The meeting was called to order by Mayor Schock at 7:00 p.m. The Invocation was given by Pastor Jack Thompson, from the Immanuel Baptist Church and the Pledge of Allegiance was led by Retiring City Clerk Dolonna Mecum. ROLL CALL Roll call was answered by Councilmembers Figueroa, Gilliam, Kaptain, Rodgers, Sandor, Walters and Mayor Schock. Absent: None. PROCLAMATION OF THE RESULTS OF THE CONSOLIDATED ELECTION FOR THE OFFICE OF MAYOR AND COUNCILMEMBERS FOR THE CITY OF ELGIN, KANE AND COOK COUNTIES, ILLINOIS City Clerk Mecum read the following proclamation: PROCLAMATION OF THE RESULTS OF THE CONSOLIDATED ELECTION FOR THE OFFICES OF MAYOR AND COUNCILMAN FOR THE CITY OF ELGIN, KANE AND COOK COUNTIES, ILLINOIS WHEREAS, a Consolidated Election for the offices of Mayor and Councilman to be elected at large, of and for the City of Elgin, Kane and Cook Counties, Illinois, was held on April 17, 2007; and WHEREAS, the election authority of Cook County transmitted the results for those precincts located in Hanover Township, Cook County, City of Elgin to the Kane County election authority; and WHEREAS, the election authority of Kane County compiled the results for those precincts located Campton, Dundee, Elgin, Plato, and Rutland Townships, Kane County, and Hanover Township, Cook County, Elgin, Illinois; and WHEREAS, on May 8, 2007, the County Canvassing Board of Kane County met at the County Clerk’s office in Geneva, Illinois, canvassed the returns of the Consolidated Election, and issued an Abstract of Votes which was furnished to the Local Election Official of the City of Elgin. VOLUME LXXII MAY 9, 2007 312 NOW, THEREFORE, pursuant to the Abstract of Votes prepared by the Kane County Canvassing Board, it is hereby proclaimed that of the 47,745 registered voters, a total of 5,665 ballots were cast at the Consolidated Election on April 17, 2007. PROCLAMATION WHEREAS, Brenda Rodgers has dutifully served the citizens of Elgin for four years on the Elgin City Council; and WHEREAS, Councilwoman Rodgers has been an advocate for improving and expanding communications with residents and has been active in responding to issues raised by individual members of the community; and WHEREAS, Councilwoman Rodgers has been an advocate in promoting issues and programs benefiting the downtown and local businesses; and WHEREAS, Brenda Rodgers provides a commitment to church and community that has served and will continue to serve Elgin far into the future. NOW, THEREFORE, the City of Elgin, sincerely and warmly expresses its thanks to retiring Councilwoman Brenda Rodgers for all that she has done and will continue to do for Elgin. PROCLAMATION OF APPRECIATION TO THOMAS SANDOR Mayor Schock read and presented Thomas Sandor with a proclamation of appreciation for his service as a Councilmember for the past four years. PROCLAMATION WHEREAS, Tom Sandor has dutifully served the citizens of the City of Elgin for four years on the Elgin City Council; and WHEREAS, Councilman Sandor has been an advocate of providing residents city services at the highest standards; and VOLUME LXXII MAY 9, 2007 314 WHEREAS, Councilman Sandor has been an advocate of orderly growth of the city and for new development providing for diversification and expansion of the city's tax base; and WHEREAS, Councilman Sandor has been committed to veterans within the community including having spearheaded the Veterans Memorial Committee and Veterans Memorial Project. NOW, THEREFORE, the City of Elgin, sincerely and warmly expresses its thanks to retiring Councilman Tom Sandor for all he has done and will continue to do for Elgin. INAUGURATION OF ELECTED MAYOR AND COUNCILMEMBERS The Honorable F. Keith Brown administered the oath of office to Councilmembers David J. Kaptain and F. John Steffen. The Honorable James Hallock administered the oath of office to Councilmember Michael Powers and Mayor Edward Schock. ROLL CALL Roll call was answered by Councilmembers Figueroa, Gilliam, Kaptain, Powers, Steffen, Walters and Mayor Schock. Absent: None. NEWLY-INAUGURATED MAYOR AND COUNCILMEMBER COMMENTS Councilmember Kaptain thanked the many people who helped with his campaign since last October of 2006, and gave special thanks to Carl and Chris Missele who managed his campaign. He also thanked his family for their support in the election, stating that he couldn’t have done it without their encouragement. Councilmember Kaptain thanked the various focus groups, and the citizens who supported his campaign by posting signs in their yards, writing letters, and disseminating information for him. He lastly thanked the 3,643 people who voted for him during the election, and also addressed the 100,000 people who didn’t vote for him, stating that he had sworn an allegiance to the City of Elgin to do the best job he can do as a Councilmember. He believes that this means that he represents everyone in the City, not just a neighborhood or a particular group, and stated that he looked forward to the challenge of the next four years. MAY 9, 2007 VOLUME LXXII 315 Councilmember Steffen thanked his family, friends, and neighbors for all of their support and help during his campaign. He gave credit to his parents for his current community involvement, stating that he learned to become involved at an early age from them. He thanked his committee for the interesting discussions they provided, his brother for serving as his campaign treasurer, and Eric Engleby for his graphics expertise for his campaign signs. He thanked all of the other candidates who ran for Council, stating that it was a very exciting, positive experience, focusing on the important issues that are important to the City. He encouraged all of the other candidates to stay involved within the community by applying for positions on the various boards and commissions within the City. He echoed Councilmember Kaptain stating that he intends to represent the whole City and thanked the Elgin citizens who afforded him the opportunity to serve the City in the capacity of Councilmember. Councilmember Powers stated that this campaign allowed him to meet new people and get their perspective on the City of Elgin. He stated that walking through the various neighborhoods of Elgin was like taking a journey through his lifetime. He stated that he was thrilled to become reacquainted with many people from his past and meeting the many citizens of Elgin. He informed everyone that he loves the City of Elgin and will do his best to serve its citizens. He also looks forward to working with the rest of the Council and City Staff to help make this Elgin a better place to live. Mayor Schock thanked the voters of Elgin for allowing him to serve another four years as their Mayor. He believes it has been an honor and a privilege to serve on the Elgin City Council for the past fourteen years, eight of which he has served as Mayor. He thanked his wife Karen, for all of her support through his campaign and during the years that he has served on the City Council. He stated that the Councilmembers’ families pay the biggest price for their service to the City because of late meetings, phone calls, and time away from home addressing City issues. Mayor Schock is very proud of the progress that the City of Elgin has made in the last several years. He believes it has been the hard work of all of his colleagues on the Council that have made the progress possible. He looks forward to working with Councilmember Powers and Councilmember Steffen, and stated that he firmly believes that the City’s best years are ahead of us. Mayor Schock believes that we can achieve what James Gifford, one of Elgin’s founding fathers, described upon landing in Elgin, quoting “I believe I have found the finest spot along the river that could possibly exist, or which has ever been seen.” RECESS FOR RECEPTION Meeting recessed at 6:07 p.m. Meeting resumed at 6:45 p.m. immediately following the adjournment of Committee of the Whole Meeting. VOLUME LXXII MAY 9, 2007 316 MINUTES OF THE APRIL 25, 2007, COUNCIL MEETING APPROVED AS DISTRIBUTED Councilmember Figueroa made a motion, seconded by Councilmember Gilliam, to approve the April 25, 2007, Council Meeting Minutes as distributed. Upon a roll call vote: Yeas: Councilmembers Figueroa, Gilliam, Kaptain, Powers, Steffen, Walters, and Mayor Schock. Nays: None. COMMUNICATIONS Proclamation Recognizing National Public Works Week Mayor Schock declared May 20th through May 26th National Public Works Week and read the following proclamation: PROCLAMATION WHEREAS, public works services provided in our community are an integral part of our citizens’ everyday lives; and WHEREAS, the support of an understanding and informed citizenry is vital to the efficient operation of public works systems and programs such as: solid waste/recycling collection, engineering, water, sewer, parks, forestry, streets, traffic signals/signs, and fleet maintenance. WHEREAS, the health, safety and quality of life of this community greatly depends on these services; and WHEREAS, the efficiency of the skilled and dedicated personnel who staff public works departments is materially influenced by the people’s attitude and understanding of the importance of the work they perform. NOW, THEREFORE, I, Ed Schock, Mayor of the City of Elgin, Illinois do hereby proclaim the week of May 20th through May 26th, 2007 as “National Public Works Week” in the City of Elgin, and I call upon all citizens and civic organizations to acquaint themselves with the issues involved in providing our public works and to recognize the contributions which public works officials make every day to our health, safety, comfort, and quality of life. MAY 9, 2007 VOLUME LXXII 317 IN WITNESS WHEREOF, I have hereunto set my hand this 9th Day of May, 2007. s/Ed Schock Ed Schock, Mayor Director of Public Works Loete accepted the proclamation from Mayor Schock and invited all Elgin residents to the 8th Annual Open House for the Public Works Department and Riverside Water Treatment Plant in celebration of National Public Works Week and National Drinking Water Week, which will be held on Saturday, May 19, 2007. He stated that it is an excellent opportunity to learn about the many services provided by the Public Works and the Water Departments. He also stated that there will be equipment rides and demonstrations, the “Touch- A-Truck” program, informational displays, giveaways, free refreshments, and facility tours of both the Public Works Department located at 1900 Holmes Road and the Riverside Water Treatment Plant located at 375 W. River Road. Mayor Schock also encouraged Elgin residents to attend, stating that it is fun for the entire family. Proclamation Recognizing the Elgin Area Chamber of Commerce’s “Join the Chamber Week” Mayor Schock declared May 9th through May 16th “Join the Chamber Week” and read the following proclamation: PROCLAMATION WHEREAS, the Elgin Area Chamber of Commerce has been serving our area’s business community and enriching our quality of life for nearly 100 years. WHEREAS, the Chamber of Commerce and the city of Elgin have a formal partnership to attract businesses to and retain businesses in our community. WHEREAS, www.elginchamber.com provides a portal to community information on all that Elgin and the chamber membership have to offer an average of 1,800 times every day. WHEREAS, the Elgin Area Chamber of Commerce is holding a membership drive from May 1st through May 16th to expand the Chamber and further strengthen our business community. NOW, THEREFORE, I, Ed Schock, Mayor of the City of Elgin, Illinois, do hereby express appreciation to the Elgin Area Chamber of Commerce for their enhancement of our community and further declare the week of May 9th through 16th “Join the VOLUME LXXII MAY 9, 2007 318 Chamber Week” in encouragement and support of the efforts of the Elgin Area Chamber of Commerce. IN WITNESS WHEREOF, I have hereunto set my hand this 9th Day of May, 2007 s/Ed Schock Ed Schock, Mayor Susan Angell-Case and Leo Nelson from the Elgin Area Chamber of Commerce accepted the proclamation. Ms. Angell-Case thanked the Mayor and Council for this honor. She stated that the Chamber will be celebrating its 100th anniversary next year by hosting a gala on February 1, 2008, at the Stonegate and invited the Council and residents to attend. She stated that the Chamber is currently going through a membership drive, and thanked all of the various volunteers that have participated. RECOGNIZE PERSONS PRESENT Dawn Wojtas, representing the Blackhawk Residents Association, requested the City of Elgin’s help in the development and installation of a park on the vacant City owned property at the northeast corner of Blackhawk Drive and Congdon Avenue. Ms. Wojtas outlined some of the features that the residents in the area would like to see implemented in the proposed park, and stated that the residents are willing to help with the installation of these features. Ms. Wojtas and the Blackhawk Residents Association believes that a park in this location would not only benefit the residents in the area, but it would also help to enhance and beatify one of the entrances into the City of Elgin from the east. BID 07-022 AWARDED TO SAFETY SYSTEMS CORPORATION FOR POLICE BODY ARMOR Councilmember Walters made a motion, seconded by Councilmember Figueroa, to approve a contract to Safety Systems Corporation, for an amount not to exceed $19,044 for the purchase of body armor for the Elgin Police Department. The contract will be for a period of one year from the date of the award with three (3) one year options to renew. MAY 9, 2007 VOLUME LXXII 319 BID 07-033 AWARDED TO WHEELED COACH INDUSTRIES FOR THE CONSTRUCTION AND PURCHASE OF TWO AMBULANCES Councilmember Kaptain made a motion, seconded by Councilmember Gilliam, to approve the contract with Wheeled Coach Industries in the amount of $286,008 for the construction and purchase of one replacement ambulance and one additional ambulance for the Elgin Fire Department. Upon a roll call vote: Yeas: Councilmembers Figueroa, Gilliam, Kaptain, Powers, Steffen, Walters, and Mayor Schock. Nays: None. BID 07-040 AWARDED TO VARIOUS VENDORS FOR BITUMINOUS PATCHING MIXTURES Councilmember Walters made a motion, seconded by Councilmember Figueroa, to authorize the Public Works Department to purchase Bituminous Patching Mixtures, Groups I and II, from all of the suppliers listed below depending on the need and availability, at the unadjusted rates shown the tabulation provided by memo to the Council. BID 07-049 AWARDED TO GOLD MEDAL CHICAGO AND FOX RIVER FOODS FOR CONCESSIONS ITEMS FOR VARIOUS PARKS AND RECREATION FACILITIES Councilmember Figueroa made a motion, seconded by Councilmember Gilliam, to approve a contract with Gold Medal Chicago in the amount of $14,900 for concession items at Wing and Lords Park Family Aquatic Centers and The Centre of Elgin, as well as, approve a contract with Fox River Foods in the amount of $33,750 for concession items at the Elgin Sports Complex, Wing and Lords Park Family Aquatic Centers, and The Centre of Elgin. BID 07-053 AWARDED TO VARIOUS VENDORS FOR CONSTRUCTION OF FIRE STATION 7 Councilmember Kaptain made a motion, seconded by Councilmember Walters, to approve the package of bids as provided to Council by memo for a total dollar amount of $2,539,987 for the construction of Fire Station 7. VOLUME LXXII MAY 9, 2007 320 BID 07-056 AWARDED TO M & A CEMENT WORK INC. FOR 2007 NEIGHBORHOOD SIDEWALK REPLACEMENT PROGRAM-PHASE III Councilmember Figueroa made a motion, seconded by Councilmember Kaptain, to award M & A Cement Work, Inc. in the amount of $378,444.75 for the 2007 Neighborhood Sidewalk Replacement Program – Phase III. CONTRACT APPROVED FOR THE PURCHASE OF SIX 2008 FORD HYBRID ESCAPE UTILITY VEHICLES FROM BOB RIDINGS FORD THROUGH THE STATE OF ILLINOIS JOINT PURCHASE PROGRAM Councilmember Walters made a motion, seconded by Councilmember Figueroa, to approve the purchase of six 2008 Ford Hybrid Escape utility vehicles from Bob Ridings Ford in the amount of $145,215 through the State of Illinois Joint Purchase Program. Further, it is recommended that the five vehicles being replaced be disposed of through a public auction later this year following delivery and conversion of the new vehicles. PUBLIC HEARING TABLED REGARDING AN ANNEXATION AGREEMENT, ANNEXATION, ZONING, AND PRELIMINARY PLAT FOR THE WESEMANN PROPERTY; PROPERTY LOCATED AT 955 MARSHALL ROAD; BY HPI ELGIN, LLC, AS APPLICANT AND OWNER (02-07) Community Development Director Deering stated that the applicant is requesting that Petition 02-07 be tabled until the next City Council meeting to be held on May 23, 2007. Councilmember Walters made a motion, seconded by Councilmember Gilliam, to table the public hearing for the property located at 955 Marshall Road (Petition 02-07), until the May 23, 2007, City Council meeting. Ordinance No. G26-07 AN ORDINANCE AMENDING CHAPTER 6.06 OF THE ELGIN MUNICIPAL CODE, 1976 AS AMENDED, ENTITLED “ALCOHOLIC LIQUOR DEALERS” BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS: Section 1. That Chapter 6.06 of the Elgin Municipal Code, 1976, as amended, entitled “Alcoholic Liquor Dealers,” be and is hereby amended by amending Section 6.06.040, entitled, “License Classes; Fees,” to add the following new subsection to read as follows: Class U: For the retail sale of alcoholic liquor on the specified premises in any public place kept, used, maintained, advertised and held out to the public as a place where meals are served, and where meals actually are served and regularly served, without sleeping accommodations, such space being provided with adequate and sanitary kitchen facilities licensed and certified pursuant to the city’s retail food stores and food service establishments sanitation code, 77 Illinois Administrative Code 750, and with dining room equipment and capacity and having employed therein a sufficient number and kind of employees to prepare, cook and serve suitable food for its guests. The intent of this license classification is that the primary business conducted on the premises to be licensed shall be the service of meals in a restaurant that also has an integrated tavern area. A full menu, including entrees and appropriate side dishes, shall be available at all times liquor sales are being conducted until ten o'clock (10:00) P.M. Sunday through Thursday, and eleven o'clock (11:00) P.M. Friday and Saturday. After such times, in the event a full menu is not provided, a reduced menu, which includes only appetizers, MAY 9, 2007 VOLUME LXXII 329 sandwiches, snacks, hors d'oeuvres or other similar foods, shall be available. Provided, the kitchen may cease operating no sooner than one hour before closing. A licensee holding a class U license may sell or permit to be sold alcoholic liquors daily from six o’clock (6:00) A.M. until three o'clock (3:00) A.M. the following day. A licensee holding a class U license may also sell or permit to be sold alcoholic liquors on the Wednesday immediately preceding Thanksgiving Day from six o'clock (6:00) A.M. until four o'clock (4:00) A.M. the following day and on New Year's Eve from six o'clock (6:00) A.M. until four o'clock (4:00) A.M. the following day. All such liquor service shall be by the drink only, excepting vinous beverages by the bottle or carafe, or beer by the pitcher of a capacity not to exceed sixty (60) ounces. There shall be no exterior signage on any premises issued a class U liquor license indicating or advertising the sale of alcoholic liquor. The license fee per year is two thousand five hundred dollars ($2500.00). Section 2. That Chapter 6.06 of the Elgin Municipal Code, 1976, as amended, entitled “Alcoholic Liquor Dealers,” be and is hereby amended by amending Section 6.06.050, entitled “Licenses; Number to be Issued,” to add the following new subsection to read as follows: The number of Class U licenses shall not exceed one (1) in number. Section 3. That Chapter 6.06 of the Elgin Municipal Code, 1976, as amended, entitled “Alcoholic Liquor Dealers,” be and is hereby amended by amending Section 6.06.055, entitled “Exterior Sales Permit,” to read as follows: There is established an exterior sales permit to allow the retail sale of alcoholic liquor for consumption on or within any beer garden, patio area or other similar outside or unroofed or unenclosed areas (hereinafter referred to as "exterior sales areas") adjoining and utilized in conjunction with a principal establishment for which there is a then currently issued and valid class A, AA, A-1, C, D, E, E-1, E-2, E-3, F, F-1, K, O or U license. Except as otherwise expressly authorized in this chapter, no alcoholic liquor may be sold, served or consumed in any exterior sales area without first obtaining a permit as provided herein. A. No exterior sales permit shall be issued to any licensee whose establishment is located one hundred feet (100') or closer to any residential zone as measured from the boundary line of such residential zone to the exterior sales area, provided, however, that such distance limitation shall not apply to any licensee located within the CC1 Center City zoning district. Provided further, the foregoing limitation on the issuance of exterior sales permits shall not apply to otherwise qualified establishments located one hundred feet (100') or closer to a residential zone, for which an exterior sales area had been established prior to March 10, 1986. Such otherwise qualified establishments shall be permitted to apply for, obtain and renew an exterior sales permit and to continue sales in the previously established exterior sales area until such sales area is abandoned, VOLUME LXXII MAY 9, 2007 330 discontinued or the exterior sales area is relocated or until the exterior sales permit expires and is not renewed, whichever occurs first. B. Qualified applicants for exterior sales permits shall pay an annual fee of five hundred dollars ($500.00). Provided no fee shall be required for permits issued for exterior sales areas which are engaged in the regular service of food with alcoholic liquor and which have a total seating capacity of not more than twenty (20) or for sales in conjunction with a valid class L license. C. Exterior sales permit issued to any licensee for an establishment located within the CC1 center city zoning district and east of the Fox River may include an exterior sales area on an adjacent public sidewalk on property in the front of such an establishment notwithstanding the prohibitions regarding the possession and consumption of alcoholic liquors on public property as provided by subsection 6.06.150B of this chapter and section 13.25.080 of this code or other provisions of this code, further provided however, that any such exterior sales area to be located on any adjacent public sidewalk on property must include the regular service of food with any alcoholic liquor, must not unreasonably obstruct the sidewalk, and must limit hours of operations to no later than twelve o'clock (12:00) midnight. Section 4. That Chapter 6.06 of the Elgin Municipal Code, 1976, as amended, entitled “Alcoholic Liquor Dealers,” be and is hereby amended by amending subsection H, subparagraph 6 of Section 6.06.056, entitled “Young Adult Night Permit,” to read as follows: A special police detail consisting of not less than one city police officer shall be required for each entertainment event conducted pursuant to a young adult night permit and such police detail shall be paid by the permit holder upon receipt of invoice for such services from the city. The size of the special police detail shall be determined by the chief of police based upon, but not limited to, the anticipated number of patrons expected to attend the entertainment event. The special police detail shall commence at the time patrons are admitted to the entertainment event and shall conclude thirty (30) minutes following the conclusion of the entertainment event. The special police detail with a minimum of one city police officer required to be present at any class R establishment in accordance with this chapter may be utilized for the special police detail required for a young adult night permit. Section 5. That Chapter 6.06 of the Elgin Municipal Code, 1976, as amended, entitled “Alcoholic Liquor Dealers,” be and is hereby amended by deleting subsection K of Section 6.06.056, entitled “Young Adult Night Permit,” in its entirety. Section 6. That Chapter 6.06 of the Elgin Municipal Code, 1976, as amended, entitled “Alcoholic Liquor Dealers,” be and is hereby amended by amending the introductory paragraph of Section 6.06.059, entitled “Off-Site Special Event Permit,” to read as follows: There is established a special event permit to allow the retail sale of alcoholic liquor for consumption at a special event off the site of a licensed premises for such events as MAY 9, 2007 VOLUME LXXII 331 private parties, picnics or other special or theme event. Special event permits shall be issued only to licensees with a currently issued and valid class A, AA, A-1, D, E, E-1, E- 2, F, F-1, K, N, O, P, R, R-1, S or U license. Except as otherwise expressed authorized in this chapter, no alcoholic liquor may be sold, served or consumed at any special event without first obtaining a permit as provided herein. The fee for a special event permit is twenty five dollars ($25.00). Any special event permit shall also be subject to the following: Section 7. That Chapter 6.06 of the Elgin Municipal Code, 1976, as amended, entitled “Alcoholic Liquor Dealers,” be and is hereby amended by amending subparagraph A of Section 6.06.115, entitled “Basset Training Requirements,” to read as follows: For licenses effective on or after May 1, 1990, the original or renewal application for a Class A, AA, A-1, B, B-1, C, C-1, D, E, E-1, E-2, F, F-1, G, J, K, N, N-1, O, P, R, R-1, S, T and U license shall be accompanied with proof of completion of a State certified “Beverage Alcohol Sellers and Service Education and Training Program” (BASSET) for all persons who serve or sell alcoholic beverages pursuant to that license. Section 8. That all ordinances or parts of ordinances in conflict with the provisions of this ordinance be and are hereby repealed. Section 9. D. Zoning Districts - Generally. In this PGI Planned General Industrial District, the use and development of land and structures shall be subject to the provisions of Chapter 19.07, Zoning Districts, as may be amended from time to time. E. Location and Size of District. PGI Planned General Industrial Districts should be located in substantial conformance to the official comprehensive plan. The amount of land necessary to constitute a separate PGI District exclusive of rights of way, but including adjoining land or land directly opposite a right of way shall not be less than two acres. No departure from the required minimum size of a planned industrial district shall be granted by the City Council. F. Land Use. In this PGI Planned General Industrial District, the use and development of land and structures shall be subject to the provisions of Chapter 19.10, Land Use, of the Elgin Municipal Code, as amended.
