COUNCIL-MANAGER FORM OF GOVERNMENT
REGULAR MEETING
The regular meeting of the Council of the City of Elgin, Illinois, was held on August 13, 2008, in
the Council Chambers. The meeting was called to order by Mayor Schock at 7:00 p.m. The
Invocation was given by Pastor McCullough of Second Baptist Church and the Pledge of
Allegiance was led by Councilmember David Kaptain.
MAYOR PRO TEM APPOINTMENT FOR THE MEETING
Councilmember Walters made a motion, seconded by Councilmember Figueroa, to appoint
Councilmember Gilliam as Mayor Pro Tem. Upon a roll call vote: Yeas: Councilmembers
Figueroa, Gilliam, Kaptain, Steffen, and Walters. Nays: None.

MINUTES OF THE JULY 23, 2008, COUNCIL MEETING APPROVED AS
DISTRIBUTED
Councilmember Walters made a motion, seconded by Councilmember Figueroa, to approve the
July 23, 2008, Council Meeting Minutes as distributed. Upon a roll call vote: Yeas:
Councilmembers Figueroa, Gilliam, Kaptain, Steffen, and Walters. Nays: None.
RECOGNIZE PERSONS PRESENT
Bill Horn requested that port-a-potties be made available for fisherman in the Walton
Island/Kimball Street bridge area. Councilmember Kaptain asked staff to look into the cost of
these.
Charlene Sligting, President of S.W.A.N., expressed her appreciation to staff and especially Jim
Bell for all of the work at Ryerson Park.
Dave Lopez, on behalf of the Puerto Rican Heritage Organization, invited everyone to Boriqua
Fest on August 16, 2008.

Kevin Escheveria spoke regarding the sound amplification permits. He stated that City
departments do not agree on the procedure and he requested that the ordinance be clarified so
that all are in agreement.
Robert Rosa expressed his concerns about the car show issues and how the police handled the
situation. He would like to have the Police Department investigated for their actions.
Councilmember Gilliam stated that a meeting has already been scheduled for August 19, 2008, to
meet with the organizers and that a representative from the Police Department will be in
attendance.
Marcus Banner expressed his concerns about harassment and discrimination by members of the
Police Department. He said that consequences need to be enacted and would like to see an
outside internal affairs investigation.
BID 08-051 AWARDED TO MOWERWORKS, LTD FOR THE PURCHASE OF
SIDEWALK SNOW REMOVAL EQUIPMENT
Councilmember Kaptain made a motion, seconded by Councilmember Figueroa, to award a
contract to MowerWorks, LTD in the amount of $35,233.04 for the purchase of four Gravely
Rapid M units with accessories for sidewalk snow removal. Upon a roll call vote: Yeas:
Councilmembers Figueroa, Gilliam, Kaptain, Steffen, and Walters. Nays: None.
BID 08-052 AWARDED TO LIFE FITNESS FOR THE PURCHASE OF PHYSICAL
FITNESS EQUIPMENT FOR FIRE STATION 7
Councilmember Figueroa made a motion, seconded by Councilmember Kaptain, to award a
contract to Life Fitness in the amount of $25,042.72 for the purchase of cardiovascular,
resistance, and strength training equipment for Fire Station 7. Upon a roll call vote: Yeas:
Councilmembers Figueroa, Gilliam, Kaptain, Steffen, and Walters. Nays: None.
BID 08-055 AWARDED TO MIKE HARRIS MASON CONTRACTOR FOR
STRUCTURAL MASONRY REPAIRS AT THE EAST SIDE RECREATION CENTER
Councilmember Walters made a motion, seconded by Councilmember Steffen, to award a
contract to Mike Harris Mason Contractor in the amount of $194,100 for structural masonry
repairs at the East Side Recreation Center. Upon a roll call vote: Yeas: Councilmembers
Figueroa, Gilliam, Kaptain, Steffen, and Walters. Nays: None.

BID 08-056 AWARDED TO LPS PAVEMENT COMPANY FOR PAVER
INSTALLATION ON THE POLICE FACILITY ROOF DECK
Councilmember Kaptain made a motion, seconded by Councilmember Figueroa, to award a
contract to LPS Pavement Company in the amount of $18,775 for paver installation on the Police
Facility roof deck. Upon a roll call vote: Yeas: Councilmembers Figueroa, Gilliam, Kaptain,
Steffen, and Walters. Nays: None.
PUBLIC HEARING REGARDING THE ESTABLISHMENT OF THE MACKENZIE
WOODS SUBDIVISION SPECIAL SERVICE AREA IN THE CITY OF ELGIN
Mayor Pro Tem Gilliam declared the public hearing open.
Community Development Director Deering described the establishment of the special service
area and stated there would be a sixty-day waiting period at which time the ordinance would be
presented to Council. No one else spoke
Mayor Pro Tem Gilliam declared the public hearing closed.
PUBLIC HEARING REGARDING THE ESTABLISHMENT OF THE MADISON
HOMES SUBDIVISION SPECIAL SERVICE AREA IN THE CITY OF ELGIN
Mayor Pro Tem Gilliam declared the public hearing open.
Community Development Director Deering described the establishment of the special service
area and stated there would be a sixty-day waiting period at which time the ordinance would be
presented to Council. No one else spoke.
Mayor Pro Tem Gilliam declared the public hearing closed.
PETITION 15-08 APPROVED REQUESTING VARIOUS AMENDMENTS TO THE
TEXT OF TITLE 19, ZONING, OF THE ELGIN MUNICIPAL CODE, BY THE CITY
OF ELGIN (ARCHITECTURAL DESIGN REVIEW)
Community Development Director Deering stated these amendments would establish
architectural review guidelines for all properties in the City and will replace the arterial overlay
district. It will be a staff-based program and will not require an applicant to apply for any special
permits. The Planning and Development Commission has recommended approval with no
conditions.
Councilmember Figueroa made a motion, seconded by Councilmember Kaptain, to approve
Petition 15-08.

Councilmember Figueroa stated he was concerned it was adding another layer to the process.
Councilmember Walters stated that he likes the idea because it will prevent infill projects that do
not fit into the neighborhood. Councilmember Kaptain asked Mr. Deering if he had the staff
available to enforce this new process. Mr. Deering said that he did and that the process had
already been in place for some time. Councilmember Steffen stated that he appreciated the
changes and the work that staff had put into this.

PUBLIC HEARING ON PROPOSED THIRD AMENDMENT TO THE BOWES CREEK
ANNEXATION AGREEMENT (BOWES CREEK COUNTRY CLUB)
Mayor Pro Tem Gilliam declared the public hearing open.
Corporation Counsel William Cogley reviewed the amendment. He stated this amendment
includes the clubhouse plans, when it will be completed, modest changes in the age restrictions,
timing of payments, recording of plats, additional architectural costs and how these will be paid,
construction schedule, and conveyance of the golf course and the clubhouse. There were no
other comments.

RESOLUTION 08-189 ADOPTED AUTHORIZING EXECUTION OF A THIRD
AMENDMENT TO BOWES CREEK ANNEXATION AGREEMENT WITH TOLL IL,

Councilmember Figueroa made a motion, seconded by Councilmember Walters, to adopt the

AUTHORIZING EXECUTION OF A THIRD AMENDMENT TO
BOWES CREEK ANNEXATION AGREEMENT WITH TOLL IL, L.P.
AND LO LAND ASSETS, L.P.
(Bowes Creek Country Club – 3600 Bowes Road)
WHEREAS, the owners of certain property commonly known as Bowes Creek Country
Club have proposed that the annexation agreement between the owners and the City of Elgin
concerning said property be amended; and

WHEREAS, after due notice as required by law, a public hearing on said proposal was
held by the corporate authorities of the City of Elgin; and
WHEREAS, the proposed Third Amendment to Annexation Agreement with Toll IL,
L.P. and LO Land Assets, L.P., is in the best interests of the City of Elgin.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF ELGIN, ILLINOIS, that Ed Schock, Mayor, and Diane Robertson, City Clerk, be and are
hereby authorized and directed to execute, on behalf of the City of Elgin, the Third Amendment
to Annexation Agreement with Toll IL, L.P. and LO Land Assets, L.P., a copy of which is
attached hereto.

directed to execute a Special Event Co-Sponsorship Agreement on behalf of the City of Elgin
with the Puerto Rican Heritage Organization for activities related to Puerto Rican Week to be
held August 3 through August 16, 2008, a copy of which is attached hereto and made a part
hereof by reference.

AN ORDINANCE
AMENDING CHAPTER 3.04 OF THE ELGIN MUNICIPAL CODE, 1976, AS AMENDED,
ENTITLED ―CIVIL SERVICE COMMISSION‖
WHEREAS, the City Council of the Elgin has determined that it necessary and desirable
to amend the procedures relating to the termination of probationary employees to provide the
City Manager with the authority to terminate probationary employees; and
WHEREAS, the City of Elgin is a home rule unit authorized to exercise any power and
perform any function pertaining to its government and affairs; and
WHEREAS, the procedures relating to the termination of probationary employees pertain
to the government and affairs of the City of Elgin.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF ELGIN, ILLINOIS:
Section 1. That Section 3.04.020 of the Elgin Municipal Code, 1976, as amended,
entitled ―Powers and Duties‖ be and is hereby further amended by adding a subparagraph J
thereto to read as follows:
―J. Any person, during a probationary period pursuant to original
appointment pursuant to this chapter, may be discharged and terminated
from employment by and at the discretion of the City Manager without a
hearing and without cause.‖

Section 2. That all ordinances or parts of ordinances in conflict with the provisions of
this ordinance be and are hereby repealed.
Section 3. That this ordinance shall be in full force and effect upon its passage in the

WHEREAS, the City Council of the City of Elgin has met from time to time in executive
session for purposes authorized by the Illinois Open Meetings Act; and
WHEREAS, as required by the Act, the City Clerk has kept written minutes of all such
executive sessions; and
WHEREAS, pursuant to the requirements of the Illinois Open Meetings Act, the City
Council has met in closed session to review all closed session minutes; and
WHEREAS, they have determined that a need for confidentiality still exists as to a
portion of the executive session minutes from the meetings set forth on the exhibit referred to
herein; and
WHEREAS, they have further determined that the remaining portion of the meetings
listed no longer require confidential treatment and should be made available for public

A. Purpose and Intent. The purpose of the PORI Planned Office Research Industrial District
is to provide a planned industrial environment that fosters a sense of place and destination within
a coordinated campus or park setting, subject to the provisions of Chapter 19.60, Planned
Developments. A PORI zoning district is most similar to, but departs from the standard
requirements of the ORI zoning district.
B. Supplementary Regulations. Any word or phrase contained within this ordinance
followed by the symbol "[SR]" shall be subject to the definitions and the additional interpretive
requirements provided in Chapter 19.90, Supplementary Regulations, of the ELGIN
MUNICIPAL CODE. The exclusion of such symbol shall not exempt such word or phrase from
the applicable supplementary regulation.
C. General Provisions. In this PORI district, the use and development of land and structures
shall be subject to the provisions of Chapter 19.05, General Provisions, of the ELGIN
MUNICIPAL CODE, as may be amended from time to time.
D. Zoning Districts Generally. In this PORI district, the use and development of land and
structures shall be subject to the provisions of Chapter 19.07, Zoning Districts of the ELGIN
MUNICIPAL CODE, as may be amended from time to time.
E. Location and Size of Districts. Planned industrial districts should be located in
substantial conformance to the official comprehensive plan. The amount of land necessary to
constitute a separate planned industrial district exclusive of rights of way, but including
adjoining land or land directly opposite a right of way shall not be less than two acres. No
departure from the required minimum size of a planned industrial district shall be granted by the
City Council.

F. Land Use. In this PORI District, the use and development of land and structures shall be
subject to the provisions of Chapter 19.10 Land Use, of the Elgin Municipal Code, as amended.
The following "PORI Land Uses", as identified in Section F.1.A & B, below, and the "AB Land
Uses", as identified in Section F.2.A, below, shall be the only land uses allowed as a "permitted
use" [SR], as a "conditional use" [SR], or as a "similar use" [SR] in this PORI Planned Office
Research Industrial District, as amended.

allowed as a "permitted use" [SR], as a "conditional use" [SR], or as a "similar use" [SR]
in this PORI Planned Office Research Industrial District, as amended.

G. Site Design. In this PORI district, the site design regulations shall be as required in the
ORI Office Research Industrial District, pursuant to Chapter 19.40.135 Site Design, of the Elgin
Municipal Code, as may be amended from time to time. Prior to the development of the subject
property the owner of the subject property shall be required to submit a development plan to the
city for a public hearing and City Council approval pursuant to the provisions of Chapter 19.60,
Planned Developments, of the Elgin Municipal Code, 1976, as amended.
H. Off-Street Parking. In this PORI district, off street parking shall be subject to the
provisions of Chapter 19.45, Off Street Parking, of the ELGIN MUNICIPAL CODE, as
amended.
I. Off-Street Loading. In this PORI district, off street loading shall be subject to the
provisions of Chapter 19.47, Off Street Loading, of the ELGIN MUNICIPAL CODE, as
amended.
J. Signs. In this PORI district, signs shall be subject to the provisions of Chapter 19.50,
Signs of the Elgin Municipal Code, 1976, as amended. The development administrator may
require, and may approve signs not otherwise provided by this title in support of the
development.

K. Amendments. In this PORI district, application for text and map amendments shall be
subject to the provisions of Chapter 19.55, Amendments. A text and map amendment may be
requested by an individual lot or property owner for a zoning lot without necessitating that all
other property owners in this PORI zoning district authorize such an application.
L. Planned Developments. . In this PORI district, the use and development of the land and
structures shall be subject to the provisions of Chapter 19.60, Planned Developments of the Elgin
Municipal Code, 1976, as amended. A conditional use for a planned development may be
requested by an individual lot or property owner for a zoning lot without requiring an
amendment to this PORI zoning district and without necessitating that all other property owners
in this PORI zoning district authorize such an application.
M. Conditional Uses. In this PORI district, the use and development of the land and
structures shall be subject to the provisions of Chapter 19.65 Conditional Uses of the Elgin
Municipal Code, 1976, as amended. A conditional use may be requested by an individual lot or
property owner for a zoning lot without requiring an amendment to this PORI zoning district and
without necessitating that all other property owners in this PORI zoning district authorize such
an application.
N. Variations. In this PORI district, the use and development of the land and structures
shall be subject to the provisions of Chapter 19.70, Variations of the Elgin Municipal Code,
1976, as amended. Any of the requirements of this ordinance may be varied by petition of a lot
or property owner for a zoning lot without requiring an amendment to this PORI zoning district
and without necessitating that all other property owners in this PORI zoning district authorize
such an application.
O. Subdivisions – Generally. The subdivision of the subject property and development
thereof shall comply with the subdivision regulations of the city, as amended, and the Plat Act of
the State of Illinois.
P. Appeals. Any requirement, determination, or interpretation associated with the
administration and enforcement of the provisions of this ordinance may be appealed subject to
the provisions of Chapter 19.75, Appeals of the Elgin Municipal Code, 1976, as amended.
Q. ARC Arterial Road Corridor Overlay District. Notwithstanding anything to the
contrary in this ordinance, the use and the development of the subject property in this PORI
zoning district shall also be subject to the regulations of the ARC Arterial Road Corridor Overlay
District. In the event of any conflict between the regulations in the ARC Arterial Road Corridor
Overlay District and other provisions of this ordinance, the regulations of the ARC Arterial Road
Corridor Overlay District shall control.
Section 4. That this ordinance shall be in full force and effect immediately after its
passage in the manner provided by law.

ANNEXING CERTAIN TERRITORY TO THE CITY OF ELGIN
(Henrikson Property-3301 Route 20)
WHEREAS, a petition signed by all the owners of record of certain territory has been
filed with the City Clerk requesting annexation of said territory to the City of Elgin, Illinois; and
WHEREAS, said petition includes therein a statement under oath by all the owners of
record that no electors reside on the subject territory; and
WHEREAS, said territory is contiguous to the City of Elgin and is not within the
corporate limits of any municipality; and
WHEREAS, legal notices of the intent of the City of Elgin to annex said territory have
been forwarded to all public bodies required to receive said notice in the manner provided by
law.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY

WHEREAS, the territory herein described has been annexed to the City of Elgin; and
WHEREAS, written application has been made to classify said territory to a P AB
Planned Area Business District; and
WHEREAS, after due notice in the manner provided by law the Planning and
Development Commission conducted public hearings concerning said application and has
submitted its written findings and recommendations; and
WHEREAS, the City Council of the City of Elgin, Illinois, has reviewed the findings and
recommendations of the Planning and Development Commission.

A. Purpose and Intent. The purpose and intent of this PAB zoning district is to
provide commodities and services to several neighborhoods, and in some

instances to a communitywide or regional supporting populations, subject to the
provisions of chapter 19.60 of the zoning ordinance. A PAB zoning district is
most similar to, but departs from the standard requirements of the AB zoning

B. Supplementary Regulations. Any word or phrase contained herein, followed by
the symbol ―[SR]‖, shall be subject to the definitions and the additional
interpretive requirements provided in Chapter 19.90, Supplementary Regulations
of the Elgin Municipal Code, 1976, as amended. The exclusion of such symbol
shall not exempt such word or phrase from the applicable supplementary
regulation.
C. General Provisions. In this PAB zoning district, the use and development of
land and structures shall be subject to the provisions of Chapter 19.05, General
Provisions, of the Elgin Municipal Code, 1976, as amended.
D. Zoning Districts - Generally. In this PAB zoning district, the use and
development of land and structures shall be subject to the provisions of Chapter
19.07, Zoning Districts, of the Elgin Municipal Code, 1976, as amended.
E. Location and Size of District. This PAB zoning district should be located in
substantial conformance to the official comprehensive plan. The amount of land
necessary to constitute a separate PAB zoning district exclusive of rights-of-way,
but including adjoining land or land directly opposite a right of way shall not be
less than two acres.
F. Land Use. In this PAB zoning district, the use of land and structures shall be
subject to the provisions of Chapter 19.10, Land Use of the Elgin Municipal
Code, 1976, as amended. The following enumerated ―land uses‖ [SR] shall be the
only land uses allowed as a ―permitted use‖ [SR] in this PAB zoning district:

development, a soils suitability and bearing capacity test shall be performed as
required by the City Engineer and the Development Administrator, and the
provisions of the Annexation Agreement.
P. Buildings – Required Improvements. In addition to those building
improvements required by Title 16 of the Elgin Municipal Code, the following
building improvements shall also be required:
1. All sanitary sewer shall be overhead sewers.
2. All structures containing sump pits and pumps shall have separate lines
connecting the sump pump to the storm sewer as required by the City
Engineer and the Development Administrator.

WHEREAS, the City Council of the City of Elgin finds that the parking and storing of
commercial vehicles in residential zoning districts and on residential property adversely effects
the desirability of immediate and neighboring areas, is aesthetically harmful and impairs the
benefits of occupancy of existing properties in such areas, prevents the most appropriate use of
real estate, reduces property values, and produces degeneration of property in such areas with
attendant deterioration of conditions affecting the public health, safety, comfort, morals and
well-being of citizens; and,
WHEREAS, the regulation of the parking and storing of commercial vehicles as set forth
in this ordinance will serve to protect, preserve and enhance the nature and character of
residential areas within the City, to protect and enhance property values, and to promote the
health, safety and welfare of the City and its residents; and,
WHEREAS, 65 ILCS 5/11-13-1 authorizes municipalities to classify regulate and restrict
the location of trades and industries for specified industrial, business and residential uses, to
divide the municipality into districts according to the use of land and buildings, and to prohibit
uses, buildings or structures incompatible with the character of such districts; and,
WHEREAS, the City of Elgin Zoning Ordinance regulates and restricts commercial and
other non-residential uses within residential zoning districts; and,
WHEREAS, the City of Elgin is a home rule unit authorized to exercise any power and
perform any function pertaining to its government and affairs; and,
WHEREAS, the regulation of the parking and storing of commercial vehicles in
residential zoning districts, on residential property and on streets within residential areas pertains
to the government and affairs of the City of Elgin; and
WHEREAS, written application has been made to amend the Elgin Zoning Ordinance
provisions pertaining to the parking and storing of commercial vehicles within residential zoning
districts; and,
WHEREAS, the Planning and Development Commission held a public hearing
concerning the proposed amendment after due notice in manner provided by law; and,
WHEREAS, the Planning and Development Commission has forwarded the proposed
amendment to the City Council without a recommendation; and

WHEREAS, the Community Development Group recommends the requested amendment
be granted.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF ELGIN, ILLINOIS:
Section 1. That chapter 19.45 entitled ―Off Street Parking,‖ of the Elgin Municipal
Code, 1976, as amended, be and is hereby further amended by adding a new section 19.45.065
thereto entitled ―Commercial Vehicles Prohibited,‖ to read as follows:
19.45.065: Commercial Vehicles Prohibited:
A. For the purposes of this Section, words, terms or phrases shall have the
definition ascribed to them in the Illinois Vehicle Code, 625 ILCS 5/1-100 et
seq., unless otherwise defined herein or a different meaning is clear from their
context.
B. Definitions: For the purposes of this Section, whenever any of the following
words, terms or phrases are used they shall have the meanings ascribed to
them as follows:
COMMERCIAL VEHICLE: A ―motor vehicle‖ [SR] having attributes or
characteristics that meet or satisfy any of the following conditions:
1. The vehicle has a State of Illinois license plate designation indicating a
weight classification in excess of eight thousand (8,000) pounds, said
designations being as follows: D (8,001 – 12,000 lbs.); F (12,001 –
16,000 lbs.); H (16,001 – 26,000 lbs.); J (26,001 – 28,000 lbs.); K
(28,001 – 32,000 lbs.); L (32,001 – 36,000 lbs.); N (36,001 – 40,000
lbs.); P (40,001 – 45,000 lbs.); Q (45,001 – 50,000 lbs.); R (50,001 –
54,999 lbs.); S (55,001 – 59,500 lbs.); T (59,501 – 64,000 lbs.); V
(64,001 – 73,280 lbs.); X (73,281 – 77,000 lbs.); and Z (77,001 –
80,000 lbs.).
2. The vehicle has a State of Illinois license plate bearing one of the
following designations: CN (Conservation Truck/Truck Tractor); VF
through VZ (Farm Truck/Truck Tractor – All weight classifications);
D through Z (Flat Weight Truck/Truck Tractor – All weight
classifications); MD through MZ (Mileage Tax Truck/Truck Tractor –
All weight classifications); MC (Medical Carrier); PM (Permanently

3. The vehicle has an out-of-state license plate but is of a type that would
require any of the State of Illinois license plate designations listed
herein.
4. The vehicle has a gross vehicular weight rating in excess of eight
thousand (8,000) pounds.
5. The vehicle is designed to transport ten (10) or more persons.
GROSS VEHICULAR WEIGHT RATING (GVWR): The value specified by
the manufacturer or manufacturers as the maximum loaded weight of a single
vehicle.
TRAILER: Every vehicle without motive power designed for carrying persons
or property and for being drawn by a motor vehicle. Trailers shall include,
without limitation, semitrailers, farm trailers, pole trailers, recreational vehicle
trailers, campers, camping trailers, pop ups, trailer coaches, travel trailers and
utility trailers.
C. No commercial vehicle shall be parked, kept or stored at any time on a
―zoning lot‖ [SR] located within a Residence Conservation District or a
Residence District, or on any ―zoning lot‖ [SR] having a residential use as its
―principal use‖ [SR], or having a residential building or structure as its
―principal building‖ [SR]. Exceptions: The prohibition on the parkin g of
commercial vehicles provided for in this Section shall not apply to
(1) commercial vehicles parked between the hours of 7:00 a.m. and 7:00 p.m.,
when such commercial vehicles are parked for the purpose of delivering or
collecting persons, materials or merchandise, or for the purpose of performing
a service on the ―zoning lot‖ [SR] on which the commercial vehicle is parked,
or (2) the services or operations of any governmental unit, public utility or any
such activities performed on behalf of any such governmental unit or public
utility.
D. No person shall at any time park or store any trailer on a ―zoning lot‖ [SR]
located within a Residence Conservation District or a Residence District, or
on any ―zoning lot‖ [SR] having a residential use as its ―principal use‖ [SR],
or having a residential building or structure as its ―principal building‖ [SR].
Section 2. That chapter 11.60 entitled ―Stopping, Standing and Parking‖ of the Elgin
Municipal Code, 1976, as amended, be and is hereby further amended by adding a new section
11.60.135 thereto entitled ―Parking of Commercial Vehicles Prohibited,‖ to read as follows:

Section 1. That Chapter 11.60 of the Elgin Municipal Code, 1976, as amended, entitled
"Stopping, Standing and Parking," be and is hereby amended to create section 11.60.066, entitled
―Limited Parking Areas; Restrictions on Odd and Even Numbered Days,‖ to read as follows:
A. No vehicle shall be or remain parked on any street between the hours of 12:00
a.m. and 5:00 p.m. as follows:
1. On even-numbered calendar days of a month, on the side of any street on which
the properties bear odd street address numbers.
2. On odd-numbered calendar days of a month, on the side of any street on which
the properties bear even street address numbers.
B. The parking restrictions of subparagraph A of this section shall apply on each of
the streets located within the following defined areas:
1. Area 1—Randall Ridge: Those streets located within the area commonly
known as the Randall Ridge subdivision, including Avalon Drive, Marshfield
Drive, Weld Road, Sarah Court, Barnes Road, Randall Ridge Drive, Colonial
Drive, Newberry Court, Sterling Court, Kettlehook Drive, Derby Court, Boxwood
Drive, Winhaven Drive, Marshfield Court, Avalon Court, Randall Ridge Court
and Portsmouth Court.
2. Area 2—Southwest Area Neighbors: Those streets located within the area
bounded by the north line of Walnut Avenue on the north, the east line of South
State Street on the east, the north line of U.S. Highway 20 on the south, and the
west line of Gertrude Street on the west.

D. Any vehicle parked in violation of this section is declared a nuisance and a hazard
to public safety and any police officer of the city is authorized to cause the
removal of such vehicle to a public garage or other place of storage at the expense
of the owner of the vehicle.
Section 3. That Chapter 11.62 of the Elgin Municipal Code, 1976, as amended, entitled
"Administrative Adjudication," be and is hereby amended to amend section 11.62.110,
subparagraph D, entitled ―Schedule of Fines and Penalties,‖ to read as follows:
D. Notwithstanding the provisions of subsection A of this section, a violation of
either section 11.60.066 or section 11.60.090 of this title, as amended, shall be an
offense punishable by a fine in the amount of fifty dollars ($50.00). The owner of
a vehicle impounded in connection with the violation of either section 11.60.066
or section 11.60.090 of this title, as amended, shall also be liable for fees for the
respective towing and storage of the vehicle as provided in section 11.60.066 or
section 11.60.090 of this title.
Section 4. That this ordinance shall without further city council action automatically
expire on July 31, 2009. It is hereby declared to be the legislative intent of the city council that
the adoption this ordinance establishing daytime parking restrictions in designated residential
areas on odd- and even-numbered weekdays is being done on an experimental basis only. The
city manager is directed to submit a report to the city council prior to the automatic expiration of
this ordinance and advise the city council as to the city’s experience with the ordinance’s parking

restrictions and recommend whether an ordinance providing for the continuation of such parking
restrictions should be continued and expanded to other areas within the city.
Section 5. That all ordinances or parts of ordinances in conflict with the provisions of this

publication in the manner provided by law.

Section 1. That Chapter 10.36 of the Elgin Municipal Code, 1976, as amended, entitled
―Loitering,‖ be and is hereby amended to amend section 10.36.020, entitled ―Lo itering for the
Purpose of Engaging in Prostitution-Related Activity Unlawful,‖ to read as follows:
A. It is unlawful for any person to loiter in or near any thoroughfare, or place open to
the public, for the purpose of engaging in an act of prostitution contrary to any
provisions of the prostitution-related portions of article II of the Illinois Criminal
Code, 720 Illinois Compiled Statutes 5/11-14 through 5/11-19.1, as amended, or
any other local, State, or Federal law prohibiting prostitution-related activity
(hereinafter "prostitution laws").
B. Among the circumstances which ma y be considered by the arresting officer in
determining whether such purpose is "manifested" are the following:
1. Such person is a known prostitute, panderer, or pimp. For purposes of this
Chapter, a "known prostitute, panderer, or pimp" is a person who has, within the
knowledge of the arresting officer, been convicted in any court within this State of
any violation of the prostitution laws or substantially similar laws of any political
subdivision or this State or of any other state or jurisdiction within the previous
year; and
2. Such person repeatedly beckons to, stops, attempts to stop, or engages in
conversation with any person or motor vehicle operator by hailing, waving, or any
other bodily gesture for the purpose of inducing, enticing, soliciting, or procuring
another for purposes of committing an act of prostitution.
3. Such person repeatedly beckons to, stops, attempts to stop, or engages in
conversation with any pedestrian by hailing, waving, or any other bodily gesture
for the purpose of inducing, enticing, soliciting, or procuring another for purposes
of committing an act of prostitution.
C. No determination of intent shall be made absent an affirmative act by the person
to be charged, which act or acts, when taken in the context of the totality of the
surrounding circumstances, shall constitute substantial step towards a violation of
the aforementioned prostitution laws.
D. Any person violating the provisions of this section shall be fined not less than
$1000 nor more than $1500 for each offense.
E. A motor vehicle that is used in the violation of this section or in the commission
of prostitution as defined in section 11-14 of the Illinois Criminal Code of 1961,
as amended, soliciting for a prostitute as defined in section 11-15 of such code,
soliciting for a juvenile prostitute as defined in section 11-18 of such code, or
patronizing a juvenile prostitute as defined in section 11-18.1 of such code, shall
be subject to seizure and impoundment under this subsection.

1. The owner of record of such vehicle shall be liable to the city for an
administrative penalty of $1,000.00 in addition to fees for the towing and storage
of the vehicle.
2. Whenever a police officer has probable cause to believe that a vehicle is subject
to seizure and impoundment pursuant to this section, the police officer shall
provide for the towing of the vehicle to a facility controlled by the city or its
agents. When the vehicle is towed, the police officer shall notify the person who
is found to be in control of the vehicle at the time of the alleged violation, if there
is such a person, of the fact of the seizure and of the vehicle owner's right to
request a preliminary hearing to be conducted under section 11.40.095 of this
Code.
3. With the exception of the amount of the enumerated fine, the provisions of
section 11.40.095 of this Code shall apply whenever a motor vehicle is seized and
impounded pursuant to this section.
Section 2. That Chapter 10.36 of the Elgin Municipal Code, 1976, as amended, entitled
―Loitering,‖ be and is hereby amended to amend section 10.36.030, entitled ―Loitering for the
Purpose of Engaging in Drug-Related Activity Unlawful,‖ to read as follows:
A. It is unlawful for any person to loiter in or near any thoroughfare, or place open to
the public, for the purpose of engaging in activity contrary to any of the
provisions of the Illinois Controlled Substances Act, 720 Illinois Compiled
Statutes 570/100 et seq., as amended, the Illinois Cannabis Control Act, 720
Illinois Compiled Statutes 550/1 et seq., as amended, the Illinois Steroid Control
Act, as amended, or any other local, State, or Federal law prohibiting the
manufacture, distribution, delivery, use, or possession of a controlled substance
(hereinafter "drug laws").
B. Among the circumstances which may be considered in determining whether such
purpose is "manifested" are the following:
1. Such person is a known unlawful drug user, possessor, or seller. For purposes
of this Chapter, a "known unlawful drug user, possessor, or seller" is a person
who has, within the knowledge of the arresting officer, been convicted in any
court within this State of any violation involving the use, possession, or sale of
any of the substances referred to in the drug laws within the previous year; or
such person has been convicted of any of the provisions of said drug laws or
substantially similar laws of any political subdivision of this State or of any other
state or jurisdiction within the previous year; or a person who displays physical
characteristics of drug intoxication or usage, such as "needle tracks" or a person
who possesses drug paraphernalia as defined in the Illinois Drug Paraphernalia
Control Act, 720 Illinois Compiled Statutes 600/1 et seq., as amended;
2. Such person is currently subject to an order of court prohibiting his or her

presence in a high drug activity geographic area and such person is located in
such an area;
3. Such person behaves in such a manner as to raise a reasonable suspicion that he
or she is about to engage in or is then engaged in an unlawful drug-related
activity, including, but not limited to, such person acting as a "lookout";
4. Such person is a known member of a "gang" or association which has as its
purpose illegal drug activity; for purposes of this Chapter, a "known" member of
"gang" is a person, who has, within the knowledge of the arresting officer, been
convicted in any court within the United States, within the previous year, of any
violation involving illegal gang activity;
5. Such person transfers small objects or packages for currency in furtive fashion;
6. Such person takes flight upon the appearance of a police officer;
7. Such person manifestly endeavors to conceal himself or herself or any object
which reasonably could be involved in an unlawful drug-related activity;
8. The area involved is known to be an area of unlawful drug use and trafficking.
For purposes of this Section, an area "known to be an area of unlawful drug use"
is a specifically defined geographic area, designated by the Chief of Police to be a
known area of unlawful drug use; said designation being based on empirical data.
C. No determination of intent shall be made absent an affirmative act by the person
to be charged, which act or acts, when taken in context of the totality of the
surrounding circumstances, shall constitute a substantial step towards the
violation of the aforementioned drug laws.
D. Any person violating the provisions of this section shall be fined not less than
$1000 nor more than $1500 for each offense.
E. A motor vehicle used in the violation of this section shall be subject to seizure and
impoundment under this subsection.

10.37, entitled ―Prostitution and Prostitution-Related Offenses,‖ to read as follows:

10.37.010: DEFINITIONS:
As used in this chapter, unless the context otherwise requires:
PUBLIC PLACE: Any street, sidewalk, bridge, alley or alleyway, plaza, park, driveway,
parking lot or transportation facility or the doorways and entrance ways to any building
which fronts on any of the aforesaid places, or a motor vehicle in or on any such place, or
any other public way.
PROSTITUTION: Shall have the same meaning given that term in the Illinois Criminal
Code of 1961, as amended.
PANDERING: Shall have the same meaning given that term in the Illinois Criminal
Code of 1961, as amended.
SOLICITING FOR A PROSTITUTE: Shall have the same meaning given that term in
the Illinois Criminal Code of 1961, as amended.
10.37.020: HOUSE OF ILL-FAME OR ASSIGNATION:
A. Every house of ill-fame or house of assignation where men and women resort for
the purpose of fornication, prostitution, or lewdness is hereby declared to be a
nuisance.

B. No person shall keep or maintain a house of ill-fame or assignation, or a place for
the practice of fornication, prostitution, or lewdness.
C. Each 24 hours that such house or place shall be kept or maintained for such
purpose shall constitute a separate and distinct offense.
D. No person shall patronize, frequent, be found in, or be an inmate of any such
house or place used for any of the purposes set forth in this section.
E. No person shall lease to another any house, room, or other premises, in whole or
in part, for any of the uses or purposes set forth in this section or knowingly
permit the same to be used or occupied for such purposes.
F. Any person violating the provisions of this section shall be fined not less than
$1000 nor more than $1500 for each offense.
10.37.030: DIRECTING PERSONS TO HOUSES OF ILL FAME:
A. No person knowingly shall direct, take, transport, or offer to direct, take, or
transport, any person for immoral purposes to any other person, or assist any
person by any means to seek or to find any prostitute or other person engaged in
immoral practices, or any brothel, bawdy house, or any other place of ill-fame.
B. Any person violating the provisions of this section shall be fined not less than
$1000 nor more than $1500 for each offense.
10.37.040: PROSTITUTION OR LEWDNESS IN CONVEYANCES:
A. No person shall knowingly receive any person for purposes of lewdness,
assignation, or prostitution into or upon any vehicle or other conveyance or permit
any person to remain for any of the said purposes in or upon any such vehicle or
other conveyance.
B. Any person violating the provisions of this section shall be fined not less than
$1000 nor more than $1500 for each offense.
10.37.050: SOLICITING:
A. No person shall by any overt acts in or upon the public ways or in any hotel,
motel or other public place of accommodation or on public conveyances or in any
establishment licensed to sell alcoholic beverages, offer to perform or solicit for
another person to perform any act of prostitution.
B. Any person violating the provisions of this section shall be fined not less than
$1000 nor more than $1500 for each offense.

10.37.060: RESPONDING TO PROSTITUTES:
A. Any person who responds to the beckoning of a prostitute in a public place by
inquiring about, negotiating for, accepting an offer of or engaging in an act of
prostitution, or by allowing another into his or her motor vehicle for purposes of
inquiring about, negotiating for, accepting an offer of or engaging in an act of
prostitution , shall be guilty of a violation of this section.
B. The chief of police shall make available to local newspapers, radio and television
stations the names of all persons charged with violating this subsection.
C. Any person violating the provisions of this section shall be fined not less than
$1000 nor more than $1500 for each offense.
10.37.070: MOTOR VEHICLE IMPOUNDMENT:
A. A motor vehicle that is used in the violation of section 10.37.030, 10.37.040,
10.37.050 or 10.37.060 of this chapter, or in the commission of prostitution as
defined in section 11-14 of the Illinois Criminal Code of 1961, as amended,
soliciting for a prostitute as defined in section 11 -15 of such code, soliciting for a
juvenile prostitute as defined in section 11-18 of such code, or patronizing a
juvenile prostitute as defined in section 11-18.1 of such code, shall be subject to
seizure and impoundment under this subsection.
1. The owner of record of such vehicle shall be liable to the city for an
administrative penalty of $1,000.00 in addition to fees for the towing and storage
of the vehicle.
2. Whenever a police officer has probable cause to believe that a vehicle is subject
to seizure and impoundment pursuant to this section, the police officer shall
provide for the towing of the vehicle to a facility controlled by the city or its
agents. When the vehicle is towed, the police officer shall notify the person who
is found to be in control of the vehicle at the time of the alleged violation, if there
is such a person, of the fact of the seizure and of the vehicle owner's right to
request a preliminary hearing to be conducted under section 11.40.095 of this
Code.
3. The provisions of section 11.40.095 of this Code shall apply whenever a motor
vehicle is seized and impounded pursuant to this section.
Section 4. That Chapter 10.44 of the Elgin Municipal Code, 1976, as amended, entitled
―Chronic Nuisance Property,‖ be and is hereby amended to amend section 10.44.020, entitled
―Definitions,‖ to read as follows:
CHRONIC NUISANCE PROPERTY: Property upon which three (3) or more instances
of any one or any combination of the behaviors listed below have occurred during any

one hundred twenty (120) day period, as a result of any three (3) separate factual events
that have been independently investigated by any law enforcement agency:
A. Disorderly conduct as defined in 720 Illinois Compiled Statutes 5/26-1, as
amended.
B. Unlawful use of weapons as defined in 720 Illinois Compiled Statutes 5/24-1 et
seq., as amended.
C. Mob action as defined in 720 Illinois Compiled Statutes 5/25-1, as amended.
D. Discharge of a firearm as defined in 720 Illinois Compiled Statutes 5/24-1.2 and
1.5, as amended.
E. Gambling as defined in 720 Illinois Compiled Statutes 5/28-1, as amended.
F. Possession, manufacture or delivery of controlled substance as defined in 720
Illinois Compiled Statutes 570/401 et seq., as amended.
G. Assault or battery or any related offense as defined in 720 Illinois Compiled
Statutes 5/12-1 et seq., as amended.
H. Sexual abuse or related offenses as defined in 720 Illinois Compiled Statutes
5/12-15 et seq., as amended.
I. Public indecency as defined in 720 Illinois Compiled Statutes 5/11-9 et seq., as
amended.
J. Violations of any city of Elgin ordinance or state of Illinois statute controlling or
regulating prostitution, as the term ―prostitution‖ is defined in 720 Illinois
Compiled Statutes 5/11-14 et seq., as amended.
K. Criminal damage to property as defined in 720 Illinois Compiled Statutes 5/21-1
et seq., as amended
L. Possession, cultivation, manufacture or delivery of cannabis as defined in 720
Illinois Compiled Statutes 550/1 et seq., as amended
M. Illegal consumption or possession of alcohol as defined in 235 Illinois Compiled
Statutes 5/1 et seq., as amended.
N. Violations of subsection 9.40.470A of this code relative to property care and
maintenance.

O. Violation of any city of Elgin ordinance or state of Illinois statute controlling or
regulating the sale or use of alcoholic beverages.
P. Violations of city of Elgin property maintenance code section 307 et seq., as
amended, relative to rubbish and garbage.
CONTROL: The ability to regulate, restrain, dominate, counteract or govern conduct that
occurs on that property.
OWNER: Any person, agent, partnership, limited liability company or corporation,
having any legal or equitable interest in the property.
PERMIT: To suffer, allow, consent to, acquiesce by failure to prevent, or expressly
assent or agree to the doing of an act.
PERSON IN CHARGE: Any person in actual or constructive possession of a property,
including, but not limited to, an owner-occupant of property under his or her domain,
ownership or control.
PROPERTY: Any real property, including land in that which is affixed, incidental or
pertinent to land, including, but not limited to, any premises, room, house, building, or
structure or any separate part or portion thereof, whether permitted or not.
Section 5. Severability. If any provision, clause, sentence, paragraph, section or part of
this ordinance or application thereof to any person or circumstance, shall for any reason be
adjudged by a court of competent jurisdiction to be unconstitutional or inv alid, said judgment
shall not affect, impair or invalidate the remainder of this ordinance and the application of such
provision to other persons or circumstances, but shall be confined in its operation to the
provision, clause, sentence, paragraph, section or part thereof directly involved in the
controversy in which such judgment shall have been rendered and to the person or circumstances
involved. It is hereby declared to be the legislative intent of the City Council that this ordinance
would have been adopted had such unconstitutional or invalid provisions, clause, sentence,
paragraph, section or part thereof not been included.
Section 6. That all ordinances or parts of ordinances in conflict with the provisions of
this ordinance be and are hereby repealed.
Section 7. That this ordinance shall be in full force and effect upon its passage and
publication in the manner provided by law.

WHEREAS, written application has been made requesting a map amendment from CF
Community Facility District to RC3 Residence Conservation District, and Repealing Ordinance
No. G66-95;
WHEREAS, after due notice in the manner provided by law the Planning and
Development Commission conducted public hearings concerning said application and has
submitted its written findings and recommendations; and
WHEREAS, the City Council of the City of Elgin, Illinois, has reviewed and concurs
with the findings and recommendations of the Planning and Development Commission.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF ELGIN, ILLINOIS:
Section 1. That the City Council of the City of Elgin hereby adopts the Findings of Fact,
dated July 7, 2008 made by Planning and Development Commission, a copy of which is attached
hereto and made a part hereof by reference as Exhibit A.
