the
amount of $237,213 to provide necessary improvements at the Bowes Creek Clubhouse patio.
Upon a roll call vote: Yeas: Councilmembers Good, Martinez, Powell, Rauschenberger, Shaw,
Steffen, Thoren, and Mayor Kaptain. Nays: None. Councilmember Dixon abstained.
BID 21-055 AWARDED TO RCN TECHNOLOGIES FOR SIERRA MOBILE
NETWORK DEVICES
Councilmember Shaw made a motion, seconded by Councilmember Martinez, to approve a
contract with RCN Technologies in the amount of $30,252 for Sierra Mobile Network devices to
improve the efficiency and effectiveness of fire department responses by replacing outdated
communications equipment utilized on front line apparatus. Upon a roll call vote: Yeas:
Councilmembers Dixon, Good, Martinez, Powell, Rauschenberger, Shaw, Steffen, Thoren, and
Mayor Kaptain. Nays: None.

JOB ORDER CONTRACT AWARDED TO F. H. PASCHEN FOR THE ROOF
REPLACEMENT AT WING PARK POOL BUILDINGS
Councilmember Shaw made a motion, seconded by Councilmember Martinez, to approve a
contract with F. H. Paschen in the amount of $91,803 to replace the leaking roof on Wing Park
Pool Buildings. Upon a roll call vote: Yeas: Councilmembers Dixon, Good, Martinez, Powell,
Rauschenberger, Shaw, Steffen, Thoren, and Mayor Kaptain. Nays: None.
NATIONAL COOPERATIVE PURCHASING ALLIANCE CONTRACT APPROVED
TO PURCHASE SIXTY GETAC SEMI -RUGGED COMPUTERS
Councilmember Shaw made a motion, seconded by Councilmember Martinez, to approve the
purchase of the computers from the Emergency Telephone System Fund in the amount of
$173,931 in order to increase police operational efficiencies with improved technology. Upon a
roll call vote: Yeas: Councilmembers Dixon, Good, Martinez, Powell, Rauschenberger, Shaw,
Steffen, Thoren, and Mayor Kaptain. Nays: None.
PETITION 29-21 APPROVED FOR 164 E. DIVISION STREET, SUITE 402 FOR
CONDITIONAL USE TO ESTABLISH A HEALING CENTER WITHIN AN EXISTING
MULTIPLE -TENANT OFFICE BUILDING
Marc Mylott, Community Development Director, outlined Petition 29-21 for 164 E. Division
Street, Suite 402. The petition allows for a conditional use to establish a healing center. Staff
and the Planning and Zoning Commission recommend approval subject to the conditions
outlined.
Councilmember Powell made a motion, seconded by Councilmember Martinez, to approve
Petition 29-21 subject to conditions. Upon a roll call vote: Yeas: Councilmembers Dixon, Good,
Martinez, Powell, Rauschenberger, Shaw, Steffen, Thoren, and Mayor Kaptain. Nays: None.
PETITION 35-21 APPROVED FOR 115 S. GROVE AVENUE, SUITE 210-211 FOR
CONDITIONAL USE TO ESTABLISH A CHURCH WITHIN AN EXISTING
MULTIPLE -TENANT OFFICE BUILDING
Marc Mylott, Community Development Director, outlined Petition 35-21 for 115 S. Grove
Avenue, Suite 210-211. The petition allows for a conditional use to establish a church. He noted
they would recommend adopting an ordinance in conjunction with this project regarding liquor
licenses in proximity to the church. Staff and the Planning and Zoning Commission recommend
approval subject to the conditions outlined.
Angela Holmes, applicant, stated she was excited about the project and was grateful for the city's
support. Doreen Davis, church member, noted her experiences with the church.

AUTHORIZING EXECUTION OF A CHANGE ORDER NO. 1 WITH LDV, INC. FOR THE
PURCHASE OF A MOBILE EMERGENCY OPERATIONS VEHICLE
WHEREAS, the City of Elgin has heretofore entered into a contract with LDV, Inc. for
the purchase of a mobile emergency operations vehicle; and
WHEREAS, it is necessary and desirable to modify the terms of the contract as is
described in Change Order No. 1 attached hereto.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF ELGIN, ILLINOIS, that pursuant to Elgin Municipal Code Section 5.02.020B(9) the City
Council hereby finds that an exception to the requirements of the procurement ordinance is
necessary and in the best interest of the city; and

RESOLUTION
APPROVING AN INTERGOVERNMENTAL AGREEMENT WITH THE STATE OF
ILLINOIS AND THE CITY OF ELGIN APPROPRIATING $58,111 FOR BIKEWAY ROUTE
4, SW QUADRANT FROM BOWES ROAD/BOWES CREEK BLVD (WEST LIMITS) TO
EAST ROAD/IL ROUTE 31 (EAST LIMITS)
WHEREAS, the City of Elgin endeavors to construct bikeway route 4, SW quadrant from
Bowes Road/Bowes Creek Blvd to East Road/IL Route 31, for a total length of approximately
5.8 miles and known to the Illinois Department of Transportation as Section Number 09-00176-
00-BT and State Job Number D-91-305-09; and
WHEREAS, the construction cost of said improvement has necessitated the use of federal
funds; and
WHEREAS, the City of Elgin received two hundred thirty two thousand four hundred
forty and 00/100 dollars ($232,440.00) in CMAQ federal funding through the Chicago
Metropolitan Agency for Planning for Phase II design of said improvements; and
WHEREAS, the federal fund source requires a match of local funds; and
WHEREAS, the use of federal funds requires a joint funding agreement (hereinafter
"AGREEMENT") with the Department of Transportation.
NOW, THEREFORE, BE IT RESOLVED, that the City of Elgin authorizes fifty eight
thousand one hundred eleven and 00/100 ($58,111.00) or as much of such sum as may be needed
to match federal funds in the completion of the aforementioned project known as Section
Number 09-00176-00-BT.
BE IT FURTHER RESOLVED, that the Mayor is hereby authorized and directed to
execute the above -mentioned AGREEMENT and any other such documents related to
advancement and completion of said project.

BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS,
that pursuant to Elgin Municipal Code Section 5.02.020B(9) the City Council hereby finds that
an exception to the requirements of the procurement ordinance is necessary and in the best
interest of the city; and
BE IT FURTHER RESOLVED BY THE CITY COUNCIL OF THE CITY OF ELGIN,
ILLINOIS, that Richard G. Kozal, City Manager, and Kimberly A. Dewis, City Clerk, be and are
hereby authorized and directed to execute a Maintenance Support and Lifecycle Management
Purchase Agreement on behalf of the City of Elgin with Motorola Solutions, Inc. for the
continued support of emergency communications, backup dispatch centers infrastructure, related
equipment and software maintenance, a copy of which is attached hereto and made a part hereof

AN ORDINANCE
PROHIBITING THE USE OF GROUNDWATER AS A POTABLE WATER SUPPLY BY
THE INSTALLATION OR USE OF POTABLE WATER SUPPLY WELLS OR BY ANY
OTHER METHOD WITHIN A DEFINED AREA OF THE CITY OF ELGIN AT 520
MCBRIDE STREET, 464 MCBRIDE STREET AND 40 ANN STREET
WHEREAS, certain properties in the City of Elgin, commonly known as 520 McBride
Street, 464 McBride Street and 40 Ann Street has been used over a period of time for
commercial/industrial purposes; and
WHEREAS, because of said use, concentrations of certain chemical constituents in the
groundwater beneath the property depicted in Exhibit A may exceed Class I groundwater quality
standards for potable resource groundwater as set forth in 35 Illinois Administrative Code 620 or
Tier I residential remediation objectives as set forth in 35 Illinois Administrative Code 742; and
WHEREAS, the City of Elgin desires to limit potential threats to human health from
groundwater contamination while facilitating the redevelopment and productive use of properties
that are the source of chemical constituents.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF ELGIN, ILLINOIS:
Section 1. Recitals. The foregoing recitals are incorporated herein as findings of the
Mayor and City Council.
Section 2. Definitions. The terms and words used in this ordinance shall be used,
interpreted and defined as set forth in this Section:
"Person" shall mean any individual, partnership, co -partnership, firm, company, limited liability
company, corporation, association, joint stock company, trust, estate, political subdivision, or
any other legal entity, or their legal representatives, agents or assigns.
"Potable water" shall mean any water used for human or domestic consumption, including, but
not limited to, water used for drinking, bathing, swimming, washing dishes, preparing foods, or
watering gardens in which produce intended for human consumption is grown.
"the Property" shall mean that real property depicted and legally described in the three surveys
attached hereto and incorporated by reference into this ordinance as Exhibit A, such properties
being commonly known as 520 McBride Street, 464 McBride Street and 40 Ann Street.
Section 3. Use of groundwater as a potable water supply prohibited. The use or attempt to
use as a potable water supply, groundwater from the Property, by the installation or drilling of
wells or by any other method is hereby prohibited.

Section 4. Restrictions binding on City. Except for the provisions of Section 5, all
restrictions contained in this ordinance shall be binding on the City.
Section 5. Penalties. Any person violating the provisions of this Ordinance shall be
subject to a fine of up to $500.00 for each violation.
Section 6. Repealed. All ordinances or parts of ordinances in conflict with this Ordinance
are hereby repealed insofar as they are in conflict with this Ordinance.
Section 7. Severability. If any provision of this Ordinance or its application to any person
or under any circumstances is adjudged invalid, such adjudication shall not affect the validity of
the Ordinance as a whole or of any portion not adjudged invalid.
Section 8. Effective Date. This ordinance shall be in full force and effect upon its passage
and publication in the manner provided by law.

authorized and directed to execute a Brink's Complete Service Agreement on behalf of the City
of Elgin with Brink's Capital LLC, to provide certain cash management solutions, a copy of
which is attached hereto and made a part hereof by reference.
