HomeMy WebLinkAbout12-109 Resolution No. 12-109 RESOLUTION ESTABLISHING PREVAILING WAGEll RATES ON PUBLIC WORKS CONTRACTS WHEREAS, 820 ILCS 130/0.01 et seq. entitled "AN ACT regulating wages of laborers, mechanics, and other workers employed in any public works by the State, county, city or any public body or any political subdivision or by any one under contract for public works." requires that any public body awarding any contract for public work, or Otherwise undertaking any public works as defined herein, shall ascertain the general prevailing hourly rate of wages for employees engaged in such work; and WHEREAS, said Act further provides that if the public Ibody desires that the Department of Labor ascertain the prevailing rate of wages, it shall notify the Department of Labor to ascertain the general prevailing wage rate; and WHEREAS, at the request of the City of Elgin the Department of Labor has determined the prevailing rate of wages for construction work in Cook and Kane Counties in the State of Illinois. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS, that the determination of the prevailing wages as made by the Department of Labor, copies of which are attached hereto and made a part hereof by reference, are adopted by the City of Elgin. BE IT FURTHER RESOLVED that all contracts for public work of the City of Elgin shall include a stipulation to the effect that not less than the prevailing rate of wages as found by the Department of Labor shall be paid to all laborers, workers and mechanics perfoiin ing work under the contract. BE IT FURTHER RESOLVED that all contract bonds for public works shall include a provision to guarantee the faithful performance of the previnling wage clause as provided by contract. BE IT FURTHER RESOLVED that a copy of the prevailing wage rate as established by the Department of Labor shall be publicly posted and kept available for inspection by any interested party. BE IT FURTHER RESOLVED that nothing herein contained shall be construed to apply to the prevailing hourly rate of wages in the locality for employment other than public works construction as defined in the Act, and that the City Clerk be nd is hereby authorized to file a certified copy of this resolution with the Secretary of State Index Division and the Department of Labor of the State of Illinois. s/ David J. Ge erally, any of these holidays which fall on a Sunday is ce1ebratec on the following Monday. This then makes work performed on that Monday payable at the appropriate overtime rate for holiday pay. Common practice in a given local may alter certain days of celebration. If in doubt, please check with IDOL. TRUCK DRIVERS (WEST) - That part of the county West of Barrington Road. EXPLANATION OF CLASSES ASBESTOS - GENERAL - removal of asbestos material/ old and hazardous materials from any place in a building, including nechanical systems where those mechanical systems are to be removed. This includes the removal of asbestos materials/mold and hazardous mlaterials from ductwork or pipes in a building when the building lis to be demolished at the time or at some close future date. ASBESTOS - MECHANICAL - removal of asbestos material from mechanical systems, such as pipes, ducts, and boilers, where the mechanical systems are to remain. http://www.state.il.us/agency/idol/rates/EVENIVIO/COOK9999.htm 6/14/2012 I , .Cook County Prevailing Wage for June 2012 Page 3 of 8 CERAMIC TILE FINISHER The grouting, cleaning, and polishing of all classes of tile, whether for interior or exterior purposes, all burned, glazed or unglazed products; all composition materials, granite tiles, warning detectable tiles, cement tiles, epoxy composite materials, pavers, glass, mosaics, fiberglass, and all substitute materials, for tile made in tile-like units; all mixtures in tile like form of cement, metals, and other materials that are for and intended for use as a finished floor surface, stair treads, promenade roofs, walks, walls, ceilings, swimming pools, and all other places where tile is to form a finished interior or exterior. The mixing of all setting mortars including but not limited to thin-set mortars, epoxies, wall mud, and any other sand and cement mixtures or adhesives when used in the preparation, installation, repair, or maintenance of tile and/or similar materials. The handling and unloading of all sand, cement, lime, tile, fixtures, equipment, adhesives, or any other materials to be used in the preparation, installation, repair, or maintenance of tile and/or similar materials. Ceramic Tile Finishers shall fill all joints and voids regardless of method on all tile work, particularly and especially after installation of said tile work. Application of any and all protective coverings to all types of tile i stallations including, but not be limited to, all soap compounda, paper products, tapes, and all polyethylene coverings, plywood, masdnite, cardboard, and any new type of products that may be used to protect tile installations, Blastrac equipment, and all floor scarifying equipment used in preparing floors to receive tile. The clean up and removal of all waste and materials. All demolition of existing tile floors and walls to be re-tiled. RECOMMENDATION: Approve adoption of the Resolution establishing prevailing wage rates on public works con- tracts. r BACKGROUND By law, Illinois municipalities are required to annually establ sh the prevailing rate of wages for employees engaged in work on public works projects. Con ractors entering into public works projects are required to pay employees not less than the preiailing wage established. OPERATIONAL ANALYSIS Municipalities may hold public hearings to determine prevailing wages or may rely upon the Illinois Department of Labor to ascertain them. Historically, the city council has elected to ac- cept the Illinois Department of Labor's prevailing rate deterMination. The Illinois Department of Labor prepares a schedule of prevailing wages. The Department's June rates will be available June 15 and will be an exhibit to the attached resolution submitted for council action. Copies of the rates for May 2012 are attached for informational purpoes. INTERESTED PERSONS CONTACTED Illinois Department of Labor. FINANCIAL ANALYSIS r In the event the city elects to independently establish wage rates, the city will incur the costs of conducting the public hearing required to ascertain such rimges, and will be required to bear , the cost of hearing any objections and of defending such rates in the event they are legally chal- lenged.
