HomeMy WebLinkAboutf - March 26, 2008 CC157 VOLUME LXXIII MARCH 26, 2008 COUNCIL OF THE CITY OF ELGIN, ILLINOIS COUNCIL-MANAGER FORM OF GOVERNMENT REGULAR MEETING The regular meeting of the Council of the City of Elgin, Illinois, was held on March 26, 2008, in the Council Chambers. The meeting was called to order by Mayor Schock at 7:05 p.m. The Invocation was given by Almida Dominguez from the Highland Fellowship Church and the Pledge of Allegiance was led by Mr. and Mrs. Art Richoz. ROLL CALL Roll call was answered by Councilmembers Figueroa, Kaptain, Powers, and Mayor Schock. Absent: Councilmembers Gilliam, Steffen, and Walters. MINUTES OF THE MARCH 12, 2008, COUNCIL MEETING APPROVED AS DISTRIBUTED Councilmember Kaptain made a motion, seconded by Councilmember Figueroa, to approve the March 12, 2008, Council Meeting Minutes as distributed. Upon a roll call vote: Yeas: Councilmembers Figueroa, Kaptain, Powers, and Mayor Schock. Nays: None. COMMUNICATIONS National Fair Housing Month Proclamation The Mayor read a proclamation recognizing April as National Fair Housing Month. He then presented it to Ina Dews. Awards Presentation to State “Top Ops” Competition Champions Kyla Jacobson, on behalf of the Illinois Water Works Association, presented trophies to the following City employees who competed at the recent state conference: Eric Kresmery, a third place in Meter Madness and a first place to the team of Stuart Nelson, Mike Bourgerie, and Eric Olson in the Top Ops competition. The Illinois Water Works Association will be paying the expenses for this team to compete at the national convention in Atlanta, GA in June. The Mayor thanked the four men for their hard work and invited the public to tour the water plant. RECOGNIZE PERSONS PRESENT John Collins referred to a November 6, 1998, memo that concerned payment to Mr. Garret Kelly for repair to a sanitary sewer. He then introduced Mrs. Kelly. MARCH 26, 2008 VOLUME LXXIII 158 Marilyn Kelly asked the Council if, in fact, payment had been made to Mr. Kelly at that time. Mayor Schock indicated that staff would check and let her know. Ina Dews expressed her concerns about why there are so few minority males in the Fire Department. BID 08-011 AWARDED TO REILLY GRAPHICS FOR THE PRINTING OF THE HEMMENS CULTURAL CENTER SEASON BROCHURE Councilmember Powers made a motion, seconded by Councilmember Kaptain, to award a contract to Reilly Graphics in the amount of $27,747.05 for the printing of The Hemmens Cultural Center brochure. Upon a roll call vote: Yeas: Councilmembers Figueroa, Kaptain, Powers, and Mayor Schock. Nays: None. BID 08-015 AWARDED TO IWS, INC. FOR CAULK REPLACEMENT AT PUBLIC WORKS FACILITY Councilmember Figueroa made a motion, seconded by Councilmember Kaptain, to award a contract to IWS, Inc. in the amount of $35,600 for caulk replacement between each of the prefab concrete wall sections of the Public Works facility to keep the building water tight and prevent possible structural damage. Upon a roll call vote: Yeas: Councilmembers Figueroa, Kaptain, Powers, and Mayor Schock. Nays: None. BID 08-016 AWARDED TO WATER SERVICES FOR CONSULTING SERVICES FOR A WATER SYSTEM LEAK DETECTION SURVEY FOR THE WATER DEPARTMENT Councilmember Kaptain made a motion, seconded by Councilmember Figueroa, to award a contract to Water Services in the amount of $51,000 for completion of all services necessary to detect and pinpoint leaks in the water distribution system for the Water Department. MARCH 26, 2008 VOLUME LXXIII 160 Mayor Schock said that he was flabbergasted at the amount of water saved by detecting these leaks. It amounted to 293,460,000 gallons of potentially lost water. Upon a roll call vote: Yeas: Councilmembers Figueroa, Kaptain, Powers, and Mayor Schock. Nays: None. CONTRACT AWARDED TO LANDMARK FORD, INC. FOR THE PURCHASE OF THIRTEEN 2008 FORD POLICE INTERCEPTOR SQUAD CARS THROUGH THE STATE OF ILLINOIS JOINT PURCHASE PROGRAM Councilmember Kaptain made a motion, seconded by Councilmember Figueroa, to award a contract to Landmark Ford in the amount of $301,226.25 for the purchase of thirteen 2008 Ford Police Interceptor Squad Cars through the State of Illinois Joint Purchase Program. It is recommended that the thirteen vehicles being replaced be disposed of through a public auction later this year following the delivery and conversion of the new vehicles. CONTRACT AWARDED TO PRAIRIE INTERNATIONAL TRUCK SALES FOR THE PURCHASE OF THIRTEEN 2009 INTERNATIONAL 7400 TRUCK CHASSIS EQUIPPED WITH DUMP BODIES, SNOW PLOWS, AND ICE CONTROL EQUIPMENT THROUGH THE STATE OF ILLINOIS JOINT PURCHASE PROGRAM FOR THE PUBLIC WORKS DEPARTMENT Councilmember Figueroa made a motion, seconded by Councilmember Powers, to award a contract to Prairie International Truck Sales in the amount of $1,719,152 for the purchase of thirteen 2009 International 7400 truck chassis equipped with dump bodies, snow plows, and ice control equipment through the State of Illinois Joint Purchase Program for the Public Works Department. Councilmember Figueroa congratulated the City Manager for finding the money to purchase the additional equipment for street improvements. PETITION 02-08 APPROVED REQUESTING CONDITIONAL USE APPROVAL FOR A DRINKING PLACE, AN OUTDOOR EATING AND DRINKING PLACE, PACKAGED WINE SALES, AND EDUCATIONAL SERVICES IN THE CC1 CENTER CITY DISTRICT; PROPERTY LOCATED AT 74 SOUTH GROVE AVENUE, BY ELLSWORTH JAMES CANFIELD, AS APPLICANT, AND SPRING LANE INVESTMENTS, LLC, AS OWNER Assistant Community Development Director Fitzgibbons reported that this petition was requesting approval of the Red Bar Winery. The business owner is proposing a wine bar that includes wine tasting, retail sales of wine, limited sale of food, wine production, wine production classes, and conditional use to serve food and beverages outdoors. This petition has the VOLUME LXXIII MARCH 26, 2008 161 unanimous approval of the Zoning and Subdivision Commission. Jim Canfield, the owner, was introduced. Councilmember Powers said he thought this was an exciting project. Councilmember Figueroa made a motion, seconded by Councilmember Powers, to approve Petition 02-08 subject to conditions. RESOLUTION 08-87 TABLED AUTHORIZING EXECUTION OF A PURCHASE OF SERVICE AGREEMENT WITH ELGIN COMMUNITY NETWORK, INC. Councilmember Kaptain made a motion, seconded by Councilmember Figueroa, to table Resolution 08-87 for consideration until the following City Council meeting on April 9, 2008. RESOLUTION 08-88 ADOPTED AUTHORIZING FILING OF NATIONAL STREET STATION AREA PROJECT APPLICATION FOR A TECHNICAL ASSISTANCE GRANT FROM THE REGIONAL TRANSPORTATION AUTHORITY Councilmember Powers made a motion, seconded by Councilmember Figueroa, to adopt the following resolution. Mayor Schock mentioned that many of the neighbors were looking forward to this project. Upon a roll call vote: Yeas: Councilmembers Figueroa, Kaptain, Powers, and Mayor Schock. Nays: None. Resolution No. 08-88 RESOLUTION AUTHORIZING FILING OF NATIONAL STREET STATION AREA PROJECT APPLICATION FOR A TECHNICAL ASSISTANCE GRANT FROM THE REGIONAL TRANSPORTATION AUTHORITY WHEREAS, the Regional Transportation Authority (the “Authority”), is authorized to study public transportation problems and developments; and to conduct, in cooperation with other public and private agencies, such studies; and WHEREAS, the Authority has the power to expend funds for use in connection with these studies; and WHEREAS, the Authority has the power to make and execute all contracts and other instruments necessary or convenient to the exercise of its powers; and WHEREAS, approval for said funds will impose a 20% match obligation upon the recipient. MARCH 26, 2008 VOLUME LXXIII 162 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS: 1. That the Mayor is authorized to execute and file applications on behalf of the City of Elgin with the Regional Transportation Authority for a technical assistance grant for the National Street Station Area Project. 2. That the Mayor is authorized to furnish such additional information, assurances, certifications and amendments as the Regional Transportation Authority may require in connection with this technical assistance grant application. 3. That the Mayor is authorized and directed on behalf of the City of Elgin to execute and deliver grant agreements and all subsequent amendments thereto between the City of Elgin and the Regional Transportation Authority for the subject technical assistance grants, and the City Clerk of the City of Elgin is authorized and directed on behalf of the City of Elgi n to attest said agreements and all subsequent amendments thereto. 4. VOLUME LXXIII MARCH 26, 2008 163 Ordinance No. T18-08 AN ORDINANCE CREATING A LIMITED DURATION CLASS R LIQUOR LICENSE VIDEO PRODUCTION PERMIT BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS: Section 1. There is established a class R video production permit to allow class R licensee to provide entertainment consisting of, but not limited to, dancing, musical and theatrical performances, or other such similar events of an entertaining nature on the licensed premises of the principal establishment for which there is a then currently issued and valid class R license during the filming or video taping of such event for the purposes of creating a television or theatrical production. Admission to an entertainment event being conducted pursuant to a class R video production permit shall be solely limited to the members of a private club consisting of members who are of seventeen (17) years of age or older and the members‟ guests. Section 2. Notwithstanding section 6.06.095 of the Elgin Municipal Code, 1976, as amended, the issuance of a class R video production permit shall only be granted upon the submission and approval of an application to the chairman of the local liquor control commission. Section 3. Not more than two (2) entertainment events conducted pursuant to class R video production permit shall occur within any licensing year. Section 4. A class R video production permit shall expire thirty (30) days after the date of issue. Section 5. Notwithstanding section 6.06.140N of the Elgin Municipal Code, 1976, as amended, an entertainment event being conducted pursuant to a class R video production permit shall be subject to the following age restrictions and identification requirements: A. No person conducting or operating an entertainment event pursuant to a class R video production permit shall permit, either by act or omission, any person under the age of seventeen (17) years to enter or remain on the licensed premises. B. The person conducting or operating the class R video production shall require a government-issued photo identification card showing the age of each person admitted or seeking to be admitted. Section 6. Any person who shall by affirmative misrepresentation of age obtain admission to or permission to remain at any entertainment event being conducted pursuant to a class R video production permit contrary to the provisions of this code shall be punishable by a fine of not less than five hundred dollars ($500.00) nor more than one thousand dollars ($1000.00). Section 7. Any person who permits a person to enter or remain at any entertainment event being conducted pursuant to a class R video production permit contrary to the provisions of this code shall be punishable by a fine of not less than five hundred dollars ($500.00) nor more than one thousand dollars ($1000.00). MARCH 26, 2008 VOLUME LXXIII 164 Section 8. An application for a class R video production permit shall be submitted to the local liquor control commission and shall contain the following information: A. The applicant‟s name, address and day and evening telephone numbers. If the applicant is not a natural person, this information shall be provided for the both the applicant and for the natural person making the application on behalf of the applicant. If the applicant is not a natural person, the applicant shall also provide the names, addresses and day and evening telephone numbers of the limited partners, partners, owners and principals of the applicant. B. The complete address and identification of the areas within the licensed premises in which the class R video production event will be conducted. C. The proposed date or dates on which the entertainment event or events requiring a class R video production permit will occur and a description of the proposed entertainment that will be occurring on those dates. D. The designation of not less than one on-site manager who will be in attendance during and following each class R video production and be responsible for the direct operation and oversight of the licensed premises and the supervision of other employees or workers. The on-site manager shall have authority to accept complaints, notice of violations and take any corrective actions required by the city. E. A security plan detailing the manner in which the applicant will maintain order on the licensed premises and ensure compliance with the laws of the state and the code. Any changes to the approved security plan must be submitted and approved by the chief of police not less than five (5) business days before the event. F. A statement from the applicant that the licensed premises on which the applicant will conduct or operate the class R video production will comply with all laws and other legal requirements, including but not limited to building, property maintenance, zoning, health and fire prevention codes; and a statement that the applicant and any employee or agent thereof will, in the conduct of any class R video production, comply with all laws and other legal requirements, including but not limited to the building, property maintenance, zoning, health and fire prevention codes. G. A statement of indemnification from the applicant stating that the licensee shall indemnify and hold the city harmless from any and all losses, claims, actions or damages suffered by any person or persons by reason of or resulting from any negligence of the licensee or its agents, employees, or patrons or on account of any act or omission of the licensee in its exercise of its license or use or occupancy of any premises in connection with such license. In the event any suit or action is brought against the city, the licensee shall, upon notice of the commencement thereof, defend the same, at no cost and expense to the city, and promptly satisfy any final judgment adverse to the city or to the city and the licensee jointly; provided, that in the event the city determines that one or more principles of governmental or public law are involved, the city retains the right to participate in such action. The above liability shall not be diminished by the fact, if it be a fact, that any such death, injury, damage, loss, cost or expense may have been, or may be VOLUME LXXIII MARCH 26, 2008 165 alleged to have been, contributed to by the negligence of the city or its officers, employees or agents; provided, however, that nothing contained in this section shall be construed as requiring the licensee to indemnify the city against liability for damages arising out of bodily injury to persons or damage to property caused by or resulting from the sole negligence of the city, or its officers, employees or agents. H. Such other information as the local liquor control commission shall require to ensure the health, safety and welfare of the patrons of a class R video production event. I. A certification or declaration under penalty of perjury under the laws of the State of Illinois that the information and statements in the application are true and correct. Section 9. Any class R video production permit issued by the chairman of the local liquor control commission shall also be subject to the following limitations: A. The approved security plan shall be followed without any changes unless such change has been submitted to the chief of police in writing not less than five (5) business days before the entertainment event being conducted pursuant to the class R video production permit and any such change has been approved by the chief of police prior to the event. B. Security personnel shall be required for the maximum capacity of the entertainment event at the licensed premises as determined by the chief of police upon receiving the fire chief„s determination regarding the maximum capacity of the licensed premises. C. The holder of a class R video production permit shall notify the local liquor control commission in writing as to any proposed changes regarding the proposed date or dates on which the entertainment event or events requiring a class R video production permit will occur and shall not change any designated event dates without first receiving approval from the local liquor control commission. D. No members of the private club or members of the general public shall be admitted to the licensed premises prior to the opening of the event. E. Only the holder of a then currently issued and valid Class R liquor license for the establishment may apply for a class R video production permit. F. A special police detail consisting of not less than one (1) city police officer shall be required for each entertainment event conducted pursuant to a class R video production permit. The size of the special police detail shall be determined by the chief of police based upon, but not limited to, the anticipated number of patrons expected to attend the entertainment event. The special police detail shall commence at the time patrons are admitted to the entertainment event and shall conclude thirty (30) minutes following the conclusion of the entertainment event. The estimated cost of such special police detail as determined by the City‟s Fiscal Services Group Director shall be paid by the permit holder in certified funds not less than two business days prior to a scheduled entertainment event. In the event the actual cost of such police detail exceeds the estimate amount paid by the permit MARCH 26, 2008 VOLUME LXXIII 166 holder, the permit holder shall pay such additional amount upon receipt of an invoice for such services from the city. Section 10. All peace officers of the city shall have free access to an event begin conducted pursuant to a class R video production permit. Section 11. Notwithstanding the permitted days of operation for a class R license established in Section 6.06.040U of the Elgin Municipal Code, 1976, as amended, a class R video production permit may be issued for any day of the week. Notwithstanding the hours of operation for a class R license established in section 6.06.040NU of the Elgin Municipal Code, 1976, as amended, a class R video production permit shall be limited to the hours between 12:00 p.m. and 4:00 a.m. Section 12. There shall be no annual fee for a class R video production permit. Section 13. The provisions of this ordinance providing for a class R video production permit shall without further city council action automatically expire on April 30, 2008. It is hereby declared to be the legislative intent of the city council that the adoption of an ordinance provision for a class R video production permit is being done for a short-term, limited basis only and that no licensee who is granted a class R video production permit shall have any property interest, vested right, or other continuing protectible interest in the continuation of a class R video production permit. Section 14. That all ordinances or parts of ordinances in conflict with the provisions of this ordinance be and are hereby repealed. Section 15. RESOLUTION 08-76 ADOPTED ADOPTING A BIKEWAY MASTER PLAN FOR THE CITY OF ELGIN Councilmember Figueroa made a motion, seconded by Councilmember Powers, to adopt the following resolution. Resolution No. 08-76 RESOLUTION ADOPTING A BIKEWAY MASTER PLAN FOR THE CITY OF ELGIN BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS, that the Bikeway Master Plan prepared by TranSystems, dated January 2008, is hereby adopted as the Bikeway Master Plan for the City of Elgin. Ordinance No. T17-08 AN ORDINANCE REGARDING ABATING A PORTION OF THE ANNUAL TAX FOR 2007 FOR REFUNDING AND CORPORATE PURPOSE BONDS WHEREAS, the City Council has adopted Ordinance Numbers T1-08, T2-08, T3-08, T5- 08, T6-08, T7-08, T8-08, and T13-08 providing for abating a portion of the annual tax for 2007 for refunding and corporate purpose bonds for the series bonds referred to in such ordinances; and MARCH 26, 2008 VOLUME LXXIII 200 WHEREAS, depending upon the 2007 assessed valuation figures and the state multiplier it may be necessary to further adjust the amounts of the abatement and resulting tax levy in Section 1 of such ordinances in order to arrive at a 2007 tax rate for the City of Elgin not to exceed $1.9299 per $100.00 of assessed valuation. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS: Section 1. That the city‟s Fiscal Services Director be and is hereby authorized and directed that upon receipt of 2007 assessed valuation figures and the state multiplier to adjust, to the extent reasonably practicable, the amount of the abatement and resulting tax levy in the Section 1 of Ordinance Numbers T1-08, T2-08, T3-08, T5-08, T6-08, T7-08, T8-08, and T13-08 so as to attempt to arrive at a 2007 tax rate for the City of Elgin not to exceed $1.9299 per $100 of assessed valuation. The city‟s Fiscal Services Director shall make such adjustments, if any, prior to the filing of a certified copy of Ordinance Numbers T1-08, T2-08, T3-08, T5-08, T6-08, T7-08, T8-08, and T13-08 with the County Clerks of Kane and Cook Counties, Illinois, whereupon the amount of the abatement and tax levy in Section 1 of Ordinance Numbers T1-08, T2-08, T3-08, T5-08, T6-08, T7-08, T8-08, and T13-08 shall be deemed final.
