The meeting was called to order by Mayor Kaptain at 7:00 p.m. The Invocation was given by Reverend Janie McCutchen from the Second Baptist Church and the Pledge of Allegiance was led by Councilmember Toby Shaw. ROLL CALL Roll call was answered by Councilmembers Dunne, Gavin, Martinez, Powell, Prigge, Rauschenberger, Shaw, Steffen, and Mayor Kaptain. Absent: None. MINUTES OF THE SEPTEMBER 28, 2016, COUNCIL MEETING APPROVED AS DISTRIBUTED Councilmember Dunne made a motion, seconded by Councilmember Shaw, to approve the September 28, 2016, Council Meeting Minutes as distributed. Upon a roll call vote: Yeas: Councilmembers Dunne, Gavin, Martinez, Powell, Prigge, Rauschenberger, Shaw, Steffen, and Mayor Kaptain. Nays: None. COMMUNICATIONS Kane County Association for Home and Community Education Proclamation Mayor Kaptain read the following proclamation: PROCLAMATION WHEREAS, Illinois Association for Home and Community Education was organized under the name Illinois Home Bureau Federation for the purpose of improving rural living and family and community life; and WHEREAS, Illinois Association for Home and Community Education was initiated in July, 1915; an Advisor was hired by the University of Illinois to develop a home improvement association. Kane County joined this University of Illinois Extension program in 1918; and VOLUME LXXXI OCTOBER 12, 2016 411 WHEREAS, Illinois Association for Home and Community Education evolved from Kane County Home Bureau Federation to Kane County Homemakers Education Association to the 2008 change, Kane County Association for Home and Community Education; and WHEREAS, Kane County Association for Home and Community Education is based at the University of Illinois Extension, 535 Randall Road, St. Charles, Illinois; and WHEREAS, Kane County Association for Home and Community Education is dedicated to addressing the issues of community outreach, cultural enrichment, family living, international study, public relations and community involvement for the entire population of Kane County, regardless of race color, national origin, sex, age or creed; NOW, THEREFORE, I, David Kaptain, Mayor of the City of Elgin, Illinois, congratulate the Plato Center Unit of Kane County Association for Home and Community Education and designate the week of October 9-15 as HCE week. Kaptain Mayor Crisis Center Domestic Violence Awareness Month Proclamation Mayor Kaptain read the following proclamation: PROCLAMATION WHEREAS, violence against women and children continues to become a more prevalent problem and is not confined to any group of people, but across all economic, gender, racial and societal barriers and is supported by societal indifference; and WHEREAS, the crime of domestic violence violates an individual’s privacy, dignity, security and humanity through the systematic use of physical, emotional, sexual, psychological and economic control and/or abuse; and WHEREAS, the impact of domestic violence is wide-ranging, directly affecting families and society as a whole; and WHEREAS, it is battered women themselves who have been at the forefront of efforts to bring peace and equity to the home; and WHEREAS, it is fitting to set aside a special time to bring this issue to the attention of all residents of the City of Elgin so they can become better informed and involved in programs to eliminate this epidemic from our society. OCTOBER 12, 2016 VOLUME LXXXI 412 NOW, THEREFORE, I, David Kaptain, Mayor of the City of Elgin, Illinois, do hereby proclaim the month of October 2016 as Domestic Violence Awareness Month in the City of Elgin and encourage our residents to join forces with victim service programs, criminal justice officials and concerned citizens across the country to raise the public awareness of domestic violence issues. Kaptain Mayor RECOGNIZE PERSONS PRESENT Tod Martin stated his concerns with the proposed nuisance ordinance, including the sections relating to panhandling and storing possessions. Katie Lange, downtown property manager, stated her support of the proposed nuisance ordinance and noted the impact of the current situation has on businesses. Daisy De La Cruz stated her support for Shared Harvest for its ability to provide locally grown produce. She asked for the city’s support for this project Chuck Keysor noted that he was supportive of the proposed nuisance ordinance, but asked that consideration be given to the storage of possessions and safety by the train tracks. Tonya Hudson and Dr. David Sam, campaign co-chairs, provided details for this years United Way Campaign and provided information on how the funds are used throughout the community. Thomas Lesiewicz outlined his reasons for supporting Shared Harvest food co-op including job creation. He asked the city for financial support of this project. Colleen Anderson expressed her support for Shared Harvest food co-op. She noted the impact on a community’s economy when food co-ops opened. She asked for the city’s support of Shared Harvest. Grace Richard, a downtown property owner, stated her support for the proposed nuisance ordinance and asked that it be strictly enforced. Jeri McCue outlined her support of the nuisance ordinance and asked that it be strictly enforced. Betsy Kahn, downtown business owner, stated her support of the nuisance ordinance and her safety concerns for customers. VOLUME LXXXI OCTOBER 12, 2016 413 BID 16-037A AWARDED TO ELANAR CONSTRUCTION FOR COMMUNITY DEVELOPMENT BLOCK GRANT PARK PROJECTS There was discussion regarding the work to make city parks ADA (Americans with Disabilities Act) compliant. Councilmember Dunne made a motion, seconded by Councilmember Martinez, to award the bid to Elanar Construction in the amount of $742,622 for the park projects in order to upgrade parks in low-to-moderate income neighborhoods. Upon a roll call vote: Yeas: Councilmembers Dunne, Gavin, Martinez, Powell, Prigge, Rauschenberger, Shaw, Steffen, and Mayor Kaptain. Nays: None. BID 16-041 TABLED FOR THE PURCHASE OF GAC FILTER MEDIA REMOVAL AND REPLACEMENT Councilmember Dunne made a motion, seconded by Councilmember Martinez, to table the GAC Filter Media Removal and Replacement bid to Calgon Carbon Corporation in the amount of $109,531. Upon a roll call vote: Yeas: Councilmembers Dunne, Gavin, Martinez, Powell, Prigge, Rauschenberger, Shaw, Steffen, and Mayor Kaptain. Nays: None. Resolution No. 16-127 RESOLUTION ACCEPTING FOR OWNERSHIP AND MAINTENANCE CERTAIN PUBLIC IMPROVEMENTS WITHIN RANDALL ROSE AUTO MALL SUBDIVISION BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS, that the City of Elgin hereby accepts for ownership and maintenance the landscaping public OCTOBER 12, 2016 VOLUME LXXXI 414 improvements within the Randall Rose Auto Mall Subdivision. Acceptance of the public improvements will add 128 parkway trees as city-maintained facilities. This acceptance of the landscaping public improvements within the Randall Rose Auto Mall Subdivision is also subject to the terms and conditions of the Fourth Amendment to the Development Agreement dated January 27, 2016, between the City of Elgin and Forecom Challenger, Inc., et al. s/ David J. Ordinance No. G43-16 AN ORDINANCE AMENDING THE ROUTE 19/EAST CHICAGO STREET AREA OF SPECIAL CHARACTER AND THE ASSOCIATED SPECIAL REGULATIONS FOR STREET GRAPHICS WHEREAS, Section 19.50.105 of the Elgin Municipal Code, 1976, as amended, provides that the City Council may designate specific locations within the City as areas of special character to provide appropriate flexibility in the regulation of street graphics and may adopt special regulations for these areas that can vary from the regulations contained within the City’s Street Graphics Ordinance; and WHEREAS, the City Council, in its Ordinance No. G25-08, has designated the Route 19/East Chicago Street Area of Special Character, defined as all zoning lots of four (4) acres or more, fronting Route 19/East Chicago Street between Willard Avenue on the west and Shales Parkway on the east, and which zoning lots are occupied by motor vehicle dealers (the “Route 19/East Chicago Street Area of Special Character”) pursuant to Section 19.50.105; and WHEREAS, the City Council, in its Ordinance No. G22-09, has adopted special regulations for the street graphics within the Route 19/East Chicago Street Area of Special Character pursuant to Section 19.50.105; and WHEREAS, written application has been made to add the Elgin High School campus, commonly referred to as 1200 Maroon Drive and legally described herein (the “Subject Property”), to the Route 19/East Chicago Street Area of Special Character and to adopt special regulations for street graphics specific to the Subject Property within the Route 19/East Chicago Street Area of Special Character; and VOLUME LXXXI OCTOBER 12, 2016 417 WHEREAS, the Planning and Zoning Commission conducted a public hearing on September 6, 2016 following due notice by publication; and WHEREAS, the Community Development Department and the Planning and Zoning Commission have submitted their written findings of fact and recommendations concerning said application; and WHEREAS, the Community Development Department and the Planning and Zoning Commission recommend approval of said application, subject to the conditions articulated below; and WHEREAS, the City Council of the City of Elgin, Illinois has reviewed the findings and recommendations of the Community Development Department and the Planning and Zoning Commission; and WHEREAS, the City of Elgin is a home rule unit and as a home rule unit may exercise any power and preform any function pertaining to its government and affairs; and WHEREAS, zoning, including but not limited to, this ordinance approving the expansion of an existing area of special character and establishing special regulations for street graphics that otherwise depart from the Elgin Zoning Ordinance, pertain to the government and affairs of the city. NOW, THEREFORE, be it ordained by the City Council of the City of Elgin, Illinois: Section 1. That the City Council of the City of Elgin hereby adopts the Findings of Fact, dated September 6, 2016, made by the Community Development Department and the Planning and Zoning Commission, a copy of which is attached hereto and made a part hereof by reference as Exhibit A. Section 2. That Section 19.50.105 of the Elgin Municipal Code, 1976, as amended, entitled “Areas of Special Character”, be hereby amended by replacing only Section A.3. in its entirety with the following: 3. The Route 19/East Chicago Street area defined as all zoning lots of four (4) acres or more, fronting on Route 19/East Chicago Street between Willard Avenue on the west and Shales Parkway on the east, and which such zoning lots are occupied by motor vehicle dealers or Elgin High School. Section 4. That the special regulations for street graphics for the Route 19/East Chicago Street Area of Special Character, adopted by Ordinance G22-09, be and are hereby amended by replacing Section 1, Subsection 1 “Area Defined” in its entirety with the following : 1. Area Defined: The Route 19/East Chicago Street Area of Special Character shall encompass all zoning lots of four acres or more, fronting on Route 19/East Chicago Street between Willard Avenue on the west and Shales Parkway on the east, and which zoning lots are occupied by motor vehicle dealers or Elgin High School. VOLUME LXXXI OCTOBER 12, 2016 419 Section 5. That the special regulations for street graphics for the Route 19/East Chicago Street Area of Special Character, adopted by Ordinance G22-09, be and are hereby amended by adding a new Section 1, Subsection 5 “Elgin High School” to read as provided below, and by renumbering Section 1, Subsections 5 and 6 accordingly: “5. Elgin High School: A. Monument Graphics: 1. Number. Elgin High School is permitted to have two (2) monument graphics; one located along Maroon Drive and the second along East Chicago Street. 2. Maximum Surface Area. The maximum surface area of the Maroon Drive monument graphic shall not exceed forty (40) square feet. The maximum surface area of the East Chicago Street monument graphic shall not exceed one hundred and twenty four (124) square feet. 3. Maximum Height. The maximum height of the Maroon Drive monument graphic shall not exceed five (5) feet. The maximum height of the East Chicago Street monument graphic shall not exceed fifteen (15) feet. 4. Electronic/LED Changeable Copy. The East Chicago Street monument graphic may include an electronic/LED changeable copy panel not to exceed 26 square feet. 5. Design. The East Chicago Street monument graphic shall be constructed in substantial conformance with the one-page illustration of the monument graphic, prepared by Signet Sign Company and dated March 23, 2015 (attached hereto as Exhibit B), and the one-page plan which shows the location of the proposed monument graphic with dimensions, prepared by Signet Sign Company but undated (attached hereto as Exhibit C). The East Chicago Street monument graphic shall include landscaping as required by Section 19.50.070 E. of the Elgin Municipal Code, 1976, as amended, as generally depicted upon the one-page “Landscape Plan”, prepared by Joseph E. Creadon, Elgin School District U46, and dated August 30, 2016. 6. Restrictions. The electronic/LED changeable copy panel shall be operated in compliance with the standards provided in Section 19.50.090I 5a-e of the Elgin Municipal Code, as amended. B. Wall Graphics: OCTOBER 12, 2016 VOLUME LXXXI 420 1. Number. Elgin High School is permitted to have three (3) wall graphics along those facades generally facing and otherwise oriented toward Maroon Drive. 2. Maximum Surface Area. The maximum surface area of all wall graphics shall not exceed one hundred and eight (180) square feet. 3. Maximum Height. No wall graphic shall project higher than the parapet wall to which the graphic is attached. C. All Other Street Graphics: All other street graphics shall comply with the provisions of Chapter 19.50 of the Elgin Municipal Code, 1976, as amended, entitled “Street Graphics”.” Section 6. This ordinance shall be in full force and effect immediately upon its passage in the manner provided by law. s/ David J. Kaptain David J.
