RESOLUTION
ADOPTING AMENDED OVERHEAD SEWER AND BACKWATER
VALVE ASSISTANCE PROGRAM
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ELGIN,ILLINOIS,that it
hereby adopts the Amended Overhead Sewer and Backwater Valve Assistance Program dated March
2011, a copy of which is attached.

AMENDED OVERHEAD SEWER AND BACKWATER VALVE
ASSISTANCE PROGRAM

I. ELIGIBLE PROPERTIES
To be eligible for this program, residents must own and reside on a property serviced
by either (1) a combined sewer system, or (2) a separated storm and sanitary sewer
system in an area identified by the City's Public Services Director as having cross-
connection or other potential system deficiencies leading to backups. The map attached
hereto, identified as "Overhead Sewer and Backflow Valve Assistance Program"
prepared by the City of Elgin-Department of Community Development dated March
2011, depicts the current combined storm/sanitary sewer system areas and the areas
identified to date by the City's Public Services Director as consisting of separated
storm/sanitary sewer areas known to have potential cross-connections or other potential
system deficiencies leading to backups. The City reserves the right, through its Public
Services Director, to identify other properties or areas eligible for participation in this
program upon certification by the Public Services Director that such property or area
has a separated storm/sanitary sewer system with cross-connections or other potential
system deficiencies leading to backups. The City of Elgin will determine if this
criterion has been met. All applications received will be considered on a first-come,
first-serve basis until funds are exhausted for that program year.
II. APPLICATION & PROCESS
1. Contact licensed plumbers to discuss best option for property.
2. Obtain at least two detailed, written quotes/cost estimates.
3. Fill out and submit application (see below for required attachments). Once all
required documents have been submitted, City staff will review the application and
provide a decision to the applicant.
4. Sign agreement upon approval from City.
5. Obtain permit and complete work.
6. Submit invoice from completed work for payment. Once the invoice is processed,
the City will provide a check to the contractor for payment of work completed.
Attach supporting documentation to the application form including:
❑ Verification of property ownership in the form of deed and most-recent property
tax form;
❑ Two detailed, written quotes/cost estimates provided by licensed contractors; and
❑ Photographs of existing conditions.
Additionally, eligible program participants must:
❑ Obtain all required permits prior to beginning any work;

❑ Comply with all applicable codes, ordinances, and regulations; and
❑ Have all repairs inspected by City Building Inspectors.
The city reserves the right to deny the application of, or funding to, those persons who
do not comply with the above criteria.
III. FINANCING MECHANISMS
As this program has limited funding, funds will be allocated based on a first-come,
first-serve basis. The financing structure is as follows:
Option 1: OVERHEAD SEWER Installation
• City provides funding for 100% of cost (up to $10,000) to property owner.
— 50% (up to $5,000) as a grant.
— 50% (up to $5,000) as 5-yr loan
• The loan will be interest free.
• Loan repayments incorporated in water and sewer bill.
Option 2: BACKWATER VALVE Installation
• City provides funding for 100% of cost (up to $2,000) to property owner.
— 50% (up to $1,000) as a grant
— 50% (up to $1,000) as a 5-yr loan
• The loan will be interest free.
• Loan repayments incorporated in water and sewer bill.
Low-income Households
Those households that meet the Department of Housing and Urban Development's
(HUD) low-income thresholds for Kane County are eligible for increased funding (see
Table 1. below).
If low-income threshold met:
• 75%of above option cost will be granted to resident.
• 25% of above option cost will be loaned.
• Same repayment structure as above.

The property owner's household must meet the current low income guidelines set by the
United States Department of Housing and Urban Development. For household sizes
between 1 and 8, the low to moderate income guidelines are as follows (current as of
June 26,2010):

Increase Eligibility for the Overhead Sewer and Backflow Valve Assistance Program
(No Cost to the City)
OBJECTIVE:
Make grant funding available to residents serviced by separated storm and sanitary sewers
where the public works department can verify either cross contamination or other system
deficiencies.
RECOMMENDATION:
Approve changes to the eligibility requirements for the Overhead Sewer and Backflow Valve
Assistance Program.
rk BACKGROUND
The Overhead Sewer and Backflow Valve Assistance Program was created in 2009 to help
property owners defray costs incurred while trying to minimize the chance of sewer backups
into basements and/or basement flooding. Under the current requirements of the program
(Attachment A), only properties serviced by a combined storm/sanitary sewer system are
eligible for funding. A map of the program area is attached (Attachment B).
However, since September of 2010, the city has received two requests to participate in the
program from owners of property serviced by separated storm and sanitary sewers. These
properties are located in areas of the city that have known sewer system deficiencies: Preston
and Cooper Streets and along North Commonwealth Avenue. The public works department has
shown that, in a substantial rain event, storm water enters the sanitary system causing back-
ups into private residences. Both properties could benefit by installing an overhead sewer and
backflow valve.
OPERATIONAL ANALYSIS
The Overhead Sewer and Backflow Valve Assistance Program assists property owners by
covering the cost of the installation of an overhead sewer system or a backflow valve. These
devices help prevent sewer backups into basements and/or basement flooding.

LEGAL IMPACT
The proposed amendment to the Overhead Sewer and Backflow Valve Assistance Program will
require the adoption of a resolution. An agreement will be undertaken with each property
owner selected to participate in the program.
ALTERNATIVES
The city council may choose not to amend the Overhead Sewer and Backflow Valve Assistance
Program to include properties serviced by separated storm and sanitary sewers where the
public works department confirms system deficiencies.
NEXT STEPS
1. Update the application form and eligibility requirements of the Overhead Sewer and
Backflow Valve Assistance Program on the city's website
2. Contact residents within the expanded program areas announcing availability of the
program
3. Process applications from residents intending to participate in the program
4. At the end of the program year, evaluate the effectiveness of the expanded program
and report the results to the city council

❑ Property Warranty Deed
❑ Most recent Property Tax Form
❑ Land Contract registered with the County
• Two detailed cost estimates provided by licensed contractors.
• Photographs of existing conditions.
Additionally,eligible program participants must:
• Obtain all required permits prior to beginning any work.
• Comply with all applicable building codes.
• Have all repairs inspected by City Building Inspectors.
Those residents who do not comply with the above criteria may be subject to a denial of
application or withdrawal of funding.
