HomeMy WebLinkAboutl - June 22, 2011 CC241 VOLUME LXXVI JUNE 22, 2011 COUNCIL OF THE CITY OF ELGIN, ILLINOIS COUNCIL-MANAGER FORM OF GOVERNMENT REGULAR MEETING The regular meeting of the Council of the City of Elgin, Illinois, was held on June 22, 2011, in the Council Chambers. The meeting was called to order by Mayor Kaptain at 7:22 p.m. The Invocation was given by Pastor Mark Ahrens from the New Covenant Fellowship Church and the Pledge of Allegiance was led by Mayor Kaptain. ROLL CALL Roll call was answered by Councilmembers Gilliam, Moeller, Powell, Prigge, Steffen, and Mayor Kaptain. Absent: Councilmember Dunne. MINUTES OF THE JUNE 8, 2011, COUNCIL MEETING APPROVED AS DISTRIBUTED Councilmember Steffen made a motion, seconded by Councilmember Moeller, to approve the June 8, 2011, Council Meeting Minutes as distributed. Upon a roll call vote: Yeas: Councilmembers Dunne, Gilliam, Moeller, Powell, Prigge, Steffen, and Mayor Kaptain. Nays: None. COMMUNICATIONS 13th Annual Citizenship Recognition Program Judge Manuel Barbosa acted as emcee and Richard Reed, an Elgin Community College citizenship instructor, reviewed the process of becoming a citizen. Ms. Abril Gant and Ms. Blanca Vargas each spoke about their experiences in the United States and becoming citizens. Members of the Elgin Choral Union sang two selections. Each new citizen was recognized by name by Judge Barbosa and they were congratulated by the Mayor, members of Council, as well as representatives from Keith Farnum and Michael Noland‟s offices. JUNE 22, 2011 VOLUME LXXVI 242 RECOGNIZE PERSONS PRESENT Terry Gable asked that Council review the Lord‟s Park Task Force recommendations and requested that they move forward with some of the projects suggested. Gary Bohlin expressed his concerns about lawfully non-conforming properties, and predatory and discriminatory zoning tactics. Chuck Anderson and Jim Hahs, representatives of El gin ALINOE, stated that the program is currently looking for a permanent facility to house this program. Laurie Faith Gibson-Aiello would like to see the Council move forward with some of the projects that have been suggested by the Lord‟s Park Task Force. BID 11-035 AWARDED TO GROVE MASONRY MAINTENANCE, INC. FOR LORDS PARK MUSEUM MASONRY REPAIR Councilmember Steffen made a motion, seconded by Councilmember Moeller, to award a contract to Grove Masonry Maintenance, Inc. in the amount of $27,000 for masonry repairs at the Lords Park Museum. Upon a roll call vote: Yeas: Councilmembers Gilliam, Moeller, Powell, Prigge, Steffen, and Mayor Kaptain. Nays: None. PUBLIC HEARING REGARDING A SECOND AMENDMENT TO THE ANNEXATION AGREEMENT, AND AN AMENDMENT TO THE PLANNED DISTRICT ORDINANCE NO. G40-05, TO PERMIT ACCESSORY STRUCTURES ATTACHED TO THE PRINCIPAL BUILDING OF CERTAIN PROPERTIES TO ENCROACH INTO THE REQUIRED REAR YARD SETBACK, FOR THE RESIDENTIAL SUBDIVISION KNOWN AS EDGEWATER; PROPERTY LOCATED AT 2700 BOWES ROAD, BY THE CITY OF ELGIN, AS APPLICANT, AND PULTE HOME CORPORATION, AS OWNER (PETITION 10-11) Mayor Kaptain declared the public hearing open. Community Development Director Mylott reviewed the petition and stated the Community Development Department recommends approval of the petition subject to the conditions outlined in the memo received by Council. The Planning and Development Commission also recommended approval subject to conditions. Eugene Walewski stated he supports this amendment and the Staff recommendations. Gary Bohlin questioned if City Staff had worked with the residents of the subdivision when developing this amendment. Mr. Mylott replied in the affirmative. There being no further discussion, Mayor Kaptain declared the public hearing closed. VOLUME LXXVI JUNE 22, 2011 243 PETITION 10-11 APPROVED REQUESTING A SECOND AMENDMENT TO THE ANNEXATION AGREEMENT AND AN AMENDMENT TO THE PLANNED DISTRICT ORDINANCE NO. G40-05, TO PERMIT ACCESSORY STRUCTURES ATTACHED TO THE PRINCIPAL BUILDING OF CERTAIN PROPERTIES TO ENCROACH INTO THE REQUIRED REAR YARD SETBACK, FOR THE RESIDENTIAL SUBDIVISION KNOWN AS EDGEWATER; PROPERTY LOCATED AT 2700 BOWES ROAD, BY THE CITY OF ELGIN, AS APPLICANT, AND PULTE HOME CORPORATION, AS OWNER Community Development Director Mylott stated that in addition to the two conditions outlined in the memo provided to Council, Lot 608 on Rambling Brook Court should be included in the amendment changes. Councilmember Steffen made a motion, seconded by Councilmember Moeller, to approve Petition 10-11 subject to conditions and with the addition of Lot 608. Upon a roll call vote: Yeas: Councilmembers Gilliam, Moeller, Powell, Prigge, Steffen, and Mayor Kaptain. Nays: None. RESOLUTION 11-114 ADOPTED AUTHORIZING EXECUTION OF A LONGITUDINAL PIPELINE ENCROACHMENT AGREEMENT WITH UNION PACIFIC RAILROAD COMPANY (LORD STREET SEWER SEPARATION PROJECT) Councilmember Steffen made a motion, seconded by Councilmember Moeller, to adopt the following resolution. Resolution No. 11-114 RESOLUTION AUTHORIZING EXECUTION OF A LONGITUDINAL PIPELINE ENCROACHMENT AGREEMENT WITH UNION PACIFIC RAILROAD COMPANY (Lord Street Sewer Separation Project) BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS, that David J. Kaptain, Mayor, and Jennifer Quinton, Acting City Clerk, be and are hereby authorized and directed to execute a longitudinal pipeline encroachment agreement on behalf of the City of Elgin with Union Pacific Railroad Company for the Lord Street Sewer Separation Project, a copy of which is attached hereto and made a part hereof by reference. s/ David J. Stegall, City Manager, and Jennifer Quinton, Acting City Clerk, be and are hereby authorized and directed to execute a First Amendment to Purchase of Service Agreement on behalf of the City of Elgin with Elgin Community Network for the creation of neighborhood area boards that provide a structure for communication, collaboration and coordination between residents, city staff and elected officials, a copy of which is attached hereto and made a part hereof by reference. s/ David J. Resolution No. 11-112 RESOLUTION AUTHORIZING EXECUTION OF AN ANNEXATION AGREEMENT (Second Baptist Church of Elgin - 1300 Summit Street) WHEREAS, the owners of record of certain territory described in Exhibit A, attached hereto and made a part hereof by reference, desire annexation of said territory to the City of Elgin; and WHEREAS, said territory is not a part of any other municipality; and WHEREAS, no electors reside on the subject territory; and WHEREAS, the corporate authorities of the City of Elgin desire to annex said territory upon certain terms and conditions; and WHEREAS, a proposed annexation agreement has been filed with the City Clerk and a public hearing has been held after due notice as required by law and all persons appearing and wishing to testify concerning the proposed annexation agreement have been heard; and WHEREAS, it is the considered opinion of the corporate authorities of the City of Elgin that it is in the best interests of the City of Elgin to enter into said annexation agreement as proposed. Ordinance No. G20-11 AN ORDINANCE CLASSIFYING NEWLY ANNEXED TERRITORY IN THE PCF PLANNED COMMUNITY FACILITY DISTRICT AND GRANTING AN AMENDMENT TO PCF ORDINANCE No. G78-04 (1280 and 1300 Summit Street) WHEREAS, the territory herein described as Parcels 2, 3 and 4, commonly known as 1300 Summit Street, have been annexed to the City of Elgin; and WHEREAS, written application has been made to classify said territory in the PCF Planned Community Facility District; and WHEREAS, written application has been made for an amendment to PCF Ordinance G78-04 for the property described herein as Parcel 1 and commonly known as 1280 Summit Street; and WHEREAS, the Planning and Development Commission conducted a public hearing after due notice by publication and has submitted its Findings of Fact and recommended approval; and WHEREAS, the City Council of the City of Elgin concurs in the Findings and Recommendation of the Planning and Development Commission. That the City Council of the City of Elgin hereby grants the rezoning from R- 3 Single Family Residential District in Cook County to PCF Planned Community Facility District at 1280 Summit Street which shall be designed, developed, and operated subject to the following provisions: A. Purpose and Intent. The purpose of this PCF Planned Community Facility District is to provide a planned environment for the various types of community facilities, subject to the provisions of Chapter 19.60, Planned Developments. In general, community facilities provide governmental, recreational, educational, health, social, religious, and transportation services to the community on a for profit or a not for profit basis. B. Supplementary Regulations. Any word or phrase contained herein, followed by the symbol “[SR]”, shall be subject to the definitions and the additional interpretive requirements provided in Chapter 19.90, Supplementary Regulations, of the Elgin Municipal Code, as amended. The exclusion of such symbol shall not exempt such word or phrase from the applicable supplementary regulation. C. General Provisions. In this PCF District, the use and development of land and structures shall be subject to the provisions of Chapter 19.05, General Provisions, of the Elgin Municipal Code, as may be amended from time to time. D. Zoning Districts - Generally. In this PCF Planned Community Facility District, the use and development of land and structures shall be subject to the provisions of Chapter 19.07, Zoning Districts, as may be amended from time to time. E. Location and Size of District. PCF Planned Community facility Districts should be located in substantial conformance to the official comprehensive plan. The amount of land necessary to constitute a separate PCF District exclusive of rights of way, but including adjoining land or land directly opposite a right of way shall not be less than two acres, unless such land is located between any nonresidential zoning district, and any residence district or an residence conservation district, which all have frontage on the same block. No departure from the required minimum size of a planned community facility district shall be granted by the City Council. F. Land Use. In this PCF Planned Community Facility District, the use and development of land and structures shall be subject to the provisions of Chapter 19.10, Land Use, of the Elgin Municipal Code, as amended. That Section 2.20.030 of the Elgin Municipal Code, 1976, as amended, entitled “Establishment” be and is hereby further amended to read as follows: “2.20.030: ESTABLISHMENT: All full time officers and employees of the city named in this chapter shall establish residency within twenty-four (24) months following original appointment whether or not probationary, or employment or promotion to an office or position for which a different residence is required by this chapter. Extensions of time in which to establish residency, or temporary exceptions to residency as required by this chapter, may be granted in the discretion of the city manager for a period not to exceed an additional thirty-six (36) months, upon written application and, where there are practical difficulties or particular hardship in establishing residency within the time provided or in maintaining residency as otherwise provided. Notwithstanding the foregoing, in the event that a full-time officer or employee of the city named in this chapter establishes a new bona fide residence and principal place of abode during either the twenty-four (24) month period or the thirty-six (36) month period referred to in this section, the additional time period for the officer or employee to establish residency within the corporate limits of the City of Elgin shall be deemed terminated and such employee shall immediately thereafter be subject to the residency requirement within the corporate limits of the City of Elgin as provided for in section 2.20.020 hereof. Section 3. That all ordinances or parts of ordinances in conflict with the provisions of this ordinance be and are hereby repealed. Section 4.
