RESOLUTION
ESTABLISHING PREVAILING WAGEll RATES
ON PUBLIC WORKS CONTRACTS
WHEREAS, 820 ILCS 130/0.01 et seq. entitled "AN ACT regulating wages of laborers,
mechanics, and other workers employed in any public works by the State, county, city or any
public body or any political subdivision or by any one under contract for public works." requires
that any public body awarding any contract for public work, or Otherwise undertaking any public
works as defined herein, shall ascertain the general prevailing hourly rate of wages for
employees engaged in such work; and
WHEREAS, said Act further provides that if the public Ibody desires that the Department
of Labor ascertain the prevailing rate of wages, it shall notify the Department of Labor to
ascertain the general prevailing wage rate; and
WHEREAS, at the request of the City of Elgin the Department of Labor has determined
the prevailing rate of wages for construction work in Cook and Kane Counties in the State of
Illinois.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF ELGIN, ILLINOIS, that the determination of the prevailing wages as made by the
Department of Labor, copies of which are attached hereto and made a part hereof by reference,
are adopted by the City of Elgin.
BE IT FURTHER RESOLVED that all contracts for public work of the City of Elgin
shall include a stipulation to the effect that not less than the prevailing rate of wages as found by
the Department of Labor shall be paid to all laborers, workers and mechanics perfoiin ing work
under the contract.
BE IT FURTHER RESOLVED that all contract bonds for public works shall include a
provision to guarantee the faithful performance of the previnling wage clause as provided by
contract.
BE IT FURTHER RESOLVED that a copy of the prevailing wage rate as established by
the Department of Labor shall be publicly posted and kept available for inspection by any
interested party.
BE IT FURTHER RESOLVED that nothing herein contained shall be construed to apply
to the prevailing hourly rate of wages in the locality for employment other than public works
construction as defined in the Act, and that the City Clerk be nd is hereby authorized to file a
certified copy of this resolution with the Secretary of State Index Division and the Department of
Labor of the State of Illinois.

Explanations
COOK COUNTY
The following list is considered as those days for which holiday rates
of wages for work performed apply: New Years Day, Memorial Day,
Fourth of July, Labor Day, Thanksgiving Day, Christmas Day and
Veterans Day in some classifications/counties. Ge erally, any of
these holidays which fall on a Sunday is ce1ebratec on the following
Monday. This then makes work performed on that Monday payable at the
appropriate overtime rate for holiday pay. Common practice in a given
local may alter certain days of celebration. If in doubt, please
check with IDOL.
TRUCK DRIVERS (WEST) - That part of the county West of Barrington
Road.
EXPLANATION OF CLASSES
ASBESTOS - GENERAL - removal of asbestos material/ old and hazardous
materials from any place in a building, including nechanical systems
where those mechanical systems are to be removed. This includes the
removal of asbestos materials/mold and hazardous mlaterials from
ductwork or pipes in a building when the building lis to be demolished
at the time or at some close future date.
ASBESTOS - MECHANICAL - removal of asbestos material from mechanical
systems, such as pipes, ducts, and boilers, where the mechanical
systems are to remain.

CERAMIC TILE FINISHER
The grouting, cleaning, and polishing of all classes of tile, whether
for interior or exterior purposes, all burned, glazed or unglazed
products; all composition materials, granite tiles, warning detectable
tiles, cement tiles, epoxy composite materials, pavers, glass,
mosaics, fiberglass, and all substitute materials, for tile made in
tile-like units; all mixtures in tile like form of cement, metals, and
other materials that are for and intended for use as a finished floor
surface, stair treads, promenade roofs, walks, walls, ceilings,
swimming pools, and all other places where tile is to form a finished
interior or exterior. The mixing of all setting mortars including but
not limited to thin-set mortars, epoxies, wall mud, and any other
sand and cement mixtures or adhesives when used in the preparation,
installation, repair, or maintenance of tile and/or similar materials.
The handling and unloading of all sand, cement, lime, tile,
fixtures, equipment, adhesives, or any other materials to be used in
the preparation, installation, repair, or maintenance of tile and/or
similar materials. Ceramic Tile Finishers shall fill all joints and
voids regardless of method on all tile work, particularly and
especially after installation of said tile work. Application of any
and all protective coverings to all types of tile i stallations
including, but not be limited to, all soap compounda, paper products,
tapes, and all polyethylene coverings, plywood, masdnite, cardboard,
and any new type of products that may be used to protect tile
installations, Blastrac equipment, and all floor scarifying equipment
used in preparing floors to receive tile. The clean up and removal of
all waste and materials. All demolition of existing tile floors and
walls to be re-tiled.
COMMUNICATIONS ELECTRICIAN
Installation, operation, inspection, maintenance, repair and service
of radio, television, recording, voice sound vision production and
reproduction, telephone and telephone interconnect; facsimile, data
apparatus, coaxial, fibre optic and wireless equipnent, appliances and
systems used for the transmission and reception of signals of any
nature, business, domestic, commercial, education, entertainment, and
residential purposes, including but not limited to, communication and
telephone, electronic and sound equipment, fibre otic and data
communication systems, and the performance of any lask directly
related to such installation or service whether at new or existing
sites, such tasks to include the placing of wire and cable and
electrical power conduit or other raceway work within the equipment
room and pulling wire and/or cable through conduit and the
installation of any incidental conduit, such that the employees
covered hereby can complete any job in full.
MARBLE FINISHER
Loading and unloading trucks, distribution of alli aterials (all
stone, sand, etc. ) , stocking of floors with materi 1, performing all
rigging for heavy work, the handling of all materi 1 that may be
needed for the installation of such materials, building of
scaffolding, polishing if needed, patching, waxing of material if
damaged, pointing up, caulking, grouting and cleaning of marble,
holding water on diamond or Carborundum blade or s w for setters
cutting, use of tub saw or any other saw needed fo preparation of

material, drilling of holes for wires that anchor material set by
setters, mixing up of molding plaster for installation of material,
mixing up thin set for the installation of material, mixing up of sand
to cement for the installation of material and such other work as may
be required in helping a Marble Setter in the handling of all
material in the erection or installation of interior marble, slate,
travertine, art marble, serpentine, alberene stone, blue stone,
granite and other stones (meaning as to stone any fcreign or domestic
materials as are specified and used in building interiors and
exteriors and customarily known as stone in the trace) , carrara,
sanionyx, vitrolite and similar opaque glass and th laying of all
marble tile, terrazzo tile, slate tile and precast tile, steps, risers
treads, base, or any other materials that may be used as substitutes
for any of the aforementioned materials and which are used on interior
and exterior which are installed in a similar manner.
MATERIAL TESTER I: Hand coring and drilling for te4ting of materials;
field inspection of uncured concrete and asphalt.
MATERIAL TESTER II: Field inspection of welds, structural steel,
fireproofing, masonry, soil, facade, reinforcing st el, formwork,
cured concrete, and concrete and asphalt batch plants; adjusting
proportions of bituminous mixtures.

the Department shall undertake a special determination, such special

LANDSCAPING
Landscaping work falls under the existing classifications for laborer,
operating engineer and truck driver. The work performed by
landscape plantsman and landscape laborer is covered by the existing
classification of laborer. The work performed by landscape operators
(regardless of equipment used or its size) is covered by the
classifications of operating engineer. The work performed by

The following list is considered as those days for which holiday rates
of wages for work performed apply: New Years Day, emorial Day,
Fourth of July, Labor Day, Thanksgiving Day, Christmas Day and
Veterans Day in some classifications/counties. Ge erally, any of
these holidays which fall on a Sunday is celebrated on the following
Monday. This then makes work performed on that Monday payable at the
appropriate overtime rate for holiday pay. Common practice in a given
local may alter certain days of celebration. If in doubt, please

EXPLANATION OF CLASSES
ASBESTOS - GENERAL - removal of asbestos material/Told and hazardous
materials from any place in a building, including Mechanical systems
where those mechanical systems are to be removed. This includes the
removal of asbestos materials/mold and hazardous materials from
ductwork or pipes in a building when the building is to be demolished
at the time or at some close future date.
ASBESTOS - MECHANICAL - removal of asbestos materi 1 from mechanical
systems, such as pipes, ducts, and boilers, where he mechanical

CERAMIC TILE FINISHER
The grouting, cleaning, and polishing of all classes of tile, whether
for interior or exterior purposes, all burned, glazed or unglazed
products; all composition materials, granite tiles, warning detectable
tiles, cement tiles, epoxy composite materials, pavers, glass,
mosaics, fiberglass, and all substitute materials, for tile made in
tile-like units; all mixtures in tile like form of cement, metals, and
other materials that are for and intended for use a a finished floor
surface, stair treads, promenade roofs, walks, wall , ceilings,
swimming pools, and all other places where tile is to form a finished
interior or exterior. The mixing of all setting mortars including but
not limited to thin-set mortars, epoxies, wall mud, and any other
sand and cement mixtures or adhesives when used in the preparation,
installation, repair, or maintenance of tile and/orlsimilar materials.
The handling and unloading of all sand, cement, lime, tile,
fixtures, equipment, adhesives, or any other materials to be used in
the preparation, installation, repair, or maintenanLe of tile and/or
similar materials. Ceramic Tile Finishers shall fill all joints and
voids regardless of method on all tile work, particularly and
especially after installation of said tile work. Application of any
and all protective coverings to all types of tile i stallations
including, but not be limited to, all soap compound , paper products,
tapes, and all polyethylene coverings, plywood, masonite, cardboard,
and any new type of products that may be used to protect tile
installations, Blastrac equipment, and all floor scarifying equipment
used in preparing floors to receive tile. The clean up and removal of
all waste and materials. All demolition of existing tile floors and
walls to be re-tiled.
COMMUNICATIONS TECHNICIAN
Construction, installation, maintenance and removal of
telecommunication facilities (voice, sound, data and video) ,
telephone, security systems, fire alarm systems tl-at are a component
of a multiplex system and share a common cable, and data inside wire,
interconnect, terminal equipment, central offices, PABX and
equipment, micro waves, V-SAT, bypass, CATV, WAN ( ide area network) ,

The handling of sand, cement, marble chips, and all other materials
that may be used by the Mosaic Terrazzo Mechanic, and the mixing,
grinding, grouting, cleaning and sealing of all Marble, Mosaic, and
Terrazzo work, floors, base, stairs, and wainscoting by hand or
machine, and in addition, assisting and aiding Marble, Masonic, and
Terrazzo Mechanics.

For definitions of classifications not otherwise set out, the
Department generally has on file such definitions Which are available.
If a task to be performed is not subject to one of the
classifications of pay set out, the Department will upon being
contacted state which neighboring county has such a classification and
provide such rate, such rate being deemed to exist by reference in
this document. If no neighboring county rate applies to the task,
the Department shall undertake a special determination, such special
determination being then deemed to have existed under this

LANDSCAPING
Landscaping work falls under the existing classifications for laborer,
operating engineer and truck driver. The work performed by landscape
plantsman and landscape laborer is covered by the existing
classification of laborer. The work performed by landscape operators
(regardless of equipment used or its size) is covered by the
classifications of operating engineer. The work performed by
landscape truck drivers (regardless of size of truck driven) is
covered by the classifications of truck driver.

Resolution Establishing Prevailing Wage Rates on Public Works Contracts
(No Cost to the City)
OBJECTIVE:
Establish prevailing wage rates on public works projects in accordance with the Illinois Depart-
ment of Labor's rate schedule.
RECOMMENDATION:
Approve adoption of the Resolution establishing prevailing wage rates on public works con-
tracts.
r BACKGROUND
By law, Illinois municipalities are required to annually establ sh the prevailing rate of wages for
employees engaged in work on public works projects. Con ractors entering into public works
projects are required to pay employees not less than the preiailing wage established.
OPERATIONAL ANALYSIS
Municipalities may hold public hearings to determine prevailing wages or may rely upon the
Illinois Department of Labor to ascertain them. Historically, the city council has elected to ac-
cept the Illinois Department of Labor's prevailing rate deterMination. The Illinois Department of
Labor prepares a schedule of prevailing wages. The Department's June rates will be available
June 15 and will be an exhibit to the attached resolution submitted for council action. Copies of
the rates for May 2012 are attached for informational purpoes.

r In the event the city elects to independently establish wage rates, the city will incur the costs of
conducting the public hearing required to ascertain such rimges, and will be required to bear

the cost of hearing any objections and of defending such rates in the event they are legally chal-
lenged. Challenges to wage rates which are based on the determination of the Illinois Depart-
ment of Labor's findings are typically defended by the Illinois Department of Labor.

LEGAL IMPACT
The Prevailing Wage Act (820 ILCS 130/3.01 et seq.) requires any public body not intending to
adopt the findings of the Illinois Department of Labor as to wage rates to investigate and ascer-
tain the prevailing rate of wages during the month of June.
ALTERNATIVES
In the event the city council chooses not to adopt the proposed resolution and wishes to inde-
pendently ascertain wage rates, it must immediately authorize and direct the scheduling of a
public hearing to investigate and ascertain such rates.

ESTABLISHING PREVAILING WA E RATES
ON PUBLIC WORKS CONT' CTS
WHEREAS, 820 ILCS 130/0.01 et seq. entitled "AN ACT regulating wages of laborers,
mechanics, and other workers employed in any public wor is by the State, county, city or any
public body or any political subdivision or by any one under ontract for public works." requires
that any public body awarding any contract for public work, •r otherwise undertaking any public
works as defined herein, shall ascertain the general pre ailing hourly rate of wages for
employees engaged in such work; and
WHEREAS, said Act further provides that if the publ c body desires that the Department
of Labor ascertain the prevailing rate of wages, it shall otify the Department of Labor to
ascertain the general prevailing wage rate; and
WHEREAS, at the request of the City of Elgin the D-partment of Labor has determined
the prevailing rate of wages for construction work in Cook and Kane Counties in the State of
Illinois.
NOW, THEREFORE, BE IT RESOLVED BY TH CITY COUNCIL OF THE CITY
OF ELGIN, ILLINOIS, that the determination of the pi evailing wages as made by the
rik Department of Labor, copies of which are attached hereto a Id made a part hereof by reference,
are adopted by the City of Elgin.
BE IT FURTHER RESOLVED that all contracts fol public work of the City of Elgin
shall include a stipulation to the effect that not less than the irevailing rate of wages as found by
the Department of Labor shall be paid to all laborers, work:rs and mechanics performing work
under the contract.
BE IT FURTHER RESOLVED that all contract bo ds for public works shall include a
provision to guarantee the faithful performance of the pre ailing wage clause as provided by
contract.
BE IT FURTHER RESOLVED that a copy of the pr vailing wage rate as established by
the Department of Labor shall be publicly posted and keit available for inspection by any
interested party.
BE IT FURTHER RESOLVED that nothing herein contained shall be construed to apply
to the prevailing hourly rate of wages in the locality for employment other than public works
construction as defined in the Act, and that the City Clerk be and is hereby authorized to file a
certified copy of this resolution with the Secretary of State Index Division and the Department of
Labor of the State of Illinois.

COOK COUNTY
The following list is considered as those days for which holiday rates
of wages for work performed apply: New Years Day, Memorial Day,
Fourth of July, Labor Day, Thanksgiving Day, Christmas Day and
Veterans Day in some classifications/counties. Generally, any of
these holidays which fall on a Sunday is celebrated on the following
Monday. This then makes work performed on that Monday payable at the
appropriate overtime rate for holiday pay. Common practice in a given
local may alter certain days of celebration. If in doubt, please
check with IDOL.
TRUCK DRIVERS (WEST) - That part of the county West of Barrington
Road.
EXPLANATION OF CLASSES
ASBESTOS - GENERAL - removal of asbestos material/mold and hazardous
materials from any place in a building, including mechanical systems
where those mechanical systems are to be removed. This includes the
removal of asbestos materials/mold and hazardous materials from
ductwork or pipes in a building when the building is to be demolished
at the time or at some close future date.

ELECTRICIANS AND COMMUNICATIONS TECHNICIAN (NORTH) - Townships of
Burlington, Campton, Dundee, Elgin, Hampshire, Plato, Rutland, St.
Charles (except the West half of Sec. 26, all of Secs. 27, 33, and
34, South half of Sec. 28, West half of Sec. 35) , Virgil and Valley

The following list is considered as those days for which holiday rates
of wages for work performed apply: New Years Day, Memorial Day,
Fourth of July, Labor Day, Thanksgiving Day, Christmas Day and
Veterans Day in some classifications/counties. Generally, any of
these holidays which fall on a Sunday is celebrated on the following
Monday. This then makes work performed on that Monday payable at the
appropriate overtime rate for holiday pay. Common practice in a given
local may alter certain days of celebration. If in doubt, please

EXPLANATION OF CLASSES
ASBESTOS - GENERAL - removal of asbestos material/mold and hazardous
materials from any place in a building, including mechanical systems
where those mechanical systems are to be removed. This includes the
removal of asbestos materials/mold and hazardous materials from
ductwork or pipes in a building when the building is to be demolished
at the time or at some close future date.
ASBESTOS - MECHANICAL - removal of asbestos material from mechanical

CERAMIC TILE FINISHER
The grouting, cleaning, and polishing of all classes of tile, whether
for interior or exterior purposes, all burned, glaz-d or unglazed
products; all composition materials, granite tiles, warning detectable
tiles, cement tiles, epoxy composite materials, pav-rs, glass,
mosaics, fiberglass, and all substitute materials, for tile made in
tile-like units; all mixtures in tile like form of dement, metals, and
other materials that are for and intended for use a- a finished floor
surface, stair treads, promenade roofs, walks, wall-, ceilings,
swimming pools, and all other places where tile is .o form a finished
interior or exterior. The mixing of all setting mortars including but

voids regardless of method on all tile work, particlarly and

tapes, and all polyethylene coverings, plywood, masonite, cardboard,
and any new type of products that may be used to protect tile

COMMUNICATIONS TECHNICIAN
Construction, installation, maintenance and removal of
telecommunication facilities (voice, sound, data and video) ,
telephone, security systems, fire alarm systems th.:t are a component
of a multiplex system and share a common cable, and data inside wire,
interconnect, terminal equipment, central offices, 'ABX and
equipment, micro waves, V-SAT, bypass, CATV, WAN (w de area network) ,

Terrazzo work, floors, base, stairs, and wainscoti g by hand or
machine, and in addition, assisting and aiding Mar.le, Masonic, and
Terrazzo Mechanics.

For definitions of classifications not otherwise s-t out, the
Department generally has on file such definitions hich are available.
If a task to be performed is not subject to one of the
classifications of pay set out, the Department will upon being
contacted state which neighboring county has such classification and
provide such rate, such rate being deemed to exist by reference in
this document. If no neighboring county rate applies to the task,
the Department shall undertake a special determina ion, such special
determination being then deemed to have existed u der this
determination. If a project requires these, or an6 classification not

LANDSCAPING
Landscaping work falls under the existing classifi ations for laborer,
operating engineer and truck driver. The work per ormed by landscape
plantsman and landscape laborer is covered by the existing
classification of laborer. The work performed by andscape operators
(regardless of equipment used or its size) is cov-red by the
classifications of operating engineer. The work p-rformed by
landscape truck drivers (regardless of size of truck driven) is
covered by the classifications of truck driver.
