The meeting was called to order by Mayor Kaptain at 7:13 p.m. The Invocation was given by Rabbi Margaret Frisch Klein, from the Congregation Kneseth Israel and the Pledge of Allegiance was led by Councilmember Toby Shaw. ROLL CALL Roll call was answered by Councilmembers Dixon, Gavin, Martinez, Powell, Rauschenberger, Shaw, Steffen, and Mayor Kaptain. Absent: Councilmember Dunne. MINUTES OF THE MAY 24, 2017, COUNCIL MEETING APPROVED AS DISTRIBUTED Councilmember Shaw made a motion, seconded by Councilmember Steffen, to approve the May 24, 2017, Council Meeting Minutes as distributed. Upon a roll call vote: Yeas: Councilmembers Dixon, Gavin, Martinez, Powell, Rauschenberger, Shaw, Steffen, and Mayor Kaptain. Nays: None. RECOGNIZE PERSONS PRESENT John Butler stated his support for a livable wage and for the Cook County Minimum Wage and Sick Leave ordinances. Mary Shesgreen stated her support of the Cook County Minimum Wage and Sick Leave ordinances. Earl Silbar stated his support of the Cook County Minimum Wage and Sick Leave ordinances. Ray Chapman, representative from ABODE, commented on efforts to continue their service project of picking up trash on a portion of Route 20. Rose Ramirez addressed the Council through her interpreter, Tim Bell, and urged the Council to support the Cook County Minimum Wage and Sick Leave ordinances. Tim Bell stated his support of the Cook County Minimum Wage and Sick Leave ordinances. VOLUME LXXXII JUNE 14, 2017 187 BID 17-027 AWARDED TO GOLD MEDAL CHICAGO AND PERFORMANCE FOOD SERVICE-FOX RIVER FOR PURCHASE ITEMS FOR RESALE AT CITY OWNED RECREATION FACILITIES Councilmember Steffen made a motion, seconded by Councilmember Martinez, to award contracts to Gold Medal Chicago and Performance Food Service-Fox River in the amount of $38,200 to provide patrons of Lords and Wing Park Family Aquatic Centers and the Sports Complex concession items for purchase. Upon a roll call vote: Yeas: Councilmembers Dixon, Gavin, Martinez, Powell, Rauschenberger, Shaw, Steffen, and Mayor Kaptain. Nays: None. BID 17-029 AWARDED TO ILLINOIS CONSTRUCTORS CORPORATION FOR BRIDGE REHABILITATION PROGRAM Councilmember Gavin made a motion, seconded by Councilmember Steffen, to award the Bridge Rehabilitation Program to Illinois Constructors Corporation in the amount of $774,430 to eliminate structural, pavement and channel deficiencies of eight city bridges. Upon a roll call vote: Yeas: Councilmembers Dixon, Gavin, Martinez, Powell, Rauschenberger, Shaw, Steffen, and Mayor Kaptain. Nays: None. BID 17-031 AWARDED TO ARROW ROAD CONSTRUCTION FOR 2017 STREET RESURFACING PROGRAM – NORTHWEST There was discussion regarding the procurement requirements and their enforcement. Councilmember Shaw made a motion, seconded by Councilmember Powell, to award the 2017 Street Resurfacing Program - Northwest bid to Arrow Road Construction in the amount of $2,192,874 to provide pavement maintenance on various city streets. Upon a roll call vote: Yeas: Councilmembers Dixon, Gavin, Martinez, Powell, Rauschenberger, Shaw, Steffen, and Mayor Kaptain. Nays: None. PETITION 02-17, APPROVED FOR AN APPLICATION FOR CONDITIONAL USE TO INCLUDE ACCESSORY PACKAGE LIQUOR SALES AT THE EXISTING BP GAS STATION CONVENIENCE STORE AT 1190 N. MCLEAN BLVD Marc Mylott, Community Development Director, provided an overview of Petition 02-17 which would grant a conditional to allow accessory package liquor sales at the existing gas station convenience store. Staff and the Planning and Zoning Commission approved the petition subject to the conditions outlined in the memo. Councilmember Shaw made a motion, seconded by Councilmember Gavin, to approve Petition 02-17 subject to conditions. JUNE 14, 2017 VOLUME LXXXII 188 PETITION 07-17, APPROVED FOR AN APPLICATION FOR MAP AMENDMENT TO REZONE 1325 E. CHICAGO STREET FROM CI COMMERCIAL INDUSTRIAL DISTRICT TO PAB PLANNED AREA BUSINESS DISTRICT TO RENOVATE THE EXISTING BIGGERS MITUSBISHI AUTO DEALERSHIP AND INSTALL NEW WALL GRAPHICS Marc Mylott, Community Development Director, provided an overview of Petition 07-17 which would grant a map amendment. Staff and the Planning and Zoning Commission approved the petition subject to the conditions outlined in the memo. Councilmember Gavin made a motion, seconded by Councilmember Steffen, to approve Petition 07-17 subject to conditions. PETITION 08-17, APPROVED FOR AN APPLICATION TO AMEND THE TEXT OF THE ZONING ORDINANCE, SPECIFICALLY CHAPTER 19.50 STREET GRAPHICS Marc Mylott, Community Development Director, provided an overview of Petition 08-17 which would grant a text amendment in the zoning ordinance for street graphics. Staff and the Planning and Zoning Commission approved the petition subject to the conditions outlined in the memo. Councilmember Powell made a motion, seconded by Councilmember Gavin, to approve Petition 08-17 subject to conditions. Upon a roll call vote: Yeas: Councilmembers Dixon, Gavin, Martinez, Powell, Rauschenberger, Shaw, Steffen, and Mayor Kaptain. Nays: None. PETITION 13-17, APPROVED FOR FINAL PLAT OF SUBDIVISION FOR WEST POINT GARDENS SOUTH, PHASE 1, LOCATED WEST OF NESLER, BETWEEN GANSETT PARKWAY AND MARIGOLD DRIVE Marc Mylott, Community Development Director, provided an overview of Petition 13-17 which would approve a final plat of subdivision. Staff and the Planning and Zoning Commission approved the petition subject to the conditions outlined in the memo. Councilmember Powell made a motion, seconded by Councilmember Martinez, to adopt the following resolution. Upon a roll call vote: Yeas: Councilmembers Dixon, Martinez, Powell, Rauschenberger, Steffen, and Mayor Kaptain. Nays: Councilmembers Gavin and Shaw. Resolution No. 17-84 JUNE 14, 2017 VOLUME LXXXII 190 RESOLUTION IN SUPPORT OF A MINIMUM WAGE THAT IS A LIVING WAGE WHEREAS, the current federal minimum wage of $7.25 per hour has been in effect since 2009 and has not been increased since that time; and WHEREAS, the current Illinois minimum wage of $8.25 per hour has been in effect since 2010, and has not been increased since that time; and WHEREAS, a full-time minimum wage worker in Illinois does not earn a living wage; and WHEREAS, a higher minimum wage in Illinois would likely increase spending on locally produced goods and services by workers benefitting from such increased wages, which, in turn could produce greater demand and help stimulate the local economy; and WHEREAS, sound economic policies require that minimum wages be established by the federal and state governments rather than on an ad hoc basis by local communities; and WHEREAS, the City Council of the City of Elgin supports an increase in the minimum wage to provide workers a living wage. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS, that the City Council of the City of Elgin hereby urges the federal government and the State of Illinois to increase the current federal and Illinois minimum wages to provide workers a living wage. BE IT FURTHER RESOLVED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS, that the City Clerk is hereby directed to send a copy of this resolution to the President of the United States, to each member of the Illinois delegation to the United States House of Representatives, to each of the Illinois United States Senators, to the Governor of Illinois, to each member of the Illinois House of Representatives and to each member of the Illinois Senate. s/ David J. Kaptain, Mayor, and Kimberly A. Dewis, City Clerk, be and are hereby authorized and directed to execute a Plat of Easement for stormwater management purposes and for city easement for public improvements purposes from Maciej Spiechow regarding the property legally described on said plat, a copy of which is attached hereto. Ordinance No. G19-17 AN ORDINANCE AMENDING TITLE 6 OF THE ELGIN MUNICIPAL CODE, 1976, AS AMENDED, ENTITLED "BUSINESS LICENSES AND REGULATIONS" BY CREATING A NEW CHAPTER 6.95 THERETO ENTITLED "CONFLICTS WITH CERTAIN HOME RULE ORDINANCES OF COOK COUNTY" WHEREAS, the City of Elgin, as a home rule unit of local government as provided by Article VII, Section 6 of the Illinois Constitution of 1970, has the authority to exercise any power and perform any function pertaining to its government and affairs except as limited by Article VII, Section 6 of the Illinois Constitution of 1970; and WHEREAS, on October 5, 2016, the County of Cook Board of Commissioners adopted ordinance number 16-4229 that requires employers in "Cook County" to provide a minimum number of paid sick days to employees ("Cook County Earned Sick Leave Ordinance"); and WHEREAS, on October 26, 2016, the County of Cook Board of Commissioners adopted ordinance number 16-5768 creating a minimum wage for employers in "Cook County" ("Cook County Minimum Wage Ordinance"); and WHEREAS, the State of Illinois is considering a unified statewide regulation and the City of Elgin has employers in Kane and Cook Counties and wants to keep a unified set of rules regarding sick days and minimum wages; and WHEREAS, the City of Elgin finds that many businesses employ individuals that are required to work across municipal and county borders within the Chicago metropolitan region and throughout the State of Illinois, and the City of Elgin believes that employment-related laws are best established at the Federal and State level; and WHEREAS, Article VII, Section 6(c) of the Illinois Constitution provides that if a home rule county ordinance conflicts with an ordinance of a municipality, the municipal ordinance shall prevail within its jurisdiction. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ELGIN, COOK AND KANE COUNTIES, ILLINOIS, AS FOLLOWS: Section 1. That Title 6 of the Elgin Municipal Code, 1976, as amended, entitled "Business Licenses and Regulations", be and is hereby further amended by adding a new Chapter VOLUME LXXXII JUNE 14, 2017 199 6.95 thereto entitled "Conflicts with Certain Home Rule Ordinances of Cook County" to read as follows: "Chapter 6.95 CONFLICTS WITH CERTAIN HOME RULE ORDINANCES OF COOK COUNTY 6.95.010: MINIMUM HOURLY WAGES AND PAID SICK LEAVE A. Employers located within the City of Elgin shall comply with all applicable Federal and/or State laws and regulations as such laws and regulations may exist from time to time with regard to both the payment of minimum hourly wages and paid sick leave. Employee eligibility for paid sick leave and minimum hourly wages shall also be in compliance with all applicable Federal and/or State laws and regulations as such laws and regulations may exist from time to time. B. No additional obligations with regard to paid sick leave, or minimum hourly wages, including, without limitation, any additional obligations by ordinances adopted by the County of Cook Board of Commissioners, including but not limited to ordinance numbers 16-4229 and 16- 5768, shall apply to employers located within the City of Elgin, except those required by Federal and/or State laws and regulations as such laws and regulations may exist from time to time. C. For the purposes of this Section, the term "employee" means an individual permitted to work by an employer regardless of the number of persons the employer employs, and the term "employer" means any person employing one or more employees, or seeking to employ one or more employees, if the person has its principal place of business within the City of Elgin or does business within the City of Elgin. D. For the purposes of this Section, the term "employer" does not mean: 1. The government of the United States or a corporation wholly owned by the government of the United States. 2. An Indian tribe or a corporation wholly owned by an Indian tribe. 3. The government of the State or any agency or department thereof; or 4. A unit of local government or a school district." Section 2. That all ordinances or parts of ordinances in conflict with the provisions of this ordinance be and are hereby repealed to the extent of any such conflict. Section 3.
