COUNCIL-MANAGER FORM OF GOVERNMENT
REGULAR MEETING
The regular meeting of the Council of the City of Elgin, Illinois, was held on July 14, 2021, in
the Council Chambers. The meeting was called to order by Mayor Kaptain at 7:08 p.m. The
Pledge of Allegiance was led by Mayor David Kaptain.
ROLL CALL
Roll call was answered by Councilmembers Dixon, Good, Martinez, Powell, Rauschenberger,
Shaw, Steffen, Thoren, and Mayor Kaptain. Absent: None.
MINUTES OF THE JUNE 23, 2021, COUNCIL MEETING APPROVED AS
DISTRIBUTED
Councilmember Martinez made a motion, seconded by Councilmember Steffen, to approve the
June 23, 2021, regular council meeting minutes as distributed. Upon a roll call vote: Yeas:
Councilmembers Dixon, Good, Martinez, Powell, Rauschenberger, Shaw, Steffen, Thoren, and
Mayor Kaptain. Nays: None.
COMMUNICATIONS
Parks and Recreation Month Proclamation
Mayor Kaptain read the following proclamation:
PROCLAMATON
WHEREAS, parks and recreation programs are an integral part of communities
throughout this country, including Elgin; and
WHEREAS, our parks and recreation programs are vitally important in building an active
community, establishing and maintaining the quality of life in our city, ensuring the health of all
citizens and contributing to the economic and environmental well-being of a community and
region; and
WHEREAS, our 75 parks and natural recreation areas improve water quality, protect
groundwater, prevent flooding, improve the quality of the air we breathe, provide vegetative
buffers to development, and produce habitat for wildlife; and

WHEREAS, our parks and natural recreation areas ensure the ecological beauty of our
community and provide a place for children and adults to connect with nature and recreate
outdoors; and
WHEREAS, the U.S. House of Representatives has designated July as Parks and
Recreation Month.
NOW THEREFORE, I, David Kaptain, Mayor of the city of Elgin, Illinois do hereby
declare the month of July as Parks and Recreation Month in the city of Elgin.

PUBLIC COMMENTS
Grace Richard, via email, stated her opinion regarding the attempts to save the D.C. Cook
building from demolition.
Sue Webb, via email, commented on using federal funds to make improvements at the Elgin
Sports Complex and the impact it would have on the city.
Joe Galli commented on using federal funds to impact staffing at the fire department.
Patrick Richardson commented on climate change including the recent heat wave out west and
the impact it will have on crops.
Al Walters stated his opinion regarding the attempts to save the D.C. Cook building from
demolition.
Betsy Couture stated her opinion regarding the attempts to save the D.C. Cook building from
demolition.
Martin Nobs stated his opinion regarding the attempts to save the D.C. Cook building from
demolition.
Jimena Sanchez commented and offered his opinion on the education requirements in the Police
department recruiting process.
Joan Steffen commented and offered her opinion on the education requirements in the Police
department recruiting process.
Lucy Nguyen commented and offered her opinion on the education requirements in the Police
department recruiting process.

Dr. Angelos Bravos commented on the creation of an additional sister city program with a city in
Greece.
Kevin Jaime-Villagomez commented and offered his opinion on the education requirements in
the Police department recruiting process.
Denise Habun asked the council to consider using federal funds to support mental health
services. She also thanked the police department for the response to a tragedy in her
neighborhood.
BID 21-035 AWARDED TO WEST PIER LAUNDRY FOR LAUNDERING OF STAFF
UNIFORMS AND LINEN
Councilmember Shaw made a motion, seconded by Councilmember Martinez, to award a
contract to West Pier Laundry of Elgin for a term of two years with three, one-year renewal
options in an annual amount of $22,000 to provide laundry services for code enforcement officer
uniforms and linens for the police and fire departments. Upon a roll call vote: Yeas:
Councilmembers Dixon, Good, Martinez, Powell, Rauschenberger, Shaw, Steffen, Thoren, and
Mayor Kaptain. Nays: None.
BID 21-036 AWARDED TO GLI SERVICES, INC., D/B/A GEORGES LANDSCAPING
INC. FOR BRICK RESTORATION AT FOUNDRY PARK
Councilmember Steffen made a motion, seconded by Councilmember Martinez, to award a
contract to GLI Services, Inc., d/b/a Georges Landscaping Inc. in the amount of $38,400 to
perform maintenance necessary to replace permeable pavers at Foundry Park. Upon a roll call
vote: Yeas: Councilmembers Dixon, Good, Martinez, Powell, Rauschenberger, Shaw, Steffen,
Thoren, and Mayor Kaptain. Nays: None.
CONSENT AGENDA
By unanimous consent, Councilmember Powell made a motion, seconded by Councilmember
Martinez, to pass Ordinance Nos. G34-21 and G35-21 and adopt Resolution Nos. 21-101 through
21-104 by omnibus vote. Upon a roll call vote: Yeas: Councilmembers Dixon, Good, Martinez,

and directed to execute a Redevelopment Agreement on behalf of the City of Elgin with Legend
Partners, LLC, for the redevelopment of 40 DuPage Court, Elgin, Illinois, a copy of which is

FROM HURON'S MCLEAN BOULEVARD SUBDIVISION AND ACCEPTING FOR
OWNERSHIP AND MAINTENANCE CERTAIN PUBLIC IMPROVEMENTS WITHIN THE
HURON'S MCLEAN BOULEVARD SUBDIVISION LOTS 1 AND 2
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS,
that David J. Kaptain, Mayor, and Kimberly A. Dewis, City Clerk, be and are hereby authorized
and directed to execute a Plat of Easement Grant and Release for public improvements for Huron's
McLean Boulevard Subdivision from Huron Investment and Development Company, LLC for
Lots 1 and 2 regarding the property legally described on said plat, prepared by Cemcon, Ltd. dated
March 11, 2016, last revised on September 19, 2019 a copy of which is attached hereto.
BE IT FURTHER RESOLVED that the City Clerk is hereby authorized and directed to
cause said Plat of Easement Grant and Release for Huron's McLean Boulevard Subdivision Lots
1 and 2 to be recorded in the office of the Recorder of Deeds of Kane County, Illinois.
BE IT FURTHER RESOLVED BY THE CITY COUNCIL OF THE CITY OF ELGIN,
ILLINOIS, that the City of Elgin hereby accepts for ownership and maintenance certain public
improvements within the Huron's McLean Boulevard Subdivision. Acceptance of the public
improvements will add the following city maintained facilities: 108 lineal feet of 6-inch water
main, 1,509 lineal feet of 8-inch water main, five 8-inch valves in 4-foot vaults, 4 fire hydrants,
348 lineal feet of 8-inch sanitary sewer, 1 sanitary manhole and their appurtenances to the City
maintained facilities.

improvements within the Huron's McLean Boulevard Subdivision. Acceptance of the public
improvements will add the following city maintained facilities: 354 lineal feet of 8-inch water
main, one 8-inch valve in 4-foot vault, one sampling station, 2 fire hydrants, 384 lineal feet of 8-
inch sanitary sewer, 3 sanitary manholes and their appurtenances to the City maintained facilities.

AN ORDINANCE
GRANTING A CONDITIONAL USE FOR ACCESSORY PACKAGE LIQUOR SALES IN
THE AB AREA BUSINESS DISTRICT AND ARC ARTERIAL ROAD CORRIDOR
OVERLAY DISTRICT
(2455 South Street)
WHEREAS, written application has been made requesting conditional use approval to
establish accessory package liquor sales at 2455 South Street; and
WHEREAS, the zoning lot with the building containing the premises at 2455 South Street
is legally described herein (the "Subject Property"); and
WHEREAS, the Subject Property is located within the AB Area Business District, and
ARC Arterial Road Corridor Overlay District, and accessory package liquor sales establishment
[SR] (UNCL) is listed as a conditional use within the AB Area Business District; and
WHEREAS, the Planning and Zoning Commission conducted a public hearing concerning
said application on June 7, 2021 following due notice including by publication; and

WHEREAS, the Community Development Department and the Planning and Zoning
Commission have submitted their Findings of Fact concerning said application; and
WHEREAS, the Community Development Department and the Planning and Zoning

WHEREAS, the City Council of the City of Elgin, Illinois, has reviewed the findings and
recommendations of the Community Development Department and the Planning and Zoning
Commission; and
WHEREAS, the City of Elgin is a home rule unit and as a home rule unit may exercise any
power and perform any function pertaining to its government and affairs; and
WHEREAS, zoning, including, but not limited to, this ordinance granting a conditional use
in the AB Area Business District pertains to the government and affairs of the city.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF

Fact, dated June 7, 2021, and the recommendations made by the Community Development

Section 3. That the conditional use for the Subject Property as authorized by this
ordinance shall be subject to the following additional conditions:
1. Substantial conformance to the Development Application submitted by RDK Ventures
LLC as applicant and property owner, received March 12, 2021 and supporting
documents including:
a. Undated narrative letter received March 22, 2021;
b. ALTA/ACSM Land Title Survey, prepared by Harrington Land Surveying, Ltd..,
dated November 5, 2009, last revised November 20, 2009;
c. As -Built floor plan, prepared by Tzveta Radeva, dated June, 24, 2019, last revised
September 3, 2020, and received March 8, 2021, with such further revisions as
requested by the Community Development Director.
In the event of any conflict between such documents and the terms of this ordinance or

2. The sale of any beer or malt products by the single container is not permitted. The sale
of any single container of alcoholic liquor, other than beer, with a volume of the
container less than 25.36 fluid ounces (or approximately 750 milliliters) is not
permitted.
3. Consumption of alcoholic beverages on the premises is not permitted.
4. All street graphics must comply with the zoning ordinance requirements.
5. Compliance with all applicable codes and ordinances.

269 Lincoln Avenue, and 738 Prospect Boulevard)
WHEREAS, written application has been made to reclassify certain properties located at
731 Center Street, 737 Center Street, 265 Lincoln Avenue, 269 Lincoln Avenue, and 738 Prospect
Boulevard from RC2 Residence Conservation District to CF Community Facility District; and
WHEREAS, the zoning lots containing the premises at 731 Center Street, 737 Center
Street, 265 Lincoln Avenue, 269 Lincoln Avenue, and 738 Prospect Boulevard are legally
described herein (the "Subject Property"); and
WHEREAS, the Planning and Zoning Commission conducted a public hearing concerning
said application on June 7, 2021, following due notice including by publication; and
WHEREAS, the Community Development Department and the Planning and Zoning
Commission have submitted their Findings of Fact concerning said application; and

NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
ELGIN, ILLINOIS:
Section 1. That the City Council of the City of Elgin hereby adopts the Findings of
Fact, dated June 7, 2021, and the recommendations made by the Community Development
Department and the Planning and Zoning Commission, a copy of which is attached hereto and
made a part hereof by reference as Exhibit A.
Section 2. That Chapter 19.07 Zoning Districts, Section 19.08.020 entitled "Official
Zoning District Map" of the Elgin Municipal Code, as amended, be and the same is hereby further
amended by adding thereto the following paragraph:
The boundaries hereinafter laid out in the "Zoning District Map", as amended, be and are
hereby altered by including in the CF Community Facility District the following described
properties:
LOT 2 OF PLEASANT VIEW ADDITION TO ELGIN ACCORDING TO THE PLAT
RECORDED IN BOOK 8 OF PLATS, PAGE 43, IN THE CITY OF ELGIN, KANE
COUNTY, ILLINOIS.
