HomeMy WebLinkAbouts - October 12, 2011 CC433 VOLUME LXXVI OCTOBER 12, 2011 COUNCIL OF THE CITY OF ELGIN, ILLINOIS COUNCIL-MANAGER FORM OF GOVERNMENT REGULAR MEETING The regular meeting of the Council of the City of Elgin, Illinois, was held on October 12, 2011, in the Council Chambers. The meeting was called to order by Mayor Kaptain at 8:00 p.m. The Invocation was given by Pastor Mark Ahrens New Covenant Fellowship and the Pledge of Allegiance was led by Councilmember Robert Gilliam. ROLL CALL Roll call was answered by Councilmembers Dunne, Gilliam, Moeller, Powell, Prigge, Steffen, and Mayor Kaptain. Absent: None. MINUTES OF THE SEPTEMBER 28, 2011, COUNCIL MEETING APPROVED AS DISTRIBUTED Councilmember Prigge made a motion, seconded by Councilmember Moeller, to approve the September 28, 2011, Council Meeting Minutes as distributed. Upon a roll call vote: Yeas: Councilmembers Dunne, Gilliam, Moeller, Powell, Prigge, Steffen, and Mayor Kaptain. Nays: None. COMMUNICATIONS Food Day Proclamation Mayor Kaptain read the following proclamation: PROCLAMATION WHEREAS, the health and well-being of our citizens is of primary concern for the City of Elgin and reducing obesity and diet-related diseases by promoting safe and healthy diets is a critical factor in improving citizens’ overall health; and WHEREAS, supporting sustainable family farms and local agriculture benefits the local economy; and WHEREAS, obtaining truth in labeling, fair pay and safe conditions for food and farm workers is beneficial for both the producer and consumer so that the food we produce and consume is safe and fair for all; and OCTOBER 12, 2011 VOLUME LXXVI 434 WHEREAS, expanding access to food and ending hunger is of critical importance to aid those who live in food deserts; and WHEREAS, curbing junk food marketing aimed at children is vitally important in order to combat rising obesity rates and raise a generation of healthy children; and WHEREAS, protecting the environment and farm animals is necessary to sustain future generations; and WHEREAS, Elgin Green Drinks will host a “Back to Nature Food Day Awareness Fair and Tasting” on October 22 & 23 at Simple Balance Holistic Center to promote food awareness in the community. NOW, THEREFORE, I, David Kaptain, Mayor of the City of Elgin, Illinois, do hereby proclaim Monday, October 24, 2011 as FOOD DAY in the City of Elgin, and urge all citizens to participate in the planned activities. Kaptain Mayor Red Ribbon Day Proclamation Mayor Kaptain read the following proclamation: PROCLAMATION WHEREAS, The Elgin Gang & Drug Task Force’s mission is to reduce gang and drug activity and ensure a safe and healthy community through facilitation of an effective and strategic integration of resources, the building of strong relationships, the fostering of open communication, and continuous education; and WHEREAS, The Elgin Gang & Drug Task Force formed in the early 1990’s to help the city of Elgin and the Elgin Police Department deal with increasing gang violence and drug trafficking problems; and WHEREAS, The Elgin Gang & Drug Task Force along with the help and support of the Elgin Police Department, assisted schools, community organizations and neighborhood groups in accessing vital information and resources on gang and drugs; and VOLUME LXXVI OCTOBER 12, 2011 435 WHEREAS, The Elgin Gang & Drug Task Force was also once the central entity responsible for dispersing City Block Grant funds to organizations, schools, neighborhood groups, and Elgin Police Department in an effort to help them with their anti-gang and anti-drug efforts; and WHEREAS, The Red Ribbon was chosen as a symbol commemorating the work of Enrique “Kiki” Camarena, a Drug Enforcement Administration agent, who was murdered in the line of duty and has come to represent the belief that one person can make a difference; and WHEREAS, the Red Ribbon Campaign was established by Congress in 1988 to promote this belief and encourage a drug-free lifestyle and involvement in drug prevention efforts; and WHEREAS, October 23 - 31, 2011, has been designated National Red Ribbon Week calling on all Americans to show their support for a drug-free state by wearing a red ribbon and participating in drug-free activities during that week; and WHEREAS, The Elgin Gang & Drug Task Force will work until our communities are free of illegal drugs and gang activity NOW, THEREFORE. I David Kaptain, Mayor do hereby proclaim October 23 - 31, 2011, as Red Ribbon Week in the city of Elgin and encourage all citizens, businesses, public and private agencies, media, religious and educational institutions to wear and display red ribbons and participate in drug-free activities throughout that week, joining the rest of the state in promoting the Red Ribbon Celebration and a drug-free America. Kaptain Mayor Domestic Violence Awareness Month Mayor Kaptain read the following proclamation: PROCLAMATION WHEREAS, violence against women and children continues to become a more prevalent problem; and OCTOBER 12, 2011 VOLUME LXXVI 436 WHEREAS, the problems of domestic violence are not confined to any group of people, but cross all economic, gender, racial and societal barriers and are supported by societal indifference; and WHEREAS, the crime of domestic violence violates an individual’s privacy, dignity, security and humanity through the systematic use of physical, emotional, sexual, psychological and economic control and/or abuse; and WHEREAS, the impact of domestic violence is wide-ranging, directly affecting families and society as a whole; and WHEREAS, it is battered women themselves who have been at the forefront of efforts to bring peace and equity to the home; and WHEREAS, it is fitting to set aside a special time to bring this issue to the attention of all residents of the City of Elgin so they can become better informed and involved in programs to eliminate this epidemic from our society. NOW, THEREFORE, I, David Kaptain, Mayor of the City of Elgin, Illinois, do hereby proclaim the month of October 2011 as Domestic Violence Awareness Month in the City of Elgin and encourage our residents to join forces with victim service programs, criminal justice officials and concerned citizens across the country to raise the public awareness of domestic violence issues. Kaptain Mayor Elgin Police Explorers Award Recognition Officer Tom Olsen stated the purpose and mission of the Explorers Program and Explorer Cadets presented the Mayor and Council with their second place state trophy. RECOGNIZE PERSONS PRESENT John Rothenberger, retired City employee, offered clarification of his previous comments regarding a memo and policy, discussed salaries of City of Elgin employees, and stated his interest in participating in any focus groups involving code enforcement. Eleanor Richoz thanked the Mayor, Council, and Staff who were responsible for the new room for the Senior Center. She also praised Cheri Aschenbrenner as an exemplary City employee who serves the entire community of Elgin. Mrs. Richoz also thanked the Elgin Police Department and Elgin Fire Department for all that they do within the community. VOLUME LXXVI OCTOBER 12, 2011 437 Mary Jo McCornack stated she was a volunteer at the Elgin Senior Center and thanked the Council for the Senior Center addition. Bill Werst expressed his concerns about the City’s budget and the fall leaf pick-up program. Chuck Keysor discussed the business license within the City and the terms of the purchase of service agreement with the Elgin Chamber of Commerce. Fran Cella thanked the Council and Community for making the Gifford Park Association’s 30th Anniversary celebration a success. She presented the Mayor and Council with a plaque and booklet commemorating the event. Anthony Nance discussed the City’s budget and offered suggestions regarding maintaining taxes. Craig Mason stated that he feels businesses within the City feel too intimidated to speak freely with the Council about revoking the business licenses. He wanted the Council to be aware of this and do more to reach out to local businesses and encourage their input. Marty McCormack, a representative from Keith Farnum’s office, announced the following two upcoming events: Cell Collection Drive and Good Neighbor Business of the Year Award. BID 11-031 AWARDED TO UNIFORM DEN EAST FOR THE PURCHASE OF POLICE BODY ARMOR Councilmember Steffen made a motion, seconded by Councilmember Moeller, to approve an agreement with Uniform Den East in the amount of $32,325 for the purchase of police body armor. Upon a roll call vote: Yeas: Councilmembers Dunne, Gilliam, Moeller, Powell, Prigge, Steffen, and Mayor Kaptain. Nays: None. BID 11-050 AWARDED TO ALL SERVICE CONTRACTING CORPORATION FOR THE PURCHASE OF GAC FILTER MEDIA REMOVAL AND REPLACEMENT Councilmember Steffen made a motion, seconded by Councilmember Powell, to approve an agreement with All Service Contracting Corporation in the amount of $203,274 for the purchase of GAC filter media removal and replacement. Upon a roll call vote: Yeas: Councilmembers Dunne, Gilliam, Moeller, Powell, Prigge, Steffen, and Mayor Kaptain. Nays: None. RESOLUTION 11-171 ADOPTED ESTABLISHING A POLICY ON FUND BALANCE CLASSIFICATION AND DISBURSEMENT IN ACCORDANCE WITH GOVERNMENTAL ACCOUNTING STANDARDS BOARD STATEMENT NO. 54 Councilmember Gilliam made a motion, seconded by Councilmember Steffen, to adopt the following resolution. Upon a roll call vote: Yeas: Councilmembers Dunne, Gilliam, Moeller, Powell, Prigge, Steffen, and Mayor Kaptain. Nays: None. Resolution No. 11-171 RESOLUTION ESTABLISHING A POLICY ON FUND BALANCE CLASSIFICATION AND DISBURSEMENT IN ACCORDANCE WITH GOVERNMENTAL ACCOUNTING STANDARDS BOARD STATEMENT NO. 54 BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS, that it hereby establishes a policy on fund balance classification and disbursement in accordance with governmental accounting standards board statement no. 54 as follows: PURPOSE The purpose of this policy is to define the components of fund balance, describe how amounts are classified into each component and to establish the order of use of fund balance in all governmental funds. The City of Elgin will use GASB’s definitions of fund balance for the annual financial reports and for all other financial reporting. BACKGROUND In February 2009, the Governmental Accounting Standards Board (GASB) issued Statement No. 54, Fund Balance Reporting and Governmental Fund Type Definition. The objective of this Statement is to enhance the usefulness of fund balance information by providing clearer fund balance classifications that can be more consistently applied and by clarifying the existing governmental fund type definitions. GASB Statement No. 54 will shift the focus of fund balance reporting from the availability of fund resources for budgeting to “the extent to VOLUME LXXVI OCTOBER 12, 2011 439 which the government is bound to honor constraints on the specific purposes for which amounts in the fund can be spent”. COMPONENTS OF FUND BALANCE Fund balance is an important measure that represents the difference between a fund’s assets and liabilities. GASB Statement No. 54 establishes five components of fund balance. Nonspendable fund balance - Amounts that are not in a spendable form or are required to be maintained intact. Restricted fund balance - Amounts that can be spent only for the specific purposes stipulated by constitution, external resource providers, or through enabling legislation. Committed fund balance - Amounts that can be used only for the specific purposes determined by a formal action of the government’s highest level of decision-making authority. Assigned fund balance - Amounts that are intended to be used by the government for specific purposes but do not meet the criteria to be classified as restricted or committed. In governmental funds other than the general fund, assigned fund balance represents the remaining amount that is not restricted or committed. Unassigned fund balance - The residual classification for the City’s general fund and includes all spendable amounts not contained in the other classifications. In other funds, the unassigned classification should be used only to report a deficit balance resulting from overspending for specific purposes for which amounts had been restricted, committed or assigned. CLASSIFYING FUND BALANCE Nonspendable and Restricted fund balances - determined by the nature of their restrictions. Committed fund balance - The City Council, as the City’s highest level of decision-making authority, may commit fund balance for specific purposes pursuant to constraints imposed by formal actions taken, such as an ordinance or resolution. These committed amounts cannot be used for any other purpose unless the City Council removes or changes the specified use through the same type of formal action taken to establish the commitment. City Council action to commit fund balance needs to occur within the fiscal reporting period; however the amount can be determined subsequently OCTOBER 12, 2011 VOLUME LXXVI 440 Assigned fund balance – This policy hereby delegates the authority to assign amounts to be used for specific purposes to the Chief Financial Officer for the purpose of reporting these amounts in the annual financial statements. Unassigned fund balance – These are residual positive net resources in the general fund in excess of what can properly be classified in one of the other four categories and deficient balances in all other funds. SPENDING ORDER OF FUND BALANCE Fund balance classifications should depict the nature of the net resources that are reported in the governmental fund. Fund balance in individual governmental funds may be comprised of a single classification or many classifications. When both restricted and unrestricted funds are available for expenditures, it is the City’s policy to expend restricted resources first then unrestricted resources. Unrestricted fund balance includes the committed, assigned, and unassigned classifications. When any of these amounts are available for expenditure, it is the City’s policy to expend committed resources first, followed by assigned, then unassigned resources. s/ David J. Kaptain David J. VOLUME LXXVI OCTOBER 12, 2011 441 Resolution No. 11-172 RESOLUTION AUTHORIZING EXECUTION OF AN INTERGOVERNMENTAL AGREEMENT WITH THE REGIONAL TRANSPORTATION AUTHORITY FOR THE ELGIN-CHICAGO STREET STATION AREA PLAN BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS, that David J. Kaptain, Mayor, be and is hereby authorized and directed to execute an intergovernmental agreement on behalf of the City of Elgin with the Regional Transportation Authority for the Elgin-Chicago Street Station Area Plan, a copy of which is attached hereto and made a part hereof by reference. s/ David J.
