COUNCIL-MANAGER FORM OF GOVERNMENT
REGULAR MEETING
The regular meeting of the Council of the City of Elgin, Illinois, was held on November 5, 2008,
in the Council Chambers. The meeting was called to order by Mayor Schock at 7:25 p.m. The
Invocation was given by Pastor Leon Thornton from the New Beginning Christian Fellowship
and the Pledge of Allegiance was led by Mayor Schock.
ROLL CALL
Roll call was answered by Councilmembers Figueroa, Gilliam, Kaptain, Steffen, Walters and
Mayor Schock. Absent: None.
MINUTES OF THE OCTOBER 22, 2008, COUNCIL MEETING APPROVED AS
DISTRIBUTED
Councilmember Figueroa made a motion, seconded by Councilmember Steffen, to approve the
October 22, 2008, Council Meeting Minutes as distributed. Upon a roll call vote: Yeas:
Councilmembers Figueroa, Gilliam, Kaptain, Steffen, Walters, and Mayor Schock. Nays: None.
RECOGNIZE PERSONS PRESENT
John Collins expressed his concerns about flooding at Preston and Cooper and showed a number
of pictures.
James Halik expressed his support for the odd/even parking ban.
Jim Armstrong expressed his support for the odd/even parking ban.
BID 08-090 AWARDED TO CRD CONSTRUCTION FOR REPLACEMENT OF THE
UNDERGROUND SEWER AT FIRE STATION 4 ON MCLEAN BOULEVARD
Councilmember Walters made a motion, seconded by Councilmember Steffen, to award a
contract to CRD Construction in the amount of $55,596 for the replacement of the underground
sewer at Fire Station 4 on McLean Boulevard, plus the alternate bid to fully paint the walls in the
affected areas. Upon a roll call vote: Yeas: Councilmembers Figueroa, Gilliam, Kaptain,
Steffen, Walters, and Mayor Schock. Nays: None.

PETITION 84-06 APPROVED REQUESTING ANNEXATION, ZONING AND
PRELIMINARY PLAT APPROVAL FOR A RESIDENTIAL SUBDIVISION;
PROPERTY COMMONLY KNOWN AS 1901 VILLA STREET; BY RYLAND HOMES,
AS APPLICANT AND VO-LAND, LLC, AS OWNER.
Councilmember Gilliam made a motion, seconded by Councilmember Figueroa, to remove
Petition 84-06 from the table for consideration. Upon a roll call vote: Yeas: Councilmembers
Figueroa, Gilliam, Kaptain, Steffen, Walters, and Mayor Schock. Nays: None.
Community Development Director Deering stated that the various concerns expressed by
residents of Tuscan Woods and Castle Creek subdivisions at the previous public hearing had
been reviewed by staff. It was determined that only those concerning public improvements
could be addressed by the city. With regard to Tuscan Woods, Mr. Deering reported that there
are no outstanding issues that remain. The Castle Creek subdivision has two issues the city can
deal with pertaining to a storm sewer and landscaping issues. Mr. Deering also pointed out that
after the public hearing, the developer had proposed to remove a road connection. The
Community Development group is recommending that the road connection to Castle Creek
remain. He stated that the developer also wanted to construct duplexes instead of townhomes in
Area X. The Community Development group believes the proposed buffer is adequate for the
construction of the townhomes according to the original plan. Mr. Deering stated the
Community Development group recommends approval subject to conditions.
Councilmember Figueroa referenced a letter from the homeowners association of Castle Creek
indicating their willingness to work with the developer, Ryland Homes.
Councilmember Gilliam made a motion, seconded by Councilmember Figueroa, to approve
Petition 84-06 subject to conditions.
Councilmember Kaptain stated he would not support Petition 84-06 based on reports that he
reviewed and because of the upcoming court decision regarding the following: the covenant, the
water and sewer connections, and the fact that the development will operate at a financial loss to
the city. He pointed out that other developments produce profits for the city, but that this one
will cost the city $175 per year. He also said that this development is outside the original
planning area for the city. Councilmember Walters replied that none of the early developments
would have met the current financial criteria.
Councilmember Steffen stated that he would like to reinforce the fact that there is a process in
place and that the Council needs to rely on the commission to do its job. He feels the Council
got off track because of neighborhood issues. He stated that the Bartlett study showed a positive
impact, that the developer would be paying for some of the water and sewer pressure costs, that
there was already an agreement for a 30% limit on rentals, that ten acres are already in Elgin, and
that the Ryland plan is less dense than the original Bartlett plan.
Upon a roll call vote: Yeas: Councilmembers Figueroa, Gilliam, Steffen, Walters, and Mayor
Schock. Nays: Councilmember Kaptain.

Councilmember Gilliam made a motion, seconded by Councilmember Figueroa, to remove
Petition 85-06 from the table for consideration. Upon a roll call vote: Yeas: Councilmembers
Figueroa, Gilliam, Kaptain, Steffen, Walters, and Mayor Schock. Nays: None.
Mr. Deering stated this was for the commercial portion of the property and that the Community
Development group recommended approval subject to conditions.
Councilmember Steffen made a motion, seconded by Councilmember Figueroa, to approve
Petition 85-06 subject to conditions. Upon a roll call vote: Yeas: Councilmembers Figueroa,
Gilliam, Steffen, Walters, and Mayor Schock. Nays: Councilmember Kaptain.
PUBLIC HEARING DATE SET FOR DECEMBER 3, 2008, TO CONSIDER THE
ESTABLISHMENT OF “BACK-UP” SPECIAL SERVICE AREAS FOR
STORMWATER MANAGEMENT FACILITIES IN CASTLE CREEK AND
CREEKSIDE SUBDIVISIONS
Councilmember Figueroa made a motion, seconded by Councilmember Gilliam, to set the public
hearing date for December 3, 2008, to consider the establishment of “Back-up” Special Service
Areas for stormwater management facilities in Castle Creek and Creekside Subdivisions. Upon a
roll call vote: Yeas: Councilmembers Figueroa, Gilliam, Kaptain, Steffen, Walters, and Mayor
Schock. Nays: None.

AN ORDINANCE
PROPOSING THE ESTABLISHMENT OF THE
CASTLE CREEK SUBDIVISION
SPECIAL SERVICE AREA IN THE CITY OF ELGIN, ILLINOIS
AND PROVIDING FOR A PUBLIC HEARING
AND OTHER RELATED PROCEDURES
WHEREAS, the City of Elgin is a home rule unit under Article VII, Section 6(a) of the
1970 Constitution of the State of Illinois; and
WHEREAS, subject to Article VII, Section 6(a) of the 1970 Constitution of the State of
Illinois, a home rule unit may exercise any power and perform any function pertaining to its
government and affairs for the protection for the public health, safety, morals and welfare; and
WHEREAS, special service areas are established pursuant to Article VII, Section 6(l) of
the 1970 Constitution of the State of Illinois and the Special Service Area Tax Law (35 ILCS
200/27-5, et seq.) and the Property Tax Code (35 ILCS 200/1-1 et seq.); and
WHEREAS, it is in the public interest that the area legally described in Exhibit A to this
resolution be established as the Castle Creek Subdivision Special Service Area of the City of
Elgin for the purposes described in this resolution (the “Special Service Area”); and
WHEREAS, the approximate location of the proposed Special Service Area is 1801 Villa
Street in the City of Elgin, Kane County, Illinois. An accurate map depicting the location of the
proposed Special Service Area is attached to and incorporated b y reference into this resolution as
Exhibit B.
WHEREAS, the Special Service Area is compact and contiguous and entirely l ocated
within the boundaries of the City; and
WHEREAS, the Special Service Area will benefit specially from the municipal services
to be provided by the City and that said municipal services are unique and in addition to
municipal services provided to the City of Elgin as a whole, and it is, therefore, in the best
interests of the Special Service Area and the City of Elgin as whole tha t special taxes be levied
against the Special Service Area for the services to be provided be considered at a public
hearing.
NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of Elgin,
Illinois as follows:
Section 1. Incorporation of Preambles. The preambles of this ordinance are hereby
incorporated into this text as if set out herein in full.

Section 2. That a public hearing shall be held by the City Council of the City of Elgin on
December 3, 2008, at 7:00 p.m. in the City Council Chambers of Elgin City Hall, 150 Dexter
Court, Elgin, Illinois to consider the establishment of a Special Service Area consisting of
territory legally described in Exhibit A and as depicted on the map labeled Exhibit B, both
exhibits being attached to and incorporated by reference into this resolution.
At the hearing, a tax levy for the Special Service will be considered. The proposed a nnual tax
levy for the Special Service Area is in an amount not to exceed an annual rate of 2.181 of the
equalized assessed value of the property within the proposed Special Service Area and the tax
will be levied for an indefinite period of time from and after the date of the ordinance
establishing the Special Service Area. These taxes shall be in addition to all other taxes permitted
by law and shall be levied pursuant to the provisions of the Property Tax Code (35 ILCS 200/1-1
et seq). The tax levies are intended to produce approximately $89,620.00 annually for the cost of
the services described above. The City of Elgin, however, may annually levy up to the maximum
rate specified in the ordinance establishing the Special Service Area for the cost of the services
described above as said services become necessary and are provided by the City of Elgin.
Notwithstanding the foregoing, taxes shall not be levied hereunder and the proposed Special
Service Area shall remain abeyant and shall take effect only in the event the homeowners‟ or
other property owner association responsible for the property within the proposed Special
Service Area fails to maintain, repair, replace or pay for the improvements described above
and/or any related costs for those improvements, so as to require the City of Elgin to assume
those responsibilities.
Notice of the public hearing shall be published at least once not less than fifteen (15) days prior
to the public hearing in the Courier News, a newspaper of general circulation in the City of
Elgin. Additionally, notice of the public hearing by mail shall be provided with the public
hearing notice being deposited in the U.S. Mail not less than ten (10) days prior to the time set
for the public hearing. The notice of public hearing shall be addressed to the person or persons in
whose name the general taxes for the last preceding year were paid on each lot, block, tract or
parcel of land lying within the Special Service Area, and in the event taxes for the last preceding
year were not paid, the notice of the Hearing was sent to the person or persons last listed on the
tax rolls prior to that year as the owner or owners of said property.
The notice of the public hearing shall substantially be in the following form:

issue and may object to the establishment of the Special Service Area and the tax
levy affecting that Special Service Area.
The purpose for establishing the Special Service Area is to provide
services including the operation, maintenance, repair, rehabilitation, replacement
and reconstruction of any site runoff storage area, drainage way, ditch, swale,
storm sewer, or other stormwater facility; costs of design, engineering and other
consulting services, surveying and permits, public liability insurance, and all
administrative, legal and other costs or expenses incurred in connection therewith
and with the administration of the Special Service Area, including the repayment
of any loan or debt incurred for the provision of such services. All the described
services described are unique and in addition to services generally provided by the
City of Elgin.
At the hearing, all persons affected will be provided with an opportunity to
be heard. At the hearing, a tax levy for the Special Service will be considered. The

to the proposed Special Service Area that has been signed b y at least fifty-one
percent (51%) of the electors residing within the proposed Special Service Area,
and by at least fifty-one percent (51%) of the owners of record of the land
included within the boundaries of the proposed Special Service Area, is filed with
the City of Elgin City Clerk within sixty (60) days following the final
adjournment of the public hearing regarding the establishment of the proposed
Special Service Area, no such Special Service Area may be established nor any
tax levied or imposed.

AND OTHER RELATED PROCEDURES

AN ORDINANCE
RECLASSIFYING CERTAIN PROPERTY AT
1405 WING STREET, 1408 and 1418 HARLAN AVENUE
(New Hope Mission Baptist Church)
WHEREAS, written application has been made to reclassify certain properties located at
1405 Wing Street, 1408 and 1416 Harlan Avenue, from CF Community Facility District and
RC2 Residence Conservation District, to PCF Planned Community Facility District; and
WHEREAS, the Planning and Development Commission conducted a public hearing
after due notice by publication and has submitted its findings of fact and recommended approval;
and
WHEREAS, the City Council of the City of Elgin concurs in the findings and
recommendation of the Planning and Development Commission.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF ELGIN, ILLINOIS:
Section 1. That the City Council of the City of Elgin hereby adopts the Findings of
Fact, dated September 15, 2008, made by the Planning and Development Commission, a copy of
which is attached hereto and made a part hereof by reference as Exhibit A.
Section 2. That Chapter 19.08, Section 19.08.020 entitled Zoning District map of the
Elgin Municipal Code, as amended, be and the same is hereby further amended by adding thereto
the following paragraph:
The boundaries hereinafter laid out in the Zoning District Map, as amended, be
and are hereby altered by including in the PCF Planned Community Facility
District the following described property:

Section 3. That the City Council of the City of Elgin hereby grants the map amendment
to PCF Planned Community Facility District, for the properties commonly known as 1405 Wing
Street, 1408 and 1416 Harlan Avenue, and legally described above, which shall be designed,
developed, and operated subject to the following provisions:
A. Purpose and Intent. The purpose and intent of this PCF zoning district is to provide a
planned environment for various types of community facilities, subject to the provisions
of Chapter 19.60 Planned Developments, of the Elgin Municipal Code, 1976, as
amended. In general, community facilities provide governmental, recreational,
educational, health, social, religious, and transportation services to the community on a
for profit or a not for profit basis.
B. Supplementary Regulations. Any word or phrase contained herein, followed by the
symbol “[SR]”, shall be subject to the definitions and the additional interpretive
requirements provided in Chapter 19.90, Supplementary Regulations of the Elgin
Municipal Code, 1976, as amended. The exclusion of such symbol shall not exempt such
word or phrase from the applicable supplementary regulation.
C. General Provisions. In this PCF zoning district, the use and development of land and
structures shall be subject to the provisions of Chapter 19.05, General Provisions, of the
Elgin Municipal Code, 1976, as amended.
D. Zoning Districts - Generally. In this PCF zoning district, the use and development of
land and structures shall be subject to the provisions of Chapter 19.07, Zoning Districts,
of the Elgin Municipal Code, 1976, as amended.
E. Location and Size of District. This PCF zoning district should be located in substantial
conformance to the official comprehensive plan. The amount of land necessary to
constitute a separate PCF zoning district exclusive of rights-of-way, but including
adjoining land or land directly opposite a right of way shall not be less than two acres.
F. Land Use. In this PCF zoning district, the use of land and structures shall be subject to
the provisions of Chapter 19.10, Land Use of the Elgin Municipal Code, 1976, as
amended. The following enumerated “land uses” [SR] shall be the only land uses
allowed as a “permitted use” [SR] in this PCF zoning district:

6. “Fences and walls" [SR] (UNCL).
7. “Loading facilities" [SR] (UNCL), exclusively "accessory" [SR], subject to the
provisions of Chapter 19.47, Off Street Loading.
8. “Parking lots" [SR] (UNCL), exclusively "accessory" [SR] to a use allowed in this
PCF zoning district, subject to the provisions of Chapter 19.45, Off Street Parking.
9. "Refuse collection area" [SR].
10. "Signs" [SR] (UNCL), subject to the provisions of Chapter 19.50, Signs.
11. "Temporary uses" [SR] (UNCL).
12. "Accessory structures" [SR] (UNCL) to the permitted uses allowed in this PCF
Community Facility District, subject to the provisions of Section 19.12.500, Accessory
Structures and Buildings.
13. "Accessory uses" [SR] (UNCL) to the permitted uses allowed in this PCF Community
Facility District, subject to the provisions of Section 19.10.400, Component Land Uses.
Conditional Uses. The following enumerated land uses shall be the only land uses
allowed as a conditional use in this PCF Planned Community Facility District:

G. Site Design. In this PCF zoning district, the site design regulations shall be as required in
the CF District, pursuant to Chapter 19.30.135 Site Design, of the EMC, as may be

amended from time to time. The development of land and structures shall be in
substantial conformance with the following:
1. Substantial conformance to the Petitioner‟s Statement of Purpose and
Conformance, submitted with the development application, prepared by Esther K.
Markwart, Scheflow Engineering, and dated June 12, 2008.
2. Substantial Conformance to the proposed Site Development for New Hope
Mission Baptist Church prepared by Esther K. Markwart, Scheflow Engineering,
and dated June 11, 2008, last revised August 4, 2008.
3. Substantial Conformance to the Landscape Plan Phase 1 (Sheet 1) prepared by
Esther K. Markwart, Scheflow Engineering, and dated June 13, 2008, with
revisions as required by the Community Development Group.
4. The proposed Landscape Plan for Phase 2 of the development shall include a
continuous hedge screening along the vehicle use area along Harlan Avenue.
5. All proposed building additions shall be subject to the Architectural Design
Review by the Development Administrator.
6. The proposed dumpster enclosure shall be located behind the building setbacks
lines within the rear yard, and shall be constructed with the same building
materials as the principal building.
7. All outdoor mechanicals, such as air conditioners, shall be located within a side or
rear yard and shall be fully screened by a fence or landscape; or must be
incorporated within the building or located on top of the roof of the building. If
they are located on the roof of the building, the mechanical units must be screened
by a parapet wall, which shall be the same height as the tallest mechanical units.
8. All proposed changes to the existing signage shall conform to the Zoning
Ordinance, Chapter 19.50 Street Graphics.
9. The proposed parking lot shall be curbed.
10. Compliance with all other applicable codes and ordinances.
H. Off-Street Parking. In this PCF zoning district, off street parking shall be subject to the
provisions of Chapter 19.45, Off Street Parking, of the EMC, as amended.
I. Off-Street Loading. In this PCF zoning district, off street loading shall be subject to the
provisions of Chapter 19.47, Off Street Loading, of the EMC, as amended.
J. Signs. In this PCF zoning district, signs shall be subject to the provisions of Chapter
19.50, Street Graphics of the Elgin Municipal Code, 1976, as amended.

K. Amendments. In this PCF zoning district, applications for text and map amendments
shall be subject to the provisions of Chapter 19.55, Amendments.
L. Planned Developments. . In this PCF zoning district, the use and development of the

Developments of the Elgin Municipal Code, 1976, as amended.
M. Conditional Uses. In this PCF zoning district, the use and development of the land and
structures shall be subject to the provisions of Chapter 19.65 Conditional Uses of the
Elgin Municipal Code, 1976, as amended.
N. Variations. In this PCF zoning district, the use and development of the land and
structures shall be subject to the provisions of Chapter 19.70, Variations of the Elgin
Municipal Code, 1976, as amended.
O. Subdivisions – Generally. The subdivision of the subject property and development
thereof shall comply with the subdivision regulations of the city, as amended, and the Plat
Act of the State of Illinois.
P. Appeals. Any requirement, determination, or interpretation associated with the
administration and enforcement of the provisions of this ordinance may be appealed
subject to the provisions of Chapter 19.75, Appeals of the Elgin Municipal Code, 1976,
as amended.
Section 4. That this ordinance shall be in full force and effect immediately after its
passage in the manner provided by law.

APPROVING CHANGE ORDER NO. 1
IN THE CONTRACT WITH MARTAM CONSTRUCTION, INC.
FOR THE 2008 NEIGHBORHOOD RESURFACING
WING PARK BOULEVARD PROJECT
WHEREAS, the City of Elgin has heretofore entered into a contract with Martam
Construction, Inc., for the 2008 Neighborhood Resurfacing-Wing Park Boulevard Project; and
WHEREAS, it is necessary and desirable to modify the terms of the contract as is
described in Change Order No. 1, attached hereto.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CIT Y
OF ELGIN, ILLINOIS, that Olufemi Folarin, City Manager, be and is hereby authorized and
directed to execute Change Order No. 1, a copy of which is attached hereto and made a part
hereof by reference.

interest of the city; and

authorized and directed to execute a Real Estate Sale Contract on behalf of the City of Elgin with
Habitat for Humanity for the purchase of property commonly known as 355 Ann Street, Elgin,

BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS,
that the City of Elgin hereby accepts for ownership and maintenance the following public utility
easements and improvements:
Capital Corporate Center -1750 Capital Street - public water main in proposed water
main easement (property located on the southwest side of Interstate 90 and Randall
Road).
3091 Route 20 - public water main and bike-path, and a public sanitary sewer along the
southern property line in a proposed easement (property located on the southeast side of
Nesler Road and US Route 20).
3651 Centennial Way - public water main and a public utility easement (property located
within Golf Course Country Club subdivision on the southwest side of Randall Road and
Bowes Road).
Acceptance of these improvements will add approximately 475 lineal feet of bike-path, 460
lineal feet of 8” sanitary sewer, three sanitary manholes, 38 lineal feet of 6” water main, 1,757
lineal feet of 8” water main, 439 lineal feet of 24” water main, six hydrants, and four valve vaults
to the City maintained facilities. Four easements are being accepted to provide access for
maintenance of these utilities.
BE IT FURTHER RESOLVED that the City Clerk is hereby authorized and directed to
cause the plats of easement to be recorded in the Office of the Recorder of Deeds of Kane
County, Illinois.

ORDINANCE NO. G8-05

WHEREAS, the territory herein described has been annexed to the City of Elgin and
classified in the PMFR Planned Multiple Family Residence District; and

WHEREAS, written application has been made to amend PMFR Planned Multiple
Family Residence District Ordinance No. G8-05 to permit the construction of additional
residential building elevations and floor plans in the West Point Gardens Subdivision; and
WHEREAS, after due notice in the manner provided by law the Planning and
Development Commission conducted public hearings concerning said applications and has
submitted its written findings and recommendations; and
WHEREAS, the City Council of the City of Elgin, Illinois, has reviewed the findings and
recommendations of the Planning and Development Commission.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF ELGIN, ILLINOIS:
Section 1. That the City Council of the City of Elgin hereby adopts the Findings of
Fact, dated October 15, 2007, made by the Planning and Development Commission, a copy of
which is attached hereto and made a part hereof by reference as Exhibit A.
Section 2. That Ordinance No. G8-05 entitled “An Ordinance Classifying Newly
Annexed Territory in the PMFR Planned Multiple Family Residence District,” passed January12,
2005, be and is hereby amended in its entirety to read as follows:
Section 3. That Chapter 19.07, Section 19.07.600 entitled “Zoning District Map” of the
Elgin Municipal Code, 1976, as amended, be and the same is hereby further amended by adding
thereto the following paragraph:
“The boundaries herein before laid out in the „Zoning District Map‟, as
amended, be and are hereby altered by including in the PMFR Planned Multiple
Family Residence District, the following described property:
Those areas on the attached Zoning Exhibit, prepared by Cowhey
Gudmonson Leder, Ltd., and dated December 16, 2004, revised December 21,
2004, designated in the PMFR Planned Multiple Family Residence District.”
Section 4. That the City Council of the City of Elgin hereby grants the PMFR Planned
Multiple Family Residential District which shall be designed, developed, and operated subject to
the following provisions:
A. Purpose and Intent. The purpose and intent of this PMFR zoning district is to
provide a planned urban residential environment of the lowest standardized
density for single family attached dwellings, subject to the provisions of Chapter
19.60 Planned Developments of the Elgin Municipal Code, 1976, as amended.
The PMFR District is most similar to, but departs from the standard requirements
of, the MFR Multiple Family Residential District.

B. Supplementary Regulations. Any word or phrase contained herein, followed by
the symbol “[SR]”, shall be subject to the definitions and the additional
interpretive requirements provided in Chapter 19.90, Supplementary Regulations
of the Elgin Municipal Code, 1976, as amended. The exclusion of such symbol
shall not exempt such word or phrase from the applicable supplementary
regulation.
C. General Provisions. In this PMFR zoning district, the use and development of
land and structures shall be subject to the provisions of Chapter 19.05, General
Provisions, of the Elgin Municipal Code, 1976, as amended.
D. Zoning Districts -Generally. In this PMFR zoning district, the use and
development of land and structures shall be subject to the provisions of Chapter
19.07, Zoning Districts, of the Elgin Municipal Code, 1976, as amended.
E. Location and Size of District. This PMFR zoning district should be located in
substantial conformance to the official comprehensive plan. The amount of land
necessary to constitute a separate PMFR zoning district exclusive of rights-of-
way, but including adjoining land or land directly opposite a right-of-way shall
not be less than two acres.
F. Land Use. In this PMFR zoning district, the use of land and structures shall be
subject to the provisions of Chapter 19.10, Land Use, of the Elgin Municipal
Code, 1976, as amended. The following enumerated “land uses” [SR] shall be the
only land uses allowed as a “permitted use” [SR] in this PMFR District:

1. Substantial conformance to the Preliminary Plat of Subdivision prepared
by Cowhey, Gudmonson, Leder, Ltd., and dated January 3, 2005.
2. Substantial conformance to the Preliminary Engineering Plans North and
South, pages 1 and 2, prepared by Cowhey Gudmunson Leder, Ltd., dated
August 2, 2004, with a final revision date of January 3, 2005.
3. Substantial conformance to the Master LS Plan pages 1 through 5,
encompassing the Master LS Plan 2, Planting Details, and Detention Plan,
prepared by Matarazzo Land Planning Consultants, Ltd., and dated
September 9, 2004.
4. Substantial conformance to the Typical Townhome Streetscape, prepared
by Matarazzo Land Planning Consultants, Inc., and dated August 19,
2004; and as amended by the Petitioner‟s Statement prepared by Curran
Enterprises II, LLC, dated September 25, 2007, with attached building
elevation drawings and floor plans.
5. All exterior building materials for the attached single family homes shall
meet the design requirements of the Far West Area Plan.
6. The floor area for the attached single family dwellings shall be a minimum

H. Off-street Parking. In this PMFR zoning district, off street parking shall be
subject to the provisions of Chapter 19.45, Off-street Parking, of the Elgin
Municipal Code, 1976, as amended.
I. Off-street Loading. In this PMFR zoning district, off street loading shall be
subject to the provisions of Chapter 19.47, Off-street Loading, of the Elgin
Municipal Code, 1976, as amended.
J. Street Graphics. In this PMFR zoning district, street graphics shall be subject to
the provisions of Chapter 19.50, Signs, of the Elgin Municipal Code, 1976, as

K. Amendments. In this PMFR zoning district, application for text and map

zoning district authorize such an application.
L. Planned Developments. In this PMFR zoning district, application for a planned
development shall be subject to the provisions of Chapter 19.60, Planned
Developments, of the Elgin Municipal Code, 1976, as amended. A conditional
use for a planned development may be requested by an individual lot or property
owner for a zoning lot without requiring an amendment to this PMFR zoning
district and without necessitating that all other property owners in this PMFR
zoning district authorize such an application.
M. Conditional Uses. In this PMFR zoning district, application for conditional uses
shall be subject to the provisions of Chapter 19.65 Conditional Uses, of the Elgin
Municipal Code, 1976, as amended. A conditional use may be requested by an
individual lot or property owner for a zoning lot without requiring an amendment
to this PMFR zoning district and without necessitating that all other property
owners in this PMFR zoning district authorize such an application.
N. Variations. Any of the requirements of this ordinance may be varied by petition
of a lot or property owner subject to this Ordinance, however, such variation is
subject to the provisions of Section 19.70, Variations, of the Elgin Municipal
Code, as may be amended. A variation may be requested by an individual
property owner for a zoning lot without requiring an amendment to this PMFR
zoning district and without necessitating that all other property owners in this
PMFR zoning district authorize such an application.
O. Subdivisions – Generally. The subdivision of the subject property and
development thereof shall comply with the subdivision regulations of the city, as
amended, and the Plat Act of the State of Illinois. Prior to building permit
issuance, for each building or structure proposed to be built within the planned
development, a soils suitability and bearing capacity test shall be performed as
required by the City Engineer and the Development Administrator, and the
provisions of the Annexation Agreement.
P. Buildings – Required Improvements. In addition to those building
improvements required by Title 16 of the Elgin Municipal Code, the following
building improvements shall also be required:
1. All sanitary sewer shall be overhead sewers.
2. All structures containing sump pits and pumps shall have separate lines
connecting the sump pump to the storm sewer as required by the City
Engineer and the Development Administrator.

WHEREAS, the territory herein described has been annexed to the City of Elgin and
classified in the PSFR2 Planned Single Family Residence District; and
WHEREAS, written application has been made to amend PSFR2 Planned Single Family
Residence District Ordinance No. G6-05 to permit the construction of additional residential
building elevations and floor plans in the West Point Gardens Subdivision; and

amended, be and are hereby altered by including in the PSFR2 Planned Single
Family Residence District, the following described property:
Those areas on the attached Zoning Exhibit, prepared by Cowhey

Section 4. That the development of this PSFR2 Planned Single Family Residence
District as described in Section 1 shall be developed subject to the following provisions:
A. Purpose and Intent. The purpose and intent of this PSFR2 zoning district is to
provide a planned urban residential environment of standardized moderate density
for single family detached dwellings, subject to the provisions of Chapter 19.60
Planned Developments of the Elgin Municipal Code, 1976, as amended. The
PSFR2 District is most similar to, but departs from the standard requirements of
the SFR2 Single Family Residential District.
B. Supplementary Regulations. Any word or phrase contained herein, followed by
the symbol “[SR]”, shall be subject to the definitions and the additional
interpretive requirements provided in Chapter 19.90, Supplementary Regulations,
of the Elgin Municipal Code, 1976, as amended.

C. General Provisions. In this PSFR2 zoning district, the use and development of
land and structures shall be subject to the provisions of Chapter 19.05, General

development of land and structures shall be subject to the provisions of Chapter
19.07, Zoning Districts, of the Elgin Municipal Code, 1976, as amended.
E. Location and Size of District. This PSFR2 zoning district should be located in
substantial conformance to the official comprehensive plan. The amount of land
necessary to constitute a separate PSFR2 zoning district exclusive of rights-of-
way, but including adjoining land or land directly opposite a right -of-way, shall
not be less than two acres.
F. Land Use. In this PSFR2 zoning district, the use of land and structures shall be
subject to the provisions of Chapter 19.10, Land Use, of the Elgin Municipal
Code, 1976, as amended. The following enumerated “land uses” [SR] shall be the
only land uses allowed as a “permitted use” [SR] in this PSFR2 District:

lot area" [SR] shall be 4,800 square feet per dwelling unit, and in
substantial conformance to the Preliminary Plat of Subdivision prepared
by Cowhey, Gudmonson, Leder, Ltd., and dated January 3, 2005.
3. Lot Width. The minimum required "lot width" [SR] for a zoning lot shall
be in substantial conformance to the Preliminary Plat of Subdivision
prepared by Cowhey, Gudmonson, Leder, Ltd., and dated January 3, 2005.
4. Setbacks - Generally. In this PSFR2 zoning district, "setbacks" [SR]
shall be subject to the provisions of the Elgin Zoning Ordinance, Section
19.12.400, Setbacks - Clarifications and Exceptions.
5. Setbacks by Lot Line. In this PSFR2 zoning district, the minimum
required "building" [SR] "setbacks" [SR] for a zoning lot shall be as
follows:
a. Local Street Setback. Where a zoning lot has frontage on a local
street, the minimum required setback for a building from a street
lot line shall be as follows:
i. 40 foot wide lots. Eight (8) linear feet (lots 117-296).
ii. 60 foot wide lots. Ten (10) linear feet (lots 1-116, and
297-343 as depicted on the Preliminary Plat of Subdivision,
prepared by Cowhey Gudmonson Leder, Ltd., and dated
January 3, 2005).
b. Collector Street Setback. Where a zoning lot has frontage on a
buffer yard adjoining a collector street, the minimum required
setback for a building shall be ten (10) linear feet from the buffer
yard.
c. Side Setback. The minimum required building setback from a
“side lot line” [SR] shall be as follows:
i. 40 Foot Wide Lots (lot numbers as noted above). Zero
(0) linear feet, however, the combined setback of both side
setbacks shall be a minimum of five (5) linear feet.
ii. 60 Foot Wide Lots (lot numbers as noted above). Zero
(0) linear feet, however, the combined setback of both side
setbacks shall be a minimum of ten (10) linear feet.
d. Rear Setback. The minimum required building setback from a
“rear lot line” [SR] shall be as follows:
i. 40 Foot Wide Lots (lot numbers as noted above).
eighteen and one-half (18.5) linear feet..
ii. 60 Foot Wide Lots (lot numbers as noted above). On
those lots that do not have an alley to the rear of the lot, the
required building setback shall be sixteen (16) linear feet.
In all other cases, the building setback shall be eighteen and
one-half (18.5) linear feet.

6. Accessory Structures and Buildings. In this PSFR2 zoning district,
"accessory structures and buildings" [SR] shall be subject to the provisions
of Section 19.12.500, Accessory Structures and Buildings, of the Elgin
Zoning Ordinance, with the following exception: For the purpose of
determining setbacks, accessory buildings used for the parking of
motorized vehicles (commonly known as “garages”), shall be subject to
Section 2, Paragraph G. Site Design, Subparagraph 5. Setbacks by Lot
Line.
7. Yards. In this PSFR2 zoning district, a "street yard" [SR], a "side yard"
[SR], or a "rear yard" [SR] established by a required building setback or
by the actual location of a building shall be subject to the provisions of
Section 19.12.600, Obstructions in Yards, of the Elgin Zoning Ordinance.
8. Residential Floor Area. In this PSFR2 zoning district, the maximum
"residential floor area" [SR] for a single family zoning lot shall equal the
“zoning lot area” [SR] times 0.60 (60%).
9. Building Coverage. In this PSFR2 zoning district, the maximum
"building coverage" [SR] for a single family zoning lot shall equal the
“zoning lot area” [SR] times 0.55 (55%).
10. Accessory Building Coverage. In this PSFR2 zoning district, the
maximum "accessory building coverage" [SR] for a single family zoning
lot shall equal the “zoning lot area” [SR] times 0.20 (20%).
11. Vehicle Use Area. In this PSFR2 zoning district, the maximum "vehicle
use area" [SR] for a single family zoning lot shall be one thousand six
hundred (1,600) square feet.
12. Landscaping. In this PSFR2 zoning district, each zoning lot shall be
developed in substantial conformance to the Master LS Plan pages 1
through 5, encompassing the Master LS Plan 2, Planting Details, and
Detention Plan, prepared by Matarazzo Land Planning Consultants, Ltd.,
and dated September 9, 2004.
13. Supplementary Conditions. In this PSFR2 zoning district, the use and
development of land and structures shall also be subject to the following
conditions:
a. Substantial conformance to the following building elevations and
floor plans for the Meier Farm, all prepared by Matarazzo Land
Planning Consultants, Inc., and dated June 24, 2004, unless
otherwise noted:

meeting. Upon a roll call vote: Yeas: Councilmembers Figueroa, Gilliam, Kaptain, Steffen,
Walters, and Mayor Schock. Nays: None.
