VOLUME LXXXIII APRIL 11, 2018
COUNCIL OF THE CITY OF ELGIN, ILLINOIS COUNCIL-MANAGER FORM OF GOVERNMENT REGULAR MEETING
The regular meeting of the Council of the City of Elgin, Illinois, was held on April 11, 2018, in
the Council Chambers. The meeting was called to order by Mayor Kaptain at 7:00 p.m. The
Invocation was given by Anette Forster, from Kids Hope USA and the Pledge of Allegiance was
led by Councilmember Rose Martinez.
ROLL CALL
Roll call was answered by Councilmembers Dixon, Dunne, Gavin, Martinez, Powell,
Rauschenberger, Shaw, Steffen, and Mayor Kaptain. Absent: None.
MINUTES OF THE MARCH 21, 2018, COUNCIL MEETING APPROVED AS
DISTRIBUTED
Councilmember Dixon made a motion, seconded by Councilmember Martinez, to approve the
March 21, 2018, Council Meeting Minutes as distributed. Upon a roll call vote: Yeas:
Councilmembers Dixon, Dunne, Gavin, Martinez, Powell, Rauschenberger, Shaw, Steffen, and
Mayor Kaptain. Nays: None.
COMMUNICATIONS
Larkin High School Boys Basketball Team Proclamation
Mayor Kaptain read the following proclamation:
PROCLAMATION
WHEREAS, For the first time in Larkin High School’s history, the boys basketball
team advanced to the Illinois High School Association Class 4A State Finals, widely considered
as America’s Original March Madness, and
WHEREAS, In 2018, the Larkin boys basketball team had a winning record of 24-9 and
defeated Benet Academy 53-46 in the Class 4A super-sectional to advance to the final four of the
state basketball tournament; and
WHEREAS, The Royals finished fourth in the state tournament, after falling to
Evanston Township High School 64-53 in the third-place contest in Peoria; and

WHEREAS, Larkin alum Deryn Carter has been the boys’ basketball coach since 2009
and has lead the team to seven straight winning seasons; and
WHEREAS, The Royals were led by Seniors Anthony Lynch, Jalen Shaw, Kindrel
Morris, Isiah Talley, Max Wiskirchen, Jackson Reuter, Keevon Campbell and Rolax Green,
Juniors Chris Rose, Pierre Black, Latrell Hudson, Mattel McCurry, Anthony Ramirez, Trevell
Cooks, and Victor Perez, Sophomores Larenzo Coney and Jashon Johnson-Neals and Managers
Kayce Moore and Jeff Althamar.
NOW, THEREFORE, I, David Kaptain, Mayor of the City of Elgin, do hereby extend
sincere and warm congratulations and esteem to the Larkin High School boys’ basketball team
on their achievement in their 2018 season and their 4th place finish at the 4A State Finals
Championship.

National Public Safety Telecommunicators Week Proclamation
Mayor Kaptain read the following proclamation:
PROCLAMATION
WHEREAS, each day, thousands of Americans dial 9-1-1 for help in emergencies. The
men and women who answer these calls for help, gathering essential information and dispatching
the appropriate assistance, can often make the difference between life and death for persons in
need; and
WHEREAS, the City of Elgin’s Public Safety Telecommunicators are among the more
than 200,000 telecommunications specialists who work daily to protect and to promote public
safety; and
WHEREAS, Public Safety Telecommunicators are more than a calm and reassuring
voice at the other end of the phone. They are knowledgeable and highly trained individuals who
not only work closely with the Police and Fire Departments, but numerous other State and local
agencies as well as other departments within the City; and
WHEREAS, because emergencies can strike at any time, we rely on the vigilance and
the preparedness of these individuals 24 hours a day, 365 days a year; and

WHEREAS, the City of Elgin recognizes the need to maintain the highest standards of
public safety, we owe a great debt to the men and women who, by applying their expertise in
telecommunications, help to make that achievement possible; and
WHEREAS, during this special observance, we acknowledge that debt and extend a
heartfelt thank you to each of them;
NOW, THEREFORE, I, David Kaptain, Mayor of the City of Elgin, Illinois, on behalf of
the entire City Council and Staff, do hereby proclaim April 8 to April 14, 2018 as National
Public Safety Telecommunicators Week.

RECOGNIZE PERSONS PRESENT
Andrew Cuming, South West Area Neighborhood (SWAN) President, stated the residents
concerns about the lack of communication regarding the plans to update the Route 31 and Route
20 interchange. He asked that the city assist in ensuring SWAN’s concerns were addressed
regarding the project.
Sue Webb echoed the comments made by Andrew Cuming regarding the interchange project.
Joe Galli, President of the Firefighters Local 439, recognized Firefighter Chris Harris and noted
that he was injured in the line of duty.
Charles Clements, Decynthia Clements’ father, introduced members of Decynthia Clements’
family. Mr. Clements stated he understood that the investigation must run its course.
Tonya Sneed, Decynthia Clements’ sister, expressed her concerns over the actions of the police
department.
Tyri Clements, Decynthia Clements’ son, expressed his concerns over the actions of the police
department. He hoped that there would be further training to avoid this type of situation in the
future.
Mary Shesgreen, Fox Valley Citizens for Peace and Justice, read a statement regarding the
shooting of Decynthia Clements and called for the city to fire Lieutenant Jensen.
Marcus Banner stated his concerns regarding how police personnel handled the traffic stop
involving Decynthia Clements and stated that he felt Lieutenant Jensen should be fired.

Earl Silbar stated his concerns and questions regarding the traffic stop involving Decynthia
Clements. He further stated he felt Lieutenant Jensen should be fired.
Bettina Perillo stated that Lieutenant Jensen should be fired.
Demitrius Smith expressed his concerns about the costs associated with police impounded
vehicles. He stated that Lieutenant Jensen should be fired.
Randy Hopp stated his objections over allowing a credit union in the Gail Borden Public Library
and asked the council to reject the proposed zoning change.
Mayor Kaptain stated that the State Police investigation is ongoing and that any decisions would
be made after due process had taken place.
BID 18-016 AWARDED TO J. GILL AND COMPANY FOR SPRING STREET
PARKING STRUCTURE MAINTENANCE REPAIRS AND SEALING
Councilmember Dunne made a motion, seconded by Councilmember Steffen, to award a contract
to J. Gill and Company in the amount of $50,685 to perform necessary maintenance repairs and
sealing to the city-owned Spring Street parking structure to properly maintain the property.
Upon a roll call vote: Yeas: Councilmembers Dixon, Dunne, Gavin, Martinez, Powell,
Rauschenberger, Shaw, Steffen, and Mayor Kaptain. Nays: None.
PETITION 02-18 APPROVED FOR 270 NORTH GROVE AVENUE FOR A MAP
AMENDMENT TO ALLOW BANKING FACILITIES AS A PERMITTED USE IN THIS
PLANNED DEVELOPMENT
Marc Mylott, Community Development Director, provided an overview of Petition 02-18, which
is a map amendment to allow banking facilities as a permitted use in the planned development at
270 North Grove Avenue. Staff and the Planning and Zoning Commission approved the petition
subject to the conditions outlined in the memo.
There was discussion regarding the types of financial literacy programs that would be offered,
and the impact on other library services, seating and parking.
Councilmember Shaw made a motion, seconded by Councilmember Steffen, to approve Petition
02-18 subject to conditions. Upon a roll call vote: Yeas: Councilmembers Dixon, Dunne, Gavin,
Martinez, Powell, Shaw, Steffen, and Mayor Kaptain. Nays: Councilmember Rauschenberger.

RESOLUTION 18-44 ADOPTED AUTHORIZING ACCEPTANCE OF ILLINOIS
DEPARTMENT OF TRANSPORTATION DISTRACTED DRIVING/OCCUPANT
PROTECTION PROGRAM GRANT AND RATIFYING THE EXECUTION OF AN
INTERGOVERNMENTAL AGREEMENT (AGREEMENT NO. DD-18-0471)
Councilmember Dunne made a motion, seconded by Councilmember Martinez, to adopt the
following resolution. Upon a roll call vote: Yeas: Councilmembers Dixon, Dunne, Gavin,
Martinez, Powell, Rauschenberger, Shaw, Steffen, and Mayor Kaptain. Nays: None.

RESOLUTION
AUTHORIZING ACCEPTANCE OF ILLINOIS DEPARTMENT OF TRANSPORTATION
DISTRACTED DRIVING/OCCUPANT PROTECTION PROGRAM GRANT AND
RATIFYING THE EXECUTION OF AN INTERGOVERNMENTAL AGREEMENT
(Agreement No. DD-18-0471)
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS,
that the City of Elgin, Illinois hereby accepts the Illinois Department of Transportation Distracted
Driving/Occupant Protection grant in the amount of $7,104.00 for distracted driving and occupant
protection enforcement.
BE IT FURTHER RESOLVED BY THE CITY COUNCIL OF THE CITY OF ELGIN,
ILLINOIS, that it hereby ratifies and approves the execution of an intergovernmental agreement
by
Richard G. Kozal, City Manager, and Kimberly A. Dewis, City Clerk, with the State of Illinois
and Illinois Department of Transportation regarding the Distracted Driving/Occupant Protection
Program, a copy of which is attached hereto and made a part hereof by reference.

AUTHORIZING EXECUTION OF AN AGREEMENT WITH RELATIONSHIPS MATTER
NOW, LLC FOR DIVERSITY AND INCLUSION CONSULTING SERVICES
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS,
that pursuant to Elgin Municipal Code Section 5.02.020B(9) the City Council hereby finds that an
exception to the requirements of the procurement ordinance is necessary and in the best interest of
the city; and
BE IT FURTHER RESOLVED BY THE CITY COUNCIL OF THE CITY OF ELGIN,
ILLINOIS, that Richard G. Kozal, City Manager, and Kimberly A. Dewis, City Clerk, be and are
hereby authorized and directed to execute an agreement on behalf of the City of Elgin with
Relationships Matter Now, LLC for diversity and inclusion consulting services, a copy of which
is attached hereto and made a part hereof by reference.
