The meeting was called to order by Mayor Kaptain at 7:15 p.m. The Invocation was given by Pastor Scott Neubauer from the Church in the Word and the Pledge of Allegiance was led by Cherie Murphy. ROLL CALL Roll call was answered by Councilmembers Dunne, Gavin, Powell, Prigge, Rauschenberger, Shaw, Steffen, and Mayor Kaptain. Absent: None. MINUTES OF THE APRIL 23, 2014, COUNCIL MEETING APPROVED AS DISTRIBUTED Councilmember Shaw made a motion, seconded by Councilmember Steffen, to approve the April 23, 2014, Council Meeting Minutes as distributed. Upon a roll call vote: Yeas: Councilmembers Dunne, Gavin, Powell, Prigge, Rauschenberger, Shaw, Steffen, and Mayor Kaptain. Nays: None. COMMUNICATIONS Cherie Murphy Retirement Proclamation Mayor Kaptain read the following proclamation: PROCLAMATION WHEREAS, Cherie Murphy was originally hired as a neighborhood liaison on a part time basis on October 30, 2000, was promoted to full time neighborhood liaison on October 26, 2001 and reclassified to Economic Development Coordinator on April 4, 2004; and WHEREAS, Ms. Murphy was promoted to Assistant to the City Manager for Community Engagement on May 9, 2010, which included overseeing the city’s special events and Hemmens Cultural Center; and MAY 14, 2014 VOLUME LXXIX 186 WHEREAS, during Ms. Murphy’s years with the city, she has worked tirelessly with numerous commissions and committees such as the Budget Task Force, Strategic Plan Advisory Commission, Cultural Arts Commission, the Veterans Memorial Park Committee, Advisory Committee for the Sustainability Master Plan and the Lord’s Park Advisory Task Force, as well as being instrumental in establishing the city’s Elgin Community Network, Enhancing Elgin, the Volunteer Coordinators Network and most notably to the opening of the Elgin Artspace Lofts; and WHEREAS, Ms. Murphy has worked closely with local not-for-profits, social services, the business community and arts organizations in the promotion of community projects and initiatives; and WHEREAS, Ms. Murphy has been a faithful and diligent public servant for more than 14 years and announced her retirement for May 16, 2014. NOW, THEREFORE, I, David Kaptain, Mayor of the City of Elgin, Illinois do hereby extend the sincere and warm appreciation and esteem of the City of Elgin to Cherie Murphy for her outstanding service to the community on the occasion of her retirement. Kaptain Mayor Elgin Police Officers Memorial Day Proclamation Mayor Kaptain read the following proclamation: PROCLAMATION WHEREAS, May 15 has been designated as National Peace Officer’s Memorial Day; and WHEREAS, the members of the Elgin Police Department play an essential role in safeguarding the rights and freedoms of Elgin; and WHEREAS, it is important that all citizens know and understand the duties of their law enforcement agency, and that members of our law enforcement agency recognize their duty to serve the people; and WHEREAS, the men and women of the Elgin Police Department unceasingly provide a vital public service. Kaptain Mayor National Public Works Week Proclamation Mayor Kaptain read the following proclamation: PROCLAMATION WHEREAS, public works services provided in our community are an integral part of our citizens’ everyday lives; and WHEREAS, the support of an understanding and informed citizenry is vital to the efficient operation of public works systems and programs; and WHEREAS, the health, safety and comfort of this community greatly depends on these facilities and services; and WHEREAS, the quality and effectiveness of these facilities, as well as their planning, design and construction, is vitally dependent upon the efforts and skill of public works officials. NOW, THEREFORE, I, David Kaptain, Mayor of the city of Elgin, Illinois do hereby proclaim the week of May 18 to May 24, 2014 as National Public Works Week in the city of Elgin. Kaptain Mayor Poppy Days Proclamation Mayor Kaptain read the following proclamation: PROCLAMATION WHEREAS, America is the land of the free, preserved and protected willingly and freely by citizen soldiers; and MAY 14, 2014 VOLUME LXXIX 188 WHEREAS, a Nation must be reminded of the price of war and the debt owed to the millions who have died in war; and WHEREAS, the red poppy has been designated as a symbol of the sacrifice of lives in all wars; and WHEREAS, the American Legion and its Auxiliaries, the Veterans of Foreign Wars and its Auxiliaries and the AMVETS have pledged to remind America annually of this debt through the distribution of the poppy as the memorial flower. NOW, THEREFORE, I David Kaptain, Mayor of the city of Elgin, Illinois, do hereby proclaim May 15, 16 and 17, 2014 as POPPY DAYS in Elgin and ask all citizens to pay tribute to those who have made the ultimate sacrifice in the name of freedom, by making a donation to and wearing the memorial poppy during these days. Kaptain Mayor National Bike Month Proclamation Mayor Kaptain read the following proclamation: PROCLAMATION WHEREAS, for more than a century the bicycle has been an effective means of personal transportation, recreation and fitness; and WHEREAS, the city of Elgin encourages the increased use of the bicycle, benefiting all citizens of Elgin by improving air quality, reducing traffic congestion and noise, decreasing the use of and dependence upon finite energy sources, and fostering exercise; and WHEREAS, the Bicycle and Pedestrian Advisory Committee encourage all citizens to ride their bicycles to promote the personal and societal benefits achieved from bicycling. NOW, THEREFORE, I, David Kaptain, Mayor of the city of Elgin, Illinois, do hereby proclaim the month of May 2014, as “National Bike Month” in the city of Elgin, Illinois and invite all citizens to join in its observance. Kaptain Mayor VOLUME LXXIX MAY 14, 2014 189 RECOGNIZE PERSONS PRESENT Tim Buelow, representative of the Princeton West Home Owners Association, asked for the City’s support in obtaining a cautionary agreement from a developer that is utilizing their private streets in order to access their construction site. Chuck Keysor announced a free candidate information session being held at 7:00 p.m. on May 29th at the Elgin Township Building. Topics to be discussed were the legal requirements to run for office and aspects of running a campaign. The event is being sponsored by the Elgin Octave. Todd Martin stated the reasons he supported the city leasing the Fox River Country Day School property to the proposed charter school. Betsy Couture commented on a Mayor’s awards that were held at the Elgin Art Showcase. She felt it is a great space and should stay open. Rachel Maley announced that the Elgin Youth Symphony Orchestra would be hosting the Iraq Youth Symphony Orchestra this summer. Mike Curtin provided an update on sewer issues and flooding. He related his experiences with 311 and Public Works. He mentioned special insurance so homeowners are covered for sewer back up claims. BID 14-006 AWARDED TO LANDMARK CONTRACTORS FOR LOCUST STREET REHABILITATION PROJECT There was discussion regarding tunneling versus boring and coordinating with the agencies and the residents that will be impacted by the project. Councilmember Shaw made a motion, seconded by Councilmember Gavin, to award a contract to Landmark Contractors in the amount of $4,054,433.00 for the Locust Street Rehabilitation Project. Upon a roll call vote: Yeas: Councilmembers Dunne, Gavin, Powell, Prigge, Rauschenberger, Shaw, Steffen, and Mayor Kaptain. Nays: None. BID 14-008 AWARDED TO MAINTENANCE COATINGS, INC. FOR PAVEMENT MARKINGS Councilmember Steffen made a motion, seconded by Councilmember Shaw, to award a contract to Maintenance Coatings, Inc. in the amount of $331,290.00 for pavement markings. Upon a roll call vote: Yeas: Councilmembers Dunne, Gavin, Powell, Prigge, Rauschenberger, Shaw, Steffen, and Mayor Kaptain. Nays: None. MAY 14, 2014 VOLUME LXXIX 190 BID 14-020 AWARDED TO LANGOS CORP. FOR DEMOLITION OF VACANT BUILDINGS Councilmember Dunne made a motion, seconded by Councilmember Steffen, to approve an agreement with Langos Corp. in the amount of $75,000.00 for the demolition of various vacant buildings within the city. Upon a roll call vote: Yeas: Councilmembers Dunne, Gavin, Powell, Prigge, Rauschenberger, Shaw, Steffen, and Mayor Kaptain. Nays: None. MIDWESTERN HIGHER EDUCATION COMPACT CONTRACT APPROVED TO PURCHASE AN EQUALLOGIC STORAGE SYSTEM FROM DELL Councilmember Dunne made a motion, seconded by Councilmember Powell, to award a contract to Dell in the amount of $42,626.00 for the purchase of an EqualLogic Storage System. Upon a roll call vote: Yeas: Councilmembers Dunne, Gavin, Powell, Prigge, Rauschenberger, Shaw, Steffen, and Mayor Kaptain. Nays: None. PETITION 15-14 APPROVED TO AMEND THE PROVISIONS OF CHAPTER 19.82 PROVIDING FOR PUBLIC HEARING NOTIFICATION SIGNS (PET. 15-14) Marc Mylott, Community Development Director, provided an overview of Petition 15-14 which changed the look of the required public hearing signs. Councilmember Shaw made a motion, seconded by Councilmember Steffen, to approve Petition 15-14 subject to conditions. AS CUSTODIAN OF THE BOARD OF TRUSTEES OF THE CITY OF ELGIN RETIREE HEALTH INSURANCE TRUST Councilmember Gavin made a motion, seconded by Councilmember Dunne, to adopt the following resolution. AS CUSTODIAN OF THE CITY OF ELGIN RETIREE HEALTH INSURANCE TRUST BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS, that it hereby authorizes the Board of Trustees of the City of Elgin Retiree Health Insurance VOLUME LXXIX MAY 14, 2014 191 Trust to appoint Wells Fargo Bank, N.A. as custodian of the City of Elgin Retiree Health Insurance Trust, effective May 15, 2014. s/ David J. FOR INSPECTION AND EVALUATION SERVICES IN CONNECTION WITH THE 2014-2017 BRIDGE INSPECTION PROGRAM BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS, that pursuant to Elgin Municipal Code Section 5.02.020B(9) the City Council hereby finds that an exception to the requirements of the procurement ordinance is necessary and in the best interest of the city; and MAY 14, 2014 VOLUME LXXIX 192 BE IT FURTHER RESOLVED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS, that Sean R. Stegall, City Manager, and Kimberly A. Dewis, City Clerk, be and are hereby authorized and directed to execute an agreement on behalf of the City of Elgin with HR Green, Inc. for inspection and evaluation services in connection with the 2014-2017 Bridge Inspection Program, a copy of which is attached hereto and made a part hereof by reference. s/ David J. Ordinance No. G27-14 AN ORDINANCE AMENDING CHAPTER 11.62 OF THE ELGIN MUNICIPAL CODE, 1976, AS AMENDED, ENTITLED “ADMINISTRATIVE ADJUDICATION” BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS: Section 1: That Section 11.62.110 of the Elgin Municipal Code, 1976, as amended, entitled “Schedule of Fines and Penalties” be and is hereby further amended by amending Paragraph D thereof to read as follows: “D. Notwithstanding the provisions of subsection A of this section, a violation of section 11.60.066 of this title, as amended, shall be an offense punishable by a fine in the amount of twenty-five dollars ($25.00), and a violation of section 11.60.090 of this title, as amended, shall be an offense punishable by a fine in the amount of fifty dollars ($50.00). The owner of a vehicle impounded in connection with the violation of either section 11.60.066 or 11.60.090 of this title, as amended, shall also be liable for fees for the respective towing and storage of the vehicle as provided in section 11.60.066 or 11.60.090 of this title." Section 2. That all ordinances or parts of ordinances in conflict with the provisions of this ordinance be and are hereby repealed to the extent of any such conflict. Section 3.
