COUNCIL-MANAGER FORM OF GOVERNMENT
REGULAR MEETING
The regular meeting of the Council of the City of Elgin, Illinois, was held on February 26, 2014,
in the Council Chambers. The meeting was called to order by Mayor Kaptain at 7:35 p.m. The
Invocation was given by Mark Weinert and the Pledge of Allegiance was led by Councilmember
F. John Steffen.
ROLL CALL
Roll call was answered by Councilmembers Gavin, Moeller, Powell, Prigge, Rauschenberger,
Shaw, Steffen, and Mayor Kaptain. Absent: Councilmember Dunne.
MINUTES OF THE FEBRUARY 12, 2014, COUNCIL MEETING APPROVED AS
DISTRIBUTED
Councilmember Gavin made a motion, seconded by Councilmember Moeller, to approve the
February 12, 2014, Council Meeting Minutes as distributed. Upon a roll call vote: Yeas:
Councilmembers Gavin, Moeller, Powell, Prigge, Rauschenberger, Shaw, Steffen, and Mayor
Kaptain. Nays: None.
COMMUNICATIONS
Mayor Kaptain read the following proclamation:
PROCLAMATION
WHEREAS, Delta Sigma Theta Sorority, Inc. was founded by 22 college women in 1913
on the campus of Howard University. Today the Sorority has over 200,000 members in the
United States and abroad, dedicated to public service with a primary focus on the Black
community; and
WHEREAS, the Schaumburg-Hoffman Estate Alumnae Chapter was chartered on March
2, 1991, and currently has over 60 active members. Since 1991, members have used their talents,
time and resources to undertake efforts to promote literacy, diabetes awareness, aid domestic
violence survivors, tutor area youth, award high school seniors scholarships and to support
international programs in Haiti and Liberia; and

WHEREAS, the Schaumburg-Hoffman Estate Alumnae Chapter has made a conscious
effort to specifically target programs that have benefited the City of Elgin including hosting a
Prayer Breakfast at ECC and a Bowl-A-Thon benefiting the Crisis Center, hosting a Christmas
Party for the clients at the Crisis Center; sponsoring youth enrichment programs and scholarships
benefiting students from Elgin and participating in the Dr. Martin Luther King Jr. events; and
WHEREAS, this year, the Chapter will concentrate its efforts on Domestic Violence,
resulting in donations and awareness being brought to the Crisis Center and the City of Elgin.
NOW, THEREFORE, I, David Kaptain, Mayor of the City of Elgin, Illinois, do hereby
honor the Schaumburg-Hoffman Estate Alumnae Chapter of the Delta Sigma Theta Sorority for
their work dedicated to public service benefiting the Elgin community.

RECOGNIZE PERSONS PRESENT
Guillermo Trujillo, of the Aurora Police Department, stated that he was at the meeting to pay a
debt to Chief Swoboda and Commander Lalley for participating, and winning, the Top Cop
boxing event last fall. He also noted that four of Elgin's youth will be provided with tuition
scholarships (two for $1,000 and two for $500) from the National Latino Peace Officers
Association, Aurora Chapter.
Rick Poulton asked for voters support in the upcoming primary for the Show You Care Kane
referendum to support adults with developmental disabilities.
Chris Van Heck addressed the council on various topics including the budget, Elgin Symphony
Orchestra, volunteer program ideas and the improvements in the downtown area.
John Jurgensmeyer acknowledged the recent settlement between the city and TLC.
Lynn O’Shea asked for voters support in the upcoming primary for the Show You Care Kane
referendum to support adults with developmental disabilities. She noted that there was currently
a waiting list for residents who need these types of services.
Ron Benzschevel asked for voters support in the upcoming primary for the Show You Care Kane
referendum to support adults with developmental disabilities. He related a personal story about
how this referendum would impact his life.

PETITION 44-13 APPROVED REQUESTING AN AMENDMENT TO THE PLANNED
DEVELOPMENT ORDINANCE TO PROVIDE FOR ADDITIONAL GRAPHICS (1600
N RANDALL ROAD)
Marc Mylott, Community Development Director, provided an overview of the petition noting
that staff and the Planning and Zoning Commission are recommending approval subject to the
conditions outlined.
Councilmember Moeller made a motion, seconded by Councilmember Steffen, to approve
Petition 44-13 subject to conditions. Upon a roll call vote: Yeas: Councilmembers Gavin,
Moeller, Powell, Prigge, Rauschenberger, Shaw, Steffen, and Mayor Kaptain. Nays: None.
PETITION 01-14 APPROVED REQUESTING CONDITIONAL USE APPROVAL TO
ESTABLISH ACCESSORY PACKAGE LIQUOR SALES (20 TYLER CREEK PLAZA)
Marc Mylott, Community Development Director, provided an overview of the petition noting
that staff and the Planning and Zoning Commission are recommending approval subject to the
conditions outlined.
Councilmember Powell made a motion, seconded by Councilmember Steffen, to approve

PETITION 03-14 APPROVED REQUESTING AN AMENDMENT OF TITLE 19,

Corporation Counsel Cogley provided the background on the amendment and highlighted the
proposed changes to the municipal code.
Councilmember Moeller made a motion, seconded by Councilmember Shaw, to approve Petition
03-14 subject to conditions. Upon a roll call vote: Yeas: Councilmembers Gavin, Moeller,
Powell, Prigge, Rauschenberger, Shaw, Steffen, and Mayor Kaptain. Nays: None.

AN ORDINANCE AMENDING TITLE 19
OF THE ELGIN MUNICIPAL CODE, 1976, AS AMENDED,
ENTITLED “ZONING”
WHEREAS, written application has been made to amend the Elgin Zoning Ordinance
regarding the manner in which temporary uses are regulated; and
WHEREAS, the Planning and Zoning Commission has held a public hearing concerning
the proposed amendments after due notice in manner provided by law.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF ELGIN, ILLINOIS:
Section 1. That Section 19.90.015 of the Elgin Municipal Code, 1976, as amended,
entitled “Definitions and Regulations” be and is hereby further amended by amending the
definition of “Use, Temporary” and by adding a definition for “Use, Intermittent Temporary
Vehicle” to read as follows:
"USE, TEMPORARY: A "land use" [SR] which is established for a fixed period
of time with the intent to discontinue such use on the expiration of the time
period. A temporary use shall be subject to the following supplementary
regulations:
A. Land Uses Allowed: A temporary use shall be limited to those
permitted uses and accessory uses allowed in the zoning district in
which the temporary use is to be located, unless specifically
authorized otherwise.
B. Number And Duration: No more than four (4) temporary uses shall
be conducted on the same “zoning lot” [SR] within a calendar year.
No single temporary use shall be established or operate for more
than thirty (30) consecutive days, and the total number of days for
all temporary uses established or operating on the same “zoning
lot” [SR] within a calendar year shall not exceed sixty (60) days.
More than one (1) temporary use may be established or operate on
the same zoning lot at the same time; however, for each temporary
use, one (1) day of establishment or operation of each temporary
use is counted against the maximum number of sixty (60) days
allowed in a calendar year for all temporary uses on such lot.
Except as provided for an “intermittent temporary use” [SR], or for
an “intermittent temporary vehicle use” [SR], the days a temporary
use permit shall authorize a temporary use to operate or otherwise
be open or available to the general public shall be for a prescribed

number of consecutive days. Each such time period shall
constitute one (1) of the four (4) allowable temporary uses within a
calendar year.
C. Setbacks: A temporary use shall maintain a minimum fifteen foot
(15') setback from all "street lot lines" [SR] and a minimum ten
foot (10') setback from all "interior lot lines" [SR]. Temporary uses
shall maintain a minimum one hundred foot (100') setback from all
interior lot lines which adjoin any residence conservation district
or residence district, where such temporary use is not located
within such zoning districts.
D. Operation: Temporary uses may be operated outdoors. No
temporary use shall be operated in such a manner as to cause a
public nuisance including, but not limited to, stormwater runoff
onto adjoining property, soil erosion, unsafe vehicular access or on
site vehicular circulation, or any other activity that jeopardizes the
public health, safety or welfare.
E. Permit Required: No temporary use shall be established or operate
before the person or entity seeking to operate the temporary use
has received a Temporary Use Permit therefor. Such permit shall
state the absolute start and end dates of the temporary use and the
days of operation between said dates. The owner or occupant of
the principal use of the zoning lot on which the temporary use is
proposed to be located, as well as the person seeking to operate the
temporary use, shall be required to complete the application for
any temporary use permit.
F. Other Codes And Ordinances: A temporary use shall comply with
all other codes and ordinances, except the provisions for the
required number of parking spaces. “Intermittent temporary uses”
[SR] and “intermittent temporary vehicle uses” [SR] are further
and distinctly defined within this section 19.90.015 and subject to
the supplemental regulations associated therewith.
USE, INTERMITTENT TEMPORARY VEHICLE: A “temporary use” [SR]
which is conducted by a non-for-profit corporation or association at which
services are provided entirely within an enclosed motor vehicle no more than one
(1) day per week, nor more than eight (8) hours during any day, and no more than
fifty-two (52) days on the same “zoning lot” [SR] within a calendar year. An
intermittent temporary vehicle use shall not be established to provide a mobile
home dwelling [SR] or a dwelling [SR] of any type. An intermittent temporary
vehicle use shall be limited to the providing of services only and shall not include
the sale of any merchandise, goods, supplies, equipment or materials. An

intermittent temporary vehicle use is subject to the “temporary use” [SR]
supplementary regulations, except:
A. Such use shall only be located within a lawfully established off
street parking facility [SR] in a manner that does not interfere with
(i) ingress or egress to such off street parking facility or (ii) access
lanes within such off street parking facility unless use of such
access lanes is reasonably necessary to accommodate the requested
intermittent temporary vehicle use and where public safety
concerns are not materially compromised by the use of such access
lanes as depicted in a site plan approved by the city as part of a
temporary use permit; and
B. No intermittent temporary vehicle use shall be established or
operated on property located in a residence conservation zoning
district or a residence zoning district, except for properties with off
street parking facilities to serve a multi-unit residential building
with at least 150 dwelling units; and
C. The entire approved fixed period of time during which the
intermittent temporary vehicle use is established or operates during
a calendar year constitutes one single “temporary use” [SR] as
envisioned and limited by the supplementary regulations for
“temporary use” [SR]; and
D. No more than one (1) intermittent temporary vehicle use is allowed
per “zoning lot” [SR] within a calendar year.
E. Any permit fees otherwise required for a “temporary use” [SR]
shall not be required for an intermittent temporary vehicle use so
long as proof of the not-for-profit status of the corporation or
association conducting the intermittent temporary vehicle use is
filed with the city.”
Section 2. That all ordinances or parts of ordinances in conflict with the provisions of
this ordinance be and hereby repealed to the extent of any such conflict.
Section 3. That this ordinance shall be in full force and effect upon its passage and
publication in the manner provided by law.

APPROVING CULTURAL ARTS COMMISSION GRANT RECIPIENTS
WHEREAS, the Cultural Arts Commission Grant Program has been established to
provide financial assistance for arts programming; and
WHEREAS, in 2014 applications have been made for fourteen projects under the
Cultural Arts Commission Grant Program; and
WHEREAS, said applications have been reviewed and recipients selected by the City
Council.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF ELGIN, ILLINOIS, that grant assistance be provided under the Cultural Arts Commission

AGREEMENT WITH THE FOX RIVER STUDY GROUP FOR CONTINUED SUPPORT
OF THE FOX RIVER WATERSHED PROJECT
Kyla Jacobsen, Water Director, provided background on the Fox River Study group. She noted
that no other group is doing this work and they are an important source to monitor and maintain
the river. There was discussion regarding discharge permits, regulatory impacts, spill plans, long
term planning, and drinking water.

FOX RIVER STUDY GROUP FOR CONTINUED SUPPORT OF THE
FOX RIVER WATERSHED PROJECT
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS,
that Sean R. Stegall, City Manager, and Kimberly A. Dewis, City Clerk, be and are hereby
authorized and directed to execute a grant agreement with the Fox River Study Group for
continued support of the Fox River Watershed Project, a copy of which is attached hereto and
made a part hereof by reference.

Section 1. That Section 6.06.050 of the Elgin Municipal Code, 1976, as amended,
entitled "Licenses; Number to be Issued:" be and is hereby further amended by amending
subparagraphs E and I thereof to read as follows:
"E. The number of class B-1 licenses shall not exceed nine (9) in number.
I. The number of class B-5 licenses shall not exceed six (6) in number."
Section 2. That all ordinances or parts of ordinances in conflict with the provisions of
this ordinance are hereby repealed to the extent of any such conflict.
Section 3. That this ordinance shall be in full force upon its passage and publication
in the manner provided by law.

ACCEPTING FOR OWNERSHIP AND MAINTENANCE THE PUBLIC
IMPROVEMENTS WITHIN THE CAPITAL CORPORATE CENTER SUBDIVISION
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS,
that the City of Elgin hereby accepts for ownership and maintenance the following public
improvements within the Capital Corporate Center Subdivision: sanitary sewer, water main,
storm sewer, street (including pavement, curb and gutter), sidewalks, street lights, signs, parkway
trees which will add approximately 510 lineal feet of 8-inch water main; 3,342 lineal feet of 12-
inch water main; 9 12-inch valves in 5-foot vaults; 11 fire hydrants; 2,611 lineal feet of 10-inch
sanitary sewer; 15 sanitary manholes; 1,108 lineal feet of 12-inch storm sewer; 979 lineal feet of
15-inch storm sewer; 258 lineal feet of 18-inch storm sewer; 94 lineal feet of 24-inch storm
sewer; 82 lineal feet of 30-inch storm sewer; 681 lineal feet of 42-inch storm sewer; 24 catch
basins; 29 storm manholes; 6 flared end sections; 4,000 square foot detention basin with 460
square feet of block retaining wall and 93 lineal feet of guard rail; 18 street signs; 13 street lights,
80 parkway trees and 2,970 lineal feet of improved street (including pavement, curb and gutter,
parkway and sidewalk) and all their respective appurtenances to the city maintained facilities.

BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS,
that pursuant to Elgin Municipal Code Section 5.02.020B(9) the City Council hereby finds that
an exception to the requirements of the procurement ordinance is necessary and in the best
interest of the city; and
BE IT FURTHER RESOLVED BY THE CITY COUNCIL OF THE CITY OF ELGIN,
ILLINOIS, that Sean R. Stegall, City Manager, and Kimberly A. Dewis, City Clerk, be and are
hereby authorized and directed to execute a service agreement on behalf of the City of Elgin with
the Dixon Dance Academy, Inc. to provide dance instruction at The Centre for the year 2014, a
copy of which is attached hereto and made a part hereof by reference.

WHEREAS, the territory herein described has previously been annexed to the City of
Elgin and originally classified in the PSFR2 Planned Single Family Residence District pursuant
to Ordinance No. G74-04; and
WHEREAS, Ordinance No. G74-04 was amended in its entirety pursuant to Ordinance
No. G11-07; and
WHEREAS, Ordinance No. G11-07 was amended in part pursuant to Ordinance No. G3-
14 entitled “An Ordinance Amending PSFR2 Planned Single Family Residence District
Ordinance No. G11-07 (Shadow Hill Subdivision, Unit 4 - 3625 and 3650 Water Road), dated
January 22, 2014, to provide for new single-family models constructed with side-entry garages
on certain lots requiring a reduction in the side yard and street yard setbacks; and
WHEREAS, written application has been made to further amend PSFR2 Planned Single

including, but not limited to, except as specifically provided in this section below, the

93 and 95, shall be allowed to extend in front of the main residential façade for a distance
no greater than four (4) feet.

The street-facing garages on the home constructed on Lot 24 shall be allowed to extend
in front of the main residential façade for a distance no greater than four (4) feet.
And subject to the following conditions:
5. Substantial conformance to the elevation exhibit stamped “Submittal
Received on January 27, 2014” for the models entitled “Baldwin, Greenfield, Hilltop,
Riverton and Westchester” prepared by Pulte Homes, dated received on January 27,

6. Substantial conformance to the floor plans for the models entitled

Section 3. That except as amended herein, the use and development of the Subject
Property shall be controlled pursuant to the provisions of Ordinance No. G12-07, as amended. In
the event of any conflict between this ordinance, which expressly includes those documents

ORDINANCE T21-14 PASSED ABATING A PORTION OF THE ANNUAL TAX FOR
2013 FOR GENERAL OBLIGATION CORPORATE PURPOSE BONDS, SERIES 2013C
Councilmember Moeller made a motion, seconded by Councilmember Shaw, to pass the

AN ORDINANCE
ABATING A PORTION OF THE ANNUAL TAX FOR 2013 FOR
GENERAL OBLIGATION CORPORATE PURPOSE BONDS, SERIES 2013C
WHEREAS, the City of Elgin will have sufficient funds on hand to pay a portion of the
tax levied by Ordinance S4-13, An Ordinance Providing for the Issuance of $5,025,000 General
Obligation Corporate Purpose Bonds, Series 2013C, of the City of Elgin, Kane and Cook
Counties, Illinois, and Providing for the Levy and Collection of a Direct Annual Tax for the
Payment of the Principal of and Interest on said Bonds; and
WHEREAS, the levy of the tax for the year 2013 provided in the ordinance is
unnecessary.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF ELGIN, ILLINOIS:
Section 1. That the County Clerks of Kane and Cook Counties, are hereby authorized
and directed to abate a portion of the tax of $131,810 for the year 2013 as provided and levied in
the ordinance providing for the issuance of $5,025,000 General Obligation Corporate Purpose
Bonds, Series 2013C, passed March 20, 2013, a copy of which was filed with each of said
county clerks, said tax shall be abated by reducing said sum $98,270 and extending a tax for the
year 2013 in the amount of $33,540 against all taxable property situated in the City of Elgin,
Kane and Cook Counties, Illinois.

Section 2. That the City Clerk is authorized and directed to file a certified copy of this
ordinance with the County Clerks of Kane and Cook Counties, Illinois, prior to March 15, 2014.
Section 3. That this ordinance shall be in full force and effect from and after its
passage in the manner provided by law.

AN ORDINANCE
REGARDING ABATING A PORTION OF THE ANNUAL TAX FOR 2013 FOR
REFUNDING AND CORPORATE PURPOSE BONDS
WHEREAS, the City Council has adopted Ordinance Numbers T3-14, T4-14, T10-14,
T12-14, T14-14, T16-14, T19-14, T20-14and T21-14 providing for abating a portion of the
annual tax for 2013 for refunding and corporate purpose bonds for the series bonds referred to in
such ordinances; and
WHEREAS, depending upon the 2013 assessed valuation figures, prior year adjustment
and the state multiplier it may be necessary to further adjust the amounts of the abatement and
resulting tax levy in Section 1 of such ordinances in order to arrive at a 2013 tax levy for the City
of Elgin not to exceed $42,506,000.

NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF ELGIN, ILLINOIS:
Section 1. That the city’s Chief Finance Officer be and is hereby authorized and
directed that upon receipt of 2013 assessed valuation figures, prior year adjustment and the state
multiplier to adjust, to the extent reasonably practicable, the amount of the abatement and
resulting tax levy in the Section 1 of Ordinance Numbers T3-14, T4-14, T10-14, T12-14, T14-
14, T16-14, T19-14, T20-14and T21-14 so as to attempt to arrive at a 2013 tax levy for the City
of Elgin not to exceed $42,506,000. The city’s Chief Financial Officer shall make such
adjustments, if any, prior to the filing of a certified copy of Ordinance Numbers T3-14, T4-14,
T10-14, T12-14, T14-14, T16-14, T19-14, T20-14and T21-14 with the County Clerks of Kane
and Cook Counties, Illinois, whereupon the amount of the abatement and tax levy in Section 1 of
Ordinance Numbers T3-14, T4-14, T10-14, T12-14, T14-14, T16-14, T19-14, T20-14 and T21-
14 shall be deemed final.
Section 2. That this ordinance shall be in full force and effect from and after its
passage in the manner provided by law.
