COUNCIL OF THE CITY OF ELGIN, ILLINOIS
COUNCIL-MANAGER FORM OF GOVERNMENT
REGULAR MEETING
The special meeting of the Council of the City of Elgin, Illinois, was held on December 27,
2011, in the 2nd Floor South Conference Room in City Hall. The meeting was called to order by
Mayor Kaptain at 12:00 p.m.
ROLL CALL
Roll call was answered by Councilmembers Dunne, Moeller, Steffen, and Mayor Kaptain.
Councilmember Powell arrived at 12:02 p.m. Absent: Councilmember Gilliam and
Councilmember Prigge.
RESOLUTION 11-213 ADOPTED APPROVING AN AMENDMENT TO THE CITY OF
ELGIN’S PERSONNEL POLICIES
Corporation Counsel Cogley provided a brief description regarding how the amendment would
affect the City’s personnel policies. He stated that this amendment does not affect employees
pension, but it does address the “salary spiking” issue, and that it only affects employees hired
before January 1, 2012.
Council discussed how the calculations would be determined, how many employees this
amendment would affect, and questioned how often Corporation Counsel believed this
amendment would be used, as well as if the resolution could be rescinded at a later date if it
proved to be ineffective. Corporation Counsel stated that the amendment in all likelihood would
rarely be used and that the Council had the ability to revoke the amendment at any time if
necessary.
Mayor Kaptain stated that an RFP was currently being worked on by Staff to have an outside
agency perform a complete survey of City employees’ salaries and benefits and have them
compared to communities similar to City of Elgin. Councilmember Dunne would like the
agency conducting the study to include current employee positions within the City as well as
future new-hire positions.
Councilmember Steffen made a motion, seconded by Councilmember Moeller, to adopt the
following resolution. Upon a roll call vote: Yeas: Councilmembers Dunne, Moeller, Powell,
Steffen, and Mayor Kaptain. Nays: None.

RESOLUTION APPROVING AN AMENDMENT TO
THE CITY OF ELGIN’S PERSONNEL POLICIES
WHEREAS, the City of Elgin has previously adopted various personnel policies (the
“Policies”) setting forth the general policies of the City of Elgin regarding the terms of
employment with the City of Elgin; an
WHEREAS, the City Council of the City of Elgin desires to ensure that the various
provisions of the Policies do not inadvertently trigger accelerated payments to the Illinois
Municipal Retirement Fund in light of the recently adopted Public Act 97-0609.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF ELGIN, ILLINOIS, as follows:
Section 1. Amendment to City of Elgin Personnel Policies. The City of Elgin’s
Personnel Polices are hereby amended by adding the following section thereto relating to
employees who have begun service before January 1, 2012, with such new section being as
follows:
Employees Who Begin Service Before January 1, 2012: In addition to any other
categories under which an employee of the City of Elgin may be classified
pursuant to the City of Elgin’s personnel policies, there shall be a class of
employees who began service with the City of Elgin prior to January 1, 2012 (a
“Pre-2012 Employee”). To the maximum extent authorized by law, for all Pre-
2012 Employees, it is the policy of the City of Elgin not to include as part of such
employee’s reported earnings for any of the 12-month periods that may be used to
determine such employee’s final rate of earnings for the purposes of assessing or
making accelerated contributions or payments to the Illinois Municipal
Retirement Fund in accordance with 40 ILCS 5/7-172(k), any of the earnings,
adjustments, payments, benefits and compensation which are provided for or
otherwise allowed pursuant to the terms of this personnel policy, including,
without limitation:
a. Increases in vacation time earned as a result of seniority or continued
service;
b. Increases in authorized accrual of vacation time as a result of seniority or
continued service;
c. Increases in sick leave time earned as a result of seniority or continued
service;

d. Increases in authorized accrual of vacation time as a result of seniority or
continued service;
e. Payments made from selling back to the City of Elgin any accrued
vacation or sick leave time;
f. Changes to insurance benefits that are generally applicable to all Pre-2012
Employees;
g. Increases in annual compensation based on seniority or continued service,
including “step” increases;
h. Adjustments in annual salary based on increases to the Consumers Price
Index or another generally accepted index of inflation;
i. Merit bonuses; and
j. Payments made as reimbursement of amounts paid to an employee for use
of a personal vehicle or other equipment or property.
The provisions of this Section are intended to be severable in the event that any
part of this Section is found not to be enforceable under applicable law.
Section 2. Superseding Effect. In the event of any conflict between the provisions of this
Resolution and the provisions in any other City of Elgin personnel policy, the provisions of this
Resolution shall supersede and control.
Section 3. Effective Date. This Resolution shall be in full force and effect immediately
upon its passage and approval in a manner provided by law.

Councilmember Dunne made a motion, seconded by Councilmember Steffen, to adjourn the
meeting. Upon a roll call vote: Yeas: Councilmembers Dunne, Gilliam, Moeller, Powell,
Prigge, Steffen, and Mayor Kaptain. Nays: None.
The meeting adjourned at 12:20 p.m.
