COUNCIL OF THE CITY OF ELGIN, ILLINOIS COUNCIL-MANAGER FORM OF GOVERNMENT REGULAR MEETING
The regular meeting of the Council of the City of Elgin, Illinois, was held on August 14, 2013, in
the Council Chambers. The meeting was called to order by Mayor Kaptain at 7:26 p.m. The
Invocation was given by Pastor Dale Jaacks from God’s Oasis and the Pledge of Allegiance was
led by Councilmember Tish Powell.
ROLL CALL
Roll call was answered by Councilmembers Dunne, Gavin, Moeller, Powell, Prigge,
Rauschenberger, Shaw, and Mayor Kaptain. Absent: Councilmember Steffen.
MINUTES OF THE JULY 24, 2013, COUNCIL MEETING APPROVED AS
DISTRIBUTED
Councilmember Gavin made a motion, seconded by Councilmember Shaw, to approve the
July 24, 2013, Council Meeting Minutes as distributed. Upon a roll call vote: Yeas:
Councilmembers Gavin, Moeller, Powell, Prigge, Rauschenberger, Shaw, and Mayor Kaptain.
Nays: None. Councilmember Dunne abstained.
RECOGNIZE PERSONS PRESENT
Elinor Richoz thanked all of those who took part in raising funds to complete Phase 2 of the
Veteran’s Memorial. She announced that the dedication would be Saturday, September 28,
2013, at 10:00 a.m.
Danise Habun provided information regarding the upcoming International Festival (I-Fest) being
held on August 31, 2013.
Julie Schmidt expressed her concerns about the city’s budget and spending policies.
Bilal Hussaini asked about the city’s stance on the recent passing of a state law allowing for the
use of medical marijuana.

BID 13-043 AWARDED TO ALLIANCE CONTRACTORS, INC. FOR 2013 SIDEWALK
REPAIR PROGRAM
Councilmember Dunne made a motion, seconded by Councilmember Moeller, to approve an
agreement with Alliance Contractors, Inc. in the amount of $57,476 for city‐wide sidewalk
repair. Upon a roll call vote: Yeas: Councilmembers Dunne, Gavin, Moeller, Powell, Prigge,
Rauschenberger, Shaw, and Mayor Kaptain. Nays: None.
BID 13-047 AWARDED TO ORANGE CRUSH, LLC FOR 2013 NEIGHBORHOOD
STREET RESURFACING PROGRAM
Councilmember Gavin made a motion, seconded by Councilmember Moeller, to award the 2013
Street Resurfacing Program bid to Orange Crush, LLC in the amount of $1,187,731 to improve
pavement infrastructure on Preston and Forest Avenues and on several adjacent streets. Upon a
roll call vote: Yeas: Councilmembers Dunne, Gavin, Moeller, Powell, Prigge, Rauschenberger,
Shaw, and Mayor Kaptain. Nays: None.
BID 13-048 AWARDED TO COPENHAVER CONSTRUCTION, INC. FOR PUBLIC
IMPROVEMENTS AT REMINGTON MEADOWS & REMINGTON AT PROVIDENCE
There was discussion regarding the bond process and how the improvements are performed if the
developer goes out of business. Also discussed were the options in waiting to perform the
improvements.
Councilmember Dunne made a motion, seconded by Councilmember Moeller, Award the
Remington Meadows and Remington at Providence Bid to Copenhaver Construction, Inc. in the
amount of $1,002,716 to complete and repair the public improvements utilizing funds secured
from the surety upon default of the developer Remington Homes. Upon a roll call vote: Yeas:
Councilmembers Dunne, Gavin, Moeller, Powell, Prigge, Rauschenberger, Shaw, and Mayor
Kaptain. Nays: None.
JOB ORDER APPROVED CONTRACTING F.H. PASCHEN FOR THE
REPLACEMENT OF THE HEMMENS CULTURAL CENTER BOILERS
There was discussion about the condition of the remaining boilers, the estimated time to
complete the project, the costs of maintenance for the Hemmens Cultural Center, and the
financial status of the Elgin Symphony Orchestra (ESO).
Councilmember Dunne made a motion, seconded by Councilmember Moeller, to approve a
contract with F. H. Paschen in the amount of $273,232 for the replacement of three heating
boilers at the Hemmens Cultural Center. Upon a roll call vote: Yeas: Councilmembers Dunne,
Gavin, Moeller, Powell, Prigge, Rauschenberger, Shaw, and Mayor Kaptain. Nays: None.

PETITION 24-13 APPROVED FOR A VARIATION APPROVAL FOR A REDUCTION
OF FREEBOARD TO LESS THAN TWO FEET ABOVE THE RESPECTIVE HIGH
WATER LEVEL OF THE PROPOSED DETENTION BASINS AT THE JACK COOK
REGIONAL PARK. PROPERTY LOCATED AT 4600 PLANK ROAD
Marc Mylott, Community Development Director, provided an overview of the project.
Councilmember Moeller made a motion, seconded by Councilmember Powell, to approve
Petition 24-13 subject to conditions. Upon a roll call vote: Yeas: Councilmembers Dunne,
Gavin, Moeller, Powell, Prigge, Rauschenberger, Shaw, and Mayor Kaptain. Nays: None.
PETITION 21-13 APPROVED AN AMENDMENT TO PNB PLANNED
NEIGHBORHOOD BUSINESS DISTRICT ORDINANCE NUMBER G21-98, TO
PROVIDE FOR THE INSTALLATION OF A ABOVE GROUND PROPANE TANK;
PROPERTY LOCATED AT 826 SOUTH MCLEAN BOULEVARD
Community Development Director Marc Mylott provided an overview of the project and stated
that staff and the Planning and Zoning Commission are recommending approval subject to the
conditions outlined.
There was discussion regarding the intent of the petitioner to perform conversions, the volume of
customers, and the process to obtain approval from the state fire marshal.
Councilmember Shaw made a motion, seconded by Councilmember Gavin, to approve Petition
21-13 subject to conditions. Upon a roll call vote: Yeas: Councilmembers Dunne, Gavin,
Moeller, Powell, Prigge, Rauschenberger, Shaw, and Mayor Kaptain. Nays: None.

WHEREAS, written application has been made to reclassify certain property located at
899 Jay Street from RC2 Residence Conservation District and CF Community Facility District to
PCF Planned Community Facility District ; and
WHEREAS, after due notice in the manner provided by law the Planning & Zoning
Commission conducted a public hearing concerning said application and has submitted its
written findings and recommendations; and
WHEREAS, the City Council of the City of Elgin, Illinois, has reviewed the findings and
recommendations of the Planning & Zoning Commission.

Section 2. That the City Council of the City of Elgin hereby grants the PCF Planned
Community Facility District which shall be designed, developed, and operated subject to the
following provisions:
A. Purpose and Intent. The purpose and intent of this PCF zoning district is to
provide a planned environment for various types of community facilities, subject
to the provisions of Chapter 19.60 Planned Developments of the Elgin Municipal
Code, 1976, as amended. In general, community facilities provide governmental,
recreational, educational, health, social, religious, and transportation services to
the community on a for-profit or a not-for-profit basis. The PCF District is most
similar to, but departs from the standard requirements of the CF Community
Facility District.
B. Supplementary Regulations. Any word or phrase contained herein, followed by
the symbol “[SR]”, shall be subject to the definitions and the additional
interpretive requirements provided in Chapter 19.90, Supplementary Regulations
of the Elgin Municipal Code, 1976, as amended. The exclusion of such symbol
shall not exempt such word or phrase from the applicable supplementary
regulation.
C. General Provisions. In this PCF zoning district, the use and development of land
and structures shall be subject to the provisions of Chapter 19.05, General
Provisions of the Elgin Municipal Code, 1976, as amended.
D. Zoning Districts - Generally. In this PCF zoning district, the use and
development of land and structures shall be subject to the provisions of Chapter
19.07, Zoning Districts of the Elgin Municipal Code, 1976, as amended.
E. Location and Size of District. This PCF zoning district should be located in
substantial conformance to the official comprehensive plan. The amount of land
necessary to constitute a separate PCF zoning district exclusive of rights-of-way,
but including adjoining land or land directly opposite a right of way shall not be
less than two acres.
F. Land Use. In this PCF zoning district, the use of land and structures shall be
subject to the provisions of Chapter 19.10, Land Use of the Elgin Municipal
Code, 1976, as amended. The following enumerated “land uses” [SR] shall be the
only land uses allowed as a “permitted use” [SR] in this PCF zoning district:
A. Permitted Uses: in this PCF District, the following enumerated land uses shall
be the only land uses allowed as a permitted use:

N. Variations. In this PCF zoning district, application for variation shall be subject

AN ORDINANCE
PROVIDING FOR ADDITIONAL FUNDING FOR THE CITY OF ELGIN
POLICE PENSION FUND AND FIREFIGHTER PENSION FUND
WHEREAS, the City Council of the City of Elgin has determined that it is appropriate to
provide additional funding for the City of Elgin Police Pension Fund and the City of Elgin Fire
Pension Fund.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF ELGIN:
Section 1. That the City’s Chief Financial Officer, Colleen Lavery, be and is hereby
authorized and directed to provide additional funding to the City of Elgin Police Pension Fund
by transferring the amount of Two Million Dollars ($2,000,000) from the City of Elgin’s general
fund reserves to the City of Elgin Police Pension Fund.
Section 2. That the City’s Chief Financial Officer, Colleen Lavery, be and is hereby
authorized and directed to provide additional funding to the City of Elgin Firefighter Pension
Fund by transferring the amount of Five Hundred Thousand Dollars ($500,000) from the City of
Elgin’s general fund reserves to the City of Elgin Firefighter Pension Fund.
Section 3. That the foregoing transfers from the City of Elgin general fund reserves to
the City of Elgin Police Pension Fund and Firefighter’s Pension Fund shall be made within thirty
(30) days hereof and such payments shall be included within a budget amendment for the 2013
budget to be hereinafter presented to the City Council.
Section 4. This ordinance shall be in full force and effect upon its passage in the
manner provided by law.
