COUNCIL OF THE CITY OF ELGIN, ILLINOIS COUNCIL-MANAGER FORM OF GOVERNMENT REGULAR MEETING
The regular meeting of the Council of the City of Elgin, Illinois, was held on January 11, 2017,
in the Council Chambers. The meeting was called to order by Mayor Kaptain at 7:00 p.m. The
Invocation was given by Reverend Denise Tracy from the Retired Unitarian Universalist and the
Pledge of Allegiance was led by Councilmember Dunne.

Roll call was answered by Councilmembers Dunne, Gavin, Powell, Prigge, Rauschenberger,
Shaw, Steffen, and Mayor Kaptain. Absent: Councilmember Martinez.
MINUTES OF THE DECEMBER 21, 2016, COUNCIL MEETING APPROVED AS
DISTRIBUTED
Councilmember Steffen made a motion, seconded by Councilmember Gavin, to approve the
December 21, 2016, Council Meeting Minutes as distributed. Upon a roll call vote: Yeas:
Councilmembers Dunne, Gavin, Powell, Prigge, Rauschenberger, Shaw, Steffen, and Mayor
Kaptain. Nays: None.
COMMUNICATIONS
New Year 2017 Proclamation
Mayor Kaptain read the following proclamation:
WHEREAS, Elgin is a compassionate city, and is comprised of many ethnic groups,
communities of faith; and diverse backgrounds; and
WHEREAS, Elgin is a leader among cities, has citizens, residents and members of the
community and a government that cares, and is indeed The City in the Suburbs; and
WHEREAS, The strength of Elgin is based upon mutual respect and integrity; and
WHEREAS, Elgin prides itself on its diversity and is committed to protecting the rights
of all its residents whether they be Caucasians, African-Americans, Latinos, Asians, Native
Americans or immigrants from other lands, whether they are Jews, Christians, Muslims,

Buddhists, Hindus, or secular, whether they are women, or men or members of the LGBT
community, rich or poor, children or adults; and
WHEREAS, Elgin has good social service agencies and city organizations designed
specifically to protect those rights; and

NOW, THEREFORE, I, David Kaptain, Mayor of the City of Elgin, Illinois, in
celebration of the New Year 2017 do hereby proclaim that we will continue to strive for all our
residents to realize the “blessings of liberty for ourselves and our posterity” as stated in the
Preamble to the Constitution of this great nation.

Dr. Martin Luther King Jr. Proclamation
Mayor Kaptain read the following proclamation:
WHEREAS, Dr. Martin Luther King, Jr., born in Atlanta, Georgia, attended Morehouse
College in Atlanta and Crozer Theological Seminary in Pennsylvania, and was a student
thereafter at Boston University and the University of Pennsylvania, and, who following his
studies, became a spiritual leader of his church; and
WHEREAS, Dr. Martin Luther King, Jr., as a spiritual leader not only of his own
congregation, but of millions throughout the world, espoused the philosophy of nonviolence to
all mankind, and in recognition of his teachings was awarded the Nobel Peace Prize; and
WHEREAS, Dr. Martin Luther King, Jr. spent a life in service to his fellow men and
attempted to realize for them and for America, a dream of peace and brotherhood; and
WHEREAS, Dr. Martin Luther King, Jr., in his campaign for Civil Rights, extended his
work for the benefit of all humanity, and especially for the poor, and was a leader in the cause of
world peace; and
WHEREAS, The City of Elgin is a blessed and compassionate city, priding itself on its
diversity and welcoming its many immigrant groups and its many communities of faith; and
WHEREAS, Elgin is a leader among cities, has citizens and a government that cares, and
is indeed The City to Watch; and

WHEREAS, The City of Elgin through its Human Relations Commission and the Dr.
King Celebration Committee has honored the legacy of Martin Luther King, Jr, for 32 years are a
reflection of our commitment to Dr. Martin Luther King Jr. vision of a nation committed to non-
violence and love in our cities.
NOW, THEREFORE, I, David Kaptain, Mayor of the City of Elgin, Illinois, do hereby
proclaim Saturday, January 14th, Sunday, January 15th and Monday, January 16th, 2017, as days
in honor of the memory of Dr. Martin Luther King, Jr.

RECOGNIZE PERSONS PRESENT
Kyla Jacobsen, Water Director, presented the city an award from the American Public Works
Association for the Brookside Basin Retrofit Project.
Bill Neylon announced the Blackhawk Resident Association’s candidate forum being held on
February 11, 2017 at 7:00 p.m. at the New Fellow Covenant Church, located at 865 Parkway.
Rebecca Ortiz of the Homeownership Programs Department of the Illinois Housing
Development Authority (IHDA) presented information regarding the I-REFI Program. IHDA
offers $50,000 to buy down mortgages and refinance loans of persons underwater on their
mortgage, but current on their mortgage payments (home value, income, and credit limits apply).
BID 16-054 AWARDED TO BOLLER CONSTRUCTION COMPANY FOR CARBON
DIOXIDE AND CHLORINE UPDATES PROJECT
Councilmember Gavin made a motion, seconded by Councilmember Steffen, to award a contract
to Boller Construction Company in the amount of $640,100 for the Carbon Dioxide and Chlorine
Updates Project in order to update the chemical storage and feed systems at the Leo Nelson
Riverside and Airlite Water Treatment Plants which provides purified drinking water to the
city residents and businesses. Upon a roll call vote: Yeas: Councilmembers Dunne, Gavin,
Powell, Prigge, Rauschenberger, Shaw, Steffen, and Mayor Kaptain. Nays: None.
CONSENT AGENDA
By unanimous consent, Councilmember Dunne made a motion, seconded by Councilmember
Steffen, to pass Ordinance No. G1-17 and adopt Resolution Nos.17-1 through 17-4 by omnibus
vote. Upon a roll call vote: Yeas: Councilmembers Dunne, Gavin, Powell, Prigge,
Rauschenberger, Shaw, Steffen, and Mayor Kaptain. Nays: None.

RESOLUTION 17-1 ADOPTED REGARDING ELGIN IMAGE COMMISSION
RECOGNITION AWARDS
Councilmember Dunne made a motion, seconded by Councilmember Steffen, to adopt the

RESOLUTION
REGARDING ELGIN IMAGE COMMISSION RECOGNITION AWARDS
WHEREAS, the City Council has previously approved a program by the Elgin Image
Commission where a formal recognition program would be established to honor individuals with
a connection to Elgin who have received regional or national prominence; and
WHEREAS, the Elgin Image Commission has recommended to the City Council that for
2016 Mary Bramer, C. Dean Chipman and Jane Hampton Chipman, Paul Flory, Ph.D., and Max
K. Horwitt, Ph.D., be given recognition awards; and
WHEREAS, Mary Bramer a School District U-46 teacher who, in 1949, contracted polio.
Completely paralyzed and unable to breathe without assistance, she learned to use her diaphragm
muscles to breathe and through therapeutic treatments regained partial movement in her fingers.
She obtained her high school diploma, graduated from the University of Illinois and in 1960,
accepted a position as an English teacher at Kimball Junior High School. Throughout her 25 year
career, she authored many writings that were published in professional journals and created
curricular materials that were provided to other teachers through workshops; and
WHEREAS, C. Dean Chipman and Jane Hampton Chipman were leaders and innovators
in the cultural life of Elgin for over 50 years. Their accomplishments include: creating the prestige
of the Elgin Academy Art Gallery; co-founder of the Elgin Choral Union; developing the
performing arts at Elgin Community College; manager of the Elgin Symphony Orchestra; founder
of the Elgin Symphony League; instrumental in opening the Hemmens Auditorium; member of
the City’s Cultural Arts Commission; coordinating the Travel and Adventure Series which
provided residents to be transported as armchair travelers to all parts of the world; and originating
the Lenten Organ Series at the First Congregational Church; and
WHEREAS, Paul Flory, Ph.D., an American chemist and Nobel laureate, was known for
his prodigious volume of work in the field of polymers, or macromolecules. After graduating from
Elgin High School in 1927, he became a leading pioneer in understanding the behavior of polymers
in solution. He was one of a team of scientists who developed Nylon. From 1961 through 1975 he
was a professor at Stanford University and in 1974 won the Nobel Prize in Chemistry “for his
fundamental achievements, both theoretical and experimental, in the physical chemistry of
macromolecules.” After his retirement, he consulted for IBM and years after his death was
posthumously inducted into the Alpha Chi Sigma Hall of Fame; and

WHEREAS, Max K. Horwitt, Ph.D., an internationally recognized scientist, worked in the
field of human nutrition. From the 1930s through the 1950s, he did research on ascorbic acid,
Vitamin C, and the B vitamins (niacin, riboflavin and thiamin). In the 1950s and 1960s, he was
known for his findings on Vitamin E. He was the director of the L.B. Mendel Research Laboratory
and researcher at the Elgin State Hospital (now Elgin Mental Health Center). He was acting
director of the research division of the Illinois Department of Mental Health and he was a professor
of biological chemistry at the University of Illinois Medical School in Chicago until 1968. He
relocated to St. Louis University School of Medicine and subsequently held a research position
into malnutrition at the Chiang Mai Medical School in Thailand and later in the departments of
biochemistry and generic medicine at SLU. Dr. Horwitt’s reputation increased after his studies
due to his work with the United Nations and the World Health Organization on nutrition issues.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
ELGIN, ILLINOIS, that Mary Bramer, C. Dean Chipman and Jane Hampton Chipman, Paul Flory,
Ph.D., and Max K. Horwitt, Ph.D. be and are hereby awarded formal recognition as having been
prominent members of the Elgin Community.

RESOLUTION
ACCEPTING FOR OWNERSHIP AND MAINTENANCE THE PUBLIC
IMPROVEMENTS IN SHADOW HILL UNIT 4, PHASE 2 SUBDIVISION
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS,
that the City of Elgin hereby accepts for ownership and maintenance the public improvements
within the Shadow Hill Unit 4, Phase 2 Subdivision which include sanitary sewer, water main,
storm sewer, pavement, street lights, and street signs. Acceptance of the public improvements will
add the following city-maintained facilities: approximately 959 lineal feet of 8-inch water main;
2, 8-inch valves in 4-foot vaults; 5 fire hydrants; 1,131 lineal feet of 12-inch storm sewer; 14 catch
basins; 1,680 lineal feet of 8-inch PVC sanitary sewer; 13, 4-foot sanitary manholes; 9 street lights;
2 street signs; 105 parkway trees, 750 lineal feet of 10 foot bike path and 1,716 lineal feet of
improved street (including curb, gutter and sidewalk or bike path on both sides) and all their
respective appurtenances.

that Richard G. Kozal, City Manager, be and is hereby authorized and directed to execute Master
Premier Lease Schedules, Order Package Acceptance Agreement and related documents on behalf
of the City of Elgin with Konica Minolta Premier Finance, a program of Konica Minolta Business
Solutions U.S.A., Inc., for the lease of nineteen digital copiers, copies of which are attached hereto
and made a part hereof by reference.

AMUSEMENT AND RECREATIONAL SERVICE CENTER IN THE CI
COMMERCIAL INDUSTRIAL DISTRICT (1019 EAST CHICAGO STREET)

Ordinance No. G1-17
AN ORDINANCE GRANTING
A CONDITIONAL USE FOR AN AMUSEMENT AND
RECREATIONAL SERVICE CENTER
IN THE CI COMMERCIAL INDUSTRIAL DISTRICT
(1019 East Chicago Street)
WHEREAS, written application has been made requesting conditional use approval to
establish an amusement and recreational service at 1019 East Chicago Street; and
WHEREAS, the zoning lot with the building containing the premises at 1019 East Chicago
Street is legally described herein (the “Subject Property”); and
WHEREAS, the Subject Property is located within the CI Commercial Industrial District
and an amusement and recreational service use is listed as a similar use within the CI Commercial
Industrial District; and
WHEREAS, the amusement and recreational service use as described in the written
application for a conditional use at 1019 East Chicago Street is most similar to the amusement
park use listed as a conditional use within the CI Commercial Industrial District; and
WHEREAS, the Planning and Zoning Commission conducted a public hearing concerning
said application on December 5, 2016 following due notice by publication; and
WHEREAS, the Community Development and the Planning and Zoning Commission have
submitted their Findings of Fact concerning said application; and
WHEREAS, the Community Development and the Planning and Zoning Commission
recommend approval of said application, subject to the conditions articulated below; and
WHEREAS, the City Council of the City of Elgin, Illinois, has reviewed the findings and
recommendations of the Community Development Department and the Planning and Zoning
Commission; and
WHEREAS, the City of Elgin is a home rule unit and as a home rule unit may exercise any
power and perform any function pertaining to its government and affairs; and

WHEREAS, zoning, including, but not limited to, this ordinance granting a conditional use
in the CI Commercial Industrial District pertains to the government and affairs of the city.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
ELGIN, ILLINOIS:
Section 1. That the City Council of the City of Elgin hereby adopts the Findings of
Fact, dated December 5, 2016, and the recommendations made by the Community Development
Department and the Planning and Zoning Commission, a copy of which is attached hereto and
made a part hereof by reference as Exhibit A.
Section 2. That a conditional use for an “amusement and recreational service, not
elsewhere classified (7999)” and for a “parking lot [SR]” is hereby granted for the property
commonly known as 1019 East Chicago Street and commonly identified by Kane County Property
Identification Numbers (PIN) Numbers 06-18-401-016, 06-18-401-019, 06-18-401-020 and 06-
18-401-025, and legally described as follows:
That part of Lot 8 of the Plat of the County Clerk’s Subdivision of unsubdivided lots in
Section 18, Township 41 North, Range 9, East of the Third Principal Meridian, described
as follows: commencing at the intersection of the Southerly right of way line of State Route
19 with the Westerly line of said Lot 8: Thence Southwesterly along the Westerly line of
said Lot 8, a distance of 150.00 feet; Thence Southeasterly parallel with the Southerly right
of way line of State Route 19, a distance of 150.00 feet for the point of beginning; Thence
Northeasterly parallel with the Westerly line of said Lot 8, a distance of 150.00 feet to the

Section 3. That the conditional uses for the Subject Property as authorized by this
ordinance shall be subject to the following additional conditions:
1. Substantial conformance to the Development Application submitted by David P. Frayer
and Kendal L. Frayer Revocable Trust dated August 9, 2012, as applicant, and
Advocate Sherman Hospital, as property owner, received October 21, 2016 and
supporting documents including:
a. Undated Conditional Use Statement of Purpose and Conformance prepared by
David P. Frayer and Kendal L. Frayer Revocable Trust dated August 9, 2012,
received October 21, 2016;

b. Plat of Survey, prepared by Gremeley & Biedermann, Inc. dated June 15, 1994;
c. Undated Existing Site Plan, received October 21, 2016;
d. Urban Air Elgin, IL proposed floor plan, prepared by Nove Studios, dated
November 18, 2016;
e. Mezzanine floor plan, prepared by Nove Studios, dated November 18, 2016;
f. Monument sign plans, prepared by Legacy Signs of Texas, dated November 29,
2016, subject to revisions for compliance with City’s street graphics
requirements;
g. Undated Urban Air Adventure Park wall graphic plan, received October 21, 2016;
and
h. Undated Existing Floor Plan, received November 6, 2016.
In the event of any conflict between such documents and the terms of this ordinance or
other applicable city ordinances, the terms of this ordinance or other applicable city
ordinances shall supersede and control.
2. Compliance with the Site Plan with staff notes added November 9, 2016.
3. The existing chain link fence with partial barbed wire on top shall be removed prior to
the issuance of the Certificate of Occupancy.
4. The use of the “parking lot” [SR] by other off-premise uses is permitted only for the
parking of passenger “motor vehicles” [SR] and in so long as the number of parking
spaces on the Subject Property available for the amusement and recreational service
center and/or any other uses located on the Subject Property shall at no time be less
than one hundred and twenty nine (129) or the zoning ordinance requirement for all
uses on the Subject Property, whichever is greater. All parking shall be within a
designated parking space, and at no time shall any vehicle display any outward
appearance that it is for sale or lease.
5. Compliance with all applicable codes and ordinances.
Section 4. That this ordinance shall be full force and effect upon its passage in the
manner provided by law.
