COUNCIL-MANAGER FORM OF GOVERNMENT
REGULAR MEETING
The regular meeting of the Council of the City of Elgin, Illinois, was held on January 13, 2016,
in the Council Chambers. The meeting was called to order by Mayor Kaptain at 7:16 p.m. The
Invocation was given by Pastor Andre Allen from New Beginnings Ministries Worldwide and
the Pledge of Allegiance was led by Aaron Cosentino.
ROLL CALL
Roll call was answered by Councilmembers Dunne, Gavin, Martinez, Powell, Prigge,
Rauschenberger, Shaw, Steffen, and Mayor Kaptain. Absent: None.
MINUTES OF THE DECEMBER 16, 2015, COUNCIL MEETING APPROVED AS
DISTRIBUTED
Councilmember Shaw made a motion, seconded by Councilmember Steffen, to approve the
December 16, 2015, Council Meeting Minutes as distributed. Upon a roll call vote: Yeas:
Councilmembers Dunne, Gavin, Martinez, Powell, Prigge, Rauschenberger, Shaw, Steffen, and
Mayor Kaptain. Nays: None.
COMMUNICATIONS
Dr. Martin Luther King Jr. Proclamation
Mayor Kaptain read the following proclamation:
PROCLAMATION
WHEREAS, Dr. Martin Luther King, Jr., born in Atlanta, Georgia, attended Morehouse
College in Atlanta and Crozer Theological Seminary in Pennsylvania, and was a student
thereafter at Boston University and the University of Pennsylvania, and, who following his
studies, became a spiritual leader of his church; and
WHEREAS, Dr. Martin Luther King, Jr., as a spiritual leader not only of his own
congregation, but of millions throughout the world, espoused the philosophy of nonviolence to
all humanity, and in recognition of his teachings was awarded the Nobel Peace Prize; and
WHEREAS, Dr. Martin Luther King, Jr. spent a life in service to the human community

and attempted to realize for them and for America, a dream of peace and unity; and
WHEREAS, Dr. Martin Luther King, Jr., in his campaign for Civil Rights, extended his
work for the benefit of all humanity, and especially for the poor, and was a leader in the cause of
world peace.
NOW, THEREFORE, I, David Kaptain, Mayor of the City of Elgin, Illinois, do hereby
proclaim Saturday, January 16th, Sunday, January 17th and Monday, January 18th, 2016, as days
in honor of the memory of Dr. Martin Luther King, Jr.

RECOGNIZE PERSONS PRESENT
Paige Roeber and Deirdre White from the Downtown Neighborhood Association announced the
winners of the 17th Annual Window Wonderland contest and presented awards and prizes to the
parties who participated. There were 35 participating businesses and organization in this year’s
contest, and the businesses reported a 25 % increase in foot traffic and sales.
Chuck Keysor thanked the Elgin Police Department for their diligence and expressed his
thoughts on snow removal.
Andrea Evenson representing residents in the area of Petition 21-15, commented on their
concerns regarding signage for the project.
Larry Rohrssen commented on his negative experiences with the Code Enforcement Department
and expressed concerns regarding procedures. He recommended that the Council form an
oversight panel for the department. He also stated that he did not believe the council should
enact any laws regarding snow removal from sidewalks within the city.
Peter Bazos, representing the applicant for Petition 21-15, commented on the zoning for the
property on Lambert Lane, signage for the business, and the changes the applicant made based
on the neighbors suggestions.

AN ORDINANCE
GRANTING A MAP AMENDMENT FROM GI GENERAL INDUSTRIAL DISTRICT
TO PGI PLANNED GENERAL INDUSTRIAL DISTRICT
(980 Lambert Lane)
WHEREAS, written application has been made to reclassify certain property located at 980
Lambert Lane, which property is legally described herein (the “Subject Property”), from GI
General Industrial District to PGI Planned General Industrial District; and
WHEREAS, the Planning and Zoning Commission conducted a public hearing on
November 2, 2015 following due notice by publication; and
WHEREAS, the Community Development Department and the Planning & Zoning
Commission have submitted their findings of fact concerning said application; and
WHEREAS, the Community Development Department and the Planning & Zoning
Commission recommend approval of said application, subject to the conditions articulated below;
and
WHEREAS, the City Council of the City of Elgin, Illinois has reviewed the findings and
recommendations of the Community Development Department and the Planning & Zoning
Commission; and
WHEREAS, the City of Elgin is a home rule unit and as a home rule unit may exercise any
power and preform any function pertaining to its government and affairs; and

WHEREAS, zoning, including but not limited to, this ordinance approving a planned
development and granting the departures below from the Elgin Zoning Ordinance, pertain to the
government and affairs of the city.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
ELGIN, ILLINOIS:
Section 1. That the City Council of the City of Elgin hereby adopts the Findings of Fact,
dated November 2, 2015, made by the Community Development Department and the Planning &
Zoning Commission, a copy of which is attached hereto and made a part hereof by reference as
Exhibit A.
Section 2. That Chapter 19.08, Section 19.08.020 entitled Zoning District map of the Elgin
Municipal Code, as amended, be and the same is hereby further amended by amending from the
GI General Industrial District to the PGI Planned General Industrial District the property legally
described as follows:
PARCEL 1:
That part of the Northeast Quarter and the Northwest Quarter of Section 29,
Township 41 North, Range 9 East of the Third Principal Meridian, described as
follows:
Beginning at the Northwest corner of Lot 124 of Castle Creek of Bartlett, being a
subdivision recorded June 23, 2004 as Document No. 0417534056, said point also
being on the Easterly Right of Way line of The Elgin Joliet and eastern Railroad;
thence North 09 Degrees 02 Minutes 55 Seconds East along said Easterly Right of
Way Line, 393.25 feet to the Southwest corner of land conveyed to Edward R.
Hayes per Document No. 0030061048, thence South 89 Degrees 52 Minutes 05
Seconds East along said the South line of said land conveyed to Edward R. Hayes,
1012.11 feet to the Westerly line of Lambert Lane per Plat of Dedication recorded
November 17, 2003 as Document No. 0332119045; thence South 27 Degrees 32
Minutes 55 Seconds West along said Westerly Line, being a curve concave to the
East having a radius of 582.22 feet an Arc distance of 338.89 feet to the Northeast
corner of said Lot 124, the Chord of said Arc having a length of 334.12 feet and a
Bearing of South 100 Degrees 52 Minutes 25 Seconds West, thence South 88
Degrees 33 Minutes 58 Seconds West along the North Line of said Lot 124, a
distance of 994 feet to the point of beginning, Cook County, Illinois (property
commonly known as 980 Lambert Lane).
Section 3. That the City Council of the City of Elgin hereby grants the rezoning from GI
General Industrial District to PGI Planned General Industrial District for the property commonly
known as 980 Lambert Lane, which is legally described above, and which shall be designed,
developed, and operated subject to the following provisions:

A. Purpose and Intent. The purpose of this PGI Planned General Industrial District is
to provide a planned industrial environment for those industrial uses that do not
require the location or environment of an ORI Office Research Industrial District.
A PGI zoning district is most similar to, but departs from the standard requirements
of the GI zoning district.
B. Supplementary Regulations. Any word or phrase contained herein, followed by the
symbol [SR], shall be subject to the definitions and the additional interpretive
requirements provided in Chapter 19.90, Supplementary Regulations, of the Elgin
Municipal Code, as amended. The exclusion of such symbol shall not exempt such
word or phrase from the applicable supplementary regulation.
C. General Provisions. In this PGI District, the use and development of land and
structures shall be subject to the provisions of Chapter 19.05, General Provisions,
of the Elgin Municipal Code, as may be amended from time to time.
D. Zoning Districts - Generally. In this PGI Planned General Industrial District, the
use and development of land and structures shall be subject to the provisions of
Chapter 19.07, Zoning Districts, as may be amended from time to time.
E. Location and Size of District. PGI Planned General Industrial Districts should be
located in substantial conformance to the official comprehensive plan. The amount
of land necessary to constitute a separate PGI District exclusive of rights of way,
but including adjoining land or land directly opposite a right of way shall not be
less than two acres. No departure from the required minimum size of a planned
industrial district shall be granted by the City Council.
F. Land Use. In this PGI Planned General Industrial District, the use and development
of land and structures shall be subject to the provisions of Chapter 19.10, Land Use,
of the Elgin Municipal Code, as amended. The only permitted, conditional, and
similar land uses allowed within this PGI zoning district shall be those permitted,
conditional, and similar land uses listed in Chapter 19.40.300, GI General
Industrial District.
G. Site Design. In this PGI Planned General District, the use and development of land
and structures shall be subject to the provisions of Section 19.12, Site Design, of
the Elgin Municipal Code, as amended, with the following exceptions:
1. Transition Setback for South Lot Line of the Subject Property: The
minimum required building setback from a "transition lot line" [SR] shall
be twenty-five (25) feet along the south lot line of the Subject Property,
whereas the GI General Industrial District would have otherwise required a
building setback of 132 feet.
2. Transition Landscape Yard for South Lot Line of the Subject Property: A
"transition landscape yard" [SR] no less than twenty-five (25) feet in depth

shall be provided adjoining the entire length of the “transition lot line” [SR]
along the south lot line of the Subject Property, whereas the GI General
Industrial District would have otherwise required a 66-foot “transition
landscape yard” [SR].
and shall be in substantial conformance with the following documents:
1. Substantial conformance to Development Application and Statement of
Purpose submitted by Peter Bazos of Bazos Freeman Kramer Schuster &
Braithwaite, LLC, and attorney for the project dated September 3, 2015. In
the event of any conflict between such documents and the terms and
provisions of this ordinance or other applicable city ordinances, the terms
and provisions of this ordinance or other applicable city ordinances shall
supersede and control.
2. Substantial conformance to the Development Plan containing the following
exhibits:
a. Substantial conformance to the ALTA/ACSM Land Title Survey
prepared by Haeger Engineering, LLC and dated December 19, 2014.
b. Floor Plans, Elevations and Renderings entitled “Proposed Offices and
Warehouse Building for Europe Holding, LLC” Sheets A1.0, A1.1 and
A4, prepared by Silva Architects last revised on October 26, 2015.
c. Landscape Plan Sheet L1.1, prepared by Paul Bednar Planning and
Design, Ltd., for Silva Architects, last revised on December 31, 2015,
and subject to further revisions as may be required of the Community
Development Department.
d. Preliminary Engineering Plans entitled “980 Lambert Lane Site
Improvement Plans, Europe Holdings LLC,” Sheets 1-10, prepared by
Haeger Engineering LLC, dated July 15, 2015, and last revised on
December 4, 2015.
e. Easement document entitled 980 Lambert Lane, Plat of Easement,
prepared by Haeger Engineering LLC, dated October 21, 2015.
f. Site Photometric Plan and Lighting Notes Sheet SPM, prepared by Silva
Architects dated September 14, 2015.
g. Storm Water Pollution Prevention Plan (SWPPP) for 980 Lambert Lane
Subdivision, Sheets 1-2, prepared by Haeger Engineering, dated July
15, 2015.
3. The landscape material located along the south property line and the
frontage of the property with Lambert Lane shall be designed to screen the
truck parking areas from view of residential properties located to the south
and east of the Subject Property across Lambert Lane. Specifically, the
landscape plan shall contain no less than 124 trees consisting of shade,
ornamental and evergreen trees; and 387 shrubs.

4. The installation and use of an exterior public address (PA) system or any
other like sound amplification system is prohibited on any exterior location
of the building or upon the Subject Property.
5. Vehicular truck traffic entering and leaving the Subject Property is
prohibited from traveling on that portion of Lambert Lane south of the
Subject Property or on Belcourt Lane.
6. Compliance with all other applicable codes and ordinances.
H. Off Street Parking. In this PGI Planned General Industrial District, off street
parking shall be subject to the provisions of Chapter 19.45, Off Street Parking, of
the Elgin Municipal Code, as may be amended.
I. Off Street Loading. In this PGI Planned General Industrial District, off street
loading shall be subject to the provisions of Chapter 19.47, Off-Street Loading, as
may be amended from time to time.
J. Signs. In this PGI Planned General Industrial District, graphics shall be subject to
the provisions of 19.50, Street Graphics, as may be amended from time to time.
K. Planned Developments. In this PGI Planned General Industrial District, the use
and development of the land and structures shall be subject to the provisions of
Chapter 19.60, Planned Developments, as may be amended from time to time.
L. Conditional Uses. In this PGI Planned General Industrial District, application for
conditional uses shall be subject to the provisions of Chapter 19.65, Conditional
Uses, as may be amended from time to time.
M. Variations. In this PGI Planned General Industrial District, application for variation
shall be subject to the provisions of Chapter 19.70, Variations, as may be amended
from time to time.
N. Appeals. Any requirement, determination, or interpretation associated with the
administration and enforcement of the provisions of this ordinance may be appealed
subject to the provisions of Chapter 19.75, Appeals, as may be amended from time
to time.
Section 4. That this ordinance shall be in full force and effect immediately after its passage
in the manner provided by law.

BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS,
that pursuant to Elgin Municipal Code Section 5.02.020B(9) the City Council hereby finds that an
exception to the requirements of the procurement ordinance is necessary and in the best interest of
the city; and
BE IT FURTHER RESOLVED BY THE CITY COUNCIL OF THE CITY OF ELGIN,
ILLINOIS, that Sean R. Stegall, City Manager, be and is hereby authorized and directed to execute
a premier software maintenance agreement and addendum on behalf of the City of Elgin with Tyler

RESOLUTION 16-4 ADOPTED REGARDING ELGIN IMAGE COMMISSION
RECOGNITION AWARDS
Councilmember Shaw made a motion, seconded by Councilmember Steffen, to adopt the

RESOLUTION
REGARDING ELGIN IMAGE COMMISSION RECOGNITION AWARDS
WHEREAS, the City Council has previously approved a program by the Elgin Image
Commission where a formal recognition program would be established to honor individuals with
a connection to Elgin who have received regional or national prominence; and
WHEREAS, the Elgin Image Commission has recommended to the City Council that for
2015 Myron M. Lehman, Libby Goll and Dr. Edwin A. Kilbourne be given recognition awards;
and
WHEREAS, Myron M. Lehman served as Elgin's mayor from 1931-1943 and 1951-1955.
During his first term, he was confronted with the reality that the city's obligations far exceeded its
income and was forced to make tough decisions. Previous administrations had made generous
contributions to special-assessment paving projects which dropped the property values and
increased tax delinquencies by the downtown businesses. Under Myron's leadership salaries were
cut, fire stations were closed and services were drastically reduced. It was a tough time for Elgin,
but Myron Lehman led the city through them; and
WHEREAS, Libby Goll founded the Resthaven Sanitarium in 1909 which was one of the
largest and longest operating private "rest home" in Elgin that provided post hospital treatment,
which would be hospice care. Resthaven survived until the 1970s and over the years, it has served
as a boarding house, alcoholism treatment center and a treatment center for adolescents under the
name Lovellton Academy. Libby Goll was devoted to the facility and touched the lives of
thousands of Elgin residents; and

WHEREAS, Dr. Edwin A. Kilbourne was the first and longest serving chief executive of
the Elgin Mental Health Center. He was a progressive thinker in regards to treatment and
therapeutic innovations; establishing the third pathology research lab in the nation. His tireless
efforts, need for perfection and quality care earned the hospital the distinction of being one of the
finest institutions of its kind in the late nineteenth century. Dr. Edwin A. Kilbourne wrote articles
in the Associations' American Journal of Insanity and attended annual Association of Medical
Superintendents of American Institutions for the Insane meetings, giving him a visibility and
stature that was widely recognized.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
ELGIN, ILLINOIS, that Myron M. Lehman, Libby Goll and Dr. Edwin A. Kilbourne be and are
hereby awarded formal recognition as having been prominent members of the Elgin Community.
