COUNCIL OF THE CITY OF ELGIN, ILLINOIS COUNCIL-MANAGER FORM OF GOVERNMENT REGULAR MEETING
The regular meeting of the Council of the City of Elgin, Illinois, was held on November 5, 2014,
in the Council Chambers. The meeting was called to order by Mayor Kaptain at 7:05 p.m. The
Invocation was given by Pastor Larry Henderson from the Kingdom Advancement Center and
the Pledge of Allegiance was led by Councilmember Rich Dunne.
ROLL CALL
Roll call was answered by Councilmembers Dunne, Gavin, Martinez, Powell, Prigge,
Rauschenberger, Shaw, Steffen, and Mayor Kaptain. Absent: None.
MINUTES OF THE OCTOBER 22, 2014, COUNCIL MEETING APPROVED AS
DISTRIBUTED
Councilmember Dunne made a motion, seconded by Councilmember Martinez, to approve the
October 22, 2014, Council Meeting Minutes as distributed. Upon a roll call vote: Yeas:
Councilmembers Dunne, Gavin, Martinez, Powell, Prigge, Rauschenberger, Shaw, Steffen, and
Mayor Kaptain. Nays: None.
RECOGNIZE PERSONS PRESENT
Deidre White noted recent events in which the Downtown Neighborhood Association (DNA)
was recognized for their efforts in promoting Elgin. She also mentioned developments in
adding the Central Business District to the National Registry of Historic Sites.
Terry Gabel provided the city council with a report on the Lord’s Park Farm. He highlighted
attendance numbers and volunteers’ hours at the Farm. Councilmember Prigge thanked him for
the detailed information.
Martin Dwyer commented on Ordinance G13-13 which requires certain contractors to hire
residents from Elgin. He felt that this ordinance has had a positive influence on the community.
Chuck Keysor commented on the upcoming municipal elections, mayoral candidates and the
filing period in November.
Tony Sanders, from School District U-46, noted the school board budget process and when there
would be a final vote on their proposed tax levy.

ORDINANCE G61-14 PASSED AMENDING CHAPTER 6.06 OF THE ELGIN

DEALERS” TO CREATE A NEW CLASS E-4 RESTAURANT LICENSE
Councilmember Gavin made a motion, seconded by Councilmember Powell, to pass the
following ordinance. Upon a roll call vote: Yeas: Councilmembers Dunne, Gavin, Martinez,
Powell, Prigge, Rauschenberger, Shaw, and Mayor Kaptain. Nays: None. Councilmember
Steffen abstained.

AN ORDINANCE
AMENDING CHAPTER 6.06 OF THE ELGIN MUNICIPAL CODE, 1976,
AS AMENDED, ENTITLED “ALCOHOLIC LIQUOR DEALERS” TO
CREATE A NEW CLASS E-4 RESTAURANT LICENSE
WHEREAS, the City of Elgin is a home rule unit and as a home rule unit may exercise
any power and perform any function pertaining to its government and affairs; and
WHEREAS, the regulation of alcoholic liquor dealers pertains to the government and
affairs of the city; and
WHEREAS, the City Council of the City of Elgin has determined it is appropriate to
create a new and additional class of liquor license for restaurants.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF ELGIN, ILLINOIS:
Section 1. That Section 6.06.040 of the Elgin Municipal Code, 1976, as amended, entitled
“License Classes; Fees:” be and is hereby further amended by amending subparagraph H thereof
by adding a subparagraph 4 for a new Class E-4 license to read as follows:
“4. Class E-4: For the retail sale in restaurants, as defined in article I, paragraph 2.23 of
the Illinois liquor control law, of alcoholic liquor for consumption on the premises and
which further authorizes the sale of wine in its original sealed package or container for
consumption off the premises; expressly providing, however, that such license shall be
issued to only to establishments having a regular capacity, in accordance with existing
city and state public health and fire prevention ordinances and statutes, to serve meals to
not less than forty-five (45) persons at any one time, and that fifty percent (50%) or more
of the gross revenue in any month from the operation of the licensed premises must be
from the servicing of meals. For the purposes of this subsection, “gross revenue” shall be
defined as the total amount of cash or other consideration, including all taxes collected by
the seller, received by the licensee as a result of the transfer of goods, or the provision of
services to another. The licensee shall maintain adequate books and records in
accordance with generally accepted accounting standards that shall clearly indicate gross
revenue from the sale of alcoholic liquor separately from the gross revenue from the

serving of meals. The licensee shall make such books and records available for
inspection by the local liquor control commission or its designee. Such inspection may
be conducted during normal business hours on the licensed premises or at such other
location in the city as directed by the local liquor control commission. The local liquor
control commission shall determine, as a result of such inspection, whether, in the local
liquor control commission’s opinion, the books and records maintained by the licensee
meet the requirements of this subsection H4 and whether there is cause for the local
liquor control commission to revoke or suspend the license, impose a fine on the licensee,
or impose a fine in addition to revoking and suspending the license in accordance with
the provisions of this title. The license fee per year is six hundred sixty dollars
($660.00).”
Section 2. That Section 6.06.050 of the Elgin Municipal Code, 1976, as amended,
entitled “Licenses; Number to be Issued:” be and is hereby further amended by adding a new
subparagraph Q thereto to read: “The number of Class E-4 licenses shall not exceed one (1) in
number”, and by re-lettering the remaining subparagraphs accordingly.
Section 3. That Section 6.06.115 of the Elgin Municipal Code, 1976, as amended,
entitled “Basset Training Requirements” be and is hereby further amended by amending the
listing of license classifications in subparagraph A thereof by adding a reference to the Class E-4
license.
Section 4. That Section 6.06.117 of the Elgin Municipal Code, 1976, as amended,
entitled “Service Hours” be and is hereby further amended by amending the listing of license
classes in subparagraph A thereof by adding thereto the additional license classification of E-4.
Section 5. That all ordinances or parts of ordinances in conflict with the provisions of
this ordinance be and are hereby repealed the extent of any such conflict.
Section 6. That this ordinance shall be in full force and effect upon its passage in the
manner provided by law.

that it hereby ratifies and approves the execution of a settlement agreement with Arch Insurance
Company by Sean R. Stegall, City Manager, and Kimberly A. Dewis, City Clerk, regarding
Waterford Subdivision performance bonds, a copy of which is attached hereto and made a part
hereof by reference.

AN ORDINANCE
ESTABLISHING A PAY PLAN FOR THE
LOCAL 73, SEIU CLERICAL AND TECHNICAL EMPLOYEE
GROUP OF THE CITY OF ELGIN
WHEREAS, the City Council of the City of Elgin has heretofore ratified and approved a
negotiated settlement reached by the City of Elgin and the Local 73, SEIU Clerical and
Technical Employee Group; and

WHEREAS, such negotiated settlement includes wages for 2014 and it is therefore
necessary to implement a new salary plan for such clerical and technical employee group.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF ELGIN, ILLINOIS:
Section 1. That effective January 1, 2014 there is hereby established the following
schedule of standard hourly, annual and monthly salary ranges for the Local 73, SEIU Clerical
and Technical Employee Group.

and directed to execute an Economic Incentive Agreement with Hansen Plastics Corporation on
behalf of the City of Elgin for economic development assistance in connection with the
development of 2750 Alft Lane, a copy of which is attached hereto and made a part hereof by
reference.
