HomeMy WebLinkAboutd - February 22, 2012 CC71 VOLUME LXXVII FEBRUARY 22, 2012 COUNCIL OF THE CITY OF ELGIN, ILLINOIS COUNCIL-MANAGER FORM OF GOVERNMENT REGULAR MEETING The regular meeting of the Council of the City of Elgin, Illinois, was held on February 22, 2012, in the Council Chambers. The meeting was called to order by Mayor Kaptain at7:20 p.m. The Invocation was given by Pastor Mark Ahrens and the Pledge of Allegiance was led by Councilmember F. John Steffen. ROLL CALL Roll call was answered by Councilmembers Dunne, Moeller, Powell, Prigge, Steffen, and Mayor Kaptain. Absent: Councilmember Gilliam. MINUTES OF THE FEBRUARY 8, 2012, COUNCIL MEETING APPROVED AS DISTRIBUTED Councilmember Steffen made a motion, seconded by Councilmember Dunne, to approve the February 8, 2012, Council Meeting Minutes as distributed. Upon a roll call vote: Yeas: Councilmembers Dunne, Moeller, Powell, Prigge, Steffen, and Mayor Kaptain. Nays: None. COMMUNICATIONS Mayor Kaptain read the following proclamation: PROCLAMATION WHEREAS, Daina DeNye was hired as the city’s first Assistant Purchasing Director on March 22, 2005; and WHEREAS, Ms. DeNye was Acting Purchasing Director from November 7, 2011 to January 15, 2012 and was promoted to Purchasing Officer on January 16, 2012; and WHEREAS, during Ms. DeNye’s seven years with the city of Elgin, Ms. DeNye worked toward and was the city’s first employee to attain the level of Certified Public Procurement Officer, awarded by the Universal Public Purchasing Certification Council; and WHEREAS, Ms. DeNye was awarded the coveted certificate by showing her commitment to the ethics of the public procurement profession and affirms her high level of competency as a purchasing professional; and FEBRUARY 22, 2012 VOLUME LXXVII 72 WHEREAS, Ms. DeNye has contributed many hours on behalf of the residents of the city of Elgin as the Assistant Purchasing Director and has been a faithful and diligent public servant; and NOW, THEREFORE, I, David Kaptain, Mayor of the City of Elgin do hereby extend sincere and warm congratulations and esteem to Daina DeNye for her outstanding service to the community on the occasion of her promotion to Purchasing Officer and wish her success in her new position. Kaptain Mayor RECOGNIZE PERSONS PRESENT Chuck Keysor expressed his concerns about the Chamber of Commerce’s Service Agreement and the accountability for the aspects of the agreement. Tom Conro encouraged donation to the ROPE camp and invited the community to attend Unity Fest 2012. BID 12-002 TO MARC KRESEMERY CONSTRUCTION IN THE AMOUNT OF $91,218 FOR OAKS CLUB LIFT STATION ABANDONMENT Councilmember Steffen motioned, seconded by Councilmember Powell, to award Bid 12-002 Marc Kresmery Construction in the amount of $91,218 for Oaks Club Lift Station Abandonment. Upon a roll call vote: Yeas: Councilmembers Dunne, Moeller, Powell, Prigge, Steffen, and Mayor Kaptain. Nays: None. BID 12-003 AWARDED TO THE LOWEST RESPONSIVE BIDDERS IN THE AMOUNT OF $122,829 FOR GOLF CHEMICAL SUPPLIES Councilmember Moeller motioned, seconded by Councilmember Steffen, to award Bid 12-003 the bid to the lowest responsive bidders in the amount of $122,829 for Golf Chemical Supplies. Upon a roll call vote: Yeas: Councilmembers Dunne, Moeller, Powell, Prigge, Steffen, and Mayor Kaptain. Nays: None. VOLUME LXXVII FEBRUARY 22, 2012 73 BID 12-007 AWARDED TO TRIGGI CONSTRUCTION COMPANY INC. IN THE AMOUNT OF $1,847,258 FOR CENTER AND SENECA STREET REHABILITATION AND WATER MAIN PROJECT Councilmember Steffen motioned, seconded by Councilmember Powell, to award Bid 12-007 to Triggi Construction Company, Inc. of West Chicago in the amount of $1,847,258 for Center and Seneca Street Rehabilitation and Water Main Project. Upon a roll call vote: Yeas: Councilmembers Dunne, Moeller, Powell, Prigge, Steffen, and Mayor Kaptain. Nays: None. PETITION 07-12 APPROVED REQUESTING FINAL PLAT APPROVAL OF RANDALL POINT BUSINESS PARK RESUBDIVISION NUMBER 1; PROPERTY LOCATED AT 1385 & 1401 MADELINE LANE (LOTS 1 & 6) BY PANCOR CONSTRUCTION AND DEVELOPMENT, LLC., AS APPLICANT AND RANDALL POINT BUSINESS CENTER AS BENEFICIARY OF TRUSTS KNOW AS NUBMERS 14571 AND 14576 AS OWNER Community Development Director, Marc Mylott provided a brief overview of Petition 07-12. Councilmember Dunne asked about expansion in the future and was told that there is still potential to expand east and west. Councilmember Dunne motioned, seconded by Councilmember Steffen, to approve Petition 07-12 subject to conditions. Upon a roll call vote: Yeas: Councilmembers Dunne, Moeller, Powell, Prigge, Steffen, and Mayor Kaptain. Nays: None. RESOLUTION 12-38 ADOPTED APPROVING FINAL PLAT FOR RANDALL POINT BUSINESS PARK RESUBDIVISION NO. 1 (1385 AND 1401 MADELINE LANE - LOTS 1 AND 6) Councilmember Dunne motioned, seconded by Councilmember Moeller, to approve the final Plat for Randall Point Business Park Resubdivision No. 1. Councilmember Steffen motioned, seconded by Councilmember Moeller, to adopt the following resolution. RESOLUTION 12-39 ADOPTED AUTHORIZING EXECUTION OF AN AGREEMENT FOR ENERGY CONSULTING SERVICES WITH INDEPENDENT ENERGY CONSULTANTS, INC. Councilmember Dunne asked about the consulting pricing, the diverse selection of companies and billing issues that other communities had experienced. VOLUME LXXVII FEBRUARY 22, 2012 75 Corporation Counsel Cogley clarified the Consultants role in the process and noted that the final selection of a vendor is ultimately up to the City Council. Mr. Cogley also noted that the consultant fee is derived from the selected alternate retail energy supplier. Councilmember Steffen motioned, seconded by Councilmember Moeller, to adopt the following resolution. Upon a roll call vote: Yeas: Councilmembers Dunne, Powell, Prigge, Steffen, and Mayor Kaptain. Nays: None. Abstain: Councilmember Moeller due to a conflict of interest. Resolution No. 12-39 RESOLUTION AUTHORIZING EXECUTION OF AN AGREEMENT FOR ENERGY CONSULTING SERVICES WITH INDEPENDENT ENERGY CONSULTANTS, INC. BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS, that David J. Kaptain, Mayor, and Kimberly A. Dewis, City Clerk, be and are hereby authorized and directed to execute an Agreement for Energy Consulting Services with Independent Energy Consultants, Inc. on behalf of the City of Elgin in connection with the electric aggregation program, a copy of which is attached hereto and made a part hereof by reference. s/ David J. FEBRUARY 22, 2012 VOLUME LXXVII 76 Resolution No. 12-40 RESOLUTION AUTHORIZING EXECUTION OF AN AGREEMENT WITH THE COOK COUNTY ASSESSOR’S OFFICE FOR ACCESS TO GEOGRAPHIC INFORMATION SYSTEM WHEREAS, the Cook County Assessor’s Office (the “CCAO”) has a geographic information system (“GIS”) database that it is willing to make available to the City of Elgin at no cost; and WHEREAS, GIS data-sharing with the CCAO will allow the City to access GIS and other data from the CCAO, and facilitate the City’s decision-making with respect to land within its jurisdiction; and WHEREAS, the City and the CCAO are authorized to enter into this Agreement pursuant to Article VII, Section 10 of the Illinois Constitution of 1970, the Illinois Intergovernmental Cooperation Act, 5 ILCS 220/1 et seq., and the City’s authority as an Illinois home rule municipality. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS, that Sean R. Stegall, City Manager, is hereby authorized and directed to execute an agreement on behalf of the City of Elgin with the Cook County Assessor’s Office to allow the City to access the Cook County Assessor’s Office’s GIS database and other data, a copy of which is attached hereto and made a part hereof by reference. s/ David J. (216 PRAIRIE STREET) The Council discussed the terms of the business loan including requirements regarding opening a business at the location and termination clauses. VOLUME LXXVII FEBRUARY 22, 2012 77 Assistant City Manager Rick Kozal noted that there are leases imminent for the property. He also stated the loans termination clause of any reason upon written fourteen (14) day notice. Councilmember Steffen motioned, seconded by Councilmember Moeller, to adopt the following resolution. Resolution No. 12-41 RESOLUTION AUTHORIZING EXECUTION OF A DOWNTOWN BUSINESS LOAN INTEREST SUBSIDY PROGRAM AGREEMENT WITH THKFL, INC. ( 216 Prairie Street) BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS , that Sean R. Stegall, City Manager, and Kimberly A. Dewis, City Clerk, be and are hereby authorized and directed to execute a Downtown Business Loan Interest Subsidy Program Agreement on behalf of the City of Elgin with THKFL, Inc. for the property located at 216 Prairie Street, a copy of which is attached hereto and made a part hereof by reference. s/ David J. Resolution No. 12-33 RESOLUTION ACCEPTING FOR OWNERSHIP AND MAINTENANCE THE PUBLIC IMPROVEMENTS IN PROVIDENCE UNIT 3D SUBDIVISION BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS, that the City of Elgin hereby accepts for ownership and maintenance the public improvements in Providence Unit 3D Subdivision which include sanitary sewer main, water main and their respective appurtenances within dedicated easements and will add the following city-maintained facilities: approximately 3,193 lineal feet of 8-inch water main; seven, 8-inch valves in 4-foot vaults; 13 fire hydrants; 2,244 lineal feet of 8-inch sanitary sewer; 21 sanitary manholes; and 2 street name signs. s/ David J. Resolution No. 12-35 RESOLUTION RELEASING CERTAIN EXECUTIVE SESSION MINUTES OF THE CITY COUNCIL OF THE CITY OF ELGIN WHEREAS, the City Council of the City of Elgin has met from time to time in executive session for purposes authorized by the Illinois Open Meetings Act; and WHEREAS, as required by the Act, the City Clerk has kept written minutes of all such executive sessions; and FEBRUARY 22, 2012 VOLUME LXXVII 80 WHEREAS, pursuant to the requirements of the Illinois Open Meetings Act, the City Council has met in closed session to review all closed session minutes; and WHEREAS, they have determined that a need for confidentiality still exists as to a portion of the executive session minutes from the meetings set forth on the exhibit referred to herein; and WHEREAS, they have further determined that the remaining portion of the meetings listed no longer require confidential treatment and should be made available for public inspection. VOLUME LXXVII FEBRUARY 22, 2012 83 Ordinance No. T3-12 AN ORDINANCE ABATING THE ANNUAL TAX FOR 2011 FOR GENERAL OBLIGATION CORPORATE PURPOSE BONDS, SERIES 1996A WHEREAS, the City of Elgin will have sufficient funds on hand to pay the tax levied by Ordinance S14-96, An Ordinance Providing for the Issuance of $21,640,000 General Obligation Corporate Purpose Bonds, Series 1996A, of the City of Elgin, Kane and Cook Counties, Illinois, and Providing for the Levy and Collection of a Direct Annual Tax for the Payment of the Principal of and Interest on said Bonds; and WHEREAS, the levy of the tax for the year 2011 provided in the ordinance is unnecessary. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS: Section 1. That the County Clerks of Kane and Cook Counties, are hereby authorized and directed to abate the tax of $121,538 for the year 2011 as provided and levied in the ordinance providing for the issuance of $21,640,000 General Obligation Corporate Purpose Bonds, Series 1996A, passed December 4, 1996, a copy of which was filed with each of said county clerks Section 2. That the City Clerk is authorized and directed to file a certified copy of this ordinance with the County Clerks of Kane and Cook Counties, Illinois, on or before April 1, 2012. Section 3. Ordinance No. T21-12 AN ORDINANCE REGARDING ABATING A PORTION OF THE ANNUAL TAX FOR 2011 FOR REFUNDING AND CORPORATE PURPOSE BONDS WHEREAS, the City Council has adopted Ordinance Numbers T6-12, T7-12, T9-12, T11-12, T15-12, T16-12, T17-12, and T19-12 providing for abating a portion of the annual tax for 2011 for refunding and corporate purpose bonds for the series bonds referred to in such ordinances; and WHEREAS, depending upon the 2011 assessed valuation figures and the state multiplier it may be necessary to further adjust the amounts of the abatement and resulting tax levy in Section 1 of such ordinances in order to arrive at a 2011 tax levy for the City of Elgin not to exceed $46,445,000. VOLUME LXXVII FEBRUARY 22, 2012 105 NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS: Section 1. That the city’s Chief Finance Officer be and is hereby authorized and directed that upon receipt of 2011 assessed valuation figures and the state multiplier to adjust, to the extent reasonably practicable, the amount of the abatement and resulting tax levy in the Section 1 of Ordinance Numbers T6-12, T7-12, T9-12, T11-12, T15-12, T16-12, T17-12, and T19-12 so as to attempt to arrive at a 2011 tax levy for the City of Elgin not to exceed $46,445,000.
