HomeMy WebLinkAboute - March 11, 2017 CC78 MARCH 11, 2017 VOLUME LXXXII COUNCIL OF THE CITY OF ELGIN, ILLINOIS COUNCIL-MANAGER FORM OF GOVERNMENT RESCHEDULED MEETING The rescheduled meeting of the Council of the City of Elgin, Illinois, was held on March 11, 2017, in the Council Chambers. The meeting was called to order by Mayor Kaptain at 7:00 p.m. The Invocation was given by Rev. Denise Tracy, Elgin Police Department Chaplain and the Pledge of Allegiance was led by Mayor David Kaptain. ROLL CALL Roll call was answered by Councilmembers Dunne, Gavin, Martinez, Powell, Prigge, Rauschenberger, Steffen, and Mayor Kaptain. Absent: Councilmember Shaw. MINUTES OF THE FEBRUARY 22, 2017, COUNCIL MEETING APPROVED AS DISTRIBUTED Councilmember Steffen made a motion, seconded by Councilmember Martinez, to approve the February 22, 2017, Council Meeting Minutes as distributed. Upon a roll call vote: Yeas: Councilmembers Dunne, Gavin, Martinez, Powell, Prigge, Rauschenberger, Steffen, and Mayor Kaptain. Nays: None. RECOGNIZE PERSONS PRESENT Melanie Gibb stated her support for the charter school efforts and leasing the property located at 1600 Dundee Avenue. Miranda Green stated her support for the charter school efforts and leasing the property located at 1600 Dundee Avenue. Leann Rymanwood stated her concerns regarding proposed street parking changes in the area of Morton Avenue and Hill Avenue. Jonathon Bast stated his concerns regarding proposed street parking changes in the area of Morton Avenue and Hill Avenue. Dennis Vargas stated his support for the proposed charter school and the impact the school could have on the city. VOLUME LXXXII MARCH 11, 2017 79 BID 16-049 AWARDED TO PRAXAIR, INC. FOR THE PURCHASE OF WATER TREATMENT CHEMICALS Councilmember Dunne made a motion, seconded by Councilmember Prigge, to rescind the bid awarded to Air Products and Chemicals, Inc. and approve the contract with Praxair, Inc. for carbon dioxide in the amount of $97,900 to provide purified drinking water to city businesses and residents. Upon a roll call vote: Yeas: Councilmembers Dunne, Gavin, Martinez, Powell, Prigge, Rauschenberger, Steffen, and Mayor Kaptain. Nays: None. BID 17-008 AWARDED TO VARIOUS VENDORS FOR 2017 POOL CHEMICALS Councilmember Steffen made a motion, seconded by Councilmember Gavin, to award a contract to Aqua Pure Enterprises, Halogen Supply Company and Mineral Masters for pool chemicals in the total amount of $50,158 to maintain city pools to ensure the highest water quality and safety to the patrons. Upon a roll call vote: Yeas: Councilmembers Dunne, Gavin, Martinez, Powell, Prigge, Rauschenberger, Steffen, and Mayor Kaptain. Nays: None. PETITION 30-16; AN APPLICATION BY TAYLOR YMCA AND GOOD SHEPHERD CHURCH, REQUESTING APPROVAL OF A CONDITIONAL USE TO ESTABLISH A CHILD DAYCARE SERVICE (PRESCHOOL) Marc Mylott, Community Development Director, provided an overview of Petition 30-16 which would grant a conditional use to establish a preschool. Staff and the Planning and Zoning Commission approved the petition subject to the conditions outlined in the memo. Councilmember Dunne made a motion, seconded by Councilmember Steffen, to approve Petition 30-16 subject to conditions. Upon a roll call vote: Yeas: Councilmembers Dunne, Gavin, Martinez, Powell, Prigge, Rauschenberger, Steffen, and Mayor Kaptain. Nays: None. ORDINANCE G8-17 PASSED AMENDING CERTAIN PARKING RESTRICTIONS WITHIN THE CITY OF ELGIN There was discussion regarding the concerns of the residents in the area and how enforcement would be handled. Councilmember Dunne made a motion, seconded by Councilmember Martinez, to pass the following ordinance. Upon a roll call vote: Yeas: Councilmembers Dunne, Gavin, Powell, Prigge, Rauschenberger, Steffen, and Mayor Kaptain. Nays: Councilmember Martinez. MARCH 11, 2017 VOLUME LXXXII 80 Ordinance No. G8-17 AN ORDINANCE AMENDING CERTAIN PARKING RESTRICTIONS WITHIN THE CITY OF ELGIN BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS: Section 1. That Chapter 11.60 of the Elgin Municipal Code, 1976, as amended, be and is hereby further amended by adding to the list of streets where parking is prohibited under Section 11.60.050O the following: Street Side Area/Time of Restriction "Cooper Avenue North Eastern Half Between Morton Avenue and Hill Avenue" Section 2. That all ordinances or parts of ordinances in conflict with the provisions of this ordinance be and are hereby repealed to the extent of any such conflict. Section 3. JOSEPH CHURCH REGARDING THE SALE OF 115-121 CENTER STREET BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS, that David J. Kaptain, Mayor, and Kimberly A. Dewis, City Clerk, be and are hereby authorized and directed to execute an Amendment to a Contract for Purchase and Sale on behalf of the City of Elgin with St. Joseph Church regarding the City's sale and conveyance of the property commonly known as 115-121 Center Street, a copy of which is attached hereto and made a part hereof by reference. s/ David J. MARCH 11, 2017 VOLUME LXXXII 82 Resolution No. 17-41 RESOLUTION APPROVING AND RELEASING CERTAIN EXECUTIVE SESSION MINUTES OF THE CITY COUNCIL OF THE CITY OF ELGIN WHEREAS, the City Council of the City of Elgin has met from time to time in executive session for purposes authorized by the Illinois Open Meetings Act; and WHEREAS, as required by the Act, the City Clerk has kept written minutes of all such executive sessions; and WHEREAS, pursuant to the requirements of the Illinois Open Meetings Act, the City Council has met in closed session to review all closed session minutes; and WHEREAS, they have determined that a need for confidentiality still exists as to a portion of the executive session minutes from the meetings set forth on the exhibit referred to herein; and WHEREAS, they have further determined that the remaining portion of the meetings listed no longer require confidential treatment and should be made available for public inspection; and NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS: Section 1. The executive session minutes for the period from July 2016, through December, 2016 are hereby approved as set forth in Exhibit A. Such minutes no longer require confidential treatment and shall be made available for public inspection. Section 2. VOLUME LXXXII MARCH 11, 2017 89 Ordinance No. G7-17 AN ORDINANCE AMENDING SECTION 11.60.095 OF THE ELGIN MUNICIPAL CODE, 1976, AS AMENDED, ENTITLED "DOWNTOWN PARKING ZONE" BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS: Section 1. That Section 11.60.095 of the Elgin Municipal Code, 1976, as amended, entitled "Downtown Parking Zone" be and is hereby further amended by amending the introductory paragraph in subsection B1 thereof to read as follows: "On any of the following streets for a period of longer than two (2) hours unless otherwise prohibited in section 11.60.050 of this chapter, in the thirty (30) minute parking spaces provided for in subsection B2 of this section or in the fifteen (15) minute parking spaces provided for in subsection B3 of this section:" Section 2. That Section 11.60.095 of the Elgin Municipal Code, 1976, as amended, entitled "Downtown Parking Zone" be and is hereby further amended by further amending subsection B2 thereof by deleting therefrom the following provision: "South Grove Avenue, west side thereof, between East Chicago Street and Fulton Street, the parking stall directly north of the pedestrian crosswalk from DuPage Court." Section 3. That Section 11.60.095 of the Elgin Municipal Code, 1976, as amended, entitled "Downtown Parking Zone" be and is hereby further amended by adding a new subsection B3 thereto, by renumbering the remaining existing subsections B3 through B7 accordingly, with such new subsection B3 to read as follows: "3. In any of the following on-street parking stalls for a period longer than fifteen (15) minutes: South Grove Avenue, west side thereof, between East Chicago Street and Fulton Street, the parking stall directly north of the pedestrian crosswalk from DuPage Court." Section 4. That all ordinances or parts of ordinances in conflict with the provisions of this ordinance be and are hereby repealed to the extent of any such conflict. Section 5.
