COUNCIL OF THE CITY OF ELGIN, ILLINOIS
COUNCIL-MANAGER FORM OF GOVERNMENT
REGULAR MEETING
A regular meeting of the Council of the City of Elgin, Illinois,
was held on July 10, 1991, in the Council Chambers. The
meeting was called to order by Mayor VanDeVoorde at 8:00 p.m.
The Invocation was given by Reverend Robert Linstrom, and the
Pledge of Allegiance was led by Councilman Fox.
ROLL CALL
Roll call was answered by Councilmembers Fox, Moylan, Popple,
Walters, Yearman, and Mayor VanDeVoorde. Councilman Gilliam
arrived at 8:05 p.m. Absent: None.
MINUTES OF THE JUNE 26 1991 COUNCIL MEETING APPROVED AS
PUBLISHED
Councilwoman Yearman made a motion, seconded by Councilwoman
Moylan, to approve the June 26, 1991, Council Minutes as
published. Yeas: Councilmembers Fox, Moylan, Walters,
Yearman, and Mayor VanDeVoorde. Nays: None. Abstain:
Councilwoman Popple.
BID AWARDED FOR TELEPHONE EQUIPMENT FOR NEW FIRE STATIONS
Councilwoman Popple made a motion, seconded by Councilman
Walters, to award this contract to the overall low bidder,
Proper Communications, Inc., for $16,805.65. Yeas:
Councilmembers Fox, Moylan, Popple, Walters, Yearman, and
Mayor VanDeVoorde. Nays: None.
BID AWARDED FOR FLOOR SCRUBBER FOR HEMMENS
Councilwoman Moylan made a motion, seconded by Councilman
Fox, to award this contract to the overall low bidder,
Jani-Serv, Division of W.W. Grainger, for $6,904.08. Yeas:
Councilmembers Fox, Moylan, Popple, Walters, Yearman, and
Mayor VanDeVoorde. Nays: None.
BID AWARDED FOR UNDERGROUND TANK REMOVALS
Councilman Fox made a motion, seconded by Councilwoman
Moylan, to award this contract to the overall low bidder,
Ainley Tank Testing & Repair, Inc., for a total estimated
cost of $115,815. Yeas: Councilmembers Fox, Moylan, Popple,
Walters, Yearman, and Mayor VanDeVoorde. Nays: None.
Councilman Gilliam arrived.

Councilwoman Moylan made a motion, seconded by Councilwoman
Popple, that contracts (effective through December 31, 1992)
be awarded in accordance with the Memorandum dated July 3,
1991, as follows:
To Kale Uniforms for the purchase of Items 1 through 18,
20 through 26, and 40 through 47, as contained in
Attachment A of the aforesaid Memorandum.
To Ray O'Herron Equipment Company for the purchase of
Item 19 and 27 through 39 as contained in Attachment A
of the aforesaid Memorandum.
Yeas: Councilmembers Fox, Gilliam, Moylan, Popple, Walters,
Yearman, and Mayor VanDeVoorde. Nays: None.
Councilwoman Yearman made a motion, seconded by Councilman
Walters, to remove Petition S3-91 from the table. Yeas:

Councilman Fox made a motion, seconded by Councilwoman
Popple, to approve Petition S3-91, subject to the
recommendations of the Land Use Committee, and with the
following breakdown of lot sizes as shown on the preliminary
plat: In the south half, 109 lots which are 9100 square feet
or larger; in the north half, 72 lots between 7500-8000
square feet; 51 lots between 8000-9000 square feet; and the
remaining 70 lots over 9000 square feet. Yeas:
Councilmembers Fox, Gilliam, Popple, Walters, Yearman, and

RESOLUTION
AUTHORIZING EXECUTION OF A FACADE IMPROVEMENT
PROGRAM AGREEMENT
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ELGIN,
ILLINOIS, that Larry L. Rice, City Manager, and Dolonna
Mecum, City Clerk, be and are hereby authorized and directed
to execute a facade improvement program agreement on behalf
of the City of Elgin with Jerry L. Goldstein for the property
commonly known as 107 and 109 E. Highland Avenue, and 25,
251 and 27 North Grove Avenue, a copy of which is attached
hereto and made a part hereof by reference.

AN ORDINANCE
RECLASSIFYING PROPERTY LOCATED ON THE SOUTH SIDE OF
EAST CHICAGO STREET, EAST AND WEST OF CERESA DRIVE, AND
GRANTING A SPECIAL USE FOR A PLANNED UNIT DEVELOPMENT
WHEREAS, written application has been made to reclassify
certain property located on the south side of East Chicago
Street, east and west of Ceresa Drive from M-1 Limited
Manufacturing District to R-4 General Residence District and
for a special use for a residential and commercial planned
unit development; and
WHEREAS, after due notice in the manner provided by law
the Land Use Committee conducted a public hearing concerning
said application and has submitted its written findings and
recommendation that the subject property be reclassified and
a special use for a residential and commercial planned unit
development be granted; and
WHEREAS, the City Council of the City of Elgin,
Illinois, has reviewed the findings and recommendation of the
Land Use Committee and concurs in its recommendation.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF
THE CITY OF ELGIN, ILLINOIS:
Section 1. That Chapter 19.08, Section 19.08.020
entitled "Zoning District Map" of the Elgin Municipal Code,
1976, as amended, be and the same ,is hereby further amended
by adding thereto the following paragraph:
"The boundaries hereinbefore laid out in the
'Zoning District Map', as amended, be and are hereby
altered by excluding from M-1 Limited Manufacturing
District and including in the R-4 General Residence
District the following described property:
Parcel Three: That part of the South half of
Section 18 and part of the Northeast quarter of

of the Third Principal Meridian described as

commercial planned unit development located on the south side
of East Chicago Street, east and west of Ceresa Drive, Elgin,
Illinois, legally described as follows:
"Parcel One: That part of the South half of
Section 18 and part of the Northeast quarter of
Section 19, all in Township 41 North, Range 9 East
of the Third Principal Meridian described as
follows: Beginning at the Northwest corner of said
Northeast quarter; thence southerly along the West
line of said Northeast quarter 850.0 feet; thence
easterly at right angles to the last described
course a distance of 100.0 feet; thence northerly
parallel with the West line of said Northeast
quarter a distance of 950.01 feet; thence westerly
parallel with the South line extended easterly of
the Southwest quarter of Section 18, township and
range aforesaid and parallel with the South line of
said Southwest quarter 723.49 feet, thence southerly
along a line forming an angle of 98 degrees 50

1. Substantial conformance with the Planned
Unit Development Plan:
a. Preliminary Planned Unit Development
Site Plan prepared by Jen Land 'Design, Inc.
dated February 4, 1991 and revised May 9, 1991.
b. Preliminary Landscape Plan prepared by
Jen Land Design, Inc. dated February 4, 1991
and revised May 9; 1991.
C. Phasing Plan prepared by Jen Land
Design, Inc. dated May 9, 1991 and revised
June 5, 1991.
d. Engineering Plans prepared by Everett
Scheflow Engineers dated February 8, 1991.
e. Building Elevations and Floor Plans.
2. A`written description of efforts that will
be taken to preserve and protect, or mitigate the
jurisdictional wetland areas identified in the
report prepared by K. Struck Companies, Inc., dated
May 29, 1990.
3. The Planned Unit Development Site Plan
contemplates gradings, filling, and dredging in
areas currently designated as flood fringe and/or
floodway, for the purposes of constructing
buildings, a road and bridge, and stormwater
detention in these areas. The City will require
conditional letters of approval from the Army Corps
of Engineer, and IDOT Division of Water Resources
(DWR) and FEMA prior to final plat approval. No
construction permits shall be issued until a'final
letter of map revision has been issued by FEMA and
DWR.
4. Documentation demonstrating that the six
inch watermains located in the cul-de-sacs will have
adequate capacity to serve the proposed residential
dwelling units.
5. Cul-de-sac streets and common parking areas
shall be privately owned and maintained, and shall
be indicated as such on the preliminary plan.
6. Payment of the local share of the cost of
future - signalization at the East Chicago
Street/Ceresa Drive intersection. Payment due prior
„>- to final plat approval of the first phase of the
development.

7. Indicate alternatives for a second means of %
access and stormwater detention areas, to be
constructed in the event that the location of these
facilities in the Poplar Creek floodplain is not
approved. Submit evidence of all, regulatory agency
approvals prior to final plat approval of the first
phase of the development.
8. Construct all intersection improvements
required by IDOT concurrent with the first phase of
the development.
9. Construction of Phase II of the proposed
development shall not begin until the construction
of the bridge is completed.
10. Dedicate the Poplar Creek floodplain to the
City of Elgin.
11. Final Engineering Plans and Specifications
shall include detailed plans describing measures to
be taken to preserve significant vegetation along
the ridge line above the Poplar Creek floodplain.
12. Compliance with Elgin Municipal Code
Title 17, Development Impact Fees..
13. Compliance with all other applicable codes
and ordinances.
Section 4. That the special use granted herein shall
expire if not established within one year from the date of
passage of this ordinance.
Section 5. That this ordinance shall be in full force
and effect from and after its passage in the manner provided
by law.,

AMENDING THE ELGIN MUNICIPAL CODE BY ADDING TO THE LIST OF
STOP INTERSECTIONS
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ELGIN,
ILLINOIS:
Section 1. That Title 11, Chapter 11.32 of the Elgin
Municipal Code, 1976, as amended,, be and is hereby further
amended by adding to the list of stop intersections under
Section 11.32.030 the following:
Billings Street. All vehicles being operated on
Billings Street must stop at Washburn Street before
crossing or entering the same.
DuPage Street. All vehicles being operated on
DuPage Street must stop at Warwick Place before
crossing or entering the same.
Griswold Street. All vehicles being operated on
Griswold Street must stop at Oak Street before
crossing or entering the same.
Erie Street. All vehicles being operated on
Erie Street must stop at Jane Drive before crossing
or entering the same.
Oak Street. All vehicles being operated on Oak
Street must stop at Griswold Street before crossing
or entering the same.
Standish Street. All vehicles being operated on
Standish Street must stop at Woodward Street before
crossing or entering the same.
Warwick Place. All vehicles being operated on
Warwick Place must stop at DuPage Street before
crossing, or entering the same.
Washburn Street. All vehicles being operated on
Washburn Street must stop at Billings Street before
crossing or entering the same.

AUTHORIZING THE SALE OF DICTAPHONE LOGGING RECORDER AND TAPES
WHEREAS, in the opinion of at least three -fourths of the
corporate authorities of the City of Elgin it is no longer
necessary or useful to or in the best interests of the City
of Elgin to retain a 20-channel dictaphone logging recorder
and 51 logging recorder tapes now owned by it; and
WHEREAS, Central Wisconsin Airport of Mosinee, Wisconsin
has offered to purchase said personal property for the sum of
$6,300.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF ELGIN, ILLINOIS:
Section 1. Pursuant to Section 11-76-4 of the Illinois
Municipal Code, ill. Rev. Stat., Ch. 24, Sec. 11-76-4, the
City Council finds that the 20-channel dictaphone .logging
recorder and 51 logging recorder tapes now owned by the City

AN ORDINANCE
GRANTING A SPECIAL USE FOR A COMMUNITY SERVICE FACILITY
AT 695 SOUTH STATE STREET
WHEREAS, written application has been made for a special
use for the establishment, maintenance and operation of a
community service facility at 695 South State Street; and
WHEREAS, the Land Use Committee conducted a public
hearing after due notice by publication and has submitted its
findings of fact and recommended approval; and
WHEREAS, the City Council of the City of Elgin concurs
in the findings and recommendation of the Land Use Committee.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF
THE CITY OF ELGIN, ILLINOIS:

1. The number of adults temporarily residing
at the crisis residential center at any given time
shall be limited to eight.
2. The average length of stay for residents
shall be two weeks (14 days).
3. Compliance with the site plan prepared by
Halsey Construction Company and dated May 25, 1991,
revised July 1, 1991.
4. Substantial conformance with the
petitioner's statement.
5. Compliance with all other applicable codes
and ordinances.
Section 3. That Ordinance No. G-1626 entitled "An
Ordinance Granting a Special Use for a Geriatric Day Care
Center" passed on September 26, 1973 be and is hereby
repealed.
Section 4. That Ordinance No. G31-77 entitled "An
Ordinance Granting a Special Use for a Transitional Care
Program for Ex -Drug Abusers" passed on June 22, 1977 be and
is hereby repealed.
Section 5. That the special use granted herein shall
expire if not established within one year from the date of
passage of this ordinance.
Section 6. That this ordinance shall be in full force
and effect after its passage in the manner provided by law.

ANNEXING CERTAIN TERRITORY TO THE CITY OF ELGIN
(East of Randall Road, North of the Northwest Tollway)
WHEREAS, a petition signed by all the owners of record
of certain territory has been filed with the City Clerk
requesting annexation of said territory to the City of Elgin,
Illinois; and
WHEREAS, said petition includes therein a statement
under oath by all the owners of .record that no electors
reside on the subject territory; and
WHEREAS, said territory is contiguous to the City of
Elgin and is not within the corporate limits of any
municipality; and
WHEREAS, legal notice of the intent of the City of Elgin
to annex said territory have been forwarded to all public
bodies required to receive said notice in the manner provided
by law.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF

WHEREAS, the territory herein described has been annexed

said territory in the M-2 General Manufacturing District; and
WHEREAS, after due notice in the manner provided by law

said application and has submitted its written findings and

Illinois, has reviewed the findings and recommendations of

RECOGNIZE PERSONS PRESENT

Councilman Gilliam requested that the Council be furnished
with information regarding other taxes in other communities
at the meeting when the hotel/motel tax is again considered.
Bill Sarto furnished each of the councilmembers with material
he has compiled since he last addressed the Council regarding
electromagnetic fields. The material included a copy of the
complaint which he has filed with the Illinois Commerce
Commission, press releases, and reports with reference to
overhead versus underground lines and health issues. He
stated that one of the reports indicated that 83 separate
studies have been conducted which indicate that there is some
health risk involved with electromagnetic fields. He further
stated that he didn't know how they could talk about it being
inconclusive or how many studies would have to be taken
before people understand that there is truly a risk.
He asked for the support of the council as a whole, or from
the individual council members, regarding his complaint
before the Illinois Commerce Commission. He would like to
take a letter of support to the ICC when he appears before it
for hearing.
Mayor VanDeVoorde advised Mr. Sarto that the City
Environmental Committee is also looking into this matter, and
the material he furnished will be turned over to the
committee.

COUNCIL-NANAGER FORM OF GOVERNMENT
REGULAR MEETING
A regular meeting of the Council of the City of Elgin, Illinois,
was held on July 24, 1991, in the Council Chambers. The
meeting was called to order by Mayor VanDeVoorde at 8 p.m. The
Invocation was given by Reverend Harold Ross, and the Pledge of
Allegiance was led by Councilman Gilliam.

be and is hereby further amended by adding Chapter 10.66 to
read as follows:

Chapter 10.66
10.66.010 Prohibition declared.
It is declared unlawful for any parent, legal guardian or
other person 18 years of age or older to willfully, knowingly
or recklessly permit any minor under the age of 18 years to
come into unsupervised possession of any of the following
items:
1. Bowie, switchblade, ballistic knives, or other
edged weapons as defined by Illinois Revised Statutes, Chapter
38, Paragraph 24-1(1);
2. Metallic knuckles;
3. Martial arts weaponry, including, but not limited
to, num chucks and throwing stars;
4. Arrows designed for firing from a bow or crossbow
device;
5. Stun gun or taser;
6. Any device or attachment of any kind designed, used
or intended for use in silencing the report of a firearm;
7. Machine gun as defined by Illinois Revised Statutes,
Chapter 38, Paragraph 24-1; or
8. Any bomb, bomb -shell, grenade, bottle or other
container containing an explosive substance of over
one -quarter ounce for like purposes, such as, but not limited
to, black powder bombs, molotov cocktails, pipe -bombs or
artillery projectiles.
9. Firearms, or the ammunition therefore, as defined by
Illinois Revised Statutes, Chapter 38, Paragraph 83-1.1;
10. Fireworks, as defined by Illinois Revised Statutes,
Chapter 127}, Paragraph 102.
10.66.020 Definitions.
"Knowingly" is defined as having general knowledge of, or
reason to know, or a belief or ground for belief which
warrants further inquiry or inspection.
"Recklessly" is defined as acting in a manner or under
circumstances such as evince disregard of, or indifference to,
consequences involving danger to the property, life, or safety
of others.

"Unsupervised" is defined as a lack of visual or oral
oversight coupled with lack of sufficient proximity to obtain
immediate control over the item or minor.
"Willful" is defined as proceeding from a conscious and
voluntary intentional motion of the will.
10.66.030 Exceptions.
It shall be an affirmative defense to this chapter if a
minor in possession of a firearm holds a valid hunting license
or FOID card pursuant to Illinois Revised Statutes,
Chapter 31, Paragraphs 3.1 and 83-2, et seq., neither the
minor, nor the person to be charged is otherwise in violation
of any law related to the sale or possession of weapons,
including, but not limited to: Illinois Revised Statutes,
Chapter 38, Paragraphs 24-3.1(1), 24-3(a) or 24-3.3, and the
minor is engaged in hunting, supervised target shooting, or
the otherwise legal transportation of a firearm for such
purposes.
10.66.040 Penalty.
Any person violating the provisions of this chapter shall
be punished by a fine of not less than $100.00 nor more than
$1,000.00.
Section 2. That all ordinances or parts of ordinances in
conflict with the provisions of this ordinance be and are
hereby repealed.
Section 3. This ordinance and every provision thereof
shall be deemed separable, and the invalidity of any portion
thereof shall not affect the validity of any other portion of
this ordinance.
Section 4. That this ordinance shall be in full force
and effect ten days after its passage and publication in the
manner provided by law.

RECOGNIZE PERSONS PRESENT
Nonie McKim, President of the Elgin Area Performing Arts,
requested the sum of $5,000 from the City to assist funding
performances of the 1991 Nutcracker Suite Ballet, which has
been performed at Hemmens for the past 21 years.

Approximately 2400 students annually are introduced to the
ballet as an art form through school performance programs.
Ms. McKim also stated that she disagrees with the City
charging a "head tax" for performances given for school
children.
Mayor VanDeVoorde informed Ms. McKim that the Council is in
the process of forming an Arts Council, which will review and
make recommendation regarding requests for funding.
Councilman Walters stated that this request had been
presented to the Hemmens Advisory Board, and he thought that
a recommendation was going to come from the Staff to the
Council.
It may be necessary to cancel the 1991 performance of the
Nutcracker Suite Ballet unless Elgin Area Performing Arts is
able to raise all the necessary funds.
Councilwoman Popple made a motion, seconded by Councilman
Fox, to have the City Manager meet with the Nutcracker
Suite people to try to accommodate them in some manner, and
to have a recommendation brought back to the Council at its
August 14, 1991, meeting. Yeas: Councilmembers Fox,
Gilliam, Popple, Walters, Yearman, and Mayor VanDeVoorde.
Nays: None.
Clement Baranowski of 278 Douglas Avenue informed the
Council that he had lived in Elgin approximately 20 years
ago, moved out of the area, and is now back. Since being
back in Elgin, he has noticed that there are a lot of cars
parked on lawns.
Planning Director Dahlstrom stated that any place a vehicle
is parked must be surfaced. City Manager Rice will find out
who is responsible for enforcement of this provision of the
Code.
Mr. Baranowski also complained about excessive smoke from
charcoal grills, and advised the Council that there are
municipalities that are banning the use of charcoal and
requiring people to use gas grills.
Mr. Baranowski also addressed the Council with reference to
the playing of loud music, which seems to attract a
particular group of people.
The Mayor suggested that Mr. Baranowski discuss these
complaints with the City Manager.
Robert Soderstrom of 104 South State Street advised the
Council that he is going to do everything possible to
comply with the court orders which he recently received. He
stated that he needs a job and has always been interested in
recycling.

meetings.
Councilwoman Popple made a motion, seconded by Councilwoman
Yearman, to adjourn the meeting and go into Executive Session
for the purpose of discussing land acquisition and personnel.
