COUNCIL-MANAGER FORM OF GOVERNMENT
RESCHEDULED REGULAR MEETING
A rescheduled regular meeting of the Council of the City of
Elgin, Illinois, was held on November 6, 1991, in the Council
Chambers. The meeting was called to order by Mayor VanDeVoorde
at 8:05 p.m. The Invocation was given by Reverend Joleen
Gleasman, and the Pledge of Allegiance was led by Councilman
Gilliam.
ROLL CALL
Roll call was answered by Councilmembers Fox, Gilliam, Moylan,
Popple, Walters, Yearman, and Mayor VanDeVoorde. Absent: None.

to approve the October 23, 1991 Council Minutes as published.

Councilwoman Moylan made a motion, seconded by Councilwoman

RESOLUTION
DETERMINING AMOUNTS OF MONEY ESTIMATED TO BE NECESSARY
TO BE RAISED BY TAXATION UPON TAXABLE PROPERTY IN THE
CITY OF ELGIN AND PROVIDING FOR NOTICE AND A
PUBLIC HEARING THEREON
WHEREAS, the Truth in Taxation Act provides that if the
ad valorem property tax levy for the current year is estimated
to exceed 105% of the extension for the prior year, a public
hearing shall be held after notice in the manner required by
the Act; and
WHEREAS, it is necessary and desirable to determine
whether the proposed 1991 tax levy is less than 105% of the
1990 property tax levy as proposed.

NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF ELGIN, ILLINOIS:
1. That it hereby finds and determines that the 1990 ad
valorem property tax levy excluding debt services as extended
was $9,541,297 against taxable property in the City of Elgin.
2. That it hereby finds and determines that the amounts
of money extended estimated to be necessary to be raised by ad
valorem taxation upon taxable property in the City of Elgin
for the year 1991 is $11,367,677.
3. That it hereby finds and determines that the amounts
of money estimated to be necessary to be raised by taxation
upon taxable property for the year 1991 is in excess of 105
of the amount of ad valorem property tax extended for the year
1990 against taxable property in the City of Elgin.
4. That a public hearing shall be held on November 20,
1991 at 8:00 p.m. in the City Council Chambers, 150 Dexter
Court, Elgin, Illinois concerning the 1991 property tax levy.
5. That the City Clerk shall cause publication of a
notice of said public hearing to be made in a newspaper of
general circulation published in the City of Elgin in the
manner provided by law.

PROHIBITING LOITERING FOR DTHE NPURPOSE OF ENGAGING IN
PROSTITUTION -RELATED OR DRUG -RELATED ACTIVITIES
WHEREAS, innocent persons, especially children, who come
into contact with illegal prostitution -related and drug
related activities within the City of Elgin and their own
neighborhoods are seriously and adversely affected; and
WHEREAS, the Mayor and City Council have been made
acutely aware by citizens and citizen groups of this City as
to the increased, illegal prostitution -related and
drug -related activities occurring in certain neighborhoods
within the City; and
WHEREAS, the Mayor and City Council find and declare that
prostitution -related and drug -related activities are a
City-wide problem of such substantial and significant
proportions that it threatens the health, safety, and welfare
of this City, particularly children, so as to require the
immediate passage of an ordinance prohibiting loitering for
the purpose of engaging in prostitution -related or
drug -related activities; and
WHEREAS, the City of Elgin is authorized to enact this
ordinance pursuant to its police power and its home rule power.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF ELGIN, ILLINOIS:
Section I. That Chapter 10.36 of the Elgin Municipal
Code, 1976, as amended, be and is hereby further amended by
adding the following:
10.36.020 Loitering for the purpose of engaging
in prostitution -related activity.

or near any thoroughfare, or place open to the
public, for the purpose of engaging in an act of
prostitution contrary to any provisions of the
prostitution -related portions of Article 11 of the
Illinois Criminal Code, Ill. Rev. Stat., Ch. 38,.

local, state, or federal law prohibiting

b. Among the circumstances which may be
considered in determining whether such purpose is
"manifested" are the following:
1. such person is a known unlawful drug
user, possessor, or seller. For purposes of
this ordinance, a "known unlawful drug user,
possessor, or seller" is a person who has,
within the knowledge of the arresting officer,
been convicted in any court within this state
of any violation involving the use, possession,
or sale of any of the substances referred to in
the drug laws within the previous year or such
person has been convicted of any of the
provisions of said drug laws or substantially
similar laws of any political subdivision of
this state or of any other state or
jurisdiction within the previous year; or a
person who displays physical characteristics of
drug intoxication or usage, such as "needle
tracks", or a person who possesses drug
paraphernalia as defined in the Illinois Drug
Paraphernalia Control Act, Ill. Rev. Stat., Ch.
561, Par. 2101 et seq., as amended;
2. such person is currently subject to an
order of court prohibiting his or her presence
in a high drug activity geographic area and
such person is located in such an area;
3. such person behaves in such a manner as
to raise a reasonable suspicion that he or she
is about to engage in or is then engaged in an
unlawful drug -related activity, including, but
not limited to, such person acting as a
"lookout";
4. such person is a known member of a
"gang" or association which has as its purpose
illegal drug activity; for purposes of this
ordinance, a "known" member of a "gang" is a
person, who has, within the knowledge of the
arresting officer, been convicted in any court
within the United States, within the previous
year, of any violation involving illegal gang
activity.
5. such person transfers small objects or
packages for currency in a furtive fashion;
6. such person takes flight upon the
appearance of a police officer;
7. such person manifestly endeavors to
conceal himself or herself or any object which

reasonably could be involved in an unlawful
drug -related activity;
8. The area involved is known to be an area
of unlawful drug use and trafficking. For
purposes of this ordinance, an area "known to
be an area of unlawful drug use" is a
specifically defined geographic area,
designated by the Chief of Police to be a known
area of unlawful drug use; said designation
being based on empirical data;
C. No determination of intent shall be made
absent an affirmative act by the person to be
charged, which act or acts, when taken in context of
the totality of the surrounding circumstances, shall
constitute a substantial step towards the violation
of the aforementioned drug laws.
Section 2. That this ordinance and every provision
thereof shall be deemed separable and the invalidity of any
portion thereof shall not affect the validity of any other
portion of this ordinance.
Section 3. That all ordinances or parts thereof,
inconsistent with the terms and provisions of this ordinance
are hereby repealed.
Section 4. That this ordinance shall be in full force
and effect ten days after its passage and publication in the
manner provided by law.

BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ELGIN,
ILLINOIS, that Nancy Epping be and is hereby reappointed as a
member of the Elgin Area Convention and Visitors Bureau for a
term to expire December 31, 1993.
BE IT FURTHER RESOLVED that Ed Spurr be and is hereby
reappointed as a member of the Elgin Area Convention and
Visitors Bureau for a term to expire December 31, 1993.

WHEREAS, the City of Elgin has heretofore entered into a
contract with Ainlay Tank Testing and Repair, Inc. for the
removal of underground storage tanks; and
WHEREAS, it is necessary and desirable to modify the
terms of the contract as is described in Change Order No. 2,
attached hereto.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF. THE
CITY OF ELGIN, ILLINOIS, that Larry L. Rice, City Manager, be
and is hereby authorized and directed to execute Change Order
No. 2, a copy of which is attached hereto and made a part

AN ORDINANCE
ANNEXING CERTAIN TERRITORY TO THE CITY OF ELGIN
(South Side of Summit Street, West of Commonwealth Edison
Right of Way)
WHEREAS, a petition signed by all the owners of record of
certain territory has been filed with the City Clerk
requesting annexation of said territory to the City of Elgin,
Illinois; and
WHEREAS, said petition includes therein a statement under
oath by all the owners of record that no electors reside on
the subject territory; and
WHEREAS, said territory is Contiguous to the City of
Elgin and is not within the corporate limits of any
municipality; and
WHEREAS, legal notice of the intent of the City of Elgin
to annex said territory have been forwarded to all public
bodies required to receive said notice in the manner provided
by law.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF ELGIN, ILLINOIS:
Section 1. That the following described territory be and
is hereby annexed to the City of Elgin:
The East 70.00 feet, as measured at right
angles, of Lot 6 of Benhardt's Subdivision, being a
subdivision of part of the Southwest Quarter of
Section S, Township 41 North, Range 9 East of the
Third Principal Meridian. Being situated in Hanover
Township, Cook County, Illinois and containing 0.59'
acre more or less.
Section 2. That a certified copy of this ordinance
together with an accurate map of the territory annexed shall

AN ORDINANCE
CLASSIFYING CERTAIN NEWLY ANNEXED TERRITORY
(South Side of Summit Street, West of Commonwealth Edison
Right of Way)
WHEREAS, the territory herein described has been annexed
to the City of Elgin; and
WHEREAS, written application has been made to classify
said territory in the R-2 single family residence district; and
WHEREAS, the Land Use Committee considered the
application and has recommended approval; and
WHEREAS, the City Council of the City of Elgin, Illinois,
concurs in the recommendation of the Land Use Committee.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF ELGIN, ILLINOIS:
Section 1. That Chapter 19.08.020, entitled "Zoning
District Map" of the Elgin Municipal Code, 1976, as amended,

be and the same is hereby further amended by adding thereto
the following paragraph:
"The boundaries hereinbefore laid out in the
'Zoning District Map', as amended, be and are hereby

AMENDING CHAPTER 3.75 ENTITLED "CULTURAL ARTS COMMISSION"
OF THE ELGIN MUNICIPAL CODE, 1976, AS AMENDED
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ELGIN,
ILLINOIS:
Section 1. That Chapter 3.75 entitled "Cultural Arts
Commission of the Elgin Municipal Code, 1976, as amended, be
and is hereby further amended by amending Section 3.75.020 to
read as follows:
3.75.020 Membership; appointment and term of office.
The Commission shall consist of ten (10)
members, all of whom shall be appointed by the Mayor
with the advice and consent of the City Council.
A. All members shall be residents of the City
of Elgin who are known to have an interest and
expertise in the functions of the Commission and who
shall be voting members of the Commission.
B. One member shall be a member of the Hemmens
Advisory Board and shall be a non -voting ex-officio
member of the Commission.
C. One member shall be a member of the City
Council of the City of Elgin and shall be an
ex-officio member of the Commission and shall vote
only in the event of a tie vote.
Section 2. That Chapter 3.75entitled "Cultural Arts
Commission" of the Elgin Municipal Code, 1976, as amended, be
and is hereby further amended by amending Section 3.75.030A to
read as follows:
A. Upon creation of the Commission and the
initial appointment of residents of Elgin as voting
members, two such members shall be appointed for

RESOLUTION
ENDORSING RIVERBOAT GAMBLING IN ELGIN, ILLINOIS
WHEREAS, the State of Illinois has adopted the Riverboat
Gambling Act (Public Act 86-1029) which, effective as of
February 7, 1990, legalized riverboat gambling on navigable
waterways in the State of Illinois including the Fox River
running through the City of Elgin, Illinois; and
WHEREAS, the Riverboat Gambling Act states that the
Illinois Gaming Board may issue a license authorizing a
riverboat to dock in a municipality only if, prior to the
issuance of the license, the governing body of the
municipality has by a majority vote approved the docking of
riverboats in the municipality; and
WHEREAS, Messrs. Peter Simon, Michael Ensign, William
Richardson, and David Belding have presented to the City their
plan for the establishment of riverboat gambling facility on
the Fox River within the corporate limits of the City of Elgin
to be owned and operated said individuals or by an entity
which they will own and control; and

WHEREAS, it appears that the establishment of riverboat "
gambling within the corporate limits of the City of Elgin,
Illinois, will generate substantial tax revenues for and
increase employment opportunities within the City of Elgin and
will otherwise be in the best interests of the City.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF ELGIN, ILLINOIS, that the City of Elgin hereby
endorses and supports the issuance by the Illinois Gaming
Board to Messrs. Simon, Ensign, Richardson, and Belding, or to
an entity owned and controlled by them, of an Owner's License
as provided in Section 6 of the Riverboat Gambling Act in
order that they, individually or by means of an entity owned
and controlled by them, may establish, own, and operate on the
Fox River a riverboat gambling facility which docks within the
corporate limits of the City of Elgin.

C HEARING FOR TAX LEVY 4
Mayor VanDeVoorde opened the public hearing for the 1991
property tax levy and asked City Manager Rice to make
introductory remarks.
Mr. Rice stated that the law requires a truth in taxation
advertisement in the paper and a public hearing to be held
whenever the proposed levy in dollars exceeds 105 percent of
the previous year's tax levy. Due to Elgin's rather rapid
growth, this has been the case without exception for a long
time, and particularly the last couple years when the City
has experienced heavy industrial growth. Five years ago the
Council established a policy of targeting $1.92 per $100 as
the tax rate. It has typically come under by a factor of
anywhere from 1, 2, 3, or 4 cents, and last year it was under
by 11 cents because of the huge increase that came on because
of the Randall corridor. The same phenomenon is happening
this year --a rather substantial increase in real dollars
because of that growth and the inflationary value of the
property. The tax levy was prepared at the $1.92 rate in
conformance with the Council's policy the last several years.
Mayor VanDeVoorde asked if there was anyone in the audience
who wished to make comments regarding the 1991 proposed tax
levy. Eight people addressed the Council expressing concern
and objecting to the rising real estate taxes, and a number
of other people were present for the public hearing.
Councilwoman Moylan made a motion, seconded by Councilwoman
Popple, to close the public hearing. Yeas: Councilmembers

AMENDING CERTAIN DEVELOPMENT REGULATIONS OF THE
ELGIN MUNICIPAL CODE, 1976, AS AMENDED
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ELGIN,
ILLINOIS:
Section 1. That Section 14.08.020 of Chapter 14.08
entitled "Sewer System" of the Elgin Municipal Code, 1976, as
amended, be and is hereby amended to read as follows:
14.08.020 Storm and sanitary sewer --Cross connection
prohibited.
It is unlawful for any person, firm or
l corporation to connect, cause to be connected,
assist or take part in connecting any storm sewer
with any sanitary sewer, or any part thereof, or any
sanitary sewer with any storm sewer or any part
thereof.
All downspouts, outside stairwells and roof
drains shall discharge onto the ground or be
connected to storm sewers, drainage ditches or storm
drainage systems. Footing drains shall be connected
to sump pumps and discharge shall be made into storm
sewers or sewer lines connected to storm sewers.
Where developments are approved without a storm
sewer, sump pumps shall discharge into drainage
ditches or storm drainage systems. Sump ,pumps
installed to receive and discharge building floor
drain flow, laundry tubs or other wastewater shall
be connected to the sanitary sewers. Each
individual sump pump shall be used for one function
only, either the discharge of uncontaminated storm
related groundwaters or the discharge of wastewater....
It is unlawful for any person, firm or
corporation to connect, or cause to be connected any
drain carrying, or to carry, any toilet, sink,
basement, septic tank, cesspool, or industrial waste
` or any fixture or device discharging polluting
substances to any storm water drain in the city.

entitled "Definitions" of the Elgin Municipal Code, 1976, as
amended, be and is hereby amended to read as follows:
18.08.050 Density, net residential.
"Net residential density" means the ratio
between the total number of dwelling units by
dwelling unit type on the land area designated for
that type of residential use and the total
residential land area by dwelling unit type in
acres, exclusive of all public and private
right-of-way and other nonresidential uses-.
Section 3. That Section 18.08.225 of Chapter 18.08
entitled "Definitions" of the Elgin Municipal Code, 1976, as
amended, be and is hereby added to read as follows:
18.08.225 Sanitary wastewater treatment facility,
public.
"Sanitary wastewater treatment facility,
public means a facility owned and operated by the
Fox River Water Reclamation District or the
Metropolitan Water Reclamation District of Greater
Chicago and designed for the treatment of sanitary
wastewater effluent.
Section 4. That Section 18.16.010(E) of Chapter 18.16
entitled "Preliminary Plat" of the Elgin Municipal Code, 1976,
as amended, be and is hereby amended to read as follows:

Section 5. That Section 18.16.020(G) of Chapter 18..16
entitled "Preliminary Plat" of the Elgin Municipal Code, 1976,
as amended, be and is hereby amended to read as follows:
G. Topographic data including existing
contours at vertical intervals of not more than two
feet (topographic data refers to the city datum);
watercourses, floodplains, wetlands, rock outcrops,
trees of twelve inch diameter or more, other
significant features, and soil bearing data at
locations and depths as may be required by the
engineering division of the department of public
works.
Section 6. That Section 18.16.030(H) of Chapter 18.16
entitled "Preliminary Plat" of the Elgin Municipal Code, 1976,
as amended, be and is hereby amended to read as follows:
H. Impact assessments as may be required by
the planning department in order to adequately
evaluate the effect of the proposed development on

on material capable of producing clear and legible
contact prints or photostatic copies and shall show
the following:
A. Name and address of developer;
B. Street names;
C. Location by section, township, and range
and by legal description;
D. Graphic (engineering) scale shall be one
inch to one hundred feet. An additional plat at an
alternative scale may be submitted for recording
purposes if required for plat legibility and
approved by the planning department and the
engineering division of the department of public
works;

Section 8. That Section 18,28.020(A) of Chapter 18.28
entitled "Required Improvements"' of the Elgin Municipal Code,
1976, as amended, be and is hereby amended to read as follows:
A. Sanitary sewer lines, including sewer stub
terminals at the property line of each lot or each
potential building location, shall be installed to
serve all properties except where private septic
systems are permitted. Sanitary sewer lines shall
be connected to a public sanitary sewage collection

execute an employment agreement on behalf of the City of Elgin
with Richard A. Bell for professional golf services at Spartan
Meadows and Wing Park Golf Courses, a copy of which is

WHEREAS, the City of Elgin will have sufficient funds on
hand to pay the tax levied by Ordinance S1-80, An Ordinance
Providing for Borrowing Money and Issuing Bonds of the City of
Elgin, Kane and Cook Counties, Illinois, to the Amount of
$18,900,000 for Paying the Cost of Constructing Public
Improvements in said City, and Providing for the Levy and
Collection of a Direct Annual Tax for the Payment of the
Principal and Interest of Said Bonds; and
WHEREAS, the levy of the tax for the year 1991 provided
in the ordinance is unnecessary.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE

WHEREAS, written application has been made to reclassify
certain property located at 932 East Chicago Street from R-3
Two Family Residence District to B-3 Service Business
District; and
WHEREAS, 'the Land Use Committee has conducted a public
hearing after due notice and submitted its written findings
and recommendations to the City Council; and

RESOLUTION
AUTHORIZING THE OBTAINING OF A TAX DEED FOR 129 SOUTH
STATE STREET FOR OPEN SPACE PURPOSES
WHEREAS, it is in the best interest of the City of Elgin
to dedicate certain real property for open space purposes; and
WHEREAS, the addition of said property to the public
property owned by the City of Elgin will benefit the City and
its residents.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF ELGIN, ILLINOIS, that it hereby authorizes the
acquisition of a tax deed of 129 South State Street for the
City of Elgin for the property legally described as follows:
The southerly 33 feet of that part of Lot 4 of
William C. Kimball's Addition to Elgin, lying west
E......: of the right of way of the Chicago and North Western

Councilman Gilliam made a motion, seconded by Councilman Fox,
to place the above reports on file as published. Yeas:
Councilmembers Fox, Gilliam, Moylan, Popple, Walters, and
Mayor VanDeVoorde. Nays: None.
RECOGNIZE PERSONS PRESENT
Robert Sites of 432 Hubbard addressed the Council and stated
that he is the owner of apartment buildings on Mulberry. He
said that people who live in the area are scared to death, and
potential tenants are afraid to move into the apartments
because of the problems with crime and drugs in the area. He
stated that the people in the neighborhood are willing to do
whatever is necessary to assist the police department and the
City, and he requested that the Council give this neighborhood
its most urgent consideration.
He suggested that the Mayor or City send out a newsletter
every six weeks to the people in the area, including the
people in the perimeter, informing them what the City is doing
to try to correct the problems. He feels that this would help
in the formation of a neighborhood group if the people are
assured that the City is doing something.
City Manager Rice stated that certain apartments in the area
Mr. Sites is referring to is the area where a coordinated
effort between BIS and the police department revealed 1600

code violations several months ago--50 of which are considered
serious. These violations are being processed and the
necessary repairs will probably be very expensive for the
property owners.
Councilwoman Popple suggested that it might be time to revisit
the rental registration ordinance and make it more like the
liquor license process where the City would not issue a permit
for places that have a number of code violations.
BIS Superintendent Burkart stated that the rental registration
ordinance simply requires that rental properties be listed to
make sure they meet the zoning requirements. There is no
provision in that ordinance for punishing property owners for
code violations. That is not part of that ordinance.
Mayor VanDeVoorde stated that we do have codes. However, they
have to be enforced through the courts, not always with a
great deal of success. BIS Superintendent Burkart stated that
he believes they are having increased success, because the
department is preparing its cases better and judges are
becoming more aware of the problems associated with code
violations.
ADDITIONAL BUDGET MEETING DATE SCHEDULED
Because of the late hour, the budget meeting which had been
continued to tonight was cancelled. Councilwoman Moylan made
a motion, seconded by Councilwoman Popple, to set the final
budget meeting for November 25, 1991, at 5 p.m. in the First
Floor Conference Room of the South Tower, Elgin 'City Hall.
Yeas: Councilmembers Fox, Gilliam, Moylan, Popple, Walters,
and Mayor VanDeVoorde. Nays: None.
ANNOUNCEMENTS
Mayor VanDeVoorde made an announcement that the December 11,
1991, Committee of the Whole and City Council meetings have
been rescheduled to December 18, 1991.

Councilman Walters made a motion, seconded by Councilman
Gilliam, to adjourn the meeting. Yeas: Councilmembers Fox,
Gilliam, Moylan, Popple, Walters, and Mayor VanDeVoorde.
