COUNCIL-MANAGER FORM OF GOVERNMENT
REGULAR MEETING
The regular meeting of the Council of the City of Elgin, Illinois, was held on October 10, 2012,
in the Council Chambers. The meeting was called to order by Mayor Kaptain at 8:22 p.m. The
Invocation was given by Pastor Henoch Fuentes from the Evangelical Covenant Church and the
Pledge of Allegiance was led by Fire Chief Fahy.
ROLL CALL
Roll call was answered by Councilmembers Dunne, Gilliam, Moeller, Powell, Prigge, Steffen,
and Mayor Kaptain. Absent: None.
MINUTES OF THE SEPTEMBER 26, 2012, COUNCIL MEETING APPROVED AS
DISTRIBUTED
Councilmember Gilliam made a motion, seconded by Councilmember Moeller, to approve the
September 26, 2012, Council Meeting Minutes as distributed. Upon a roll call vote: Yeas:
Councilmembers Dunne, Gilliam, Moeller, Powell, Prigge, Steffen, and Mayor Kaptain. Nays:
None.
COMMUNICATIONS
Domestic Violence Awareness Month Proclamation
Mayor Kaptain read the following proclamation:
PROCLAMATION
WHEREAS, violence against women and children continues to become a more prevalent
problem and are not confined to any group of people, but cross all economic, gender, racial and
societal barriers and are supported by societal indifference; and
WHEREAS, the crime of domestic violence violates an individual’s privacy, dignity,
security and humanity through the systematic use of physical, emotional, sexual, psychological
and economic control and/or abuse; and
WHEREAS, the impact of domestic violence is wide-ranging, directly affecting families
and society as a whole; and

WHEREAS, it is battered women themselves who have been at the forefront of efforts to
bring peace and equity to the home; and
WHEREAS, it is fitting to set aside a special time to bring this issue to the attention of all
residents of the City of Elgin so they can become better informed and involved in programs to
eliminate this epidemic from our society.
NOW, THEREFORE, I, David Kaptain, Mayor of the City of Elgin, Illinois, do hereby
proclaim the month of October 2012 as Domestic Violence Awareness Month in the City of
Elgin and encourage our residents to join forces with victim service programs, criminal justice
officials and concerned citizens across the country to raise the public awareness of domestic
violence issues.

Cauquenes, Chile - Sister City Proclamation
Mayor Kaptain read the following proclamation:
PROCLAMATION
WHEREAS, The Mayor and City Council of the City of Elgin, in the State of Illinois,
United States and the Alcalde and Municipal Council of the City of Cauquenes in the Maule
Region, Chile believe in the promotion of friendship and goodwill; and
WHEREAS, the development of educational, cultural, social and economic exchanges
between the peoples of the two cities will strengthen knowledge and understanding between the
United States and Chile; and
WHEREAS, these exchanges will transcend national and political boundaries to form an
everlasting foundation for the peace and well-being of mankind; and
WHEREAS, in becoming sister cities the City Council and Municipal Council pledge
that they will assist in the exchange of people and of information on culture, education,
recreation, custom, economic and community affairs and that they will encourage the
development of friendship between peoples of all ages of both cities and so develop a bond one
with the other.

NOW, THEREFORE, I, David Kaptain, Mayor of the City of Elgin, Illinois, along with
the Alcalde and Municipal Council of the city of Cauquenes do hereby proclaim the affiliation of
the two cities as sister cities.

RECOGNIZE PERSONS PRESENT
Allison Gronski, representing the Muscular Dystrophy Association, provided a wrap-up on the
Fill the Boot campaign. She thanked the firefighters that participated and the community for the
donations. It was noted that the City of Elgin is always among the top Fill the Boot programs in
the state.
Bill Neylon reported on Love Elgin Day held on September 29th. He thanked all of those
involved and noted the next Love Elgin Day would be held on April 27, 2013.
Chuck Keysor inquired about the status of the strategic plan that the Council discussed earlier
this year. City Manager Stegall noted that it would be discussed along with the budget.
BID 12-024B AWARDED TO GREAT LAKES SNOW SYSTEMS FOR VARIOUS
PARKING LOTS AND THE BLUFF CITY CEMETERY FOR ICE AND SNOW
REMOVAL SERVICES
Councilmember Steffen made a motion, seconded by Councilmember Powell, to approve a
contract with Great Lakes Snow Systems in the amount of $92,000 for ice and snow removal
services in parking lots and the Bluff City Cemetery. Upon a roll call vote: Yeas:
Councilmembers Dunne, Gilliam, Moeller, Powell, Prigge, Steffen, and Mayor Kaptain. Nays:
None.
BID 12-054 AWARDED TO COPENHAVER CONSTRUCTION FOR 2012 CENTRAL
BUSINESS DISTRICT STREETSCAPE IMPROVEMENT PROJECT ($3,016,030)
Councilmember Moeller made a motion, seconded by Councilmember Steffen, to award a
contract to Copenhaver Construction in the amount of $3,016,030 for the 2012 Central Business
District Streetscape Project to improve the city’s infrastructure with the construction of new
sewers and streetscape in the city’s central business district. Upon a roll call vote: Yeas:
Councilmembers Dunne, Gilliam, Moeller, Powell, Prigge, Steffen, and Mayor Kaptain. Nays:
None.

PETITION 37-12 APPROVED FOR PLANNED DEVELOPMENT APPROVAL OF
FINAL ARCHITECTURE FOR A RETAIL BUILDING AT 1010 SOUTH RANDALL
ROAD
Marc Mylott, Community Development Director, provided an overview of the project and noted
that staff and the Planning and Zoning Commission recommended approval subject to conditions
as outlined.
Councilmember Moeller made a motion, seconded by Councilmember Steffen, to approve
Petition 37-12 subject to conditions. Upon a roll call vote: Yeas: Councilmembers Dunne,
Gilliam, Moeller, Powell, Prigge, Steffen, and Mayor Kaptain. Nays: None.
RESOLUTION 12-156 ADOPTED AUTHORIZING EXECUTION OF AN AGREEMENT
WITH MARKETPLACE MEDIA GROUP, LLC FOR THE ELGIN NEIGHBOR
NEWSLETTER
Councilmember Prigge made a motion, seconded by Councilmember Steffen, to adopt the
following resolution. Upon a roll call vote: Yeas: Councilmembers Dunne, Gilliam, Moeller,
Powell, Prigge, Steffen, and Mayor Kaptain. Nays: None.

RESOLUTION
AUTHORIZING EXECUTION OF AN AGREEMENT WITH
MARKETPLACE MEDIA GROUP, LLC FOR THE ELGIN NEIGHBOR NEWSLETTER
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS,
that Sean R. Stegall, City Manager, and Kimberly A. Dewis, City Clerk, be and are hereby
authorized and directed to execute an Agreement with Marketplace Media Group, LLC, on
behalf of the City of Elgin for Fall and Winter Neighbor Newsletter design, printing and mailing
services, a copy of which is attached hereto and made a part hereof by reference.

Councilmember Gilliam made a motion, seconded by Councilmember Moeller, to approve the
authorization for payments report provided to Council by memo. Upon a roll call vote: Yeas:

ORDINANCE G58-12 PASSED AMENDING CHAPTER 6.06 OF THE ELGIN
MUNICIPAL CODE, 1976, AS AMENDED, ENTITLED "ALCOHOLIC LIQUOR
DEALERS"
Councilmember Moeller made a motion, seconded by Councilmember Steffen, to pass the
following ordinance. Upon a roll call vote: Yeas: Councilmembers Dunne, Gilliam, Moeller,
Powell, Prigge, Steffen, and Mayor Kaptain. Nays: None.
Ordinance No. G58-12
AN ORDINANCE
AMENDING CHAPTER 6.06 OF THE ELGIN MUNICIPAL CODE, 1976,
AS AMENDED, ENTITLED “ALCOHOLIC LIQUOR DEALERS”
WHEREAS, the City of Elgin is a home rule unit and as a home rule unit may exercise
any power and perform any function pertaining to its government and affairs; and
WHEREAS, the regulation of alcoholic liquor dealers pertains to the government and
affairs of the city.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF ELGIN, ILLINOIS:
Section 1. That Section 6.06.040 of the Elgin Municipal Code, 1976, as amended, entitled
“License Classes; Fees:” be and is hereby further amended by amending subparagraph H1
thereof which pertains to the Class E-1 license to read as follows:
“1. Class E-1: For the retail sale in restaurants, as defined in article I, paragraph 2.23 of
the Illinois liquor control law, of alcoholic liquor for consumption on the premises for
establishments located in the CC1 center city zoning district and east of the Fox River,
and on the premises for establishments located in the CC2 center city zoning district and
east of the Fox River south of Kimball, west of Dundee/Center and north of Prairie;
expressly providing, however, that such licenses shall be issued only to establishments
having a regular capacity, in accordance with existing city and state public health and fire
prevention ordinances and statutes, to serve meals to not less than seventy five (75)
persons at any one time, that fifty percent (50%) or more of the gross revenue in any

month from the operation of the licensed premises must be from the serving of meals and
that fifty percent (50%) or more of the floor area of the establishment must be utilized for
dining room areas for the regular service of meals. The license fee per year is five
hundred seventy two dollars ($572.00).”
Section 2. That all ordinances or parts of ordinances in conflict with the provisions of
this ordinance be and are hereby repealed the extent of any such conflict.
Section 3. That this ordinance shall be in full force and effect upon its passage in the
manner provided by law.

AUTHORIZING EXECUTION OF A COMMUNITY DEVELOPMENT
BLOCK GRANT SUB-RECIPIENT AGREEMENT
WITH P.A.D.S. OF ELGIN, INC.
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS,
that Sean R. Stegall, City Manager, and Kimberly A. Dewis, City Clerk, be and are hereby
authorized and directed to execute a community development block grant agreement on behalf of
the City of Elgin with P.A.D.S. of Elgin, Inc. for emergency shelter monthly rental costs, Elgin,
Illinois, a copy of which is attached hereto and made a part hereof by reference.
