HomeMy WebLinkAbouta - January 10, 2007 CC1 VOLUME LXXII JANUARY 10, 2007 COUNCIL OF THE CITY OF ELGIN, ILLINOIS COUNCIL-MANAGER FORM OF GOVERNMENT REGULAR MEETING The regular meeting of the Council of the City of Elgin, Illinois, was held on January 10, 2007, in the Council Chambers. The meeting was called to order by City Clerk Dolonna Mecum at 7:00 p.m. The Invocation was given by Reverend Dale Jaacks from the Elgin House of Prayer, and the Pledge of Allegiance was led by Brendan Morse. ROLL CALL Roll call was answered by Councilmembers Figueroa, Gilliam, Kaptain, Rodgers, Sandor, and Walters. Absent: Mayor Schock. Councilmember Gilliam made a motion, seconded by Councilmember Figueroa, to appoint Councilmember Walters as Mayor Pro Tem. Upon a roll call vote: Yeas: Councilmembers Figueroa, Gilliam, Kaptain, Rodgers, Sandor, and Walters. Nays: None. MINUTES OF THE DECEMBER 20, 2006, COUNCIL MEETING APPROVED AS DISTRIBUTED Councilmember Figueroa made a motion, seconded by Councilmember Rodgers, to approve the December 20, 2006, Council Meeting Minutes as distributed. Upon a roll call vote: Yeas: Councilmembers Figueroa, Gilliam, Kaptain, Rodgers, Sandor, and Walters. Nays: None. COMMUNICATIONS Proclamation Honoring the Memory of Dr. Martin Luther King, Jr. Mayor Pro Tem Walters read a proclamation proclaiming January 13 and 14, 2007, as days in honor of the memory of Dr. King. Ina Dews, Co-Chairman of the Human Relations Commission, accepted the proclamation and thanked everyone for honoring Dr. King. She invited everyone to attend the Prayer Breakfast on Saturday, January 13, and the program to be held at the Hemmens Cultural Center on Sunday, January 14, honoring Dr. King. JANUARY 10, 2007 VOLUME LXXII 2 RECOGNIZE PERSONS PRESENT Joe Salas stated that he has previously talked to Mayor Schock regarding the ballpark on the east side of Elgin. He has been cleaning it on a regular basis and said he has done a better job than most people would have. He made sure the area was safe in the morning and night. He doesn’t want anyone to look down on him anymore. D. Arias stated that she is a 20-year Elgin resident and hadn’t asked the City for help until a year ago when she applied for the Residential Rehabilitation Program to replace windows. She was advised that she was No. 65 on the waiting list. Later she was informed that a lottery had been put in place of the waiting list, which she didn’t believe was fair after being on the waiting list for a long time. She stated that she has already talked to the city staff and the Mayor. She wants to know who can help her. Doug Heaton stated that he wanted to share with the City Council the experience of Costa Mesa, California, a community that is similar in size to Elgin, regarding its efforts to reduce the presence of illegal aliens. Within the past year, the Mayor of Costa Mesa proposed entering into a partnership with Immigration and Customs Enforcement (ICE) to train police officers in immigration enforcement and place an ICE officer at the city jail full time. The proposal was adopted by the Council. Mr. Heaton cited the statistics for December 2006, the first month of operation. He stated that he believes the success of this program should tell Elgin that a city of this size can get the attention of federal officials if the Mayor and Council are behind it, and that you can get results using existing laws and programs. He urged the Council to move forward with a 287(g) proposal. Clarence Hayward stated that he asks everyone he meets what they would change in Elgin. He talked to a resident of the Catatoga Subdivision who would like to have the road by Target extended. City Manager Folarin informed Mr. Hayward funding for the engineering for the South Street extension is in the budget for 2007. BID 06-089 AWARDED TO ACE OFFICE SUPPLIES FOR TONER CARTRIDGES FOR USE BY ALL CITY DEPARTMENTS AND PLOTTER CARTRIDGES FOR USE BY ENGINEERING, MIS, PLANNING, PARKS, POLICE, AND PUBLIC WORKS Councilmember Sandor made a motion, seconded by Councilmember Figueroa, to approve a one-year contract, with a one-year option to renew, to Ace Office Supplies for a total of approximately $46,000 for new printer toner cartridges for use by all City Departments and plotter cartridges for use by Engineering, MIS, Planning, Parks, Police, and Public Works. Upon a roll call vote: Yeas: Councilmembers Figueroa, Gilliam, Kaptain, Rodgers, Sandor, and Walters. Nays: None. VOLUME LXXII JANUARY 10, 2007 3 BID 06-113 AWARDED TO JUST SAFETY FOR THE ENTIRE CITY’S USE OF FIRST AID SUPPLIES Councilmember Rodgers made a motion, seconded by Councilmember Kaptain, to approve a contract to Just Safety for an amount not to exceed $16,000 for first aid supplies for use by the entire City. Upon a roll call vote: Yeas: Councilmembers Figueroa, Gilliam, Kaptain, Rodgers, Sandor, and Walters. Nays: None. BID 06-116 AWARDED TO DOOR TO DOOR DIRECT FOR DELIVERY SERVICE OF THE PARKS AND RECREATION DEPARTMENT PROGRAM BROCHURE TO HOUSEHOLDS AND MULTI-FAMILY UNITS IN ELGIN Councilmember Kaptain made a motion, seconded by Councilmember Rodgers, to award a contract to Door to Door Direct for an amount not to exceed $22,400 for delivery service for the Parks and Recreation Department program brochure to households and multi-family units in Elgin. Upon a roll call vote: Yeas: Councilmembers Figueroa, Gilliam, Kaptain, Rodgers, Sandor, and Walters. Nays: None. PUBLIC HEARING REGARDING AN ANNEXATION AGREEMENT AND PAB PLANNED AREA BUSINESS DISTRICT; PROPERTY LOCATED AT 3301 ROUTE 20; BY BEN HENRIKSON AND MARK A. LEDEBUHR, AS APPLICANTS AND OWNERS (PETITION 65-06) Mayor Pro Tem Walters declared the public hearing open. Community Development Director Deering stated that this petition involves approximately three acres of land for which the applicants are requesting annexation and Planned Area Business District zoning. No development plans are proposed for the property at this time. They will come back to the Council with a request for approval of specific plans at a later date. The Planning and Development Commission recommended approval. Richard Holmberg, attorney for the petitioners, briefly described the location of the parcel and access to the property. No one else chose to speak and Mayor Pro Tem Walters declared the public hearing closed. JANUARY 10, 2007 VOLUME LXXII 4 PETITION 65-06 APPROVED REQUESTING ANNEXATION, AND PAB PLANNED AREA BUSINESS DISTRICT ZONING APPROVAL; PROPERTY LOCATED AT 3301 ROUTE 20; BY BEN HENRIKSON AND MARK A. LEDEBUHR, AS APPLICANTS AND OWNERS Councilmember Gilliam made a motion, seconded by Councilmember Figueroa, to approve Petition 65-06 subject to conditions. Upon a roll call vote: Yeas: Councilmembers Figueroa, Gilliam, Kaptain, Rodgers, Sandor, and Walters. Nays: None. PUBLIC HEARING REGARDING AN ANNEXATION AGREEMENT AND PAB PLANNED AREA BUSINESS DISTRICT; PROPERTY LOCATED AT 4300 MCDONALD ROAD; BY DINO CAPITANI, AS APPLICANT AND DINO CAPITANI AND LEO DANEK, AS OWNERS (PETITION 66-06) Mayor Pro Tem Walters declared the public hearing open. Community Development Director Deering stated that this petition involved 4 ½ acres at the northwest corner of McDonald Road and Corron Road. This parcel will ultimately be part of a larger project. The Planning and Development Commission recommended approval. Richard Holmberg, attorney for the applicant, stated that this petition was filed prior to the Campton Hills petition to incorporate. Therefore, the City of Elgin has priority. No one else chose to speak and Mayor Pro Tem Walters declared the public hearing closed. PETITION 66-06 APPROVED REQUESTING ANNEXATION, AND PAB PLANNED AREA BUSINESS DISTRICT ZONING APPROVAL; PROPERTY LOCATED AT 4300 MCDONALD ROAD; BY DINO CAPITANI, AS APPLICANT AND DINO CAPITANI AND LEO DANEK, AS OWNERS Councilmember Figueroa made a motion, seconded by Councilmember Gilliam, to approve Petition 66-06 subject to conditions. PETITION 98-06 APPROVED REQUESTING A CONDITIONAL USE APPROVAL FOR A PLANNED DEVELOPMENT IN THE AB AREA BUSINESS DISTRICT, TO PERMIT THE CONSTRUCTION OF A NEW BUILDING AND EXTERIOR BUILDING RENOVATIONS IN THE ARC ARTERIAL ROAD CORRIDOR OVERLAY DISTRICT; PROPERTY LOCATED AT 16 AND 24 NORTH AIRLITE STREET BY DENNIS AND JOAN JUNOD, AS APPLICANTS AND OWNERS Community Development Director Deering stated that this petition involves 1 ½ acres located at the northwest corner of Airlite and Foothill Road. Applicants are requesting a conditional use VOLUME LXXII JANUARY 10, 2007 5 for a planned development in the AB Area Business District and the ARC Arterial Road Corridor Overlay District to permit the construction of a new building, building addition, and remodel the exterior building materials. JANUARY 10, 2007 VOLUME LXXII 6 Resolution No. 07-1 RESOLUTION AUTHORIZING EXECUTION OF AN AGREEMENT WITH THE SERVICE EMPLOYEES INTERNATIONAL UNION, LOCAL 73, MUNICIPAL DIVISION, PERMANENT PART TIME MAINTENANCE AND CUSTODIAN EMPLOYEE GROUP WHEREAS, representatives of the City of Elgin and representatives of the Service Employees International Union, Local 73, Municipal Division, Permanent Part Time Maintenance and Custodian Employee Group have met and discussed wages, fringe benefits and other working conditions; and WHEREAS, said representatives have submitted for review and approval by the City Council an agreement pertaining to such matters; and WHEREAS, the City Council has reviewed said agreement and finds that it is fair and equitable for the City of Elgin and employees covered by it. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS, that it hereby approves the proposed agreement between the City of Elgin and the Service Employees International Union Local 73 Municipal Division, Permanent Part Time Maintenance and Custodian Employee Group, a copy of which is attached hereto and made a part hereof by reference. Zoning Districts Generally. In this PGI District, the use and development of land and structures shall be subject to the provisions of Chapter 19.07, Zoning Districts of the EMC, as may be amended from time to time. E. Location and Size of Districts. Planned industrial districts should be located in substantial conformance to the official comprehensive plan. The amount of land necessary to constitute a separate planned industrial district exclusive of rights of way, but including adjoining land or land directly opposite a right of way shall not be less than two acres. No departure from the required minimum size of a planned industrial district shall be granted by the City Council. F. Land Use. In this PGI District, the only land uses allowed shall be single family detached dwellings, accessory structures, open space, stormwater detention, and landscaping in substantial conformance with the proposed Forrest Glen Preliminary Plat Submittal and Preliminary Engineering Plan dated March 25, 2005 and last revised July 7, 2006, and prepared by Haeger Engineering per the Community Development Group and the Engineering Division. G. Site Design. In this PGI District, the site design regulations shall be as required in the GI District, pursuant to Chapter 19.40.335 Site Design, of the EMC, as may be amended from time to time. The development of land and structures shall be in substantial conformance with the following: 1. Any of the requirements of this ordinance may be varied by petition of a lot or property owner for a zoning lot without requiring an amendment to this PGI zoning district and without necessitating that all other property owners in this PGI zoning district authorize such an application. O. Subdivisions – Generally. The subdivision of the subject property and development thereof shall comply with the subdivision regulations of the city, as amended, and the Plat Act of the State of Illinois. P. Appeals. Any requirement, determination, or interpretation associated with the administration and enforcement of the provisions of this ordinance may be appealed subject to the provisions of Chapter 19.75, Appeals of the Elgin Municipal Code, 1976, as amended. Section 4. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS: Section 1. That the City Council of the City of Elgin hereby adopts the Findings of Fact, dated October 16, 2006, made by the Planning and Development Commission, a copy of which is attached hereto and made a part hereof by reference as Exhibit A. That Chapter 19.07, Section 19.07.600 entitled “Zoning District Map” of the Elgin Municipal Code, 1976, as amended, be and the same is hereby further amended by adding thereto the following paragraph: “The boundaries herein before laid out in the ‘Zoning District Map’, as amended, be and are hereby altered by including in the PSFR2 Planned Single Family Residence District, the following described property: Those areas on the attached Forrest Glen Preliminary Plat and Zoning Exhibit, prepared by Haeger Engineering, last revised October 10, 2006, designated in the PSFR2 Planned Single Family Residential District. Section 3. That the City Council of the City of Elgin hereby classifies the subject property in the PSFR2 Planned Single Family Residence District in accordance with the following provisions: A. Purpose and Intent. The purpose and intent of this PSFR2 zoning district is to provide a planned urban residential environment of standardized moderate density for single family detached dwellings, subject to the provisions of Chapter 19.60 Planned Developments of the Elgin Municipal Code, 1976, as amended. In this PSFR2 zoning district, the use and development of land and structures shall be subject to the provisions of Chapter 19.07, Zoning Districts, of the Elgin Municipal Code, 1976, as amended. E. Location and Size of District. This PSFR2 zoning district should be located in substantial conformance to the official comprehensive plan. The amount of land necessary to constitute a separate PSFR2 zoning district exclusive of rights-of- way, but including adjoining land or land directly opposite a right-of-way, shall not be less than two acres. F. Land Use. In this PSFR2 zoning district, the use of land and structures shall be subject to the provisions of Chapter 19.10, Land Use, of the Elgin Municipal Code, 1976, as amended. G. Site Design. In this PSFR2 zoning district, the use and development of land and structures shall be subject to the provisions of Chapter 19.12, Site Design, of the Elgin Zoning Ordinance, and in the Annexation Agreement. In this PSFR2 zoning district, the site design regulations shall be as follows: 1. Zoning Lots - Generally. In this PSFR2 zoning district, "zoning lots" [SR] shall be subject to the provisions of Section 19.12.300, Zoning Lots - Clarifications and Exceptions, of the Elgin Zoning Ordinance. In this PSFR2 zoning district, the minimum required "zoning lot area" [SR] shall be 9,018 square feet per dwelling unit, and in substantial conformance to the Preliminary Plat Submittal and Preliminary Engineering Plan dated March 25, 2005 and last revised July 7, 2006, and prepared by Haeger Engineering. 3. Lot Width. In this PSFR2 zoning district, the minimum required "lot width" [SR] for a zoning lot shall be 70 feet and in substantial conformance to the Preliminary Plat Submittal and Preliminary Engineering Plan dated March 25, 2005 and last revised July 7, 2006, and prepared by Haeger Engineering. 4. Setbacks - Generally. In this PSFR2 zoning district, the minimum required "setbacks" [SR] shall be in substantial conformance to the Preliminary Plat Submittal and Preliminary Engineering Plan dated March 25, 2005 and last revised July 7, 2006, and prepared by Haeger Engineering. 5. Setbacks by Lot Line. In this PSFR2 zoning district, the minimum required "building" [SR] "setbacks" [SR] for a zoning lot shall be in substantial conformance to the Preliminary Plat Submittal and Preliminary Engineering Plan dated March 25, 2005 and last revised July 7, 2006, and prepared by Haeger Engineering, namely: a. Street Setback: 25 feet. b. Side/Interior Setback: 7 feet. c. Rear Setback: 30 feet. d. Transition Setback: 0 feet from the industrial zoned district to the south 6. Accessory Structures and Buildings. In this PSFR2 zoning district, "accessory structures and buildings" [SR] shall be subject to the provisions of Section 19.12.500, Accessory Structures and Buildings, of the Elgin Zoning Ordinance. 7. Yards. In this PSFR2 zoning district, a "street yard" [SR], a "side yard" [SR], or a "rear yard" [SR] established by a required building setback or by the actual location of a building shall be subject to the provisions of Section 19.12.600, Obstructions in Yards, of the Elgin Zoning Ordinance. 8. Residential Floor Area. In this PSFR2 zoning district, the maximum "residential floor area" [SR] for a single family zoning lot shall equal the “zoning lot area” [SR] times 0.40 (40%). 9. Building Coverage. In this PSFR2 zoning district, the maximum "building coverage" [SR] for a single family zoning lot shall equal the “zoning lot area” [SR] times 0.35 (35%). In this PSFR2 zoning district, the maximum "accessory building coverage" [SR] for a single family zoning lot shall equal the “zoning lot area” [SR] times 0.10 (10%). 11. Vehicle Use Area. In this PSFR2 zoning district, the maximum "vehicle use area" [SR] for a single family zoning lot shall be one thousand four hundred (1,400) square feet. 12. Supplementary Conditions. In this PSFR2 zoning district, the use and development of land and structures shall also be subject to the following conditions: 8. Substantial conformance to the Preliminary Plat of Subdivision Statement of Purpose submitted by The Circle Land Company submitted on January 10, 2006. 9. Substantial conformance to the Aerial Exhibit dated December 8, 2004, Forrest Glen Preliminary Plat Submittal and Preliminary Engineering Plan dated March 25, 2005 and last revised July 7, 2006, and prepared by Haeger Engineering. 10. Substantial conformance to the proposed Forrest Glen Preliminary Plat and Zoning Exhibit dated October 10, 2006 and prepared by Haeger Engineering. 11. Substantial conformance to the Preliminary Engineering Plan dated March 25, 2005 and last revised July 7, 2006, and prepared by Haeger Engineering with revisions per the Community Development Group and the Engineering Division. In this PSFR2 zoning district, signs shall be subject to the provisions of Chapter 19.50, Signs, of the Elgin Municipal Code, 1976, as amended, and shall also be subject to paragraph G., Site Design, of this ordinance. K. Amendments. In this PSFR2 zoning district, application for text and map amendments shall be subject to the provisions of Chapter 19.55, Amendments. A text and map amendment may be requested by an individual lot or property owner for a zoning lot without necessitating that all other property owners in this PSFR2 zoning district authorize such an application. L. Planned Developments. In this PSFR2 zoning district, application for a planned development shall be subject to the provisions of Chapter 19.60, Planned Developments, of the Elgin Municipal Code, 1976, as amended. A conditional use for a planned development may be requested by an individual lot or property owner for a zoning lot without requiring an amendment to this PSFR2 zoning district and without necessitating that all other property owners in this PSFR2 zoning district authorize such an application. M. Conditional Uses. In this PSFR2 zoning district, application for conditional uses shall be subject to the provisions of Chapter 19.65 Conditional Uses, of the Elgin Municipal Code, 1976, as amended. A conditional use may be requested by an individual lot or property owner for a zoning lot without requiring an amendment to this PSFR2 zoning district and without necessitating that all other property owners in this PSFR2 zoning district authorize such an application. N. Variations. Any of the requirements of this ordinance may be varied by petition of a lot or property owner subject to this Ordinance, however, such variation is subject to the provisions of Section 19.70, Variations, of the Elgin Municipal Code, as may be amended. A variation may be requested by an individual property owner for a zoning lot without requiring an amendment to this PSFR2 zoning district and without necessitating that all other property owners in this PSFR2 zoning district authorize such an application. O. Subdivisions – Generally. The subdivision of the subject property and development thereof shall comply with the subdivision regulations of the city, as amended, and the Plat Act of the State of Illinois. Prior to building permit JANUARY 10, 2007 VOLUME LXXII 32 issuance, for each building or structure proposed to be built within the planned development, a soils suitability and bearing capacity test shall be performed as required by the City Engineer and the Development Administrator, and the provisions of the Annexation Agreement. P. Appeals. Any requirement, determination, or interpretation associated with the administration and enforcement of the provisions of this ordinance may be appealed subject to the provisions of Chapter 19.75, Appeals, of the Elgin Municipal Code, 1976, as amended.
