COUNCIL OF THE CITY OF ELGIN, ILLINOIS
COUNCIL-MANAGER FORM OF GOVERNMENT
REGULAR MEETING
The regular meeting of the Council of the City of Elgin,
Illinois, was held on in the Council Chambers. The meeting was
called to order by Mayor Schock at 7:22 p.m. The Invocation
was given by Rev. Steve Srock, and the Pledge of Allegiance was
led by Mayor Schock.
ROLL CALL
Roll call was answered by Councilmembers Figueroa, Gilliam,
Munson, Walters, Wasilowski, Yearman and Mayor Schock. Absent:
None.
MINUTES OF.THE AUGUST 25, 1999, COUNCIL MEETING APPROVED AS
DISTRIBUTED
Councilman Gilliam made a motion, seconded by Councilman
Figueroa, to approve the August 25, 1999, Council Meeting
E. Minutes as distributed. Yeas: Councilmembers Gilliam, Munson,
Walters, Wasilowski'and Mayor Schock. Nays: None.
Councilmember Yearman voted present.
COMMUNICATIONS
Police Chief Miller gave the Council an update on the City's
zero tolerance policy. He stated that 500 traffic stops were
made over the Labor Day weekend. He also advised that the last
person wanted in the August shooting at 260 Center Street was
arrested this past weekend.
RECOGNIZE PERSONS PRESENT
John Wentland, 1034 Hill Avenue, invited Councilmembers to
attend the Infofest being held Saturday, September 11, 1999, at
11 a.m. regarding the proposed community garden, which is a way
of bringing people together.
Julio Cesar Valdez, 361 Summit Street, a member of the Hispanic
Coalition, invited participation in the September 25 parade
which is being held in conjunction with Downtown Neighborhood
Association's Fiesta Salsa.
Sheri Buttstadt, 687 Linden, spoke in support of the Image
Commission's recommendation regarding overcrowding. She

believes there is community support for more aggressive measures
to be taken regarding this problem.
BID 99-085 AWARDED FOR HYDRAULIC BREAKER FOR WATER DEPARTMENT
Councilman Gilliam made a motion, seconded by Councilman
Walters, to award this contract to United Rentals in the amount
of $8,400.00. Yeas: Councilmembers Figueroa, Gilliam, Munson,
Walters, Wasilowski, Yearman and Mayor Schock. Nays: None.
BID 99-092 AWARDED FOR REPLACEMENT WATER VALVES
Councilman Figueroa made a motion, seconded by Councilman
Gilliam, to award this contract to East Jordan Iron Works, Inc.
in the amount of $22,340.00. Yeas: Councilmembers Figueroa,
Gilliam, Munson, Walters, Wasilowski, Yearman and Mayor Schock.
Nays: None.
CANCELLATION OF AWARD TO LEADMAN ELECTRONICS AND BID 99--087
AWARDED TO DTK COMPUTERS FOR DESKTOP AND NOTEBOOK COMPUTERS
Councilman Gilliam made a motion, seconded by Councilwoman
Yearman, to approve cancellation of the award to Leadman
Electronics and approve the award to DTK Computers in the amount
of $28,732. Yeas: Councilmembers Figueroa, Gilliam, Munson, t;
Walters, Wasilowski, Yearman and Mayor Schock. Nays: None..
BID AWARDED FOR FIBER OPTIC SWITCH EQUIPMENT
Councilwoman Munson made a motion, seconded by Councilman
Gilliam, to award this contract to Kissane Business Systems,
Inc. in the amount of $29,305. Yeas: Councilmembers Figueroa,
Gilliam, Munson, Walters, Wasilowski, Yearman and Mayor Schock.

BID 99-077 AWARDED FOR REPLACEMENT OF GRANULAR ACTIVATED
CARBON FILTER MEDIA AT RIVERSIDE WATER TREATMENT PLANT
Councilman Walters made a motion, seconded by Councilwoman
Yearman, to award this contract to American Carbon Services for
$35,965. Yeas: Councilmembers Figueroa, Gilliam, Munson,
Walters, Wasilowski, Yearman and Mayor Schock. Nays: None.

Councilman Walters made a motion, seconded by Councilman
Gilliam, to the sole source provider, Artron Products, in the
amount of $8,005.00. Yeas: Councilmembers Figueroa, Gilliam,
Munson, Walters, Wasilowski, Yearman and Mayor Schock. Nays:
None.
BID 99-089 REJECTED FOR GIFFORD PARK PROJECT
Councilman Walters made a motion, seconded by Councilman
Gilliam, to reject all bids and have staff redesign the project
for a 2000 bid and summer community build day. Yeas:

Yearman and Mayor Schock. Nays: None.

Councilman Gilliam made a motion, seconded by Councilman
Figueroa, to award two contracts for this project:

BID 99-097 AWARDED FOR 1999 NEIGHBORHOOD SIDEWALK REPAIR
PROGRAM
Councilman Walters made a motion, seconded by Councilman
Wasilowski, to award this contract to Triggi Construction, Inc.
in the amount of $147,462.95 and to complete additional sidewalk
repair quantities for approximately $52,000. Yeas:
Councilmembers Figueroa, Gilliam, Munson, Walters, Wasilowski,
Yearman and Mayor Schock. Nays: None.

Because of information received just. prior to the meeting, City

CLASSIFYING PROPERTY IN THE
PGI PLANNED GENERAL INDUSTRIAL DISTRICT
(850 N. Grove/20 Lincoln Ave)
WHEREAS, written application has been made to classify said
property in the PGI Planned General Industrial District; and

WHEREAS, the Planning and Development Commission has
conducted a public hearing concerning said application and has
submitted its written findings and recommendation that the
subject property be reclassified; and
WHEREAS, the City Council has reviewed the findings and

Section 2. That the City Council of the City of Elgin

the classification of PGI Planned General Industrial District
at 23 North Union Street in accordance with the following
provisions:
A. Purpose and Intent. The purpose of this PGI
Planned General Industrial District is to establish
a limited permitted and conditional use list and to
bring the existing site and building improvements
into conformance to the site design regulations of
the zoning ordinance. A PGI zoning district is
most similar to, but departs from the standard
requirements of the GI zoning district.
B. Supplementary Regulations. Any word or phrase
contained herein, followed by the symbol "(SR)
shall be subject to the definitions and the
additional interpretive requirements provided in
Chapter 19.90, Supplementary Regulations, of the
Elgin Municipal Code, as amended. The exclusion of
such symbol shall not exempt such word or phrase
from the applicable supplementary regulation.
C. General Provisions. In this PGI zoning district,
the use and development of land and structures
shall be subject to the provisions of Chapter
1.9.05, General Provisions, of the Elgin Municipal
Code, as amended.
D. Zoning Distracts - Generally. In this PGI zoning
district, the use and development of land and
structures shall be subject to the provisions of
Chapter 19.07, Zoning Districts, of the Elgin
Municipal Code, as amended.
E. Land Use. In this PGI zoning district, the use and
development of land and structures shall be subject
to the provisions of Chapter 19.10 Land Use, of the
Elgin Municipal Code, as amended.
The following enumerated "land uses" (SR) shall be
the only land uses allowed as a "permitted use"
(SR) in this PGI district:

F. Site Design. In this PGI zoning district, the use
and development of land and structures shall be

except as may be otherwise provided in this
section. In this PGI zoning district, site design
for .a zoning lot, lot area, lot width, setbacks,
accessory structures and buildings, yards,
landscape yards, floor area, and building coverage
shall be in substantial conformance to the
following :
1. The Site Plan for 850 N. Grove/20 Lincoln
Avenue prepared by Lamp Incorporated, Robert
A. Bialo, and dated June 24, 1999.
2.. Landscaping is to be provided as approved by
the Community Development Manager.
3. The colors of the materials used for the
addition will blend with the colors of the
existing building as determined by the
Community Development Manager.
4. Compliance with all other applicable codes and
ordinances.

G. Off Street Parking. In this PGI zoning district,
off street parking shall be subject to the
provisions of Chapter 19.45, Off Street Parking, of
the Elgin Municipal Code, as may be amended.
H. off Street Loading. In this PGI zoning district,
off street loading shall be subject to the
provisions of Chapter 19.47, Off Street Loading, of
the Elgin Municipal Code, as may be amended.
I. Signs. In this PGI zoning district, signs shall be
subject to the provisions of Chapter 19.50, Signs,
of the Elgin Municipal Code, as may be amended.
J. Nonconforming Uses and Structures. In this PGI
zoning district, nonconforming uses and structures
shall be subject to the provisions of Chapter
19.52, Nonconforming Uses. and Structures, of the
Elgin Municipal Code, as may be amended.
K. Planned Developments. This PGI zoning district
shall be subject to the provisions of Chapter
19.60, Planned Developments, of the Elgin Municipal
Code, as may be amended.
L. Conditional Uses. In this PGI zoning district,
conditional uses shall be subject to the provisions
of Chapter 19.65 Conditional Uses, of the Elgin
Municipal Code, as may be amended.
M. Variations. Any of the requirements of this
ordinance may be varied, subject to the provisions
of Section 19.70, Variations, of the Elgin
Municipal Code, as may be amended. A variation may
be requested by an individual property owner for a
zoning lot without requiring an amendment to this
PGI zoning district and without necessitating that
all other property owners authorize such an
application.
N. Appeals. Any requirement, determination, or
interpretation associated with the administration
and enforcement of the provision of this ordinance
may be appealed subject to the provisions of
Chapter 19.75, Appeals; of the Elgin Municipal
Code, as may be amended.
Section 3. That this ordinance shall be in full force
and effect from and after its passage in the manner provided
by law.

RECLASSIFYING PROPERTY AT 728, 756 and 760 WALNUT AVENUE
WHEREAS, written application has been made to reclassify
certain property located at 728, 756 and 760 Walnut Avenue from
NB Neighborhood Business District to RB Residence Business
District; and
WHEREAS, the Planning and Development Commission has
conducted a public hearing after due notice and submitted its
written findings and recommendations to the City Council; and
WHEREAS, the City Council has reviewed the recommendations
of the Planning and Development Commission and concurs in such
recommendations.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE

REGULAR MEETING
The regular meeting of the Council of the City of Elgin,
Illinois, was held on September 22, 1999, in the Council
Chambers. The meeting was called to order by Mayor Schock at
7:00 p.m. The Invocation was given by Reverend Tom O'Connor,
and the Pledge of Allegiance was led by Jeff Myers.

RECOGNIZE PERSONS PRESENT
John Steffen., on behalf of Gifford Park Association, thanked the
City Council and staff for all their assistance regarding the
Gifford Park Association's 18th Annual Housewalk. As President
of the Downtown Neighborhood Association, he invited everyone to
attend the Fiesta Salsa event this coming Saturday. He
announced that a booth will be set up to accept donations for
victims of Hurricane Floyd.
Jack Wentland, 1034 Hill Avenue, expressed appreciation for the
assistance rendered by the community restitution workers in
getting the grounds ready for the neighborhood infofest held
September 11. He also thanked the Council for authorizing the
work recently done in the Hill Avenue neighborhood, including
closing the driveway from the restaurant onto Hill Avenue. He
said the noise and commotion has been alleviated significantly.
Audrey Compere, 1525 Easy Street, on behalf of Baha`is Community
of Elgin., distributed a statement to the City Council called
"Two Wings of a Bird" regarding the equality of women and men.
She.said the statement is being distributed to community
leaders, because Baha'is believes that women',s full and equal
participation is essential for social and economic development,

the abolition of war, and the ultimate establishment of a
unified world.

"HISTORIC./ARCHITECTURAL REHABILITATION GRANT PROGRAM" AND
"75/25 HISTORIC/ARCHITECTURAL REHABILITATION GRANT PROGRAM"
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ELGIN,
ILLINOIS:
Section 1. That Chapter 20.15 of the Elgin Municipal Code,
1976, as amended, is hereby further amended to read as follows:
"Chapter 20:15
50/50 HISTORIC/ARCHITECTURAL
REHABILITATION GRANT PROGRAM
20.15.010 TITLE.
This program shall be entitled the 1150/50
Historic/Architectural Rehabilitation Grant Program"
of the City of Elgin.
20.15.020 PURPOSE.
The purpose of this ordinance is to provide a
financial incentive to encourage private investment
in the exterior rehabilitation and restoration of
historically/architecturally significant residential

structures, particularly those located in designated
historic districts.
20.15.030 ESTABLISHMENT.
There is hereby established a historical/
architectural rehabilitation grant program for the
City of Elgin. Completed applications must be
submitted by the deadline published by the
Department of Planning and Neighborhood. Services and
shall be reviewed based on established criteria for
selection. Grants for the program established may
be made until funds budgeted for such use are
exhausted.
20.15.040 ADMINISTRATION.
The administration of the provisions of this
chapter is hereby assigned to the Director of the
Department of Planning and Neighborhood Services
(Director), or the Director's designee. Applications
hereunder shall be made to the Department of
Planning and Neighborhood Services which shall have
the authority and responsibility for carrying out
the provisions of this chapter. The Director may
consult with the Elgin Heritage Commission in so
carrying out the provisions of this chapter. The
Director shall establish any reasonable rules and
procedures not otherwise established by this chapter
that are deemed necessary for administration of the
Historic/Architectural Rehabilitation Grant
Program. Such rules and procedures shall include
scoring criteria and a minimum point threshold
necessary to qualify for grants for the program.
Such rules and procedures shall be written and
published in pamphlet form.
20.15.050 HISTORIC/ARCHITECTURAL REHABILITATION GRANT
PROGRAM.
A. Eligible Activities. Grants for the
exterior historic/ architectural rehabilitation of
historically/architecturally significant residential
structures shall be limited to actual out of pocket
expenses incurred in meeting the requirements of the
Elgin Design Guideline Manual. Program
participation and historical/architectural
rehabilitation activities must result in full
compliance with such standards as they apply to the
exterior of the structure. In addition, as a
condition of any grant, the exterior of eligible
properties must be brought into full compliance with
the current, adopted BOCA Property Maintenance Code
by the end of the eighteen (18) month term of the

grant agreement. Notwithstanding the foregoing
requirement, a property shall be considered eligible
for participation in the grant program if the owner
of the property has either previously or
simultaneously with the execution of grant program
agreement also entered into a long term
rehabilitation agreement for the property pursuant
to Elgin Municipal Code Section 2.65.030, as
amended, providing for. the correction of all
exterior code violations. The term of any such long
term rehabilitation agreement shall not exceed
fifty-four (54) months. As a condition of continued
eligibility for the grant program and disbursement
of any grant funds, the property owner must at all
times be in compliance with the schedule for
corrective work in the long term rehabilitation
agreement.
B. Applicant Qualifications. Eligible
applicants shall include any person who:
1. Owns a lawful conforming or lawful
nonconforming residential structure which is
more than 50 years old and contains no more
than four (4) dwelling units; and
2. Is at least 18 years of age.
C. Grants. The amount of any grant shall be
determined by the Director of the Department of
Planning and Neighborhood Services, or the
Director's designee, in accordance with an approved
estimate of cost for eligible exterior
historic/architectural rehabilitation work. Grants
shall be limited to fifty percent (50%) of eligible,
approved project construction costs and applicable
to a minimum project of $5,000 with no grant to
exceed $10,000.
D. Partial Payments. Partial payments of
grant funds for completed historic/architectural
rehabilitation activities may be allowed if the
completed historic/architectural rehabilitation
activities relate to discrete, separate improvements
to a property and if the applicant's financial
ability to participate in the program is dependent
upon partial payments throughout the program of the
work.
E. Conditions - Agreement Required. Program
participation shall require the execution of an
agreement between the applicant and the City of
Elgin. The Director or the Director's designee, is
authorized to execute the agreement on behalf of the

city. The agreement shall. include, but is not
limited to, requirements for the applicant as
follows:
1. The applicant shall obtain a
Certificate of Appropriateness for any
construction work to be performed on the
residential structure which is the subject of
the agreement.
2. The applicant shall complete the
historic/architectural rehabilitation of the
residential structure which is the subject of
the agreement in compliance with the Elgin
Design Guideline Manual and in conformance with
the Certificate of Appropriateness within an.
eighteen (18) month period from the date of the
execution of the grant agreement..
3. The applicant shall retain ownership
of such rehabilitated structure for a period
not less than twelve (12) months following the
historic/architectural rehabilitation completion
date as approved by the Director, and may not
convey such real property, in whole or in part,
during said period.
F. Change to Original Scope of Grant
Project. In the event an applicant desires to
modify the scope of a grant project the applicant
must make a written request to the Director within
180 days of execution of the grant agreement. Such
written request shall specifically identify the
proposed modifications to the original scope of the
grant project and the reasons for same. Requests to
modify the scope of a grant project shall not extend
the eighteen (18) month term of a grant agreement.
The modified project shall then be reevaluated based
upon the established criteria for selection. If the
modified project still qualifies for grant funds in
the budget cycle for which the original grant was.
awarded then the grant allocation shall be adjusted
to reflect the modifications to the scope of the
grant project but in no event shall the grant
allocation exceed the original allocated amount. If
the modified grant project fails to qualify pursuant
to the criteria for selection the grant monies will
be deemed forfeited and the next qualified applicant
will be invited to participate in the grant program.
20.15.060 PROGRAM — GENERAL.
A. Evaluations and Compliance with Codes.

1. The Director shall evaluate, or cause
to be evaluated, the exterior of all premises
for which grants are approved by the city
council pursuant to the terms of this program
for compliance with the current, adopted BOCA
Property Maintenance Code, the Elgin Municipal
Code (EMC), Title 19-Zoning Ordinance, and any
other applicable codes and ordinances. Such
evaluation shall be made prior to the execution
of any agreement for a grant in order to
confirm the existence of any violations of
codes or ordinances, and to determine the scope
of the historic/architectural rehabilitation
project.
2. A second evaluation shall be made
prior to the payment of a final grant to
confirm compliance with the Elgin Design
Guideline Manual, the Certificate. of
Appropriateness and other codes and ordinances.
3. In the event the work under the grant
program is completed within the eighteen (18)
month time period as provided by the grant
program agreement,. but other code violations
exist- on the exterior of the property which
r were not identified in the first evaluation, a
compliance time frame. shall be set by the
Director setting forth a schedule for the
correction of such code violations. No grant
funds shall be paid until any and all such code
violations are corrected in conformance with
the compliance time frame. In establishing a
compliance time frame the Director shall
determine the reasonable minimal time necessary
to correct the violations based upon the number
and severity of the violations. Such a
compliance time frame shall not exceed ninety
(90) days unless the Director determines in
writing that adverse weather conditions prevent
the correction of violations within such ninety
(90) day period. In such event the Director
shall determine the additional reasonable time
necessary for the compliant time frame. A
further reinspection of the exterior of the
property shall be conducted at the end of the
compliance time frame. Upon completion of such
reinspection grant funds shall be disbursed to
the property owner if the property meets the
requirements of applicable codes. If the
Director finds that the requirements of
applicable city codes have not been met, any
grant funds shall be deemed forfeited...

4. In the event the work under the grant
program has not been properly completed within
the eighteen (18) month time period as provided
by the grant program agreement or other code
violations on the exterior of the property
remain which were identified in the first
evaluation and which were not included within a
previously executed long term rehabilitation
agreement pursuant to Elgin Municipal Code
Section 2.65.030, as amended, the grant funds
shall be deemed forfeited. Notwithstanding the
foregoing, in the event the work under the
grant program has not been properly completed
within the eighteen (18) month time period as
provided by the grant program agreement the
Director, upon written application by the
owner, may grant an extension of time not to
exceed an additional ninety (90) days when the
owner can establish that the completion of the
work under the grant program has been delayed
or stopped due to accident, strikes, shortages
of materials, extreme weather, acts of God or
other causes not within the owner's reasonable
control. A further reinspection shall be
conducted at the end of any such extension time
frame and if the work under the grant program
has not been properly completed: at the time of
such further reinspection the grant funds shall
be deemed forfeited.
B. Applications and Guidelines. The
Director, or the Director's designee, is hereby
authorized and directed to prepare and distribute
the appropriate application forms and operational
guidelines for the implementation -of this program.
C. Limitations. Grants authorized under this
chapter shall be limited to the reimbursement of
actual expenses incurred for eligible
historic/architectural rehabilitation work, shall be
payable only upon satisfactory proof of payment for
historic/architectural rehabilitation work, and
shall be limited to the amount approved at the time
of execution of the historic/architectural
rehabilitation grant agreement. No grants shall be
approved for any historic/architectural
rehabilitation, repair, reconstruction, or
accessibility improvement activities initiated or
completed prior to the execution of the
historic/architectural rehabilitation grant
agreement.
D. Failure to Perform. Failure to perform

who willfully makes any false statement or

improvement program authorized under the Elgin
Municipal Code. Such person shall also repay any
monies received pursuant to this ordinance.
F. Abstention from Voting by Member of
Heritage Commission with Pending Grant Application.
A member of the Heritage Commission who has a
pending grant application for the
Historic/Architectural Rehabilitation Grant Program
shall abstain from the vote by the Heritage
Commission recommending a project eligibility list
to the City Council.
20.15.070 PROGRAM TARGET AREA DESCRIPTION.
€' Grants made pursuant to this chapter shall be
limited to properties located within a historic
district designated by ordinance of the City Council
or properties designated as a landmark by ordinance
of the City Council."

The administration of the provisions of this
chapter is hereby assigned to the Director of the
Department of Planning and Neighborhood Services
(Director), or the Director's designee.
Applications hereunder shall be made to the
Department of Punning and Neighborhood Services —
which shall have the authority and responsibility
for carrying out the provisions of this chapter.
The Director may consult with the Elgin Heritage
Commission in so carrying out the provisions of this
chapter. The Director ,shall establish any
reasonable rules and procedures not otherwise
established by this chapter that are deemed
necessary for administration of the 75/25
Architectural Rehabilitation Grant Program. Such
rules and procedures shall include scoring criteria
and a minimum point threshold necessary to qualify
for grants for the program. - Such rules and
procedures shall be written and published in
pamphlet form.
20.16.050 75/25 ARCHITECTURAL REHABILITATION GRANT
PROGRAM.
A. Eligible Activities. Grants for the
exterior historic/architectural rehabilitation of
historically/architecturally significant residential
structures shall be limited to actual out of pocket
expenses incurred in meeting the requirements of the
Elgin Design Guideline Manual. Program
participation and historical/architectural
rehabilitation activities must result in full
compliance on the exterior of the property with such
standards as they apply to the exterior of the
structure. In addition, as a condition of any
grant, the exterior of eligible properties must be
brought into full compliance with the current,
adopted BOCA Property Maintenance Code by the end of

the eighteen (1.8) month term of the grant
agreement. Notwithstanding the foregoing
requirement, a property shall be considered eligible
for participation in the grant program if the owner
of the property has either previously or
simultaneously with the execution of grant program
agreement also entered into a long term
rehabilitation agreement for the property pursuant
to Elgin Municipal Code Section 2.65.030, as
amended, providing for the correction of all
exterior code violations. The term of any such long
term rehabilitation agreement shall not exceed
fifty-four (54) months. As a condition of continued
eligibility for the grant program and disbursement
of any grant funds, the property owner must at all
times be in compliance with the schedule for
corrective work in the. long term rehabilitation
agreement.
B. Painting Program. Grants shall also be
available for eligible applicants for the painting
of the exterior qualifying properties. The Director
of the Department of Planning and Neighborhood
Services may deny an application for a paint project
grant upon the Director's determination that an
inappropriate color is proposed to be used on the
exterior of a property. Grants for the painting
project program may be made until funds budgeted, for
such use are exhausted.
C. Applicant Qualifications. Eligible
applicants shall include any person who:
1. Owns a lawful conforming or lawful
nonconforming residential structure which is
more than 50 years old and contains no more
than four. (4) dwelling units; and.
2. Is at least 1.8 years of age.
D. Grant Amounts. The amount of any grant
shall be determined by the Director of the
Department of Planning and Neighborhood Services, or
the Director's designee, in accordance with an
approved estimate of cost for eligible exterior
historic/architectural rehabilitation work. Grants
shall be limited to seventy-five percent (75%) of
eligible, approved project construction costs and
applicable to a minimum project of $2,500 with no
grant to exceed $10,000. Grants for the painting
project program shall be 100% of the cost for the
painting of the exterior of a property with no
painting project grant to exceed $2,500.

E. Partial Payments. Partial payments of F
grant funds for completed historic/architectural
rehabilitation activities may be allowed if the
completed historic/architectural rehabilitation
activities relate to discrete, separate improvements
to a property and if the applicant's financial
ability to participate in the program is dependent
upon partial payments throughout the program of the
work.
F. Conditions - Agreement Required. Program
participation shall require the execution of an
agreement between the applicant and the City of
Elgin. The Director of the Department of Planning
and Neighborhood Services, or the Director's
designee, is authorized to execute the agreement on
behalf of the city. The agreement shall include,
but is not limited to, requirements for the
applicant as follows:
1. The applicant shall obtain a
Certificate of Appropriateness for any
construction work to be performed on the
residential structure which is the subject of
the agreement.
2. The applicant shall complete the
historic/architectural rehabilitation of the
residential structure which is the subject of
the agreement in compliance with the Elgin
Design Guideline Manual and in conformance with
the Certificate of Appropriateness within an
eighteen (18) month period from the date of the
execution of the grant agreement.
3. The applicant shall retain ownership
of such rehabilitated structure for a period
not less than twelve (12) months following the
historic/architectural rehabilitation completion
date as approved by the Director of the
Department of Planning and Neighborhood
Services, and may not convey such real
property, in whole or in part, during said
period.
G. Change to Original Scope of Grant
Project. In the, event an applicant desires to
modify the scope of a grant project the applicant
must make a written request to the director of the
Department of Planning and Neighborhood Services
within 180 days of execution of the grant
agreement. Such written request shall specifically
identify the proposed modifications to the original
scope of the grant project and the reasons for

same. Requests to modify the scope of a grant
project shall not extend the eighteen (18) month
term of a grant agreement. The modified project
shall then be reevaluated based upon the established
criteria for selection. If the modified project
still qualifies for grant funds in the budget cycle
for which the original grant was awarded then the
grant allocation shall be adjusted to reflect the
modifications to the scope of the grant project but
in no event shall the grant allocation exceed the
original allocated amount. If the modified grant
project fails to qualify pursuant to the criteria
for selection the grant monies will be deemed
forfeited and the next qualified applicant will be
invited to participate in the grant program.
20.16.060 PROGRAM - GENERAL.
A. Evaluations and Compliance with Codes.
1. The Director of the Department of
Planning and Neighborhood Services shall
evaluate, or cause to be evaluated, the
exterior of all premises for which grants are
approved pursuant to the terms of this program
for compliance with the current, adopted BOCA
Property Maintenance Code, the Elgin Municipal
Code (EMC), Title 19-Zoning Ordinance, and any
other applicable codes and ordinances. Such
evaluation shall be made prior to the execution
of any agreement for a grant in order to
confirm the existence of any violations of
codes or ordinances, and to determine the scope
of the historic/architectural rehabilitation
project.
2. A second evaluation shall be made
prior to the payment of a final grant to
confirm compliance with the Elgin Design
Guideline Manual, the Certificate of
Appropriateness and other codes and ordinances.
3. In the event the work under the grant
program is completed within the eighteen (18)
month time period as provided by the grant
program agreement, but other code violations
exist on the exterior of the property which
were not identified in the first evaluation, a
compliance time frame shall. be set by the
Director of the Department of Planning and
Neighborhood Services setting forth a schedule
for the correction of such code violations. No
grant funds shall be paid until any and all
such code violations are corrected in

conformance with the compliance time frame. In
establishing a compliance time frame the
Director of the Department of Planning and
Neighborhood Services shall determine the
reasonable minimal time necessary to correct
the violations. based upon the number and
severity of the violations. Such a compliance
time frame shall not exceed ninety (90) days
unless the Director of the Department of
Planning and Neighbourhood Services determines
in writing that adverse weather conditions
prevent the correction of violations within
such ninety (90) day period. In such event the
Director of Planning and Neighborhood Services
shall determine the additional reasonable time
necessary for the compliant time frame. A
further reinspection of the exterior of the
property shall be conducted at the end of the
compliance time frame. Upon completion. of such
reinspection grant funds shall be disbursed -to
the property owner if the property meets the
requirements of applicable coders. If the
Director of. the Department of Planning and
Neighborhood Services finds that the
requirements of applicable city codes have not
been met, any grant funds shall. be deemed
forfeited.
4. In the event the work under the grant
program has not been properly completed within
the eighteen (I8) month time period as provided
by the grant program agreement or other
exterior code violations on the property remain
which were identified in the first evaluation
and which are not included within a previously
executed long term rehabilitation agreement
pursuant to Elgin Municipal Code Section
2.6.5.030, as amended, the grant funds shall be
deemed forfeited.
5. In the event the work under the grant
program is completed within the eighteen (1.8)
month time period as .provided by the grant
program agreement but other code violations on
the property remain which are included within a
previously executed long term rehabilitation
agreement pursuant to Elgin Municipal Code
Section 2.65.030, as amended, the City shall
retain twenty-five percent (25%) of the total
of the grant funds until such time as the
exterior property is brought into compliance
with all applicable codes and. ordinances. In
the event the property owner at any time
violates the schedule for corrective work of

such a long term rehabilitation agreement, any
grants funds not previously paid shall be
deemed forfeited.
B. Applications and Guidelines. The Director
of the Department of Planning and Neighborhood
Services, or the Director's. designee, is hereby
authorized and directed to prepare and distribute
the appropriate application forms and operational
guidelines for the implementation of this ordinance.
C. Limitations. Grants authorized under this
chapter shall be limited to the reimbursement of
actual expenses .incurred for eligible
historic/architectural rehabilitation work, shall be
payable only upon satisfactory proof of payment for
historic/architectural rehabilitation work, and
shall be limited to the amount approved at the time
of execution of the historic/architectural
rehabilitation grant agreement. No grants shall be
approved for any historic/architectural
rehabilitation, repair, reconstruction, or
accessibility improvement activities initiated or
completed prior to the execution of the
historic/architectural rehabilitation grant
agreement.
D. Failure to Perform. Failure to perform
the obligations of the historic/architectural
rehabilitation grant agreement shall require the
applicant to make repayment of any grant monies
received.
E. Penalty for Misrepresentation. Any person
who willfully makes any false statement or
misrepresentation in obtaining a grant under the
provisions of this chapter shall be subject to a
fine of not less than one hundred (100) nor more
than five hundred (500) dollars and shall forfeit
the right to future participation in any property
improvement program authorized under the Elgin
Municipal Code. Such person shall also repay any
monies received pursuant to this ordinance.
F. Grants authorized pursuant to this chapter
shall be limited to owner -occupied premises of not
more than four (4) dwelling units in which the
owner -occupant household conforms to the guidelines
and definitions of low or moderate income as defined
by the U.S. 'Department of Housing and Urban
Development Community Development Block Grant
Regulations at 24 C.F.R. 570.3, as amended.

G. Grants authorized pursuant to this chapter
may be combined with other city -administered or
city -sponsored grants. In no event, however, shall
such combined grant payments exceed 100% of any
project costs; however, any previous city
grant -funded projects must be completed prior to
execution of a new grant agreement.
20.16.070 PROGRAM TARGET AREA DESCRIPTION.
Grants made pursuant to this chapter shall be
limited to properties located within a historic
district designated by ordinance of the City Council
or properties designated as a landmark by ordinance
of the City Council.
20..16.080 USE OF ANY EXCESS FUNDS FOR THE 50/50
HISTORIC/ARCH.ITE.CTURAL REHABILITATION
GRANT PROGRAM.
During the first nine months of each calendar
year any funds budgeted for the 75/25
Historic/Architectural Rehabilitation Grant Program
shall be utilized for such purpose. After such
initial nine months in any calendar year any
remaining unallocated or unused funds for the 75/25
Historic/Architectural Rehabilitation Grant Program
may be reallocated for qualifying properties under
the 50/50 Historic/Architectural Rehabilitation
Grant Program."
Section 3. That all ordinances or parts of ordinances in
conflict with the provisions of this ordinance be and are hereby
repealed.
Section 4. That this ordinance shall be in full force and
effect upon its passage and publication in the manner provided
by law.

WHEREAS, the next Decennial Census will be taken in the
year 2000, and political representation to the United States
House of Representatives, state legislatures and local
governments is determined by the Decennial Census, and the City
Council of the City of Elgin recognizes the equal importance of
each resident in the 2000 census count; and
WHEREAS, the City of Elgin has agreed to be one of 39,000
government entities in partnership with the U.S. Bureau of the
Census; and
WHEREAS, the City of Elgin understands that its primary
role in this partnership is to formulate a Complete Count
Committee that should include representatives from the following
areas: government; education, media, religious and
community --based organizations.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF ELGIN, ILLINOIS:

Section 1. Census 2000 Complete Count Committee Created.
There is hereby created the City of Elgin Census 2000 Complete
Count Committee. The purpose and duties of the committee are to
support a complete census count in the City of Elgin in the year
2000 including supporting data collection support activities,
recruiting activities and promotional activities for the year
2000 census.
Section 2. Membership, The Census 2000 committee shall be
composed of 9 members to be appointed by the Mayor with the
consent of the City Council. The Mayor with the consent of the
City Council shall designate the chairperson of the committee.
One member of the committee shall be a representative of School
District U-46, one member shall be a representative of Elgin
Community College, one member shall be a representative of a
local news organization, one member shall be a representative of
the City of Elgin, one member shall be a representative of Elgin
township, one member shall be a representative from the
religious community, one member shall be a representative of a
community organization representing members who may be
,undercounted by the official census and 2 members shall be
appointed from the public at large.
Section 3. Meetings. The members of the Census 2000
Complete Count Committee shall meet as soon as practical and
shall establish regular meeting dates. The Census 2000 Complete
Count Committee may establish rules regarding the conduct of
meetings and where not otherwise provided Robert's Rules of
Order, Newly Revised, shall apply. Minutes shall be taken at
all meetings. All meetings shall be conducted in accordance
with.the Open Meetings Act.
Section 4, Staff. The City Manager, from time to time, in
her discretion, shall make available the services of the city's
professional staff to aid and cooperate with the Census 2000
Complete Count Committee in,carrying out its responsibilities.
Section 5. Powers and Duties. The Census 2000 Complete
Count Committee shall have the power and duty to promote a
complete count in the year 2000 census in the City of Elgin
including but not limited to supporting data collection support
activity, recruiting activities and promotional activities in
connection with the year 2000 census.
Section 6. Dissolution of Committee. The Census 2000
Complete Count Committee shall automatically be dissolved as of
December 31, 2000.

City Clerk, be acid are hereby authorized and directed to execute
a facade improvement program agreement on behalf of the City of
Elgin with William Vincent for the property commonly known as 7
S. State Street, a copy of which is attached hereto and made a
part hereof by reference.

AUTHORIZING ACCEPTANCE OF UNITED STATES DEPARTMENT OF JUSTICE.
FEDERAL LOCAL LAW ENFORCEMENT GRANT
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ELGIN,
ILLINOIS, that the City of Elgin, Illinois hereby accepts the

United States Department of Justice Federal Local Law
Enforcement Grant in the amount of $97,879. f`
BE IT FURTHER RESOLVED that the City of Elgin Gang and Drug
Task Force be and is hereby appointed as the advisory board to
consider and recommend to the City Council how such grant of
$97,879 and the City of Elgin's matching expenditure or $10,879
should be expended to reduce crime and improve public safety.
BE IT FURTHER RESOLVED that Joyce A. Parker, City Manager,
is hereby authorized and directed to execute all documents
necessary in conjunction with the subject grant program.

ILLINOIS, that Ed Schock, Mayor, and Dolonna Mecum, City Clerk,
be and are hereby authorized and directed to execute an
intergovernmental agreement on behalf of the City of Elgin with
Kane County for access and improvements to Randall Road at
Holmes Road, a copy of which is attached hereto and made a part
hereof by reference.

BE IT FURTHER RESOLVED that Resolution No. 99--231 adopted
August 25, 1999 authorizing an earlier version of this
intergovernmental agreement be and is hereby repealed.
