COUNCIL-MANAGER FORM OF GOVERNMENT
REGULAR MEETING
The regular meeting of the Council of the City of Elgin, Illinois, was held on February 25, 2015,
in the Council Chambers. The meeting was called to order by Mayor Kaptain at 7:15 p.m. The
Invocation was given by Reverend Tim Perry, the Senior Chaplain for the Elgin Police
Department and the Pledge of Allegiance was led by Jerry Turnquist.
ROLL CALL
Roll call was answered by Councilmembers Dunne, Gavin, Martinez, Powell, Prigge,
Rauschenberger, Shaw, Steffen, and Mayor Kaptain. Absent: None.
MINUTES OF THE FEBRUARY 11, 2015, COUNCIL MEETING APPROVED AS
DISTRIBUTED
Councilmember Shaw made a motion, seconded by Councilmember Steffen, to approve the
February 11, 2015, Council Meeting Minutes as distributed. Upon a roll call vote: Yeas:
Councilmembers Dunne, Gavin, Martinez, Powell, Prigge, Rauschenberger, Shaw, Steffen, and
Mayor Kaptain. Nays: None.
COMMUNICATIONS
Veterans Memorial Park Phase II Proclamation
Mayor Kaptain read the following proclamation:
WHEREAS, In 2008, the city of Elgin dedicated the Elgin Veterans Memorial Park to honor all
veterans who have served during both peacetime and in war; and
WHEREAS, Attendance at the new Memorial has grown dramatically, especially during
holidays such as Memorial Day and Veterans Day; and
WHEREAS, In 2011, the need for river access at the memorial was recognized as vital to honor
those individuals who have been interred at sea and thus have no gravesites upon which to
provide them tributes; and
WHEREAS, To provide a waterfront addition to the current site, the Phase II Veterans Memorial
Committee was formed; and

WHEREAS, This addition not only allows for a more dignified ceremony for those veterans
interred at sea, but stands as a year round tribute in their honor.
NOW, THEREFORE, I, David Kaptain, Mayor of the city of Elgin, do hereby thank the
members of the Phase II Veterans Memorial Committee for their dedication to honoring those
veterans interred at sea and providing the city of Elgin a fitting tribute to all veterans who have
served our country.

RECOGNIZE PERSONS PRESENT
Jim Chevalier, from Princeton West Condominium Association, addressed the council regarding
a neighboring development and its impact on Princeton West. He stated his concerns regarding
a proposed cost sharing agreement with this development and the developer’s lack of
communication.
Jeff Turner stated his support of the project at 166 Symphony Way known as the Haight
Building.

61-14 noting that the Planning and Zoning Commission and staff are recommending approval
subject to conditions.
Councilmember Dunne made a motion, seconded by Councilmember Shaw, to approve Petitions
02-13 and 61-14 subject to conditions. Upon a roll call vote: Yeas: Councilmembers Dunne,

20-14 subject to conditions. Upon a roll call vote: Yeas: Councilmembers Dunne, Gavin,

PETITION 01-15 APPROVED FOR AN APPLICATION BY MARC MYLOTT AS
DEVELOPMENT ADMINISTRATOR FOR VARIOUS AMENDMENTS TO THE TEXT
OF THE ZONING ORDINANCE, TITLE 19 OF THE ELGIN MUNICIPAL CODE, 1976,
AS AMENDED
Marc Mylott, Community Development Director, provided an overview of Petition 01-15 noting
that the Planning and Zoning Commission and staff are recommending approval subject to
conditions. Mr. Mylott outlined the six minor changes to the zoning ordinance that the petition
covered. There was discussion regarding signage at car dealerships, and proposed changes to the
zoning application process.
Councilmember Dunne made a motion, seconded by Councilmember Steffen, to approve Petition
01-15 subject to conditions. Upon a roll call vote: Yeas: Councilmembers Dunne, Gavin,
Martinez, Powell, Prigge, Rauschenberger, Shaw, Steffen, and Mayor Kaptain. Nays: None.
MOTION TO PASS ORDINANCES T1-15 THROUGH T20-15 IN ONE VOTE BLOCK
Councilmember Steffen made a motion, seconded by Councilmember Shaw, to pass ordinances
T1-15 through T20-15 in one vote block. Upon a roll call vote: Yeas: Councilmembers Dunne,

ABATING THE ANNUAL TAX FOR 2014 FOR
GENERAL OBLIGATION CORPORATE PURPOSE BONDS, SERIES 1996A
WHEREAS, the City of Elgin will have sufficient funds on hand to pay the tax levied by
Ordinance S14-96, An Ordinance Providing for the Issuance of $21,640,000 General Obligation
Corporate Purpose Bonds, Series 1996A, of the City of Elgin, Kane and Cook Counties, Illinois,
and Providing for the Levy and Collection of a Direct Annual Tax for the Payment of the
Principal of and Interest on said Bonds; and
WHEREAS, the levy of the tax for the year 2014 provided in the ordinance is
unnecessary.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF ELGIN, ILLINOIS:
Section 1. That the County Clerks of Kane and Cook Counties, are hereby authorized
and directed to abate the tax of $2,436,538 for the year 2014 as provided and levied in the
ordinance providing for the issuance of $21,640,000 General Obligation Corporate Purpose
Bonds, Series 1996A, passed December 4, 1996, a copy of which was filed with each of said
county clerks
Section 2. That the City Clerk is authorized and directed to file a certified copy of this
ordinance with the County Clerks of Kane and Cook Counties, Illinois, on or before March 15,
2015.
Section 3. That this ordinance shall be in full force and effect from and after its
passage in the manner provided by law.

Principal of and Interest on said Bonds; and
WHEREAS, the levy of the tax for the year 2014 provided in the ordinance is
unnecessary.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF ELGIN, ILLINOIS:
Section 1. That the County Clerks of Kane and Cook Counties, are hereby authorized
and directed to abate the tax of $422,900 for the year 2014 as provided and levied in the
ordinance providing for the issuance of $4,860,000 General Obligation Corporate Purpose
Bonds, Series 1997A, passed May 14, 1997, a copy of which was filed with each of said county
clerks.
Section 2. That the City Clerk is authorized and directed to file a certified copy of this

and Interest on said Bonds; and
WHEREAS, the levy of the tax for the year 2014 provided in the ordinance is
unnecessary.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF ELGIN, ILLINOIS:

WHEREAS, the City of Elgin will have sufficient funds on hand to pay a portion of the
tax levied by Ordinance S4-08, An Ordinance Providing for the Issuance of $14,825,000 General
Obligation Corporate Purpose Bonds, Series 2008A, of the City of Elgin, Kane and Cook
Counties, Illinois, and Providing for the Levy and Collection of a Direct Annual Tax for the
Payment of the Principal of and Interest on said Bonds; and
WHEREAS, the levy of the tax for the year 2014 provided in the ordinance is
unnecessary.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF ELGIN, ILLINOIS:
Section 1. That the County Clerks of Kane and Cook Counties, are hereby authorized
and directed to abate a portion of the tax of $1,244,500 for the year 2014 as provided and levied
in the ordinance providing for the issuance of $14,825,000 General Obligation Corporate
Purpose Bonds, Series 2008A, passed April 23, 2008, a copy of which was filed with each of
said county clerks, said tax shall be abated by reducing said sum $762,040 and extending a tax
for the year 2014 in the amount of $482,460 against all taxable property situated in the City of
Elgin, Kane and Cook Counties, Illinois.
Section 2. That the City Clerk is authorized and directed to file a certified copy of this
ordinance with the County Clerks of Kane and Cook Counties, Illinois, prior to March 15, 2015.
Section 3. That this ordinance shall be in full force and effect from and after its
passage in the manner provided by law.

WHEREAS, the levy of the tax for the year 2014 provided in the ordinance is
unnecessary.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF ELGIN, ILLINOIS:
Section 1. That the County Clerks of Kane and Cook Counties are hereby authorized
and directed to abate the tax of $348,400 for the year 2014 as provided and levied in the
ordinance providing for the issuance of $8,150,000 General Obligation Refunding Bonds, Series
2008B, passed April 23, 2008, a copy of which was filed with each of said county clerks.
Section 2. That the City Clerk is authorized and directed to file a certified copy of this

AN ORDINANCE
REGARDING ABATING A PORTION OF THE ANNUAL TAX FOR 2014 FOR
REFUNDING AND CORPORATE PURPOSE BONDS
WHEREAS, the City Council has adopted Ordinance Numbers T7-15, T9-15, T11-15,
T13-15, T17-15 and T18-15 providing for abating a portion of the annual tax for 2014 for
refunding and corporate purpose bonds for the series bonds referred to in such ordinances; and
WHEREAS, depending upon the 2014 assessed valuation figures, prior year adjustment
and the state multiplier it may be necessary to further adjust the amounts of the abatement and
resulting tax levy in Section 1 of such ordinances in order to arrive at a 2014 tax levy for the City
of Elgin not to exceed $42,959,380.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF ELGIN, ILLINOIS:
Section 1. That the city’s Chief Finance Officer be and is hereby authorized and
directed that upon receipt of 2014 assessed valuation figures, prior year adjustment and the state
multiplier to adjust, to the extent reasonably practicable, the amount of the abatement and
resulting tax levy in the Section 1 of Ordinance Numbers T7-15, T9-15, T11-15, T13-15, T17-15
and T18-15 so as to attempt to arrive at a 2014 tax levy for the City of Elgin not to exceed
$42,959,380. The city’s Chief Financial Officer shall make such adjustments, if any, prior to the
filing of a certified copy of Ordinance Numbers T7-15, T9-15, T11-15, T13-15, T17-15 and T18-
15 with the County Clerks of Kane and Cook Counties, Illinois, whereupon the amount of the
abatement and tax levy in Section 1 of Ordinance Numbers T7-15, T9-15, T11-15, T13-15, T17-

WHEREAS, the City of Elgin Special Service Area Number Two has been created by an
ordinance entitled "An Ordinance Establishing Special Service Area Number Two in the City of
Elgin" passed and effective September 7, 1977, and that the corporate authorities of the City of
Elgin, acting as the governing board of the City of Elgin Special Service Area Number Two are
authorized to levy taxes for special services in special service area; and
WHEREAS, Ordinance No. T27-14 passed and effective on December 17, 2014 provided
for a levy of taxes on all taxable property within the City of Elgin Special Service Area Number
Two for the year 2014 the sum total of $124,000; and
WHEREAS, the City of Elgin will have sufficient funds on hand to pay for special
services in said special service area and the levy of the tax for the year 2014 provided in
Ordinance T27-14 is unnecessary.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF ELGIN, ILLINOIS:
Section 1. That the County Clerk of Kane County is hereby authorized and directed to
abate the tax of $124,000 for the year of 2014 as provided and levied in Ordinance T27-14 an
ordinance providing for the levy and assessment of taxes for the fiscal year ending December 31,
2014 in and for the City of Elgin Special Service Area Number Two, passed December 17, 2014,
a copy of which was filed with said county clerk.
