COUNCIL OF THE CITY OF ELGIN, ILLINOIS COUNCIL-MANAGER FORM OF GOVERNMENT REGULAR MEETING
The regular meeting of the Council of the City of Elgin, Illinois, was held on February 22, 2017,
in the Council Chambers. The meeting was called to order by Mayor Kaptain at 7:25 p.m. The
Invocation was given by Kiran and Yusuf Rasul from the Institute of Islamic Education and
Muslim Mosque and the Pledge of Allegiance was led by Mayor David Kaptain. A moment of
silence was held in respect for passing of Sergeant Tom Linder.

Roll call was answered by Councilmembers Dunne, Gavin, Martinez, Powell, Prigge,
Rauschenberger, Shaw, Steffen, and Mayor Kaptain. Absent: None.
MINUTES OF THE FEBRUARY 8, 2017, COUNCIL MEETING APPROVED AS
DISTRIBUTED
Councilmember Dunne made a motion, seconded by Councilmember Steffen, to approve the
February 8, 2017, Council Meeting Minutes as distributed. Upon a roll call vote: Yeas:
Councilmembers Dunne, Gavin, Martinez, Powell, Prigge, Shaw, Steffen, and Mayor Kaptain.
Nays: None. Councilmember Rauschenberger abstained.
BID 17-014 AWARDED TO NORTH AMERICAN VIDEO FOR POLICE
DEPARTMENT SECURITY CAMERAS
Councilmember Shaw made a motion, seconded by Councilmember Gavin, to approve a contract
with North American Video in the amount of $56,923 to supply 109 Axis brand cameras. Upon
a roll call vote: Yeas: Councilmembers Dunne, Gavin, Martinez, Powell, Prigge,
Rauschenberger, Shaw, Steffen, and Mayor Kaptain. Nays: None.

CONTRACTS APPROVED WITH VARIOUS VENDORS THROUGH THE SUBURBAN
PURCHASE COOPERATIVE TO PURCHASE AND OUTFIT PUBLIC SAFETY
VEHICLES
Councilmember Dunne made a motion, seconded by Councilmember Powell, to award contract
to Currie Motors for the purchase of seventeen replacement vehicles, a contract to Roesch Ford
for the purchase of two replacement vehicles and a contract to Ultra Strobe Communications,
Inc. for outfitting in the total amount of $677,256. Upon a roll call vote: Yeas: Councilmembers
Dunne, Gavin, Martinez, Powell, Prigge, Rauschenberger, Shaw, Steffen, and Mayor Kaptain.
Nays: None.
CONTRACT APPROVED WITH AVALON TECHNOLOGIES THROUGH THE
MIDWESTERN HIGHER EDUCATION COMPACT CONTRACT TO PURCHASE A
DELL-COMPELLENT STORAGE SYSTEM
Councilmember Dunne made a motion, seconded by Councilmember Martinez, to approve the
purchase of the Dell‐Compellent storage system from Avalon Technologies in the amount of
$155,930. Upon a roll call vote: Yeas: Councilmembers Dunne, Gavin, Martinez, Powell,
Prigge, Rauschenberger, Shaw, Steffen, and Mayor Kaptain. Nays: None.
RESOLUTION 17-34 ADOPTED AUTHORIZING EXECUTION OF A GRANT

authorized and directed to execute a grant agreement with the Fox River Study Group for continued

BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS,
that the City of Elgin hereby accepts for ownership and maintenance the public improvements at
2601 Galvin Drive for water main and sanitary sewer purposes. Acceptance of the public
improvements will add the following city-maintained facilities: 1,810 lineal feet of watermain; one
4-inch valve in a 48-inch vault; three 8-inch valves in 48-inch vaults; five fire hydrants; 822 lineal
feet of 8-inch sanitary sewer; four 48-inch sanitary manholes; and their respective appurtenances.
BE IT FURTHER RESOLVED that Resolution Number 16-151 previously adopted by the
city council on December 21, 2016, be and is hereby repealed.

AMENDING CHAPTER 6.06 OF THE ELGIN MUNICIPAL CODE, 1976,
AS AMENDED, ENTITLED "ALCOHOLIC LIQUOR DEALERS" AND CHAPTER 12.08 OF
THE ELGIN MUNICIPAL CODE, 1976, AS AMENDED, ENTITLED "PUBLIC PARKS;
GENERAL REGULATIONS"
WHEREAS, the City of Elgin is a home rule unit and as a home rule unit may exercise and
power and perform and function pertaining to its government and affairs; and
WHEREAS, regulations relating to alcoholic liquor dealers and the use of city parks pertain
to the government and affairs of the city.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
ELGIN, ILLINOIS:
Section 1. That Section 6.06.040 of the Elgin Municipal Code, 1976, as amended,
entitled "License Classes; Fees:" be and is hereby further amended by amending subparagraph J
thereof to read as follows:
"J. Class G: For the retail sale of alcoholic liquors in buildings of golf courses
owned by the city in connection with the operation of an established food serving
facility during times when food is dispensed for consumption upon the premises.
Also for the retail sale and consumption of alcoholic liquor by the city to daily fee
customers and pass holders playing golf at the city owned The Highlands of Elgin,
Bowes Creek and Wing Park Golf Courses and their attendant facilities,
notwithstanding the prohibitions regarding the possession and consumption of
alcoholic liquors in parks as provided by subsection 6.06.150B of this chapter,
subsection 12.08.010I of this code or other provisions of this code. The license fee
per year for operation by the city is no fee and operation by independent contractor
is four hundred forty dollars ($440.00)."

Section 2. That Section 6.06.150 of the Elgin Municipal Code, 1976, as amended,
entitled "Offenses By Other Than Licensee:" be and is hereby further amended by amending
subparagraph B thereof to read as follows:
"B. Except as may be expressly permitted pursuant to a special events permit
issued by the city pursuant to title 13, chapter 13.25 of this code, it is unlawful for
any person to consume any alcoholic liquor upon a public street, sidewalk, mall,
bridge or other public property. Except as may be expressly permitted pursuant to
a special event sponsored or cosponsored by the city and pursuant to a special event
permit therefor issued by the city pursuant to title 13, chapter 13.25 of this code, or
pursuant to a class G liquor license issued by the for the city owned The Highlands
of Elgin, Bowes Creek and Wing Park Golf Courses, it is unlawful to consume any
alcoholic liquor in any park. In all events it is unlawful to consume any alcoholic
liquor in any motor vehicle on any public street or public property in the city."
Section 3. That Section 12.08.010 of the Elgin Municipal Code, 1976, as amended,
entitled "Certain Acts Prohibited:" be and is hereby further amended by amending subparagraph I
thereof to read as follows:
"I. The possession of any beverage containing alcohol shall not be permitted
except as may be expressly permitted pursuant to a special event sponsored or
cosponsored by the city and pursuant to a special event permit therefor issued by
the city pursuant to title 13, chapter 13.25 of this code or pursuant to a class G liquor
license issued by the city for the city owned The Highlands of Elgin, Bowes Creek
and Wing Park Golf Courses."
Section 4. That all ordinances or parts of ordinances in conflict with the provisions of
this ordinance be and are hereby repealed to the extent of any such conflict.
Section 5. That this ordinance shall be in full force and effect upon its passage and
publication in the manner provided by law.

and Providing for the Levy and Collection of a Direct Annual Tax for the Payment of the Principal
of and Interest on said Bonds; and
WHEREAS, the levy of the tax for the year 2016 provided in the ordinance is unnecessary.

Ordinance S7-11, An Ordinance Providing for the Issuance of $9,695,000 General Obligation
Corporate Purpose Bonds, Series 2011, of the City of Elgin, Kane and Cook Counties, Illinois, and
Providing for the Levy and Collection of a Direct Annual Tax for the Payment of the Principal of
and Interest on said Bonds; and
WHEREAS, the levy of the tax for the year 2016 provided in the ordinance is unnecessary.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
ELGIN, ILLINOIS:
Section 1. That the County Clerks of Kane and Cook Counties, are hereby authorized
and directed to abate the tax of $887,625 for the year 2016 as provided and levied in the ordinance
providing for the issuance of $9,695,000 General Obligation Corporate Purpose Bonds, Series
2011, passed May 25, 2011, a copy of which was filed with each of said county clerks.
Section 2. That the City Clerk is authorized and directed to file a certified copy of this
ordinance with the County Clerks of Kane and Cook Counties, Illinois, prior to March 15, 2017.
Section 3. That this ordinance shall be in full force and effect from and after its passage
