COUNCIL OF THE CITY OF ELGIN, ILLINOIS
COUNCIL-MANAGER FORM OF GOVERNMENT
REGULAR MEETING
The regular meeting of the Council of the City of Elgin, Illinois, was held on December 5, 2007,
in the Council Chambers. The meeting was called to order by Mayor Schock at 7:00 p.m. The
Invocation was given by Pastor Ty Gooch from the Harvest Bible Chapel and the Pledge of
Allegiance was led by Councilmember Juan Figueroa.
ROLL CALL
Roll call was answered by Councilmembers Figueroa, Gilliam, Kaptain, Powers, Steffen,
Walters and Mayor Schock. Absent: None.
MINUTES OF THE NOVEMBER 28, 2007, COUNCIL MEETING APPROVED AS
DISTRIBUTED
Councilmember Walters made a motion, seconded by Councilmember Figueroa, to approve the
November 28, 2007, Council Meeting Minutes as distributed. Upon a roll call vote: Yeas:
Councilmembers Figueroa, Gilliam, Kaptain, Powers, Steffen, Walters, and Mayor Schock.
Nays: None.
COMMUNICATIONS
Drunk and Drugged Driving (3D) Prevention Month Proclamation
Mayor Schock read a proclamation recognizing December as Drunk and Drugged Driving (3D)
Prevention Month.
RECOGNIZE PERSONS PRESENT
Bob Durshlag, owner of Singles Roofing Company, expressed his desire to relocate his
company’s factory to an East Chicago Street location although that would currently be in
violation of City ordinance.
Andy Engelmann, owner of Town and Country Gardens, expressed his desire to sell property to
Singles Roofing Company, but believes he is being prevented from doing that due to the current
zoning ordinances.

BID 07-077 AWARDED TO THE CONCEPT MILL AND DAVIS DESIGN FOR
GRAPHIC DESIGN SERVICES
Councilmember Walters made a motion, seconded by Councilmember Figueroa, to approve a
purchase agreement with The Concept Mill for graphic design services at $75/per hour and Davis
Design at $40/per hour in an amount not to exceed $75,000 annually. Upon a roll call vote:
Yeas: Councilmembers Figueroa, Gilliam, Kaptain, Powers, Steffen, Walters, and Mayor
Schock. Nays: None.
BID 07-110 AWARDED TO SHERMAN HOSPITAL AND PROVENA ST. JOSEPH
HOSPITAL FOR PRE-PLACEMENT PHYSICALS AND OTHER MEDICAL
SERVICES
Councilmember Kaptain made a motion, seconded by Councilmember Gilliam, to award
contracts to Sherman Hospital and Provena St. Joseph Hospital for pre-placement physicals and
other medical services. Upon a roll call vote: Yeas: Councilmembers Figueroa, Gilliam,
Kaptain, Powers, Steffen, Walters, and Mayor Schock. Nays: None.
BID 07-111 AWARDED TO LIFEFITNESS FOR THE PURCHASE OF
CARDIOVASCULAR FITNESS EQUIPMENT FOR THE CENTRE
Councilmember Walters made a motion, seconded by Councilmember Figueroa, to award a
contract to LifeFitness in the amount of $24,997.76 for the purchase of five pieces of
cardiovascular fitness equipment. Upon a roll call vote: Yeas: Councilmembers Figueroa,
Gilliam, Kaptain, Powers, Steffen, Walters, and Mayor Schock. Nays: None.
BID 07-113 AWARDED TO CUISINE AMERICA AS THE FEATURED CATERER FOR
THE CENTRE
Councilmember Figueroa made a motion, seconded by Councilmember Kaptain, to award a
contract to Cuisine America as the featured caterer for The Centre of Elgin. Councilmember
Figueroa asked if the client wished to use another caterer would this be allowed. Parks &
Recreation Director Reopelle answered that it would. Upon a roll call vote: Yeas:
Councilmembers Figueroa, Gilliam, Kaptain, Powers, Steffen, Walters, and Mayor Schock.
Nays: None.
BID 07-126 AWARDED TO GRAVELY OF CHICAGO MOWERWORKS FOR
SIDEWALK SNOW REMOVAL EQUIPMENT
Councilmember Kaptain made a motion, seconded by Councilmember Figueroa, to award a
contract to Gravely of Chicago Mowerworks in the amount of $30,598.04 for the purchase of
four sidewalk snow removal machines. Upon a roll call vote: Yeas: Councilmembers Figueroa,
Gilliam, Kaptain, Powers, Steffen, Walters, and Mayor Schock. Nays: None.

PUBLIC HEARING ON TRUTH IN TAXATION
Mayor Schock declared the public hearing open. No one chose to speak, and Mayor Schock
declared the public hearing closed.
PUBLIC HEARING REGARDING A FIRST AMENDMENT TO THE ANNEXATION
AGREEMENT, AND AMENDMENTS TO THE PLANNED DISTRICT ORDINANCES
TO INTRODUCE ADDITIONAL BUILDING ELEVATIONS AND FLOOR PLANS IN
THE WEST POINT GARDENS SUBDIVISION; PROPERTY LOCATED AT 100
NESLER ROAD; BY WEST POINT BUILDERS & DEVELOPERS, INC., AS

Mayor Schock declared the public hearing open.
Community Development Director Deering stated the Planning and Development Commission
has recommended approval of this application subject to conditions and that the developer has
agreed to limit the number of new elevations to the small lot product to 30% of the total sales of
lots. Mr. Patrick Curran, President of West Point Builders, presented a PowerPoint presentation
illustrating the proposed elevations and new models.
There were no questions or comments from the audience and Mayor Schock declared the public
hearing closed.
PETITION 61-07 APPROVED REQUESTING APPROVAL OF A FIRST AMENDMENT
TO THE ANNEXATION AGREEMENT, AND AMENDMENTS TO THE PLANNED

Jerry Deering stated this petition features 24 townhomes with price points beginning at
$325,000. The Planning and Development Commission has recommended approval of this
petition subject to conditions. Councilmember Figueroa made a motion, seconded by
Councilmember Kaptain, to approve Petition 54-06 subject to conditions. Councilmember
Kaptain asked if the streets in the development were private and Mr. Deering answered yes.
Councilmember Kaptain also asked about visitor parking and Mr. Deering replied it had been
resolved to the satisfaction of the City. Councilmember Walters asked it the wetlands issue had
been resolved and Mr. Deering answered yes. Upon a roll call vote: Yeas: Councilmembers

AN ORDINANCE
CLASSIFYING PREVIOUSLY ANNEXED TERRITORY IN THE
PORI-PLANNED OFFICE RESEARCH INDUSTRIAL DISTRICT
(Randall Rose Auto Mall Subdivision)
WHEREAS, the real property herein described (the "Subject Property") has previously
been annexed to the City of Elgin, Illinois (the "City") and classified in the City's ORI-Office,
Research, Industrial District; and
WHEREAS, the Subject Property is the subject of a certain Development Agreement
dated December 5, 2007 (the "Development Agreement") between Randall 90, LLC, an Illinois
limited liability company (the "Owner") and the City; and
WHEREAS, written application has been made to reclassify the Subject Property in a
PORI- Planned Office Research Industrial District as created in this Ordinance; and
WHEREAS, after due notice in the manner provided by law the Planning and
Development Commission conducted public hearings concerning said application and has
submitted its written findings and recommendations; and
WHEREAS, the City Council of the City of Elgin, Illinois, has reviewed the findings and
recommendations of the Planning and Development Commission and has reviewed the findings
and recommendations of the Community Development Group.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF ELGIN, ILLINOIS:

Elgin, Kane County, Illinois).
Section 3. That the City Council of the City of Elgin hereby classifies the subject
property in the PORI Planned Office Research Industrial District in accordance with the
following provisions:
A. Purpose and Intent. The purpose of the PORI Office Research Industrial District
is to provide a planned industrial environment that fosters a sense of place and
destination within a coordinated campus or park setting, subject to the provisions
of Chapter 19.60, Planned Developments (except Section 19.60.090 shall not
apply). A PORI zoning district is most similar to, but departs from the standard
requirements of the ORI zoning district.
B. Supplementary Regulations. Any word or phrase contained herein, followed by
the symbol “(SR)”, shall be subject to the definitions and the additional
interpretive requirements provided in Chapter 19.90, Supplementary Regulations,
of the Elgin Municipal Code, as amended. The exclusion of such symbol shall not
exempt such word or phrase from the applicable supplementary regulation.
C. General Provisions. In this PORI zoning district, the use and development of
land and structures shall be subject to the provisions of Chapter 19.05, General
Provisions, of the Elgin Municipal Code, as amended, except as may be otherwise
provided in this section.

D. Zoning Districts - Generally. In this PORI zoning district, the use and
development of land and structures shall be subject to the provisions of Chapter
19.07, zoning Districts, of the Elgin Municipal Code, as amended, except as may
be otherwise provided in this section.
E. Land Use. In this PORI zoning district, the use and development of land and
structures shall be subject to the provisions of Chapter 19.10 Land Use, of the
Elgin Municipal Code, as amended, except as may be otherwise provided in this
section.
1. New Vehicle Sales Uses:
a. Prior to the time, if ever, as the Owner may elect to make
use of the Subject Property for any one or more of the ORI Land Uses (as
defined in paragraph 2 of this Section E) the Subject Property may be used
for, and at all times (if ever) after the date that the Owner shall have
received from the City either (i) any incentive payments to Honda, (ii) the
Development Assistance-Part A or Part B, (as defined in the Development
Agreement for the Subject Property between the City of Elgin and Randall
90, L.L.C., dated December 5, 2007, the “Development Agreement”), or
(iii) any Tax Rebates (as defined in the Development Agreement), or after
the Auto Mall Development Contingency is fulfilled (as defined in the
Development Agreement), the Subject Property shall be used exclusively
for New Motor Vehicle Dealers (5511). New Motor Vehicle Dealers
(5511) is further defined as the indoor and outdoor retail principal use of
the sale of new automobiles and uses customarily accessory to such new
automobile retail sales, including without limitation: the sale of used
automobiles; the sale of automobile parts and tires; the performance of
automobile service, repairs and maintenance; the operation of a car wash
for dealership and customer vehicles; In-house financial services
pertaining to automobile sales; Food sales/service/cafes for use by
employees and customers; beauty shops and barber shops for use by
employees and customers; above-ground gasoline storage tanks not
exceeding one storage tank up to 2,500 gallons per dealership for the
fueling of dealership and customer automobiles installed, constructed,
maintained and utilized pursuant to all applicable laws (excluding any City
of Elgin code that otherwise purports to prohibit such above-ground
tanks).
As used in this paragraph E.1.a., the term “automobile” shall be defined to
include passenger vehicles, sport utility vehicles, vans and pickups. As
used in this paragraph E.1.a, the term “sale” shall be broadly defined to
include all types of transactions with customers, including, without
limitation, leasing and trade transactions. (The New Motor Vehicle
Dealers (5511) use of the Subject Property as defined above including the
principal use of new automobile sales and the accessory uses described in

the preceding portion of this paragraph E.1.a shall hereinafter be called
"New Vehicle Sales".)
b. In connection with a building in which New Vehicle Sales occur
on any lot, accessory structures on that same lot for such accessory
uses as parking structures, car wash facilities, and for other
accessory uses shall be permitted.
c. In connection with any New Vehicle Sales on the Subject Property,
the Subject Property shall be subdivided in substantial
conformance with the Auto Mall Plat more fully described in
Section F-1 below. However, portions of lots may be conveyed
between adjoining lot owners under the provisions of the Illinois
Plat Act without the necessity of having a resubdivision of plat
approved by the City as long as each lot remains a buildable lot for
the purpose of New Vehicle Sales and no lot is reduced by any
such conveyance to a size of less than 4.5 acres.
2. Other Uses.
a. Prior to (but not after) such time (if ever) as the Owner shall have
received from the City Development Assistance-Part A, or
Development Assistance-Part B, or any of the incentives in
connection with the proposed the Honda Dealership (as defined in
the Development Agreement) in connection with the use of the
Subject Property for New Vehicle Sales, the Owner shall have the
right to implement upon the Subject Property within this PORI
District the "ORI Land Uses", as identified in this section, below,
as “permitted uses” (SR) or as “conditional uses” (SR), subject,
however, to the succeeding provisions of this ordinance.
(i) The only land uses allowed as a permitted use in
this PORI zoning district shall be the enumerated land uses
listed in Section 19.40.130A of the Elgin Municipal Code,
1976, as amended, the provisions of which are incorporated
herein by reference.
(ii) Conditional Uses. The only land uses allowed as a
conditional use in this PORI zoning district shall be the
enumerated land uses listed in Section 19.40.130B of the
Elgin Municipal Code, 1976, as amended, the provisions of
which are incorporated herein by reference.
F. Site Design. In this PORI zoning district, the use and development of land and
structures shall be subject to the provisions of Chapter 19.12, Site Design, of the
Elgin Municipal Code, as amended, except as may be otherwise provided in this

section. In this PORI zoning district, the site design regulations shall be as
follows:
1. General Conditions.
a. Provided the Owner proceeds to develop and use the Subject
Property for New Vehicle Sales as permitted in section E-1 above,
then the following general conditions will apply to the
development of land and structures within this PORI zoning
district:
(i). Substantial conformance to the preliminary plat of
subdivision and associated preliminary engineering for
Randall Rose Subdivision prepared by Cowhey,
Gudmundson, Leder Ltd., dated June 4, 2007, and last
revised October 31, 2007 (collectively the "Preliminary
Plat"). Without limiting the generality of the foregoing, the
driveway access points and widths from each lot to the
adjacent subdivision streets are hereby expressly approved.
(ii). Substantial conformance to the Special Signage District for
Randall/90 Auto Mall prepared by Heitman Architects last revised
on October 16, 2007 (the "Signage Plan"), a copy of which is
attached hereto as Exhibit B, and subject to the provisions of the
ordinances designating the Subject Property as an area of special
character pursuant to Chapter 19.50, of the Elgin Municipal Code,
as amended, and the ordinance adopting a program for graphics for
the Subject Property.
b. If the Owner proposes to develop and use the Subject Property for
the Other Uses as listed in section E-2 above, the site design
regulations for this PORI Zoning District shall be the regulations
otherwise applicable to the ORI Office Research Industrial District
as provided in the Elgin Municipal Code, 1976, as amended. In
such event, Owner shall, if requested by the City’s Zoning
Administrator, submit to the City an application for the approval of
a plat of resubdivision of the Subject Property in accordance with
all applicable legal requirements (with such procedure being called
a “Resubdivision Process”, it being understood, however, such
Resubdivision Process (if required) shall not require an amendment
to this PORI Ordinance.
2. Special Design Standards Applicable to New Vehicle Sales. If the
Subject Property is developed and used for New Vehicle Sales, then the
following design standards shall prevail over any ordinance to the contrary:

a. Zoning Lots. In this PORI zoning district, “zoning lots” shall be subject
to the provisions of Section 19.12.300, zoning Lots - Clarifications and
Exceptions, of the Elgin Municipal Code, as amended.
b. Lot Area. In this PORI zoning district, there shall be no minimum
required "zoning lot area".
c. Lot Width. In this PORI zoning district, there shall be no minimum
required lot width for a zoning lot.
d. Intentionally Omitted.
e. Setbacks by Lot Line. In this PORI zoning district, the minimum
required “building” setbacks” and “vehicle use area setbacks” from a “lot
line” for a zoning lot used in connection with New Vehicle Sales shall be
as follows:
1. Building Setbacks. In this PORI zoning district, the minimum
required “building setbacks” for a zoning lot shall be as follows:
(1) Street Setback. The minimum required building setback
from the Randall Road “street lot line”, from the Interstate
90 "street lot line" and from an interior subdivision road
"street lot line" [SR] shall be as follows:
A. From Randall Road 70 feet
B. From Interstate 90
(following the conveyance of
Outlot C to the City of Elgin
for the proposed expansion of the
Interstate 90 right-of-way) 30 feet
C. From an interior subdivision street 30 feet
(2) Interior Setback. The minimum required building setback
from an "interior lot line" [SR] shall be 20 linear feet.
Because the right-of-way Auto Mall Drive narrows
adjacent to all or portions of lots 5, 8 and 9, the building
setback on said lots 5, 8 and 9 from Auto Mall Drive shall
be measured as though there had been no such narrowing of
said right-of-way.
2. Vehicle Use Area Setbacks by Lot Line. In this PORI zoning
district, the minimum required “vehicle use area setbacks” for a
zoning lot shall be as follows:

(1) Street Setback. The minimum required vehicle use area
setback from Randall Road shall be 40 linear feet; but with
the right of each dealership whose lot abuts Randall Road
to establish up to three (3) concrete, masonry or bituminous
"auto display pads" with a diameter not to exceed 22 feet
each within such Randall Road vehicle use setback.
(2) The minimum required vehicle use area setback from
Interstate 90 shall be 6 linear feet,.
(3) The minimum required vehicle use area setback from an
internal subdivision road shall be 10 linear feet but with the
right of each dealership whose lot abuts an internal
subdivision road to establish up to three (3) concrete or
bituminous "auto display pads" to within 5 feet of the lot
line. Because the right-of-way Auto Mall Drive narrows
adjacent to all or portions of lots 5, 8 and 9, the vehicle use
area setback on said lots 5, 8 and 9 from Auto Mall Drive
shall be measured as though there had been no such
narrowing of said right-of-way.
(4) The minimum required vehicle use area setback from an
interior lot line shall be 6 linear feet.
(s) The minimum required vehicle use area setback from any
detention lot shall be 6 linear feet.
f. Accessory Structures and Buildings. In this PORI zoning district,
“accessory structures and buildings” shall be subject to the provisions of
Section 19.12.500, Accessory Structures and Buildings.
g. Yards - Generally. In this PORI zoning district while the Subject
Property is used in connection with New Vehicle Sales, a “street yard”
[SR], a “side yard” [SR], and a “rear yard” [SR] shall be coextensive with
the vehicle use setback yards, and there shall be no required “transition
yard” [SR],
h. Landscape Yards. In this PORI zoning district, landscape yards shall be
as follows:
1. Landscaping - Generally. All "yards" [SR] shall be landscaped
with grass, shrubs, or other suitable pervious groundcover.
Additionally:
(a) Foundation Yards. A minimum 5 linear foot wide
landscaped area shall be provided along the front of a

building. These planting areas need not be uniform in
shape so long as the required amount of space is
landscaped.
Sidewalks shall be located outside of required foundation
yard areas, with the exception of direct building access or
courtyard use.
(b) Parking and Drives. With the exception of entrance drives
and motor vehicle overhangs, no parking or drive shall be
located within any required landscaped area.
(c) Irrigation. Irrigation requirements for landscape yards shall
be as follows: only street yards shall be fully irrigated.
2. Parking Lot Landscaping. A curbed island, planted with
landscaping materials shall be required for every 20 parking spaces
in customer parking areas but not in vehicle storage areas. The
island must measure at least 4-1/2 feet by 18 feet.
3. Storage Lot Landscaping. No curbed islands or internal
landscaping shall be required in Vehicle Storage Areas.
4. Street Trees. Street trees shall be planted at the rate of one for
every eighty (80) feet of street frontage with an additional forty
(40) trees to be planted in the outlot for the southwest detention
area. The required number of trees (determined in accordance with
the preceding sentence) may be planted in clusters or spaced so as
to avoid or minimize the blocking of sight lines to retail auto
display areas, subject to the approval by the Development
Administrator (which approval shall not be unreasonably withheld,
conditioned or delayed.
5. Vehicle Use Area Trees. Vehicle use area trees shall be planted at
the rate of one for every 100 feet of interior lot lines. Bushes shall
be planted in vehicle use areas at the rate of the product of lineal
feet of the parameter of a vehicle use area times .07, it being
acknowledged that between the perimeters of vehicle use areas on
adjacent lots, such calculation of bushes shall be made so as not to
duplicate the calculation for the same any common perimeter
length. The required number of trees and / or bushes (determined
in accordance with the preceding sentence) may be planted in
clusters or spaced so as to avoid or minimize the blocking of sight
lines to retail auto display areas, subject to the approval by the
Development Administrator (which approval shall not be
unreasonably withheld, conditioned or delayed.

i. Floor Area: Building Height. In this PORI District, the maximum "floor
area" for a zoning lot shall not exceed 100% of the zoning lot area. There
shall be no maximum building height. “Floor area” shall not include the
“floor area” of parking structures.
j. Building Coverage. In this PORI District, the maximum "building
coverage" [SR] for a zoning lot shall not exceed 70% of the zoning lot
area, except if a multistory parking structure exists on a zoning lot, the
“Building Coverage” may exceed 70% of the zoning lot area but may not
exceed 85% of the zoning lot area.
k. Off Street Parking. In this PORI zoning district, off street parking shall
be subject to the provisions of Chapter 19.45, Off-street Parking, of the
Elgin Municipal Code, 1976, as amended, and the following:
1. Required Number of Parking Stalls. The required number parking stalls
shall be subject to provisions of Chapter 19.45, Off Street Parking, of the
Elgin Municipal Code, except as follows:
For New Vehicle Sales facilities, three (3) parking stalls for each 1,000
square feet of showroom space defined as interior auto display areas
excluding administrative and sales office areas.
2. Auto Inventory Storage Areas. In Vehicle Storage Areas paved
parking surfaces need not be striped or marked and there shall be
no required size for inventory parking stalls or aisles. Vehicle
Storage Areas may be used for employee parking and for storage
of vehicles awaiting service or awaiting customer pickup.
3. Striping and Markings. All required parking lot striping and
other markings shall be white.
4. Landscape Islands. Landscaped islands shall be 4 ½ linear feet
wide and provided every 20 parking spaces in retail parking areas
for retail purchase customers (but not in Vehicle Storage Areas).
l. Fencing of Vehicle Storage Areas. Vehicle Storage Areas shall be
fenced with ornamental and not chain link fencing except that interior lot
lines thereof not located in a street yard and not visible from Randall Road
or an interior subdivision street may also be fenced with black vinyl
covered chain link up to six feet in height.
m. Parking Lot and Storage Area Lighting. There shall be no limitation on
the intensity or "spill" with respect to any lighting on any lot installed to
light parking or vehicle inventory storage areas; provided that such

lighting shall not be such as to pose a traffic safety risk on adjacent public
roads.
3. Site Design Standards Applicable to Uses Other Than New Vehicle Sales. If the
Subject Property is proposed to be developed and used for uses other than New Vehicle Sales,
then the design standards for the Subject Property shall be the regulations otherwise applicable to
the ORI Office Research Industrial Zoning District set forth in the Elgin Municipal Code, 1976,
as amended, the provisions of which are incorporated herein by reference.
G. Off Street Loading. In this PORI zoning district, off street loading shall be
subject to the provisions of Chapter 19.47, Off Street Loading, of the Elgin
Municipal Code, as may be amended. Notwithstanding the foregoing, temporary
on street off loading of automobile trailers shall be permitted not to exceed two
(2) hours and only on Auto Circle Drive.
H. Signs.
a. In this PORI zoning district, signs shall be subject to the provisions of
Chapter 19.50, Signs, of the Elgin Municipal Code, as may be amended,
and as follows:
b. Notwithstanding the foregoing, if the Subject Property is developed and
used for New Vehicle Sales, then Signage for the New Vehicle Sales auto
mall development of the Subject Property shall be in substantial
conformance to the Randall/90 Auto Mall Signage prepared by Heitman
Architects, last revised on October 16, 2007 (“the Signage Plan”), a copy
of which is attached hereto as Exhibit B, and in conformance with the
provisions of the ordinance designating the Subject Property as an area of
special character pursuant to Chapter 19.50 of the Elgin Municipal Code,
1976, as amended, and the ordinance adopting a program for graphics for
the Subject Property. Additionally, New Vehicle Sales Dealers may
install up to two (2) temporary signs on the Subject Property of a size not
to exceed 80 square feet and a height not to exceed 20 feet announcing the
future opening of a Dealership on the Subject Property at such time as the
Owner may consent to such action and after such Dealership commences
construction of its Dealership on the Subject Property and until the City
issues an occupancy permit for such Dealership.
I. Nonconforming Uses and Structures. In this PORI zoning district,
nonconforming uses and structures shall be subject to the provisions of Chapter
19.52, Nonconforming Uses and Structures, of the Elgin Municipal Code, as may
be amended.
J. Planned Developments. This PORI zoning district shall be subject to the
provisions of Chapter 19.60, Planned Developments, of the Elgin Municipal
Code, as may be amended. A conditional use for a planned development may be

requested by an individual property owner for a zoning lot without requiring an
amendment to this PORI zoning district and without necessitating that all other
property owners authorize such an application.
K. Conditional Uses. In this PORI zoning district, conditional uses shall be subject
to the provisions of Chapter 19.65 Conditional Uses, of the Elgin Municipal
Code, as may be amended. A conditional use may be requested by an individual
property owner for a zoning lot without requiring an amendment to this PORI
zoning district and without necessitating that all other property owners authorize
such an application.
L. Variations. Any of the requirements of this ordinance may be varied, subject to
the provisions of Section 19.70, Variations, of the Elgin Municipal Code, as may
be amended. A variation may be requested by an individual property owner for a
zoning lot without requiring an amendment to this PORI zoning district and
without necessitating that all other property owners authorize such an application.
M. Appeals. Any requirement, determination, or interpretation associated with the
administration and enforcement of the provision of this ordinance may be
appealed subject to the provisions of Chapter 19.75, Appeals, of the Elgin
Municipal Code, as may be amended.
N. Subdivisions - Generally. In this PORI zoning district, subdivisions shall be
subject to the provisions of Title 18, Subdivisions, of the Elgin Municipal Code,
as may be amended, except as may be specifically provided otherwise in this
planned industrial district ordinance or in the preliminary plat approved by the
corporate authorities as part of the annexation of the subject property.
O. Building and Construction - Generally. In this PORI zoning district, building
and construction shall be subject to the provisions of Title 16, Building and
Construction, of the Elgin Municipal Code, as may be amended, except as may be
specifically provided otherwise in this planned industrial district ordinance.
1. Design Guidelines.
a. For any ORI Land Use, the Design Guidelines attached hereto as
Exhibit C shall be applicable to the development of the Subject
Property. No buildings (or structures ancillary thereto) proposed to
be constructed on the Subject Property in substantial conformance
with such Design Guidelines and other applicable requirements of
law (as reasonably determined by the City's Zoning Administrator
or by the corporate authorities) shall require any public hearing,
whether under the City's ARC-Arterial Road Corridor Overlay
provisions (as currently contained in section 19.15.500 of the
City's Municipal Code) or otherwise.

b. Any proposed building or other structure that (i) is intended to be
used in connection with New Vehicle Sales and (ii) is proposed to
be constructed in substantial conformance with the New Vehicle
Sales Facility Design Guidelines set forth on Exhibit D attached
hereto (as reasonably determined by the City's Zoning
Administrator or by the corporate authorities) shall be permitted
and shall not require any public hearing, whether under the City's
ARC-Arterial Road Corridor Overlay provisions (as currently
contained in Section 19.15.500 of the City's Municipal Code) or
otherwise.
2. Overhead Sewers. All sanitary sewers shall be overhead sewers.
3. Sump Lines. All structures containing sump pits and pumps shall have
separate lines connecting the sump pump to the storm sewer as required by the
City Engineer and the Development Administrator.
Section 4. If any express provision of this PORI Ordinance conflicts with any other City
ordinance, the provisions of this PORI Ordinance shall be controlling.
Section 5. That this ordinance shall be in full force and effect from and after its passage
in the manner provided by law.

AN ORDINANCE
AMENDING CHAPTER 19.50 OF THE ELGIN MUNICIPAL CODE, 1976,
AS AMENDED, ENTITLED "STREET GRAPHICS"
WHEREAS, City's comprehensive ordinance regulating street graphics has been
substantially derived from the model street graphics ordinance published in the American
Planning Association’s Street Graphics and the Law, Revised Edition, by Daniel Mandelker with
Andrew Bertucci and William Ewald; and
WHEREAS, written application has been made to amend the City's Street Graphics
Ordinance to create a special sign district known as Areas of Special Character; and
WHEREAS, the Planning and Development Commission held a public hearing
concerning the proposed amendment after due notice in manner provided by law; and
WHEREAS, the Planning and Development Commission has submitted its written
findings and recommendation that the requested amendment be denied; and
WHEREAS, the Community Development Group has submitted its written findings and
recommendation that the requested amendment be granted; and
WHEREAS, the City Council concurs in the findings and recommendation of the
Community Development Group.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF ELGIN, ILLINOIS:
Section 1. That chapter 19.50 of the Elgin Municipal Code, 1976, as amended entitled
"Street Graphics", be and is hereby further amended to add new section 19.50.105 thereto,
entitled “Areas of Special Character,” to read as follows:
“19.50.105: AREAS OF SPECIAL CHARACTER:
This street graphics ordinance cannot adequately regulate all street graphics in an area as
diverse as the City. The unique and particular character of an area and the unique
existing or proposed use thereof may present a circumstance that the street graphics
ordinance cannot adequately regulate all street graphics for such an area. The City
Council, by ordinance, authorized by a vote of two-thirds (2/3) of all members of the City
Council then holding office, and following notice and hearing, may therefore designate
specific locations within the city as Areas of Special Character in order to provide
appropriate flexibility in the regulation of street graphics through the adoption of special
regulations for these areas that can vary from any of the regulations contained within this
street graphics ordinance.

A. The Areas of Special Character within the City shall consist of the following
areas:
1. The Randall/90 Auto Mall. The property commonly known as the
Northwest corner of Randall Road and U.S. Interstate 90, and being legally
described in the Planned Development Ordinance for such property under
Ordinance No. G68-07.
B. Zoning map. The Development Administrator shall maintain and continually
revise the Official Zoning Map to indicate the boundaries of each designated Areas of
Special Character.
C. Special regulations. The City Council shall, by an ordinance authorized by a vote
of two-thirds (2/3) of all members of the City Council then holding office, adopt special
regulations for street graphics in each Area of Special Character, or for a portion of such
an Area of Special Character, that shall be consistent with the character of the Area of
Special Character. The street graphics regulations for each Area of Special Character
shall contain visual representations of the lettering, illumination, color, area and height of
street graphics and may also indicate the areas and buildings where they may be placed
and located. The special regulations may incorporate by reference the visual
representation of street graphics in the street graphics plan. In the event special
regulations have not been adopted for an Area of Special Character, or for a portion of an
Area of Special Character, the regulations for street graphics otherwise contained in this
chapter shall apply and shall control.
D. Standards for Designation of Areas of Special Character and Special Regulations
for Areas of Special Character: An application for the designation of an area as an Area
of Special Character and special regulations for Areas of Special Character shall follow
the procedures for map and text amendments pursuant to the provisions of this section
and chapter 19.55 of this title, as amended. The granting of an application for the
designation of an area as an Area of Special Character and for the approval of Special
Regulations for Street Graphics within an Area of Special Character shall be contingent
upon the extent to which affirmative findings are made with respect to each of the
standards for maps and text amendments set forth in Section 19.55.030 of this title, as
amended, and to which affirmative findings are made with respect to each of the
following additional standards:
1. Area Characteristics: The unique and particular character of the area
proposed to be designated as an Area of Special Character establishes that the
street graphics ordinance cannot adequately regulate street graphics for such area.
Such unique and particular characteristics of the area proposed to be designated as
an Area of Special Character include the area’s location, size, shape, significant
natural features, including topography, water courses and vegetation, the nature of
adjoining public rights of way, and architectural, historic or scenic features.
2. Use Characteristics: The existing or proposed use of the area proposed to

be designated as an Area of Special Character presents specified unique
challenges and demands such that the street graphics ordinance cannot adequately
regulate street graphics for such use in such area.
3. Special Regulations: The proposed special regulations for the proposed
Area of Special Character are consistent with the unique character and unique use
of the Area of Special Character and departures from the street graphics
ordinance, if any, are specifically limited to address the unique and particular area
characteristics and use characteristics of the proposed Area of Special Character.
F. Effect of special regulations. Special regulations for Areas of Special Character
shall supersede and may be either more or less restrictive than the regulations for street
graphics contained in this chapter.”
Section 2. Severability. If any provision, clause, sentence, paragraph, section or part of
this ordinance or application thereof to any person or circumstance, shall for any reason be
adjudged by a court of competent jurisdiction to be unconstitutional or invalid, said judgment
shall not affect, impair or invalidate the remainder of this ordinance and the application of such
provision to other persons or circumstances, but shall be confined in its operation to the
provision, clause, sentence, paragraph, section or part thereof directly involved in the
controversy in which such judgment shall have been rendered and to the person or circumstances
involved. It is hereby declared to be the legislative intent of the City Council that this ordinance
would have been adopted had such unconstitutional or invalid provisions, clause, sentence,
paragraph, section or part thereof not been included.
Section 3. That all ordinances or parts of ordinances in conflict with the provisions of
this ordinance be and are hereby repealed.
Section 4. That this ordinance shall be in full force and effect upon its passage and
publication in the manner provided by law.

WHEREAS, Section 19.50.105 of the Elgin Municipal Code, 1976, as amended, provides
that the City Council may designate specific locations within the City as Areas of Special
Character in order to provide appropriate flexibility in the regulation of street graphics through
the adoption of special regulation for these areas that can vary from the regulations contained
within the City's Street Graphics Ordinance; and
WHEREAS, the City Council has designated the Randall/90 Auto Mall, such property
commonly known as the Northwest corner of Randall Route and U.S. Interstate 90, and being
legally described in the planned development ordinance for such property under Ordinance No.
G68-07, as an Area of Special Character pursuant to Section 19.50.105; and
WHEREAS, written application has been made to adopt special regulations for street
graphics within the Randall/Route 90 Auto Mall Area of Special Character; and
WHEREAS, the Planning and Development Commission held a public hearing
concerning the proposed special regulations; and
WHEREAS, the Planning and Development Commission has submitted its written
findings and recommendation that the requested special regulations for street graphics be denied;
and
WHEREAS, the Community Development Group has submitted its written findings and
recommendation that the requested special regulations for street graphics be granted; and
WHEREAS, the City Council finds that the Randall/90 Auto Mall Area of Special
Character has unique characteristics including the area's location, topography and being adjacent
to both U.S. Interstate 90 and Randall Road; and
WHEREAS, the City Council further finds that the proposed use of the Randall/90 Auto
Mall Area of Special Character as an auto mall presents specified unique challenges and

demands such that the City's street graphic ordinance cannot adequately regulate street graphics
for such use in such area; and
WHEREAS, the proposed special regulations for the Randall/90 Auto Mall Area of

Mall Area of Special Character and departures from the street graphics ordinance as contained
within such proposed special regulations are limited to address the unique and particular area
characteristics and use characteristics of the Randall/90 Auto Mall Area of Special Character.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF ELGIN, ILLINOIS:
Section 1. That the following Special Regulations for Street Graphics for the Randall/90
Auto Mall Area of Special Character, such property commonly known as the Northwest corner
of Randall Road and U.S. Interstate 90, and being legally described in the planned development
ordinance for such property under Ordinance No. G68-07, be and are hereby granted and
approved pursuant and subject to the following terms and conditions:
1. Compliance with the Randall 90 Auto Mall Special Sign District Plans prepared
by Heitman Architects, dated October 16, 2007 (such plans are hereinafter referred to as
the “Subject Special Sign District Plans”).
2. The light emitting diode (LED) message center included as part of the mall
project monument sign A-1 shall comply with the following additional standards:
a. All images, displays or messages of any type or nature (hereinafter
collectively “Image” or “Images”) shall be static without any type of
movement or motion whether the Images are in the form of animation,
video, text or otherwise. No continuous traveling, scrolling, flashing,
spinning, revolving or shaking, or any other type of movement or motion
of an Image shall be allowed.
b. The rate of change for any Image shall be for a minimum period of one (1)
minute, i.e., each Image displayed shall be displayed for a minimum
period of one (1) minute.
c. Any Image or message change sequence shall be accomplished
immediately with no transition by changing from one screen to another or
by means of fade or dissolve mode.
d. The intensity of the light emitting diode (LED) display shall not exceed
the level specified in the chart below:

e. The square footage of the light emitting diode (LED) message center shall
not exceed 200 square feet.
f. The light emitting diode (LED) message center, as well as all other street
graphics within the Randall/Route 90 Area of Special Character, shall not
be operated, in whole or in part, as an Off Premises Street Graphic.
g. In the event of any conflict between the standards for the light emitting
diode (LED) message center as provided in this subsection 2 and the
provisions within the Subject Special Sign District Plans, the provisions of
this subsection 2 shall supersede and control.
3. No additional non-exempt street graphics shall be permitted within the
Randall/Route 90 Area of Special Character.
4. The special regulations for street graphics within the Randall/90 Auto Mall Area
of Special Character as provided for herein shall apply solely and only to the subject Area
of Special Character if the Subject Area of Special Character is developed and utilized for
an Auto Mall for New Vehicle Sales as provided for and defined in the planned
development ordinance for the subject property or under Ordinance No. 68-07. In the
event the Randall/90 Auto Mall Area of Special Character is not hereinafter developed
and used exclusively for such Auto Mall use for New Vehicle Sales no street graphics
shall be permitted or constructed at the subject property pursuant to these special
regulations and any street graphics to be constructed at the subject property shall comply
with all other city ordinances applicable to street graphics. In the event the Randall/90
Auto Mall Area of Special Character is developed and utilized for such an Auto Mall use
and New Vehicle sales but such Auto Mall use for New Vehicle Sales is hereinafter
discontinued on the subject property, the special regulations for the Randall/90 Auto Mall
Area of Special Character shall be deemed automatically terminated and no longer in
effect and within one hundred eighty (180) days of written notice from the City to the
property owners association for the Subject Property (or the owners of the Subject
Property in the absence of a property owners association), the signage constructed
pursuant to these regulations which is not otherwise in conformance with city’s
ordinances applicable to street graphics then in effect shall be removed.
5. Compliance with all other codes and ordinances. In the event of any conflict
between the special regulations for this Area of Special Character and the provisions of
Chapter 19.50 of the Elgin Municipal Code, 1976, as amended, entitled “Street

as contained herein shall supersede and control.

Section 2. That the development of this PSFR2 Planned Single Family Residence
District as described in Section 1 shall be developed subject to the following provisions:
A. Purpose and Intent. The purpose and intent of this PSFR2 zoning district is to
provide a planned urban residential environment of standardized moderate density
for single family detached dwellings, subject to the provisions of Chapter 19.60
Planned Developments of the Elgin Municipal Code, 1976, as amended. The
PSFR2 District is most similar to, but departs from the standard requirements of
the SFR2 Single Family Residential District.
B. Supplementary Regulations. Any word or phrase contained herein, followed by
the symbol “[SR]”, shall be subject to the definitions and the additional
interpretive requirements provided in Chapter 19.90, Supplementary Regulations,
of the Elgin Municipal Code, 1976, as amended. The exclusion of such symbol
shall not exempt such word or phrase from the applicable supplementary
regulation.
C. General Provisions. In this PSFR2 zoning district, the use and development of
land and structures shall be subject to the provisions of Chapter 19.05, General
Provisions, of the Elgin Municipal Code, 1976, as amended.
D. Zoning Districts - Generally. In this PSFR2 zoning district, the use and
development of land and structures shall be subject to the provisions of Chapter
19.07, Zoning Districts, of the Elgin Municipal Code, 1976, as amended.
E. Location and Size of District. This PSFR2 zoning district should be located in
substantial conformance to the official comprehensive plan. The amount of land
necessary to constitute a separate PSFR2 zoning district exclusive of rights-of-
way, but including adjoining land or land directly opposite a right-of-way, shall
not be less than two acres.
F. Land Use. In this PSFR2 zoning district, the use of land and structures shall be
subject to the provisions of Chapter 19.10, Land Use, of the Elgin Municipal
Code, 1976, as amended. The following enumerated “land uses” [SR] shall be the
only land uses allowed as a “permitted use” [SR] in this PSFR2 District:

G. Site Design. In this PSFR2 zoning district, the use and development of land and

shall be as follows:
1. Zoning Lots - Generally. In this PSFR2 zoning district, "zoning lots"

Clarifications and Exceptions, of the Elgin Zoning Ordinance.
2. Lot Area. In this PSFR2 zoning district, the minimum required "zoning
lot area" [SR] shall be 8,320 square for an interior lot and 9,500 feet for a
corner lot.
3. Lot Width. The minimum required "lot width" [SR] shall be sixty-five
(65) linear feet for an interior lot and seventy-five (75) linear feet for a
corner lot.
4. Setbacks - Generally. In this PSFR2 zoning district, "setbacks" [SR]
shall be subject to the provisions of the Elgin Zoning Ordinance, Section
19.12.400, Setbacks - Clarifications and Exceptions.
5. Setbacks by Lot Line. In this PSFR2 zoning district, the minimum
required "building" [SR] "setbacks" [SR] for a zoning lot shall be as
follows:
a. Local Street Setback. Where a zoning lot has frontage on a local
street, the minimum required setback for a building from a “street
lot line” [SR] shall be thirty (30) linear feet. The minimum
required setback from the corner side yard of a house shall be
twenty (20) linear feet.
b. Side Setback. The minimum required building setback from a
“side lot line” [SR] shall be five (5) linear feet, with combined side
yards of ten (10) linear feet.
c. Interior Setback. The minimum required building setback from an
“interior lot line” [SR] shall be ten (10) linear feet.
d. Rear Setback. The minimum required building setback from a
“rear lot line” [SR] shall be thirty-five (35) linear feet.
6. Accessory Structures and Buildings. In this PSFR2 zoning district,
"accessory structures and buildings" [SR] shall be subject to the provisions
of Section 19.12.500, Accessory Structures and Buildings, of the Elgin
Zoning Ordinance.

7. Yards. In this PSFR2 zoning district, a "street yard" [SR], a "side yard"
[SR], or a "rear yard" [SR] established by a required building setback or
by the actual location of a building shall be subject to the provisions of
Section 19.12.600, Obstructions in Yards, of the Elgin Zoning Ordinance.
8. Residential Floor Area. In this PSFR2 zoning district, the maximum
"residential floor area" [SR] for a single family zoning lot shall equal the
“zoning lot area” [SR] times 0.40 (40%).
9. Building Coverage. In this PSFR2 zoning district, the maximum
"building coverage" [SR] for a single family zoning lot shall equal the
“zoning lot area” [SR] times 0.35 (35%).
10. Accessory Building Coverage. In this PSFR2 zoning district, the
maximum "accessory building coverage" [SR] for a single family zoning
lot shall equal the “zoning lot area” [SR] times 0.10 (10%).
11. Vehicle Use Area. In this PSFR2 zoning district, the maximum "vehicle
use area" [SR] for a single family zoning lot shall be one thousand four
hundred (1,400) square feet.
12. Landscaping. In this PSFR2 zoning district, each zoning lot shall be
developed in substantial conformance to the landscape plans prepared by
the Lannert Group, with a final revision date of April 11, 2007.
13. Supplementary Regulations. In this PSFR2 zoning district, the use and
development of land and structures shall also be subject to the following
conditions:
a. Substantial conformance to the Preliminary Plat, prepared by the
Lannert Group, with a final revision date of January 3, 2007.
b. Substantial conformance to the Preliminary Engineering Plan,
prepared by Cowhey Gudmundson Leder, Ltd., with a final
revision date of January 10, 2007.
c. Substantial conformance to the Preliminary Landscape Plan,
prepared by the Lannert Group, with a final revision date of
April 11, 2007.
d. Building elevations, floor plans and building materials for
detached single family dwellings in this PSFR2 zoning district
shall be in substantial conformance with Single Family Options 1
(Sheet A-2), 2 (Sheet A-3), and 3 (Sheet A-4) prepared by Roth
Architects, dated July 14, 2006. Additional building elevations for
detached single family dwellings to be constructed in this PSFR2
zoning district may be authorized and approved by the city’s
Community Development Director so long as any such building
elevations are otherwise in compliance with the terms and
conditions of this ordinance and the annexation agreement.
e. Additions to any detached single family dwellings on the subject
property shall only be permitted to the rear elevations of such
structures.

H. Off-Street Parking. In this PSFR2 zoning district, off street parking shall be
subject to the provisions of Chapter 19.45, Off-Street Parking, of the Elgin
Municipal Code, 1976, as amended.
I. Off-Street Loading. In this PSFR2 zoning district, off street loading shall be
subject to the provisions of Chapter 19.47, Off-Street Loading, of the Elgin
Municipal Code, 1976, as amended.
J. Street Graphics. In this PSFR2 zoning district, signs shall be subject to the
provisions of Chapter 19.50, Street Graphics, of the Elgin Municipal Code, 1976,
as amended. The main entry sign and neighborhood signs shall be developed in
conformance with the Landscape Plans, prepared by the Lannert Group., with a
final revision date of. August 18, 2006
K. Amendments. In this PSFR2 zoning district, application for text and map
amendments shall be subject to the provisions of Chapter 19.55, Amendments. A
text and map amendment may be requested by an individual lot or property owner
for a zoning lot without necessitating that all other property owners in this PSFR2
zoning district authorize such an application.
L. Planned Developments. In this PSFR2 zoning district, application for a planned
development shall be subject to the provisions of Chapter 19.60, Planned
Developments, of the Elgin Municipal Code, 1976, as amended. A conditional
use for a planned development may be requested by an individual lot or property
owner for a zoning lot without requiring an amendment to this PSFR2 zoning
district and without necessitating that all other property owners in this PSFR2
zoning district authorize such an application.
M. Conditional Uses. In this PSFR2 zoning district, application for conditional uses
shall be subject to the provisions of Chapter 19.65 Conditional Uses, of the Elgin
Municipal Code, 1976, as amended. A conditional use may be requested by an
individual lot or property owner for a zoning lot without requiring an amendment
to this PSFR2 zoning district and without necessitating that all other property
owners in this PSFR2 zoning district authorize such an application.
N. Variations. Any of the requirements of this ordinance may be varied by petition
of a lot or property owner subject to this Ordinance, however, such variation is
subject to the provisions of Section 19.70, Variations, of the Elgin Municipal
Code, as may be amended. A variation may be requested by an individual
property owner for a zoning lot without requiring an amendment to this PSFR2
zoning district and without necessitating that all other property owners in this
PSFR2 zoning district authorize such an application.
O. Subdivisions – Generally. The subdivision of the subject property and
development thereof shall comply with the subdivision regulations of the city, as
amended, and the Plat Act of the State of Illinois. Prior to building permit

issuance, for each building or structure proposed to be built within the planned
development, a soils suitability and bearing capacity test shall be performed as
required by the City Engineer and the Development Administrator.
P. Buildings – Required Improvements. In addition to those building

building improvements shall also be required:
1. All sanitary sewers shall be overhead sewers.
2. All structures containing sump pits and pumps shall have separate lines
connecting the sump pump to the storm sewer as required by the City
Engineer and the Development Administrator.
Q. Appeals. Any requirement, determination, or interpretation associated with the
administration and enforcement of the provisions of this ordinance may be
appealed subject to the provisions of Chapter 19.75, Appeals, of the Elgin
Municipal Code, 1976, as amended.
Section 3. That this ordinance shall be full force and effect immediately after its passage
in the manner provided by law.

WHEREAS, the territory herein described has been annexed to the City of Elgin; and
WHEREAS, written application has been made to reclassify said territory from the
PMFR Planned Multiple Family Residence District to the PSFR2 Planned Single Family
Residence District (Age Restricted); and
WHEREAS, after due notice in the manner provided by law the Planning and
Development Commission conducted a public hearing concerning said application and has
submitted its written findings and recommendations; and
WHEREAS, the City Council of the City of Elgin, Illinois, has reviewed the findings and
recommendations of the Planning and Development Commission.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF ELGIN, ILLINOIS:
Section 1. That Chapter 19.07, Section 19.07.600 entitled “Zoning District Map” of the
Elgin Municipal Code, 1976, as amended, be and the same is hereby further amended by adding
thereto the following paragraph:
The boundaries herein before laid out in the ‘Zoning District Map’, as amended,
be and are hereby altered by including in the PSFR2 Planned Single Family
Residence District (Age Restricted), the following described property:
Those areas on the attached zoning plat, prepared by the Lannert Group., dated
January 3, 2007, designated in the PSFR2 Planned Single Family Residence
District.
Section 2. That the development of this PSFR2 Planned Single Family Residence
District as described in Section 1 shall be developed subject to the following provisions:
A. Purpose and Intent. The purpose and intent of this PSFR2 zoning district is to
provide a planned urban residential environment of standardized density for two
family dwellings, subject to the provisions of Chapter 19.60 Planned
Developments of the Elgin Municipal Code, 1976, as amended. The PSFR2
District is most similar to, but departs from the standard requirements of the SFR2
Single Family Residential District.

B. Supplementary Regulations. Any word or phrase contained herein, followed by
the symbol “[SR]”, shall be subject to the definitions and the additional
interpretive requirements provided in Chapter 19.90, Supplementary Regulations,

shall not exempt such word or phrase from the applicable supplementary
regulation.
C. General Provisions. In this PSFR2 zoning district, the use and development of
land and structures shall be subject to the provisions of Chapter 19.05, General
Provisions, of the Elgin Municipal Code, 1976, as amended.
D. Zoning Districts -Generally. In this PSFR2 zoning district, the use and
development of land and structures shall be subject to the provisions of Chapter
19.07, Zoning Districts, of the Elgin Municipal Code, 1976, as amended.
E. Location and Size of District. This PSFR2 zoning district should be located in
substantial conformance to the official comprehensive plan. The amount of land
necessary to constitute a separate PSFR2 zoning district exclusive of rights-of-
way, but including adjoining land or land directly opposite a right-of-way, shall
not be less than two acres.
F. Land Use. In this PSFR2 zoning district, the use of land and structures shall be
subject to the provisions of Chapter 19.10, Land Use, of the Elgin Municipal
Code, 1976, as amended. The following enumerated “and uses” [SR] shall be the
only land uses allowed as a “permitted use” [SR] in this PSFR2 District:

thousand two hundred (1,200) square feet, allocated at a maximum of six
hundred (600) square feet for each detached single family unit.
12. Landscaping. In this PSFR2 zoning district, each zoning lot shall be
developed in substantial conformance to the landscape plans prepared by
the Lannert Group, with a final revision date of April 11, 2007.
13. Supplementary Regulations. In this PSFR2 zoning district, the use and

Development Director so long as any such building elevations are
otherwise in compliance with the terms and conditions of this
ordinance and the annexation agreement.
e. Additions to any attached single family dwellings on the subject
property shall only be permitted to the rear elevations of such
structures.
f. No dwelling unit in this PSFR2 planned single family residence
district shall be occupied by any person contrary to the age
restrictions set forth in the private covenants for the subject

of the Third Amendment to the Annexation Agreement for the
subject property.
H. Off-Street Parking. In this PSFR2 zoning district, off street parking shall be

Municipal Code, 1976, as amended.
I. Off-Street Loading. In this PSFR2 zoning district, off street loading shall be
subject to the provisions of Chapter 19.47, Off-Street Loading, of the Elgin
Municipal Code, 1976, as amended.
J. Signs. In this PSFR2 zoning district, signs shall be subject to the provisions of
Chapter 19.50, Signs, of the Elgin Municipal Code, 1976, as amended, and shall
also be subject to paragraph G., Site Design, of this ordinance.
K. Amendments. In this PSFR2 zoning district, application for text and map
amendments shall be subject to the provisions of Chapter 19.55, Amendments. A
text and map amendment may be requested by an individual lot or property owner
for a zoning lot without necessitating that all other property owners in this PSFR2
zoning district authorize such an application.

AMENDING A
PMFR PLANNED MULTIPLE FAMILY RESIDENCE DISTRICT
(The Glen Subdivision – 1101 Nolan Road)
WHEREAS, the territory herein described has been annexed to the City of Elgin; and
WHEREAS, written application has been made to amend the development plan in the
PMFR Planned Multiple Family Residence District; and
WHEREAS, after due notice in the manner provided by law the Planning and
Development Commission conducted public hearings concerning said applications and has
submitted its written findings and recommendations; and
WHEREAS, the City Council of the City of Elgin, Illinois, has reviewed the findings and
recommendations of the Planning and Development Commission.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF ELGIN, ILLINOIS:
Section 1. That Chapter 19.07, Section 19.07.600 entitled “Zoning District Map” of the
Elgin Municipal Code, 1976, as amended, be and the same is hereby further amended by adding
thereto the following paragraph:

Section 2. That the City Council of the City of Elgin hereby grants the PMFR Planned
Multiple Family Residential District which shall be designed, developed, and operated subject to
the following provisions:
A. Purpose and Intent. The purpose and intent of this PMFR zoning district is to
provide a planned urban residential environment for multiple family detached
dwellings, subject to the provisions of Chapter 19.60 Planned Developments of
the Elgin Municipal Code, 1976, as amended. The PMFR District is most similar
to, but departs from the standard requirements of, the MFR Multiple Family
Residential District.

B. Supplementary Regulations. Any word or phrase contained herein, followed by
the symbol “[SR]”, shall be subject to the definitions and the additional

shall not exempt such word or phrase from the applicable supplementary
regulation.
C. General Provisions. In this PMFR zoning district, the use and development of
land and structures shall be subject to the provisions of Chapter 19.05, General
Provisions, of the Elgin Municipal Code, 1976, as amended.
D. Zoning Districts - Generally. In this PMFR zoning district, the use and
development of land and structures shall be subject to the provisions of Chapter
19.07, Zoning Districts, of the Elgin Municipal Code, 1976, as amended, and the
provisions of the Annexation Agreement.
E. Location and Size of District. This PMFR zoning district should be located in
substantial conformance to the official comprehensive plan. The amount of land
necessary to constitute a separate PMFR zoning district exclusive of rights-of-
way, but including adjoining land or land directly opposite a right-of-way shall
not be less than two acres.
F. Land Use. In this PMFR zoning district, the use of land and structures shall be
subject to the provisions of Chapter 19.10, Land Use, of the Elgin Municipal
Code, 1976, as amended. The following enumerated “land uses” [SR] shall be the

in substantial conformance to the Preliminary Plat, prepared by the
Lannert Group, with a final revision date of January 3, 2007.
4. Setbacks - Generally. In this PMFR zoning district, the minimum required
“setbacks” [SR] shall be in substantial conformance to the Preliminary
Plat, prepared by the Lannert Group, with a final revision date of January
3, 2007.
5. Setbacks by Lot Line. In this PMFR zoning district, the minimum required
“building” [SR] “setbacks” [SR] for a zoning lot shall be in substantial
conformance to the Preliminary Plat, prepared by the Lannert Group, with
a final revision date of January 3, 2007.
6. Accessory Structures and Buildings. In this PMFR zoning district,
“accessory structures and buildings” [SR] shall be subject to the
provisions of Section 19.12.500, Accessory Structures and Buildings, of
the Elgin Zoning Ordinance.
7. Yards. In this PMFR zoning district, a “street yard” [SR] a “side yard”
[SR] or a “rear yard” [SR] established by a required building setback or by
the actual location of a building shall be subject to the provisions of
Section 19.12.600, Obstructions in Yards, of the Elgin Zoning Ordinance.

8. Supplementary Conditions. In this PMFR zoning district, the use and
development of land and structures shall also be subject to the following
conditions:
a. Substantial conformance to the Preliminary Plat, prepared by the
Lannert Group, with a final revision date of January 3, 2007.
b. Substantial conformance to the Preliminary Engineering Plan,
prepared by Cowhey Gudmundson Leder, Ltd.., with a final
revision date of January 10, 2007.
c. Substantial conformance to the Preliminary Landscape Plan,
prepared by the Lannert Group, with a final revision date of April
11, 2007.
e. The number of dwelling units, and the site and architectural design
review of the “senior assisted living facility” in this PMFR District
shall be subject to review and approval pursuant to the provisions
of Chapter 19.60, Planned Developments, of the Elgin Municipal
Code, 1976, as amended. Notwithstanding anything to the
contrary in this ordinance, prior to the development of the subject
property in this PMFR planned multiple family residence district
the owner and/or developer of the subject property shall be
required to submit a development plan to the city for a public
hearing and city council approval pursuant to provisions of
Chapter 19.60, Planned Developments, of the Elgin Municipal
Code, as amended, to include the items required by Chapter 19.60
and architectural elevations, building plans and proposed building
materials.
f. No dwelling unit in this PMFR planned multiple family zoning
district shall be occupied by any persons contrary to the age
restrictions and/or the other occupancy restrictions set forth in the
private covenants for the subject property and as further referenced
and provided for in Section 49 of the Third Amendment to the
Annexation Agreement for the subject property.
H. Off-street Parking. In this PMFR zoning district, off street parking shall be
subject to the provisions of Chapter 19.45, Off-street Parking, of the Elgin
Municipal Code, 1976, as amended.
I. Off-street Loading. In this PMFR zoning district, off street loading shall be
subject to the provisions of Chapter 19.47, Off-street Loading, of the Elgin
Municipal Code, 1976, as amended.
J. Signs. In this PMFR zoning district, signs shall be subject to the provisions of
Chapter 19.50, Street Graphics, of the Elgin Municipal Code, 1976, as amended.

L. Planned Developments. In this PMFR zoning district, application for a planned
development shall be subject to the provisions of Chapter 19.60, Planned
Developments, of the Elgin Municipal Code, 1976, as amended. A conditional
use for a planned development may be requested by an individual lot or property
owner for a zoning lot without requiring an amendment to this PMFR zoning
district and without necessitating that all other property owners in this PMFR
zoning district authorize such an application.
M. Conditional Uses. In this PMFR zoning district, application for conditional uses
shall be subject to the provisions of Chapter 19.65 Conditional Uses, of the Elgin
Municipal Code, 1976, as amended. A conditional use may be requested by an
individual lot or property owner for a zoning lot without requiring an amendment
to this PMFR zoning district and without necessitating that all other property
owners in this PMFR zoning district authorize such an application.
N. Variations. Any of the requirements of this ordinance may be varied by petition
of a lot or property owner subject to this Ordinance, however, such variation is
subject to the provisions of Section 19.70, Variations, of the Elgin Municipal

M. Conditional Uses. In this PCF zoning district, application for conditional uses
shall be subject to the provisions of Chapter 19.65 Conditional Uses, of the Elgin
Municipal Code, 1976, as amended. A conditional use may be requested by an
individual lot or property owner for a zoning lot without requiring an amendment
to this PCF zoning district and without necessitating that all other property owners
in this PCF zoning district authorize such an application.
N. Variations. In this PCF zoning district, application for variation shall be subject
to the provisions of Chapter 19.70, Variations, of the Elgin Municipal Code,
1976, as amended. Any of the requirements of this ordinance may be varied by
petition of a lot or property owner for a zoning lot without requiring an
amendment to this PCF zoning district and without necessitating that all other
property owners in this PCF zoning district authorize such an application.
O. Subdivisions – Generally. The subdivision of the subject property and
development thereof shall comply with the subdivision regulations of the city, as
amended, and the Plat Act of the State of Illinois. Prior to building permit
issuance, for each building or structure proposed to be built within the planned
development, a soils suitability and bearing capacity test shall be performed as
required by the City Engineer and the Development Administrator.
P. Buildings – Required Improvements. In addition to those building
improvements required by Title 16 of the Elgin Municipal Code, the following
building improvements shall also be required:

1. All sanitary sewers shall be overhead sewers.
2. All structures containing sump pits and pumps shall have separate lines
connecting the sump pump to the storm sewer as required by the City
Engineer and the Development Administrator.
Q. Appeals. Any requirement, determination, or interpretation associated with the
administration and enforcement of the provisions of this ordinance may be
appealed subject to the provisions of Chapter 19.75, Appeals, of the Elgin
Municipal Code, 1976, as amended.
Section 3. That this ordinance shall be full force and effect immediately after its passage
in the manner provided by law.

RESOLUTION
APPROVING A PRELIMINARY SITE PLAN AND PRELIMINARY PLAT
FOR THE GLEN SUBDIVISION
(1100 Nolan Road)
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS,
that it hereby approves the preliminary site plan and preliminary plat prepared by The Lannert
Group dated last revised January 3, 2007 for The Glen Subdivision. The approval granted by
this resolution is tentative in nature, involving the general acceptability of the layout as
submitted, and shall not qualify the plat for recording. Application for final approval shall be
made not later than one year after the date of this resolution and must be supported by such
drawings, specifications and monetary assurance as may be necessary to demonstrate compliance
with applicable statutes and ordinances.
