HomeMy WebLinkAboutt - October 24, 2007 CC729 OCTOBER 24, 2007 VOLUME LXXII COUNCIL OF THE CITY OF ELGIN, ILLINOIS COUNCIL-MANAGER FORM OF GOVERNMENT REGULAR MEETING The regular meeting of the Council of the City of Elgin, Illinois, was held on October 24, 2007, in the Council Chambers. The meeting was called to order by Mayor Schock at 7:03 p.m. The Invocation was given by Pastor Freddy Rodgers and the Pledge of Allegiance was led by Deborah Allan. ROLL CALL Roll call was answered by Councilmembers Figueroa, Gilliam, Kaptain, Powers, Steffen, Walters and Mayor Schock. Absent: None. MINUTES OF THE OCTOBER 10, 2007, COUNCIL MEETING APPROVED AS DISTRIBUTED Councilmember Walters made a motion, seconded by Councilmember Figueroa, to approve the October 10, 2007, Council Meeting Minutes as distributed. Upon a roll call vote: Yeas: Councilmembers Figueroa, Gilliam, Kaptain, Powers, Steffen, Walters, and Mayor Schock. Nays: None. COMMUNICATIONS Recognition of National Hospice/Palliative Care Month Mayor Schock read a proclamation recognizing National Hospice/Palliative Care Month. Mary Jo Sheehe of Fox Valley Volunteer Hospice thanked the Council for their past support. Recognition of the Elgin Continental Little League Mayor Schock read a proclamation recognizing the 2007 Senior League Illinois Champions and winners of third place at the Central League Tournament. Team members were introduced by Coach Hartwell. The team presented the Mayor with a team baseball hat. RECOGNIZE PERSONS PRESENT Mary Shesgreen of Fox Valley Citizens for Peace and Justice expressed her concerns regarding the Iraq war and her hope that the Council would pass a resolution urging the cessation of U.S. combat operations in Iraq. VOLUME LXXII OCTOBER 24, 2007 730 Edward Herdrich of Fox Valley Citizens for Peace and Justice expressed his concerns about the Iraq war and the amount of money being spent on it. Dan Miller, President of the Gifford Park Association, thanked the Council for allowing their group to participate in an architectural salvage of properties on North Grove Street that are about to be demolished. He also announced that the GPA would be receiving the Preservation Leadership Award from Preservation Illinois. John Collins spoke about 1000 Preston Avenue, past street flooding, and his search for information. City Manager Folarin directed Mr. Collins to speak with the staff member who had replied to his most recent Freedom of Information request. Julie Schmitt, a member of the Gifford Park Association, expressed her concerns about a threat to the Historic District because of erosion to the authority of the Heritage Commission pursuant to dictates from City staff. Deborah Allan expressed her concerns about parking issues in the former Channing Y area. Mayor Schock reminded Ms. Allen that she would not be able to continue as the subject property was on tonight’s agenda. BID 07-103 AWARDED TO RIEKE OFFICE INTERIORS FOR THE PURCHASE OF OFFICE FURNITURE FOR THE CITY CLERK’S OFFICE Councilmember Walters made a motion, seconded by Councilmember Figueroa, to approve the agreement with Rieke Office Interiors in the amount of $28,606 for the purchase of office furniture for the City Clerk’s Department. Upon a roll call vote: Yeas: Councilmembers Figueroa, Gilliam, Kaptain, Powers, Steffen, Walters, and Mayor Schock. Nays: None. BID 07-109 AWARDED TO FREEWAY FORD FOR THE PURCHASE OF AN AERIAL BUCKET TRUCK FOR THE TRAFFIC DIVISION OF THE PUBLIC WORKS DEPARTMENT Councilmember Kaptain made a motion, seconded by Councilmember Figueroa, to award a contract to Freeway Ford in the amount of $81,042 after trade in for the purchase of one aerial bucket truck for the Traffic Division of the Public Works Department. PUBLIC HEARING DATE SET FOR NOVEMBER 28, 2007 TO CONSIDER A SECOND AMENDMENT TO AN ANNEXATION AGREEMENT; PROPERTY LOCATED AT 1300 AND 1301 US ROUTE 20; BY PINGREE CREEK, LLC, AS APPLICANT AND OWNER (PETITION 28-07) OCTOBER 24, 2007 VOLUME LXXII 731 Councilmember Figueroa made a motion, seconded by Councilmember Gilliam, to set the public hearing date for Petition 28-07 for November 28, 2007. PUBLIC HEARING DATE SET FOR NOVEMBER 28, 2007 TO CONSIDER A FIRST AMENDMENT TO AN ANNEXATION AGREEMENT; PROPERTY LOCATED AT 100 NESLER ROAD; BY WEST POINT BUILDERS & DEVELOPERS, INC., AS APPLICANT, AND NESLER ROAD LIMITED PARTNERSHIP, AS OWNER (PETITION 61-07) Councilmember Walters made a motion, seconded by Councilmember Figueroa, to set the public hearing date for Petition 61-07 for November 28, 2007. Upon a roll call vote: Yeas: Councilmembers Figueroa, Gilliam, Kaptain, Powers, Steffen, Walters, and Mayor Schock. Nays: None. PETITION 59-07 APPROVED REQUESTING APPROVAL OF A MAP AMENDMENT FROM CF COMMUNITY FACILITY DISTRICT AND RC3 RESIDENCE CONSERVATION DISTRICT TO PRC PLANNED RESIDENCE CONSERVATION DISTRICT, AND FINAL PLAT APPROVAL, FOR A RESIDENTIAL SUBDIVISION TO BE KNOWN AS CHANNING SQUARE; PROPERTY LOCATED AT 111 NORTH CHANNING STREET, 468 DIVISION STREET AND A PORTION OF 472 DIVISION STREET, BY CHANNING SQUARE, L.L.C., AS APPLICANT AND CITY OF ELGIN, AS OWNER Community Development Director Deering stated this project has had three changes since the public hearing: one single family home has been removed bringing the total dwellings to thirteen; the Channing Street set backs have been increased from 15’ to 20’; and additional off street parking has been provided. The Community Development group has recommended approval of the project subject to conditions. Councilmember Gilliam made a motion, seconded by Councilmember Figueroa, to approve Petition 59-07 subject to conditions. Councilmember Figueroa stated that he would be voting against the project due to the density of the project. Councilmember Powers indicated that he felt it was an outstanding project and he would support it. Councilmember Kaptain indicated that he would not support the project due to the falling real estate market. He also felt it had some shortcomings that could possibly be addressed if there was a delay in the project. Mayor Schock stated that he wants to keep the historical character of the neighborhood and felt that this project was as good as any, and would be the largest single investment to the neighborhood since it had been designated an historic district. He stated that he would be supporting the project. Councilmember Steffen indicated that he had some initial concerns, but that he would reluctantly support the project. He felt the major issues had been addressed as much as possible, but hoped VOLUME LXXII OCTOBER 24, 2007 732 that more consideration be given to the younger kids when considering the proposed park. Councilmember Walters thanked those who testified at the earlier hearings and agreed with Councilmember Steffen’s remarks about the park. ORDINANCE G61-07 PASSED RECLASSIFYING PROPERTY FROM CF COMMUNITY FACILITY DISTRICT AND RC3 RESIDENCE CONSERVATION DISTRICT TO PRC PLANNED RESIDENCE CONSERVATION DISTRICT (111 N. CHANNING STREET, 468 DIVISION STREET AND A PORTION OF 472 DIVISION STREET) Councilmember Gilliam made a motion, seconded by Councilmember Kaptain, to pass the following ordinance. Upon a roll call vote: Yeas: Councilmembers Gilliam, Powers, Steffen, Walters, and Mayor Schock. Nays: Councilmembers Figueroa and Kaptain. Ordinance No. G61-07 AN ORDINANCE RECLASSIFYING PROPERTY FROM CF COMMUNITY FACILITY DISTRICT AND RC3 RESIDENCE CONSERVATION DISTRICT TO PRC PLANNED RESIDENCE CONSERVATION DISTRICT (111 North Channing Street, 468 Division Street and a Portion of 472 Division Street) WHEREAS, written application has been made to reclassify certain property located at 111 North Channing Street, 468 Division Street and a portion of 472 Division Street from CF Community Facility District and RC3 Residence Conservation District to PRC Planned Residence Conservation District; and WHEREAS, the Planning and Development Commission has conducted a public hearing concerning said application; and WHEREAS, the Planning and Development Commission on a motion to recommend approval on said application voted 2-2 thereby resulting in a recommendation of denial of said application; and WHEREAS, the Community Development Group has submitted written findings on said application and a recommendation that the application be granted and the subject property be reclassified; and WHEREAS, the City Council has reviewed the findings and recommendation of the Community Development Group and concurs in such recommendations. OCTOBER 24, 2007 VOLUME LXXII 733 NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS: Section 1. That the City Council of the City of Elgin hereby adopts the findings made by the Community Development Group in the Map Amendment Review, dated October 18, 2007, a copy of which is attached hereto and made a part hereof by reference as Exhibit A. Section 2. That Chapter 19.08, Section 19.08.020 entitled Zoning District Map of the Elgin Municipal Code, as amended, be and the same is hereby further amended by adding thereto the following paragraph: The boundaries hereinafter laid out in the Zoning District Map, as amended, be and are hereby altered by including in the PRC Planned Residence Conservation District the following described property: Lots 1-11 and Lot 12 (except the east 10 feet) and the vacated Wauchope Court of Roy C. Wauchope’s Subdivision, being a subdivision of part of the County Clerk’s Subdivision of E. H. Hotchkiss Addition to the City of Elgin, in the City of Elgin, Kane County, Illinois (Property commonly known as 111 North Channing Street). The east 10 feet of lot 12 and all of lot 13 in Roy C. Wauchope’s Subdivision, being a subdivision of part of Lot “A” of the County Clerk’s Subdivision of E. H. Hotchkiss Addition, in Elgin Township, Kane County, Illinois (Property commonly known as 468 Division Street). The north 40 feet of that part of E. H. Hotchkiss Addition to Elgin, described as follows: beginning at the point of intersection of the North Line of Division Street with the west line of Hilton Place Addition to Elgin; thence north along the west line of said Hilton Place Addition 165 feet; thence west parallel with the north line of said Division Street 66 feet; thence south parallel with the west line of said Hilton Place Addition 165 feet to the north line of Division Street; thence east along said north line 66 feet to the point of beginning, in the City of Elgin, Kane County, Illinois (Property commonly known as a portion of 472 Division Street). Section 3. That the City Council of the City of Elgin hereby grants the rezoning from CF Community Facility District and RC3 residence Conservation District to PRC Planned Residence Conservation District for the property commonly known as 111 North Channing Street, 468 Division Street and a portion of 472 Division Street, and legally described above, which shall be designed, developed, and operated subject to the following provisions: A. Purpose and Intent. The purpose of the residence conservation districts is to provide for the conservation of the urban residential environment of the mature residential neighborhoods of the city, which developed under significantly different regulations than the current regulations for new residential development. VOLUME LXXII OCTOBER 24, 2007 734 In general, the purpose and intent of the provision for planned developments is to accommodate unique development situations. B. Supplementary Regulations. Any word or phrase contained herein, followed by the symbol “SR”, shall be subject to the definitions and the additional interpretive requirements provided in Chapter 19.90, Supplementary Regulations, of the Elgin Municipal Code, as amended. The exclusion of such symbol shall not exempt such word or phrase from the applicable supplementary regulation. C. General Provisions. In this PRC District, the use and development of land and structures shall be subject to the provisions of Chapter 19.05, General Provisions, of the Elgin Municipal Code, as may be amended. D. Zoning Districts - Generally. In this PRC Planned Residence Conservation District, the use and development of land and structures shall be subject to the provisions of Chapter 19.07, Zoning Districts, as may be amended. E. Land Use. In this PRC Planned Residence Conservation District, the use and development of land and structures shall be subject to the provisions of Chapter 19.10, Land Use, of the Elgin Municipal Code, as amended. The following enumerated “land uses” [SR] shall be the only land uses allowed as a “permitted use” [SR], in this PRC Planned Residence Conservation District: 1. Residences Division: “Residential garage sales” [SR] (UNCL). “Residential occupations” [SR] (UNCL). “Residential parking areas” [SR] (UNCL). “Residential storage” [SR] (UNCL). “Singe-Family detached dwellings” [SR] (UNCL). 2. Municipal Services Division: Public parks, recreation, open space (UNCL) on a “zoning lot” [SR] containing less than two (2) acres of land. 3. Finance, Insurance, and Real Estate Division: “Development sales office” [SR] (UNCL). 4. Intentionally Omitted. 5. Construction Division: OCTOBER 24, 2007 VOLUME LXXII 735 “Contractor's office and equipment areas” [SR] (UNCL). 6. Transportation, Communication and Utilities Division: “Radio and television antennas” [SR] (UNCL). “Satellite dish antennas” [SR] (UNCL). “Treatment, transmission, and distribution facilities: poles, wires, cables, conduits, laterals, vaults, pipes, mains, and valves” [SR] (UNCL). 7. Miscellaneous Uses Division: “Accessory uses” [SR] (UNCL) to the permitted uses allowed in this PRC Planned Residence Conservation District, subject to the provisions of Section 19.10.400 of the Elgin Municipal Code, as amended. “Fences and walls” [SR] (UNCL). “Refuse collection area” [SR]. “Signs” [SR] (UNCL), subject to the provisions of Chapter 19.50 of the Elgin Municipal Code, as amended. “Temporary uses” [SR] (UNCL). In this PRC Planned Residence Conservation District, the use and development of land and structures shall be subject to the provisions of Chapter 19.10, Land Use, of the Elgin Municipal Code, 1976, as amended. The following enumerated “land uses” [SR] shall be the only land uses allowed as a “conditional use” [SR] in this PRC Planned Residence Conservation District: 1. Residences Division: “Conditional residential occupations” [SR] (UNCL). 2. Municipal Services Division: “Municipal facilities” [SR] (UNCL) on a zoning lot containing less than two (2) acres of land. 3. Intentionally Omitted. 4. Miscellaneous Uses Division: “Accessory uses” [SR] (UNCL) to the conditional uses allowed in this PRC Planned Residence Conservation District, subject to the provisions of Section 19.10.400 of the Elgin Municipal Code, as amended. F. Site Design. In this PRC Planned Residence Conservation District, the use and development of land and structures shall be subject to the provisions of Section 19.12, Site VOLUME LXXII OCTOBER 24, 2007 736 Design, of the Elgin Municipal Code, as amended. The development of land and structures shall be in substantial conformance with the following: 1. Substantial conformance to the Statement of Purpose and Conformance, submitted by the applicant, represented by Jerome W. Pinderski, Jr., of Pinderski & Pinderski, Ltd., undated. 2. Substantial Conformance to the Plat of Subdivision prepared by Land Surveying Services, Inc, dated October 15, 2007. 3. Substantial conformance to the Dimensioned Site Plan prepared by BSB Design, dated August 8, 2007 and last revised on October 11, 2007. 4. Substantial conformance to the Site landscape Plans, Sheets L1.1 and L1.2, prepared by BSB Design, dated August 8, 2007 and last revised on October 11, 2007. 5. Substantial conformance to the preliminary engineering drawings prepared by Seton Engineering titled "Proposed Improvements for Channing Square, Elgin Illinois," Sheets C.1-C.12, dated June 10, 2007, and last revised on October 10, 2007. 6. Substantial conformance to the building plans and elevations, sections, and details for Concepts 1-3, and garage plans, elevations and sections, prepared by BSB Design, dated May 29, 2007, and last revised on August 17, 2007. 7. Compliance with all other applicable codes and ordinances. G. Off Street Parking. In this PRC Planned Residence Conservation District, off street parking shall be subject to the provisions of Chapter 19.45, Off Street Parking, of the Elgin Municipal Code, as may be amended. H. Off Street Loading. In this PRC Planned Residence Conservation District, off street loading shall be subject to the provisions of Chapter 19.47, Off Street Loading, as may be amended from time to time. I. Signs. In this PRC Planned Residence Conservation District, signs shall be subject to the provisions of Chapter 19.50, Signs, as may be amended from time to time. J. Planned Developments. In this PRC Planned Residence Conservation District, the use and development of the land and structures shall be subject to the provisions of Chapter 19.60, Planned Developments, as may be amended. A conditional use for a planned development may be requested by an individual lot or property owner for a zoning lot without requiring an amendment to this PRC zoning district and without necessitating that all other property owners authorize such an application. In this PRC Planned Residence Conservation District, application for conditional uses shall be subject to the provisions of Chapter 19.65, Conditional Uses, as may be amended. A conditional use may be requested by an individual property owner for a zoning lot without requiring an amendment to this PRC zoning district and without necessitating that all other property owners authorize such an application. L. Variations. In this PRC Planned Residence Conservation District, application for variation shall be subject to the provisions of Chapter 19.70, Variations, as may be amended. A variation may be requested by an individual property owner for a zoning lot without requiring an amendment to this PRC zoning district and without necessitating that all other property owners authorize such an application. M. Appeals. Any requirement, determination, or interpretation associated with the administration and enforcement of the provisions of this ordinance may be appealed subject to the provisions of Chapter 19.75, Appeals, as may be amended from time to time. Section 4. Resolution No. 07-260 RESOLUTION AUTHORIZING EXECUTION OF A DEVELOPMENT AGREEMENT WITH CHANNING SQUARE, L.L.C. FOR REDEVELOPMENT OF 111 N. CHANNING STREET, 468 DIVISION STREET, A PORTION OF 472 DIVISION STREET, 272 N. SPRING STREET AND 279 N. SPRING STREET BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS, that Ed Schock, Mayor, and Diane Robertson, City Clerk, be and are hereby authorized and directed to execute a development agreement on behalf of the City of Elgin with Channing Square, L.L.C., for redevelopment of 111 N. Channing Street, 468 Division Street, a portion of 472 Division Street, 272 N. Spring Street and 279 N. Councilmember Walters asked if the church had indicated to the City whether they would agree to put something over the stone. Resolution No. 07-258 OCTOBER 24, 2007 VOLUME LXXII 739 RESOLUTION OVERTURNING THE DECISION OF THE ELGIN HERITAGE COMMISSION AND THE DESIGN REVIEW SUBCOMMITTEE TO DENY A CERTIFICATE OF APPROPRIATENESS FOR THE REMOVAL OF FEATURES AT 310 EAST CHICAGO STREET, ELGIN, ILLINOIS WHEREAS, Family Life Church has applied for a Certificate of Appropriateness to remove certain features at the property commonly known as 310 East Chicago Street, Elgin, Illinois; and WHEREAS, the features requested to be removed consist of the Masonic Temple symbol and the cornerstone inscription (“Subject Features”) located on the front facade of the building located on the property; and WHEREAS, the Design Review Subcommittee of the Elgin Heritage Commission denied the subject application for a Certificate of Appropriateness; and WHEREAS, the applicant appealed such denial to the Elgin Heritage Commission; and WHEREAS, the Elgin Heritage Commission also denied the subject application for a Certificate of Appropriateness; and WHEREAS, the applicant has appealed the denial of the subject application for a Certificate of Appropriateness to the City Council of the City of Elgin. NOW, THEREOFRE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS, that the City Council hereby overturns the decisions of the Elgin Heritage Commission and the Design Review Subcommittee to deny a Certificate of Appropriateness for the removal of the Subject Features at 310 East Chicago Street, Elgin, Illinois, and the City Council hereby issues the Certificate of Appropriateness for the removal of the Subject Features at such property with the condition that the applicant is encouraged to carefully remove the features at issue from the facade of the building under the supervision of the VOLUME LXXII OCTOBER 24, 2007 740 City of Elgin so as not to damage them, and store them at a location that would make them available to be reinstalled on the building in the future. s/ Ed Schock Ed Schock, Mayor Presented: October 24, 2007 Adopted: October 24, 2007 Omnibus Vote: Yeas: 4 Nays: 3 Attest: s/ Diane Robertson Diane Robertson, City Clerk RESOLUTION 07-259 ADOPTED AUTHORIZING EXECUTION OF AN AGREEMENT WITH LOCAL #439 INTERNATIONAL ASSOCIATION OF FIREFIGHTERS Councilmember Figueroa made a motion, seconded by Councilmember Gilliam, to adopt the following resolution. That Chapter 6.06 of the Elgin Municipal Code, 1976, as amended, entitled “Alcoholic Liquor Dealers,” be and is hereby amended by amending Section 6.06.040, entitled, “License Classes; Fees,” to create the following new subsection to read as follows: Class B-2: Package stores for the retail sale of alcoholic liquor limited to beer and wine plus one additional alcoholic liquor only, on the premises specified, solely in the original package not for consumption on the premises. The local liquor control commission shall have the sole discretion for determining the one additional alcoholic liquor in addition to beer and wine being sold, all of which being in the original package not for consumption on the premises. There shall be no exterior signage on any premises issued a class B-2 liquor license indicating or advertising the sale of alcoholic liquor. The per year license fee is one thousand seven hundred fifty dollars ($1,750.00). Section 2. That all ordinances or parts of ordinances in conflict with the provisions of this ordinance be and are hereby repealed. Section 3.
