COUNCIL OF THE CITY OF ELGIN, ILLINOIS COUNCIL-MANAGER FORM OF GOVERNMENT REGULAR MEETING
The regular meeting of the Council of the City of Elgin, Illinois, was held on September 13,
2017, in the Council Chambers. The meeting was called to order by Mayor Kaptain at 7:12 p.m.
The Invocation was given by Reverend Denise Tracy, from the Unitarian Universalist and the
Pledge of Allegiance was led by Police Chief Jeff Swoboda.

Roll call was answered by Councilmembers Dixon, Dunne, Gavin, Martinez, Powell,
Rauschenberger, Shaw, Steffen, and Mayor Kaptain. Absent: None.
MINUTES OF THE AUGUST 23, 2017, COUNCIL MEETING APPROVED AS
DISTRIBUTED
Councilmember Shaw made a motion, seconded by Councilmember Martinez, to approve the
August 23, 2017, Council Meeting Minutes as distributed. Upon a roll call vote: Yeas:
Councilmembers Dixon, Dunne, Gavin, Martinez, Powell, Rauschenberger, Shaw, Steffen, and
Mayor Kaptain. Nays: None.
COMMUNICATIONS
Elgin, City of Peace Weekend Proclamation
Mayor Kaptain read the following proclamation:
PROCLAMATION
WHEREAS the United Nations has defined a Culture of Peace as a set of values,
attitudes, modes of behavior and ways of life that reject violence and prevent conflicts by
tackling their root causes to solve problems through dialogue and negotiation among individuals,
groups and nations; and
WHEREAS the World Health Organization defines health as not merely the absence of
disease or infirmity, but achievement of a balance of physical, mental, and social well- being,
and peace is not merely the absence of war and violence, but a condition where society has
achieved a balance of prosperity, security, justice and hope, and

WHEREAS the city of Elgin strives to foster a culture of peace through quality
education, promoting sustainable economic and social development, promoting respect for all
human rights, ensuring racial equality, fostering democratic participation, advancing
understanding, tolerance and solidarity and nurturing understanding and establishing new
structures of cooperation to improve the quality of life of the people of our community; and
WHEREAS the United Nations has designated 21 September of each year to be the
International Day of Peace, devoted to commemorating and strengthening the ideals of peace
both within and among all nations and peoples; from 2017 forward, The City of Elgin declares
that the weekend closest to September 21 be designated Elgin, City of Peace Weekend. During
this weekend our community will develop, share and celebrate activities that will foster Peace in
our city.
NOW, THEREFORE, I, David Kaptain, Mayor of the City of Elgin, do hereby proclaim
September 22-24 Elgin, City of Peace Weekend, hereby promoting and establishing peace in our
city in perpetuity.

Mayor’s Monarch Pledge Proclamation
Mayor Kaptain read the following proclamation:
PROCLAMATION
WHEREAS, the monarch butterfly is an iconic North American species whose migration
and metamorphosis from caterpillar to butterfly has captured the imagination of millions of
Americans; and
WHEREAS, the North American monarch population has declined by more than 90
percent in the past two decades; and
WHEREAS, cities, towns and counties have a critical role to play to save the monarch
butterfly; and
WHEREAS, the monarch butterfly was designated the official state insect in 1975, and
milkweed was just designated this year in 2017 as the official state wildflower; and
WHEREAS, every citizen of Elgin can make a difference by planting native milkweed and
nectar plants to provide habitat for the monarch and pollinators in locations where people live,
work, and play; and

WHEREAS, on behalf of the people of Elgin who have already joined me in creating
healthy habitat for these magnificent butterflies, I am honored to join mayors across the country
in signing the National Wildlife Federation’s Mayors’ Monarch Pledge; and I encourage other city
officials across our great nation to take a stand so that the monarch butterfly will once again
flourish across the continent.
NOW, THEREFORE, I, David Kaptain, Mayor of the City of Elgin, Illinois, do hereby
proclaim September 13, 2017, to be Monarch Day in Elgin, and encourage each individual in our
community to help make Elgin a monarch-friendly community by planting milkweed in their yards
and helping to educate our children so future generations can also help bring back monarch
populations across the country.

RECOGNIZE PERSONS PRESENT
Ed Piotrowski expressed his concerns regarding airplane noise and the expansion of O’Hare
Airport.
Jen Fukala announced Neighborworks Day on September 23, 2017. There would be work done
on several homes in the NENA neighborhood and volunteers are still needed. Ms. Fukala also
announced an Autumn Harvest Farm to Table dinner being held on October 1, 2017.
Don Tutt expressed his concerns about his taxes and the services the city provides the Edgewater
neighborhood.
Jean Gromert, Edgewater resident, expressed her concerns over having private streets in her
subdivision.
Demi Mitchell expressed concerns about tax increases and road maintenance in the Edgewater
neighborhood.
Barb Bajko expressed concerns about tax increases and road maintenance in the Edgewater
neighborhood. She also stated concerns regarding emergency services in the gated community.
Bill Bayko expressed his concerns about his taxes and the services the city provides the
Edgewater neighborhood.
Rick Campbell, Bowes Creek resident, expressed his support for the Edgewater residents and
their concerns regarding road maintenance and increased taxes.

BID 17-039 AWARDED TO MARTAM CONSTRUCTION FOR THE LEO NELSON
RIVERSIDE WATER TREATMENT PLANT VALVE VAULT
Councilmember Steffen made a motion, seconded by Councilmember Martinez, to award the
Leo Nelson Riverside Water Treatment Plant Valve Vault bid to Martam Construction in the
amount of $272,816 to provide a safe means to access three buried valves. Upon a roll call vote:
Yeas: Councilmembers Dixon, Dunne, Gavin, Martinez, Powell, Rauschenberger, Shaw, Steffen,
and Mayor Kaptain. Nays: None.
JOINT PURCHASING COOPERATIVE CONTRACTS APPROVED WITH VARIOUS
VENDORS FOR UTILITIES DIVISION EQUIPMENT PURCHASES
Councilmember Shaw made a motion, seconded by Councilmember Martinez, to approve
contracts with various vendors for the purchase of equipment and vehicles for the utilities
division of public services in the amount of $407,575. Upon a roll call vote: Yeas:
Councilmembers Dixon, Dunne, Gavin, Martinez, Powell, Rauschenberger, Shaw, Steffen, and
Mayor Kaptain. Nays: None.
NATIONAL INTERGOVERNMENTAL PURCHASING ALLIANCE CONTRACT
APPROVED WITH REINDERS, INC. FOR THE PURCHASE OF EMERGENCY
REPLACEMENT OF GOLF TURF EQUIPMENT
Councilmember Shaw made a motion, seconded by Councilmember Martinez, to approve the
purchase of two Toro fairway mower units from Reinders Inc. in the amount of $86,245 to
replace broken fairway mowers at The Highlands of Elgin. Upon a roll call vote: Yeas:
Councilmembers Dixon, Dunne, Gavin, Martinez, Powell, Rauschenberger, Shaw, Steffen, and
Mayor Kaptain. Nays: None.
PETITION 01-17 APPROVED FOR AN APPLICATION TO ESTABLISH DOG
GROOMING SERVICES, AND AN AMENDMENT TO THE EXISTING PLANNED
DEVELOPMENT AS A CONDITIONAL USE ( MIRA DOG GROOMING / HOUSE OF
PAWS / AMI PROPERTIES), 920 SOUTH MCLEAN BOULEVARD
Marc Mylott, Community Development Director, provided an overview of Petition 01-17 which
would grant a conditional use to allow a dog grooming facility. Staff and the Planning and
Zoning Commission approved the petition subject to the conditions outlined in the memo.
Councilmember Gavin made a motion, seconded by Councilmember Dunne, to approve Petition

Marc Mylott, Community Development Director, provided an overview of Petition 16-17 which
would grant a conditional use to allow a physical fitness facility. Staff and the Planning and
Zoning Commission approved the petition subject to the conditions outlined in the memo.

RESOLUTION 17-121 ADOPTED AUTHORIZING EXECUTION OF AN
AMENDMENT TO LOAN AGREEMENT WITH THE ELGIN SYMPHONY
ORCHESTRA ASSOCIATION
There was discussion about adding conditions to the agreement including providing grant
application results and opening the orchestra rehearsals to the public. There was discussion
regarding drafting procedures for loan forgiveness for other not for profit agencies.
Councilmember Powell made a motion, seconded by Councilmember Dixon, to add a condition
to require grant application reporting. Upon a roll call vote: Yeas: Councilmembers Dixon,
Dunne, Powell, Rauschenberger, Shaw, Steffen, and Mayor Kaptain. Nays: Councilmembers
Gavin and Martinez.

ILLINOIS, that Richard G. Kozal, City Manager, be and is hereby authorized and directed to
execute an Agreement on behalf of the City of Elgin with Hampton, Lenzini and Renwick, Inc. for
emergency engineering services in connection with Linden Avenue and Preston Avenue Roadway
Repair Project, a copy of which is attached hereto and made a part hereof by reference.

RESOLUTION
APPROVING CHANGE ORDER NO. 1 FOR THE CONTRACT WITH
BOLLER CONSTRUCTION COMPANY, INC. FOR
CARBON DIOXIDE AND CHLORINE UPDATES PROJECT
(Leo Nelson Riverside and Airlite Water Treatment Plants)
WHEREAS, the City of Elgin has heretofore entered into a contract with Boller
Construction Company, Inc. for carbon dioxide and chlorine updates project at the Leo Nelson
Riverside and Airlite Water Treatment Plants; and
WHEREAS, it is necessary and desirable to modify the terms of the contract as is described
in Change Order No. 1, attached hereto.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
ELGIN, ILLINOIS, that Richard G. Kozal, City Manager, be and is hereby authorized and directed
to execute Change Order No. 1, a copy of which is attached hereto and made a part hereof by
reference.

AN ORDINANCE
AMENDING CHAPTER 7.08 OF THE ELGIN MUNICIPAL CODE, 1976,
AS AMENDED, ENTITLED "KEEPING OF CHICKENS"
WHEREAS, the City of Elgin is a home rule unit and as a home rule unit may exercise any
power and perform any function pertaining to its government and affairs; and
WHEREAS, the City Council of the City of Elgin has determined that it is appropriate to
amend the current regulations for the keeping of chickens within the City of Elgin; and
WHEREAS, the keeping of chickens within the City of Elgin and regulations pertaining
thereto involve public health and pertain to the government and affairs of the City of Elgin.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
ELGIN, ILLINOIS:
Section 1. That Section 7.08.180 of the Elgin Municipal Code, 1976, as amended,
entitled “Number of Licenses and Permits to be Issued” be and is hereby further amended to read
as follows:
"The number of licenses authorizing the keeping of chickens shall not exceed one
hundred (100) in number. The number of building permits issued in conjunction
with structures housing hens including pens, coops, buildings or enclosures shall
not exceed one hundred (100) in number."
Section 2. That all ordinances or parts of ordinances in conflict with the provisions of
this ordinance be and are hereby repealed to the extent of any such conflict.
Section 3. That this ordinance shall be in full force and effect upon its passage and
publication in the manner provided by law.

AN ORDINANCE
AMENDING TITLE 11 OF THE ELGIN MUNICIPAL CODE, 1976,
AS AMENDED, ENTITLED "VEHICLES AND TRAFFIC" TO PROVIDE FOR RESIDENT
ONLY PARKING IN THE SUMMERHILL NEIGHBORHOOD
WHEREAS, the City of Elgin is a home rule unit, and as a home rule unit may exercise
any power and perform any function pertaining to its government and affairs; and
WHEREAS, parking regulations on streets within the City pertain to the government and
affairs of the City.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
ELGIN, ILLINOIS:
Section 1. That Chapter 11.60 of the Elgin Municipal Code, 1976, as amended, entitled
"Stopping, Standing and Parking" be and is hereby further amended by adding a new Section
11.60.067 thereto entitled "Resident Only Parking" to read as follows:
"11.60.067: RESIDENT ONLY PARKING:
A. For the purposes of this Section, a resident is a person who resides within a
described resident only parking area. Residency shall be determined by the address
at which a vehicle is registered with the Illinois Secretary of State.
B. No person other than residents of the area described below, service and delivery
vehicles, and home healthcare provider vehicles whose operators are doing
business with residents, shall park on school days from 7:00 a.m. until 4:00 p.m. on
the streets in the Summerhill neighborhood consisting of the following streets:
Thorndale Drive, Thorndale Court, Maroon Drive between Thorndale Drive and
Shales Parkway, Horace Drive, Thoreau Drive, Inverness Drive, Burns Drive,
Walden Drive, Concord Drive, Concord Court, Mariner Drive, Mariner Court, Glen
Ivy Drive, Packard Drive, Natoma Drive, Natoma Court, Dover Drive and Hampton
Circle. The foregoing resident only parking restriction shall not apply to the
exception for temporary visitors of residents of the described area where a resident
of the area has requested an exception for a temporary visitor and permission has

been granted pursuant to rules and regulations for temporary visitor exceptions, as
determined by the chief of police, or his designee."
Section 2. That all ordinances or parts of ordinances in conflict with the provisions of
