HomeMy WebLinkAboutk - June 24, 2015 CC272 JUNE 24, 2015 VOLUME LXXX COUNCIL OF THE CITY OF ELGIN, ILLINOIS COUNCIL-MANAGER FORM OF GOVERNMENT REGULAR MEETING The regular meeting of the Council of the City of Elgin, Illinois, was held on June 24, 2015, the Heritage Ballroom in The Centre, located at 100 Symphony Way. The meeting was called to order by Mayor Kaptain at 7:32 p.m. A moment of silence was observed for the passing of Elgin Police Officer Wilson and the Pledge of Allegiance was led by Mayor David Kaptain. ROLL CALL Roll call was answered by Councilmembers Dunne, Gavin, Martinez, Powell, Prigge, Rauschenberger, Shaw, Steffen, and Mayor Kaptain. Absent: None. MINUTES OF THE JUNE 10, 2015, COUNCIL MEETING APPROVED AS DISTRIBUTED Councilmember Shaw made a motion, seconded by Councilmember Steffen, to approve the June 10, 2015, Council Meeting Minutes as distributed. Upon a roll call vote: Yeas: Councilmembers Dunne, Gavin, Martinez, Powell, Prigge, Rauschenberger, Shaw, Steffen, and Mayor Kaptain. Nays: None. COMMUNICATIONS American Heart Association Mission Lifeline Award Presentation Art Miller, American Heart Association Mission Lifeline Director, presented Fire Chief Fahy and Battalion Chief, Bryan McMahan, with the Silver Award for 2014 for excellence in assisting STEMI care patients. 17th Annual Citizenship Recognition Program Jerry Turnquist acted as emcee and members of the Elgin Choral Union sang two selections. Each new citizen was recognized by name and they were congratulated by the Mayor, members of Council, as well as Representative Anna Moller, Representative Steven Andersson, and Senator Michael Noland, as well as representatives from Congresswoman Tammy Duckworth and Congressman Peter Roskom’s offices. VOLUME LXXX JUNE 24, 2015 273 RECOGNIZE PERSONS PRESENT Sandra Annan spoke in support of additional parking in the area of Lincoln Avenue, Dundee Avenue and Hill Street. BID 14-044A AWARDED TO TRIGGI CONSTRUCTION, INC. FOR THE LINCOLN, HILL AND DUNDEE PARKING PROJECT There was discussion regarding the history of the project, the number of parking spaces created, the cost of the project and how the project would be funded. Councilmember Dunne made a motion, seconded by Councilmember Steffen, to award a contract to Triggi Construction, Inc. in the amount of $ 134,749 for the Lincoln, Hill and Dundee Parking Project. Upon a roll call vote: Yeas: Councilmembers Dunne, Gavin, Martinez, Powell, Rauschenberger, Steffen, and Mayor Kaptain. Nays: Councilmembers Prigge and Shaw. RESOLUTION 15-95 ADOPTED ACCEPTING THE PROPOSAL OF PUBLIC ENTITY PROPERTY INSURANCE PROGRAM FOR THE CITY OF ELGIN'S PROPERTY, INLAND MARINE AND CYBER LIABILITY INSURANCE Councilmember Gavin made a motion, seconded by Councilmember Martinez, to adopt the following resolution. Upon a roll call vote: Yeas: Councilmembers Dunne, Gavin, Martinez, Powell, Prigge, Rauschenberger, Shaw, Steffen, and Mayor Kaptain. Nays: None. Resolution No. 15-95 RESOLUTION ACCEPTING THE PROPOSAL OF PUBLIC ENTITY PROPERTY INSURANCE PROGRAM FOR THE CITY OF ELGIN’S PROPERTY, INLAND MARINE AND CYBER LIABILITY INSURANCE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS, that pursuant to Elgin Municipal Code Section 5.02.020B(9) the City Council hereby finds that an exception to the requirements of the procurement ordinance is necessary and in the best interest of the city; and BE IT FURTHER RESOLVED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS, that the City of Elgin hereby accepts Public Entity Property Insurance Program's renewal proposal for the City of Elgin’s property, inland marine and cyber liability insurance commencing July 1, 2015 through June 30, 2016, for an annual premium of $217,643. Councilmember Powell made a motion, seconded by Councilmember Steffen, to adopt the following resolution. Upon a roll call vote: Yeas: Councilmembers Dunne, Gavin, Martinez, Powell, Prigge, Rauschenberger, Shaw, Steffen, and Mayor Kaptain. Nays: None. Resolution No. 15-97 RESOLUTION ESTABLISHING PREVAILING WAGE RATES ON PUBLIC WORKS CONTRACTS WHEREAS, 820 ILCS 130/0.01 et seq. entitled "AN ACT regulating wages of laborers, mechanics, and other workers employed in any public works by the State, county, city or any public body or any political subdivision or by any one under contract for public works." requires that any public body awarding any contract for public work, or otherwise undertaking any public works as defined herein, shall ascertain the general prevailing hourly rate of wages for employees engaged in such work; and WHEREAS, said Act further provides that if the public body desires that the Department of Labor ascertain the prevailing rate of wages, it shall notify the Department of Labor to ascertain the general prevailing wage rate; and WHEREAS, at the request of the City of Elgin the Department of Labor has determined the prevailing rate of wages for construction work in Cook and Kane Counties in the State of Illinois. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS, that the determination of the prevailing wages as made by the Department of Labor, copies of which are attached hereto and made a part hereof by reference, are adopted by the City of Elgin. JUNE 24, 2015 VOLUME LXXX 276 BE IT FURTHER RESOLVED that all contracts for public work of the City of Elgin shall include a stipulation to the effect that not less than the prevailing rate of wages as found by the Department of Labor shall be paid to all laborers, workers and mechanics performing work under the contract. BE IT FURTHER RESOLVED that all contract bonds for public works shall include a provision to guarantee the faithful performance of the prevailing wage clause as provided by contract. BE IT FURTHER RESOLVED that a copy of the prevailing wage rate as established by the Department of Labor shall be publicly posted and kept available for inspection by any interested party. BE IT FURTHER RESOLVED that nothing herein contained shall be construed to apply to the prevailing hourly rate of wages in the locality for employment other than public works construction as defined in the Act, and that the City Clerk be and is hereby authorized to file a certified copy of this resolution with the Secretary of State Index Division and the Department of Labor of the State of Illinois. s/ David J. Ordinance No. G25-15 AN ORDINANCE AMENDING PSFR1 PLANNED SINGLE FAMILY RESIDENCE DISTRICT ORDINANCE NO. G43-05 (Stonebrook Subdivision – 901-1000 Corron Road - Tracts 1, 6, 11, 12, and13) WHEREAS, the territory herein described has previously been annexed to the City of Elgin and originally classified in the PSFR1 Planned Single Family Residence District under Ordinance No. G43-05; and WHEREAS, written application has been made to amend PSFR1 Planned Single Family Residence District Ordinance No. G43-05 to permit additional single-family models constructed with street-facing forward-oriented garages on certain lots within Stonebrook Subdivision Units 1 and 2; and WHEREAS, the City Council of the City of Elgin, Illinois, adopted a Comprehensive Plan and Design Guidelines on February 9, 2005 through ordinance G18-05; and VOLUME LXXX JUNE 24, 2015 283 WHEREAS, the adopted comprehensive plan includes guidelines that provide that new single family homes in planned residential developments be constructed with street-facing garages that are designed and oriented to be recessed behind the main residential façade; and WHEREAS, the new single-family models will be constructed with street-facing garages that will be designed and oriented to be in front of the main residential façade which would be a departure from the design guidelines of the comprehensive plan; and WHEREAS, after due notice in the manner provided by law the Planning and Zoning Commission conducted public hearings concerning said applications and has submitted its written findings and recommendations; and WHEREAS, the City Council of the City of Elgin, Illinois, has reviewed the findings and recommendations of the Planning and Zoning Commission. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS: Section 1. That the City Council of the City of Elgin hereby adopts the Findings of Fact, dated May 4, 2015, and the recommendations made by the Community Development Department and the Planning and Zoning Commission, a copy of which is attached hereto and made a part hereof by reference as Exhibit A. Section 2. That Ordinance No. G43-05 entitled “An Ordinance Classifying Newly Annexed Territory in the PSFR1 Planned Single Family Residence District (Stonebrook Subdivision – 901 and 1000 Corron Road – Tracts 1,6,11,12,13),” passed April 13, 2005, be and is hereby amended only as set forth in this ordinance by amending Section G.13, entitled “Supplementary Conditions” through the addition of Subparagraph “d” to read as follows: "d. New home models constructed with street-facing garages shall be allowed to extend in front of the main residential façade for a distance no greater than six (6) feet on Lots 53-61, 66-74, 75-85, 86-89, 92-100, 120, 130-132, 146-148, 161-163, 168 and Parcel 25 within Unit 1; and Lots 62-65, 133-145, 149-160, 164-167 and 169-192 within Unit 2 of Stonebrook Subdivision. And subject to the following conditions: 1. Substantial conformance with the Petitioner’s Application, Statement of Purpose, Consent and Disclosure and attachments dated January 29, 2015. 2. Substantial conformance with the house plan exhibits prepared by Orleans Homes dated February 3, 2015, for each model proposed as follows: a. Fordham (Two-story) – 2,810 square feet (58’-0”x41’-0”) – containing the Homestead, Manor, Low Country and Craftsman elevation options. JUNE 24, 2015 VOLUME LXXX 284 b. Prescott (Two-story) – 2,927 square feet (50’-0”x41’-8”) – containing the Manor, Low Country and Craftsman elevation options. The Homestead elevation option will not be permitted for construction within Units 1 and 2 of Stonebrook. c.
