HomeMy WebLinkAbout91-11VOLUME LVI NOVEMBER 6, 1991 633 COUNCIL OF THE CITY OF ELGIN, ILLINOIS COUNCIL-MANAGER FORM OF GOVERNMENT RESCHEDULED REGULAR MEETING A rescheduled regular meeting of the Council of the City of Elgin, Illinois, was held on November 6, 1991, in the Council Chambers. The meeting was called to order by Mayor VanDeVoorde at 8:05 p.m. The Invocation was given by Reverend Joleen Gleasman, and the Pledge of Allegiance was led by Councilman Gilliam. ROLL CALL Roll call was answered by Councilmembers Fox, Gilliam, Moylan, Popple, Walters, Yearman, and Mayor VanDeVoorde. Absent: None. AS Councilwoman Popple made a motion, seconded by Councilman Fox to approve the October 23, 1991 Council Minutes as published. Yeas: Councilmembers Fox, Gilliam, Moylan, Popple, Walters, Yearman, and Mayor VanDeVoorde. Nays: None. BID FOR TOWING SERVICES - RETAINED ON TABLE Councilwoman Moylan made a motion, seconded by Councilwoman Popple to adopt the aforementioned resolution. RESOLUTION DETERMINING AMOUNTS OF MONEY ESTIMATED TO BE NECESSARY TO BE RAISED BY TAXATION UPON TAXABLE PROPERTY IN THE CITY OF ELGIN AND PROVIDING FOR NOTICE AND A PUBLIC HEARING THEREON WHEREAS, the Truth in Taxation Act provides that if the ad valorem property tax levy for the current year is estimated to exceed 105% of the extension for the prior year, a public hearing shall be held after notice in the manner required by the Act; and WHEREAS, it is necessary and desirable to determine whether the proposed 1991 tax levy is less than 105% of the 1990 property tax levy as proposed. 634 NOVEMBER 6, 1991 VOLUME LVI NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS: 1. That it hereby finds and determines that the 1990 ad valorem property tax levy excluding debt services as extended was $9,541,297 against taxable property in the City of Elgin. 2. That it hereby finds and determines that the amounts of money extended estimated to be necessary to be raised by ad valorem taxation upon taxable property in the City of Elgin for the year 1991 is $11,367,677. 3. That it hereby finds and determines that the amounts of money estimated to be necessary to be raised by taxation upon taxable property for the year 1991 is in excess of 105 of the amount of ad valorem property tax extended for the year 1990 against taxable property in the City of Elgin. 4. That a public hearing shall be held on November 20, 1991 at 8:00 p.m. in the City Council Chambers, 150 Dexter Court, Elgin, Illinois concerning the 1991 property tax levy. 5. VOLUME LVI NOVEMBER 6, 1991 637 Ordinance No. G71-91 N PROHIBITING LOITERING FOR DTHE NPURPOSE OF ENGAGING IN PROSTITUTION -RELATED OR DRUG -RELATED ACTIVITIES WHEREAS, innocent persons, especially children, who come into contact with illegal prostitution -related and drug related activities within the City of Elgin and their own neighborhoods are seriously and adversely affected; and WHEREAS, the Mayor and City Council have been made acutely aware by citizens and citizen groups of this City as to the increased, illegal prostitution -related and drug -related activities occurring in certain neighborhoods within the City; and WHEREAS, the Mayor and City Council find and declare that prostitution -related and drug -related activities are a City-wide problem of such substantial and significant proportions that it threatens the health, safety, and welfare of this City, particularly children, so as to require the immediate passage of an ordinance prohibiting loitering for the purpose of engaging in prostitution -related or drug -related activities; and WHEREAS, the City of Elgin is authorized to enact this ordinance pursuant to its police power and its home rule power. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS: Section I. That Chapter 10.36 of the Elgin Municipal Code, 1976, as amended, be and is hereby further amended by adding the following: 10.36.020 Loitering for the purpose of engaging in prostitution -related activity. a. It is unlawful for any person to loiter in or near any thoroughfare, or place open to the public, for the purpose of engaging in an act of prostitution contrary to any provisions of the prostitution -related portions of Article 11 of the Illinois Criminal Code, Ill. Among the circumstances which may be considered in determining whether such purpose is "manifested" are the following: 1. such person is a known unlawful drug user, possessor, or seller. For purposes of this ordinance, a "known unlawful drug user, possessor, or seller" is a person who has, within the knowledge of the arresting officer, been convicted in any court within this state of any violation involving the use, possession, or sale of any of the substances referred to in the drug laws within the previous year or such person has been convicted of any of the provisions of said drug laws or substantially similar laws of any political subdivision of this state or of any other state or jurisdiction within the previous year; or a person who displays physical characteristics of drug intoxication or usage, such as "needle tracks", or a person who possesses drug paraphernalia as defined in the Illinois Drug Paraphernalia Control Act, Ill. Rev. Stat., Ch. 561, Par. 2101 et seq., as amended; 2. such person is currently subject to an order of court prohibiting his or her presence in a high drug activity geographic area and such person is located in such an area; 3. such person behaves in such a manner as to raise a reasonable suspicion that he or she is about to engage in or is then engaged in an unlawful drug -related activity, including, but not limited to, such person acting as a "lookout"; 4. such person is a known member of a "gang" or association which has as its purpose illegal drug activity; for purposes of this ordinance, a "known" member of a "gang" is a person, who has, within the knowledge of the arresting officer, been convicted in any court within the United States, within the previous year, of any violation involving illegal gang activity. 5. such person transfers small objects or packages for currency in a furtive fashion; 6. such person takes flight upon the appearance of a police officer; 7. such person manifestly endeavors to conceal himself or herself or any object which 640 NOVEMBER 6, 1991 VOLUME LVI reasonably could be involved in an unlawful drug -related activity; 8. The area involved is known to be an area of unlawful drug use and trafficking. For purposes of this ordinance, an area "known to be an area of unlawful drug use" is a specifically defined geographic area, designated by the Chief of Police to be a known area of unlawful drug use; said designation being based on empirical data; C. No determination of intent shall be made absent an affirmative act by the person to be charged, which act or acts, when taken in context of the totality of the surrounding circumstances, shall constitute a substantial step towards the violation of the aforementioned drug laws. Section 2. That this ordinance and every provision thereof shall be deemed separable and the invalidity of any portion thereof shall not affect the validity of any other portion of this ordinance. Section 3. That all ordinances or parts thereof, inconsistent with the terms and provisions of this ordinance are hereby repealed. Section 4. BE IT FURTHER RESOLVED that Ed Spurr be and is hereby reappointed as a member of the Elgin Area Convention and Visitors Bureau for a term to expire December 31, 1993. Ordinance No. S19-91 AN ORDINANCE ANNEXING CERTAIN TERRITORY TO THE CITY OF ELGIN (South Side of Summit Street, West of Commonwealth Edison Right of Way) WHEREAS, a petition signed by all the owners of record of certain territory has been filed with the City Clerk requesting annexation of said territory to the City of Elgin, Illinois; and WHEREAS, said petition includes therein a statement under oath by all the owners of record that no electors reside on the subject territory; and WHEREAS, said territory is Contiguous to the City of Elgin and is not within the corporate limits of any municipality; and WHEREAS, legal notice of the intent of the City of Elgin to annex said territory have been forwarded to all public bodies required to receive said notice in the manner provided by law. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS: Section 1. That the following described territory be and is hereby annexed to the City of Elgin: The East 70.00 feet, as measured at right angles, of Lot 6 of Benhardt's Subdivision, being a subdivision of part of the Southwest Quarter of Section S, Township 41 North, Range 9 East of the Third Principal Meridian. Being situated in Hanover Township, Cook County, Illinois and containing 0.59' acre more or less. Section 2. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS: Section 1. C HEARING FOR TAX LEVY 4 Mayor VanDeVoorde opened the public hearing for the 1991 property tax levy and asked City Manager Rice to make introductory remarks. Mr. Rice stated that the law requires a truth in taxation advertisement in the paper and a public hearing to be held whenever the proposed levy in dollars exceeds 105 percent of the previous year's tax levy. Due to Elgin's rather rapid growth, this has been the case without exception for a long time, and particularly the last couple years when the City has experienced heavy industrial growth. Five years ago the Council established a policy of targeting $1.92 per $100 as the tax rate. It has typically come under by a factor of anywhere from 1, 2, 3, or 4 cents, and last year it was under by 11 cents because of the huge increase that came on because of the Randall corridor. The same phenomenon is happening this year --a rather substantial increase in real dollars because of that growth and the inflationary value of the property. The tax levy was prepared at the $1.92 rate in conformance with the Council's policy the last several years. Mayor VanDeVoorde asked if there was anyone in the audience who wished to make comments regarding the 1991 proposed tax levy. Eight people addressed the Council expressing concern and objecting to the rising real estate taxes, and a number of other people were present for the public hearing. That Section 14.08.020 of Chapter 14.08 entitled "Sewer System" of the Elgin Municipal Code, 1976, as amended, be and is hereby amended to read as follows: 14.08.020 Storm and sanitary sewer --Cross connection prohibited. It is unlawful for any person, firm or l corporation to connect, cause to be connected, assist or take part in connecting any storm sewer with any sanitary sewer, or any part thereof, or any sanitary sewer with any storm sewer or any part thereof. All downspouts, outside stairwells and roof drains shall discharge onto the ground or be connected to storm sewers, drainage ditches or storm drainage systems. Footing drains shall be connected to sump pumps and discharge shall be made into storm sewers or sewer lines connected to storm sewers. Where developments are approved without a storm sewer, sump pumps shall discharge into drainage ditches or storm drainage systems. Sump ,pumps installed to receive and discharge building floor drain flow, laundry tubs or other wastewater shall be connected to the sanitary sewers. Each individual sump pump shall be used for one function only, either the discharge of uncontaminated storm related groundwaters or the discharge of wastewater.... It is unlawful for any person, firm or corporation to connect, or cause to be connected any drain carrying, or to carry, any toilet, sink, basement, septic tank, cesspool, or industrial waste ` or any fixture or device discharging polluting substances to any storm water drain in the city. RECOGNIZE PERSONS PRESENT Robert Sites of 432 Hubbard addressed the Council and stated that he is the owner of apartment buildings on Mulberry. He said that people who live in the area are scared to death, and potential tenants are afraid to move into the apartments because of the problems with crime and drugs in the area. He stated that the people in the neighborhood are willing to do whatever is necessary to assist the police department and the City, and he requested that the Council give this neighborhood its most urgent consideration. He suggested that the Mayor or City send out a newsletter every six weeks to the people in the area, including the people in the perimeter, informing them what the City is doing to try to correct the problems. He feels that this would help in the formation of a neighborhood group if the people are assured that the City is doing something. City Manager Rice stated that certain apartments in the area Mr. Sites is referring to is the area where a coordinated effort between BIS and the police department revealed 1600 f VOLUME LVI NOVEMBER 20, 1991 691 code violations several months ago--50 of which are considered serious. These violations are being processed and the necessary repairs will probably be very expensive for the property owners. Councilwoman Popple suggested that it might be time to revisit the rental registration ordinance and make it more like the liquor license process where the City would not issue a permit for places that have a number of code violations. BIS Superintendent Burkart stated that the rental registration ordinance simply requires that rental properties be listed to make sure they meet the zoning requirements. There is no provision in that ordinance for punishing property owners for code violations. That is not part of that ordinance. Mayor VanDeVoorde stated that we do have codes. However, they have to be enforced through the courts, not always with a great deal of success. BIS Superintendent Burkart stated that he believes they are having increased success, because the department is preparing its cases better and judges are becoming more aware of the problems associated with code violations. ADDITIONAL BUDGET MEETING DATE SCHEDULED Because of the late hour, the budget meeting which had been continued to tonight was cancelled.
