COUNCIL OF THE CITY OF ELGIN, ILLINOIS COUNCIL-MANAGER FORM OF GOVERNMENT REGULAR MEETING
The regular meeting of the Council of the City of Elgin, Illinois, was held on October 14, 2015,
in the Council Chambers. The meeting was called to order by Mayor Kaptain at 7:10 p.m. The
Invocation was given by Pastor Dave DeHaan from the New City Church and the Pledge of
Allegiance was led by Marc Mylott, Community Development Director.
ROLL CALL
Roll call was answered by Councilmembers Dunne (attended electronically), Gavin, Martinez,
Powell, Prigge, Rauschenberger, Shaw, Steffen, and Mayor Kaptain. Absent: None.
MINUTES OF THE SEPTEMBER 23, 2015, COUNCIL MEETING APPROVED AS
DISTRIBUTED
Councilmember Shaw made a motion, seconded by Councilmember Steffen, to approve the
September 23, 2015, Council Meeting Minutes as distributed. Upon a roll call vote: Yeas:
Councilmembers Dunne, Gavin, Martinez, Powell, Prigge, Rauschenberger, Shaw, Steffen, and

COMMUNICATIONS
Dr. Gerald Gabris Retirement Proclamation
Mayor Kaptain read the following proclamation:
PROCLAMATION
WHEREAS, Dr. Gerald Gabris provided great contributions to the field of public
administration in his 40-year career as a professor, researcher, author and consultant at the local,
state and federal levels of government; and,
WHEREAS, in his distinguished career, Dr. Gabris focused his research and teaching on
organizational behavior, human resources management, strategic planning, and governing
board dynamics; and,

WHEREAS, Dr. Gabris taught thousands of graduate students in the field of public
administration during his 28-year tenure at NIU, many of whom work in local governments in
the northern Illinois region and at the city of Elgin; and,
WHEREAS, from 2004 to 2009, he served as the director for NIU’s Division of Public
Administration and under his leadership, helped the Master’s in Public Administration program
be ranked third nationally, according to U.S. News and World Report, in the field of city
management and urban policy; and,
WHEREAS, from 2011-2013, he consulted with the city of Elgin to facilitate the
development of the city’s five-year strategic plan and the city’s first Strategic Plan Advisory
Commission, citing this level of citizen engagement as innovative and the first of its kind.
NOW, THEREFORE, I, David Kaptain, Mayor of the City of Elgin, Illinois do hereby
extend sincere and warm appreciation to Dr. Gerald Gabris on the occasion of his retirement for
his outstanding service to the field of public administration, to the staff and elected officials and
to our community as a whole.

Kane County Association for Home and Community Education Proclamation
Mayor Kaptain read the following proclamation:
PROCLAMATION
WHEREAS, Illinois Association for Home and Community Education was organized
under the name Illinois Home Bureau Federation for the purpose of improving rural living and
family and community life; and
WHEREAS, Illinois Association for Home and Community Education was initiated in
July, 1915; an Advisor was hired by the University of Illinois to develop a home improvement
association. Kane County joined this University of Illinois Extension program in 1918; and
WHEREAS, Illinois Association for Home and Community Education evolved from Kane
County Home Bureau Federation to Kane County Homemakers Education Association to the 2008
change, Kane County Association for Home and Community Education; and
WHEREAS, Kane County Association for Home and Community Education is based at
the University of Illinois Extension, 535 Randall Road, St. Charles, Illinois; and

WHEREAS, Kane County Association for Home and Community Education is dedicated
to addressing the issues of community outreach, cultural enrichment, family living, international
study, public relations and community involvement for the entire population of Kane County,

NOW, THEREFORE, I, David Kaptain, Mayor of the City of Elgin, Illinois, congratulate
the Plato Center Unit of Kane County Association for Home and Community Education and
designate the week of October 11-17 as HCE week.

Domestic Violence Awareness Month Proclamation
Mayor Kaptain read the following proclamation:
PROCLAMATION
WHEREAS, violence against women and children continues to become a more prevalent
problem and is not confined to any group of people, but across all economic, gender, racial and
societal barriers and is supported by societal indifference; and
WHEREAS, the crime of domestic violence violates an individual’s privacy, dignity,
security and humanity through the systematic use of physical, emotional, sexual, psychological
and economic control and/or abuse; and
WHEREAS, the impact of domestic violence is wide-ranging, directly affecting families
and society as a whole; and
WHEREAS, it is battered women themselves who have been at the forefront of efforts to
bring peace and equity to the home; and
WHEREAS, it is fitting to set aside a special time to bring this issue to the attention of all
residents of the City of Elgin so they can become better informed and involved in programs to
eliminate this epidemic from our society.
NOW, THEREFORE, I, David Kaptain, Mayor of the City of Elgin, Illinois, do hereby
proclaim the month of October 2015 as Domestic Violence Awareness Month in the City of
Elgin and encourage our residents to join forces with victim service programs, criminal justice
officials and concerned citizens across the country to raise the public awareness of domestic
violence issues.

Crop Hunger Walk Proclamation
Mayor Kaptain read the following proclamation:
PROCLAMATION
WHEREAS, at the end of World War II many people wanted to share our country’s
abundance with European war victims; and Church World Service and CROP’s first purpose was
to gather wheat and other crops from U.S. farms for shipment to Europe; and
WHEREAS, today, locally-organized, Church World Service-sponsored CROP Hunger
Walks are an important part of community life for more than 2,000 towns and cities in the United
States, bringing together people of different faiths, diverse cultures, and all age groups; and
WHEREAS, in CROP Hunger Walks raise over $12 million annually to bring help and
hope to people in need around the world and in the U.S.; and
WHEREAS, each year CROP Hunger Walks help more than 2,200 local food pantries,
food banks, and meal sites in the U.S. providing food to neighbors in need, including our food
pantries and soup kettles in Elgin; and
WHEREAS, the Annual CROP Hunger Walk will be held on Sunday, October 18, 2015
to help our community become aware of and concerned about hunger and its causes; and
WHEREAS, the CROP Hunger Walk will raise funds to help stop hunger both locally
and globally.
NOW, THEREFORE, I, David Kaptain, Mayor of the city of Elgin, do hereby proclaim
Sunday, October 18, 2015 as CROP HUNGER WALK DAY in Elgin and do urge the citizens of
Elgin to support this CROP Hunger Walk.

RECOGNIZE PERSONS PRESENT
Bennie Sowers commented on the process in which various neighborhoods have been converted
to odd even parking. She also thanked Councilman Gavin, City Manager Stegall, and Mayor for
their assistance.
James Harvey invited the public to attend a Veterans Day celebration being held at Artspace on
November 7th from 6:00 p.m. – 9:00 p.m.
Karen Oswald, Literacy Connection, thanked the council for their attention to the local human
service agencies and asked the council to keep in mind the varied funding sources the agencies
utilize.
JOINT PURCHASING COOPERATIVE AGREEMENT APPROVED WITH MUSCO
LIGHTING FOR THE ELGIN NATIONAL LITTLE LEAGUE BALL FIELD LIGHT
REPLACEMENT
Councilmember Steffen made a motion, seconded by Councilmember Gavin, to approve a contract
with Musco Lighting to replace baseball field lights in the amount of $94,800. Upon a roll call
vote: Yeas: Councilmembers Dunne, Gavin, Martinez, Powell, Prigge, Rauschenberger, Shaw,
Steffen, and Mayor Kaptain. Nays: None.
PUBLIC HEARING CONTINUED FOR PETITION 02-15 AT 3191 U.S. HIGHWAY 20;
AN APPLICATION BY LAZAR BROTHERS D/B/A “OASIS ON 20” REQUESTING
ANNEXATION AND ZONING APPROVAL TO CONSTRUCT A MOTOR VEHICLE
SERVICE STATION, CONVENIENCE STORE AND COMMERCIAL TENANT
SPACES
Marc Mylott, Community Development Director, asked that the items related to Petition 02-15 at
3191 U.S. Highway 20 be continued until the next City Council meeting on November 4, 2015.
Councilmember Steffen made a motion, seconded by Councilmember Shaw, to continue the items
related to Petition 02-15 at 3191 U.S. Highway 20 until the November 4, 2015, City Council
meeting. Upon a roll call vote: Yeas: Councilmembers Dunne, Gavin, Martinez, Powell, Prigge,

PETITION 18-15 APPROVED FOR 1040 NORTH MCLEAN BOULEVARD; AN

BUILDING
Marc Mylott, Community Development Director, provided an overview of Petition 18-15 noting
the lot coverage and signage components of the petition. The Planning and Zoning Commission
and staff are recommending approval subject to conditions.
Councilmember Shaw made a motion, seconded by Councilmember Gavin, to approve Petition
18-15 subject to conditions. Upon a roll call vote: Yeas: Councilmembers Dunne, Gavin,
Martinez, Powell, Prigge, Rauschenberger, Shaw, Steffen, and Mayor Kaptain. Nays: None.
PETITION 13-15 APPROVED FOR 73 RIVERSIDE DRIVE; AN APPLICATION BY
ELGIN ALANO CLUB, INC., FOR A CONDITIONAL USE TO ESTABLISH A SOCIAL
SERVICE AGENCY/MEMBERSHIP ORGANIZATION WITHIN UNITS A & B
Marc Mylott, Community Development Director, provided an overview of Petition 13-15 noting
that the Planning and Zoning Commission and staff are recommending approval subject to
conditions.
There was discussion regarding the hours of operation, the ages of the members, the building
occupancy, potential impact on the surrounding businesses, and access for members to public
transportation.
Councilmember Shaw made a motion, seconded by Councilmember Steffen, to approve Petition
13-15 subject to conditions. Upon a roll call vote: Yeas: Councilmembers Dunne, Gavin, Prigge,
Rauschenberger, Shaw, Steffen, and Mayor Kaptain. Nays: Councilmembers Martinez and
Powell.
ORDINANCE G43-15 PASSED PROVIDING FOR CANNABIS REGULATIONS
Councilmember Powell made a motion, seconded by Councilmember Steffen, to pass the
following ordinance. Upon a roll call vote: Yeas: Councilmembers Gavin, Martinez, Powell,
Prigge, Rauschenberger, Shaw, Steffen, and Mayor Kaptain. Nays: Councilmember Dunne.
Ordinance No. G43-15
AN ORDINANCE
PROVIDING FOR CANNABIS REGULATIONS
WHEREAS, the City of Elgin is a home rule unit, and as a home rule unit may exercise
any power and perform any function pertaining to its government and affairs; and

WHEREAS, the City Council has determined that it is necessary and desirable to enact
certain regulations
with respect to the possession and use of cannabis; and
WHEREAS, the proposed regulations relating to the possession and use of cannabis will
enhance public safety and health and will provide for the more efficient prosecution of specified
minor offenses with relating to the possession and use of cannabis; and
WHEREAS, public safety and welfare and the efficient use of law enforcement resources
pertain to the government affairs of the City.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
ELGIN, ILLINOIS:
Section 1. That Title 10 of the Elgin Municipal Code, 1976, as amended, entitled
"Public Peace, Morals and Welfare" be and is hereby further amended by adding a new chapter
10.24 thereto entitled "Cannabis" to read as follows:
"Chapter 10.24
CANNABIS
10.24.010: DEFINITIONS:
As used in this Chapter, "cannabis" includes marijuana, hashish, and other substances
which are identified as including any parts of the plant Cannabis Sativa, whether growing
or not; the seeds thereof; the resin extracted from any part of such plant; and any compound,
manufacture, salt, derivative, mixture, or preparation of such plant, its seeds, or resin,
including tetrahydrocannabinol (THC) and all other cannabinol derivatives, including its
naturally occurring or synthetically produced ingredients, whether produced directly or
indirectly by extraction, or independently by means of chemical synthesis or by a
combination of extraction and chemical synthesis; but shall not include the mature stalks
of such plant, fiber produced from such stalks, oil or cake made from the seeds of such
plant, any other compound, manufacture, salt, derivative, mixture, or preparation of such
mature stalks (except the resin extracted therefrom), fiber, oil or cake, or the sterilized seed
of such plant which is incapable of germination.
10.24.020: POSSESSION:
It shall be unlawful for any person to possess up to thirty (30) grams of any substance
containing cannabis.

10.24.030: USE:
It shall be unlawful for any person to use, inject, ingest, inhale, or otherwise introduce into
the human body cannabis, or to be under the influence of cannabis.
10.24.040: EXCEPTIONS:
The provisions of this Chapter shall not apply to persons who are licensed to possess, use
or deliver cannabis by the State of Illinois and are in compliance with the requirements and
provisions of such license.
10.24.050: PENALTIES:
A. Any person found in violation of any of the provisions of this Chapter for
possession of ten (10) grams or less of any substance containing cannabis shall be fined
not less than seventy-five dollars ($75.00) for a first offense, not less than two hundred
dollars ($200.00) for a second offense and not less than five hundred dollars ($500.00) for
a third and subsequent offense.
B. Any person found in violation of any of the provisions of this Chapter for
possession of more than ten (10) grams and up to thirty (30) grams of any substance
containing cannabis shall be fined not less than one hundred fifty dollars ($150.00) for a
first offense, not less than three hundred dollars ($300.00) for a second offense and not less
than seven hundred fifty dollars ($750.00) for a third and subsequent offense.
C. In addition to the payment of the aforesaid fine, any person found to be in violation
of this Chapter may also, upon conviction, be required to complete not less than twenty-
five (25) hours and not more than fifty (50) hours of community service or community
restitution hours in addition to or in place of a fine.
D. Any person shall be guilty of a separate offense for each and every day during
which any portion of any violation of this Chapter is committed, continued or permitted to
be committed, and the person shall be punished accordingly."
Section 2. That all ordinances or parts of ordinances in conflict with the provisions of
this ordinance be and are hereby repealed to the extent of any such conflict.
Section 3. That this ordinance shall be in full force and effect upon its passage and
publication in the manner provided by law.

ACCEPTING FOR OWNERSHIP AND MAINTENANCE THE PUBLIC
IMPROVEMENTS WITHIN WATERFORD NEIGHBORHOOD 6 SUBDIVISION
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS,
that the City of Elgin hereby accepts for ownership and maintenance the public improvements
within Waterford Neighborhood 6 Subdivision. Acceptance of the public improvements will add
the following city-maintained facilities: approximately 2,820 lineal feet of 8-inch water main;
2,185 lineal feet of 12-inch water main; eight 8-inch valves in 4-foot vaults; five 12-inch valves in
5-foot vaults; 16 fire hydrants; 1,792 lineal feet of 10-inch storm sewer; 2,455 lineal feet of 12-
inch storm sewer; 340 lineal feet of 15-inch storm sewer; 1,884 lineal feet of 18-inch storm sewer;
74 lineal feet of 21-inch storm sewer; 222 lineal feet of 24-inch storm sewer; 45 catch basins; 31
storm manholes; 2 flared end sections; 3,881 lineal feet of 8-inch sanitary main; 16 sanitary sewer
manholes; 25 street lights; 10 street signs; 215 parkway trees and 6,851 lineal feet of improved
street (including curb and gutter on both sides) with sidewalk and all their respective
appurtenances.

that the City of Elgin, Illinois hereby accepts the Illinois Department of Transportation Highway
Safety Project grant in the amount of $100,668 for the Sustained Traffic Enforcement Program, a
copy of which is attached hereto and made a part hereof by reference.
BE IT FURTHER RESOLVED that Sean R. Stegall, City Manager, is hereby authorized
and directed to execute all documents necessary in conjunction with the subject grant program.
