COUNCIL OF THE CITY OF ELGIN, ILLINOIS
COUNCIL - MANAGER FORM OF GOVERNMENT
REGULAR MEETING
A regular meeting of the Council of the City of Elgin,
Illinois, was held on December 12, 1990, in the Council
Chambers. The meeting was called to order by Mayor
VanDeVoorde at 8:07 p.m. The Invocation was given by
Councilwoman Moylan, and the Pledge of Allegiance led by
Councilman Gilliam.
ROLL CALL
Roll call was answered by Councilmembers Fox, Gilliam,
Moylan, Popple, Walters, Yearman, and Mayor VanDeVoorde.
Absent: None.
CORRECTION TO NOVEMBER 14, 1990 MINUTES PREVIOUSLY APPROVED
Councilman Walters made a motion, seconded by Councilwoman
Popple, to correct the previously approved November 14, 1990,
Council minutes to include the following:
Councilwoman Popple made a motion, seconded by Councilman
Walters, to deny Petition 1 -90. Yeas: Councilmembers
Fox, Gilliam, Moylan, Popple, Walters, Yearman, and Mayor
VanDeVoorde. Nays: None.
THE NOVEMBER 28, 1990 COUNCIL MEETING APPROVED AS
Councilwoman Popple made a correction to the minutes on page
646 with reference to Petition 37 -90. She stated that her
motion had been to pass the subject ordinance, with the
condition that the City look at a way to improve the
intersection of Waverly and Summit, but she hadn't been
specific as to the manner of improvement. Councilwoman Popple
made a motion, seconded by Councilman Yearman, to approve the
November 28, 1990, Council minutes as corrected. Yeas:
Councilmembers Fox, Gilliam, Moylan, Popple, Walters, Yearman,
and Mayor VanDeVoorde. Nays: None.
RESOLUTION ADOPTED CONGRATULATING THE ELGIN SHARKS TRACK CLUB
FOR TAKING FIRST PLACE IN THE 1990 AAU NATIONAL YOUTH
CHAMPIONSHIPS
Councilman Fox made a motion, seconded by Councilwoman Popple,
to adopt the aforementioned resolution. Yeas: Councilmembers
- Fox, Gilliam, Moylan, Popple, Walters, Yearman, and Mayor
VanDeVoorde. Nays: None.

RESOLUTION
CONGRATULATING THE ELGIN SHARKS TRACK CLUB
FOR TAKING FIRST PLACE IN THE
1990 AAU NATIONAL YOUTH CHAMPIONSHIPS
WHEREAS, the Elgin Sharks Track Club was started in 1982
by Robert Pleticha; and,
WHEREAS, the Elgin Sharks Track Club finished first in
state and regional championships prior to being invited to
attend the national event; and,
WHEREAS, the Elgin Sharks Track Club participated in the
1990 Amateur Athletic Union /Carrier Cross Country National
Youth Championships on December 1 in Edwardsville, Illinois;
and,
WHEREAS, the Elgin Sharks Track Club competed against 17
teams and 325 youth; and,
WHEREAS, the Elgin Sharks Track Club team took second
place at the national event.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF ELGIN, ILLINOIS, that it congratulates the Elgin
Sharks Track Club for taking first place at the 1990
AAU /Carrier Cross Country National Youth Championships.

BID AWARDED FOR DEMOLITION OF VARIOUS STRUCTURES
Councilwoman Moylan made a motion, seconded by Councilwoman
Popple, to award the contract for demolition of twelve
structures to the low bidder, U. S. Dismantlement Corporation,
for a total amount of $44,900. Yeas: Councilmembers Fox,
Gilliam, Moylan, Popple, Walters, Yearman, and Mayor
VanDeVoorde. Nays: None.
BID AWARDED FOR DEEP WELL REPAIRS
Councilman Walters made a motion, seconded by Councilwoman
Yearman, to award this contract to Milaeger Well & Pump Co.
for $9,650. Yeas: Councilmembers Fox, Gilliam, Moylan,
Popple, Walters, Yearman, and Mayor VanDeVoorde. Nays: None.
BID AWARDED FOR PRINTING THE "ELGIN SPIRIT"
Councilman Fox made a motion, seconded by Councilwoman Popple,
to award separate contracts to the individual low bidders as
follows: Composition services to Woodman & Associates for a
total price of $3,300, and printing services, using recycled
paper, to Carson Printing for a total price of $15,498.
Yeas: Councilmembers Fox, Gilliam, Moylan, Popple, Walters,
Yearman, and Mayor VanDeVoorde. Nays: None.
BID AWARDED FOR PRINTING THE RECREATION NEWSLETTER
Councilwoman Popple made a motion, seconded by Councilwoman
Moylan, to award separate contracts to the individual low
bidders as follows: Typesetting services to Reily Graphic
Services for a total price of $3,984, and printing services,
using recycled paper, to Castle Communications for a total
price of $12,184. Yeas: Councilmembers Fox, Gilliam, Moylan,
Popple, Walters, Yearman, and Mayor VanDeVoorde. Nays: None.
BID AWARDED FOR ASPHALT ROLLER AND TRAILER
Councilman Fox made a motion, seconded by Councilman Gilliam,
to award this contract to the low bidder, Finkbiner
Equipment Company, for the amount of $17,010. Yeas:
Councilmembers Fox, Gilliam, Moylan, Popple, Walters, Yearman,
and Mayor VanDeVoorde. Nays: None.

Councilman Walters made a motion, seconded by Councilwoman
Popple, to remove this bid from the table. Yeas:

Councilman Walters made a motion, seconded by Councilwoman
Yearman, to award Sections I and II of this bid to the sole
responsive bidder, Ohm's Car Care, for the period ending
September 30, 1991. Yeas: Councilmembers Fox, Gilliam,
Moylan, Popple, Walters, Yearman, and Mayor VanDeVoorde.

BID AWARDED FOR FIRE STATIONS CONSTRUCTION
Councilwoman Popple made a motion, seconded by Councilwoman
Moylan, to award the contract for the construction of three
fire stations to the overall, low responsive bidder to
Skiender Construction, Inc. for a total amount of
$1,776,000. Yeas: Councilmembers Fox, Gilliam, Moylan,
Popple, Walters, Yearman, and Mayor VanDeVoorde. Nays: None.
BID FOR FOX LANE STORM SEWER TABLED
Councilwoman Yearman made a motion, seconded by Councilwoman
Popple, to table the aforementioned bid. Yeas:

Councilman Walters made a motion, seconded by Councilwoman
Moylan, to approve a January 9, 1991, public hearing date for

RESOLUTION
APPROVING PAYOUT FROM THE OLD MAIN RESTORATION ESCROW ACCOUNT
WHEREAS, the City of Elgin is the owner of certain real
property upon which is a structure commonly known as Old Main;
and
WHEREAS, the City of Elgin and the Elgin Historical Society
have entered into an 'agreement wherein Old Main is to be
renovated and occupied by the Historical Society as a historical
museum; and
WHEREAS, pursuant to said agreement the plans and contract
documents of such renovation are subject to the prior approval
of the City of Elgin; and
WHEREAS, on March 22, 1989 the City of Elgin, the Elgin
Area Historical Society and the First National Bank of Elgin
(escrowee) entered into an escrow agreement which established
the Old Main Restoration Account and authorized the escrowee to
make payments from said account on the written direction of the
City of Elgin and the Historical Society; and
WHEREAS, renovation work has been continuing and
application has now been made for the payment of $25.302.00 from
the escrow account.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF ELGIN, ILLINOIS, that the First National Bank of Elgin
is authorized and directed to release funds from the Old Main
Restoration Account in the following amounts to the following
suppliers:
Elgin Sheet Metal Company $25,302.00
per the written direction of the Elgin Area historical Society
dated December 3, 1990, a copy of which is attached hereto and
made a part hereof by reference.

ORDINANCE PASSED RECLASSIFYING PROPERTY WEST OF DOVER DRIVE
BETWEEN MAROON DRIVE AND VILLA STREET AND GRANTING A SPECIAL
Councilwoman Popple made a motion, seconded by Councilman
Walters, to pass the aforementioned ordinance. Yeas:

AN ORDINANCE
RECLASSIFYING PROPERTY WEST OF DOVER DRIVE BETWEEN
MAROON DRIVE AND VILLA STREET AND GRANTING A SPECIAL USE
FOR A PLANNED UNIT DEVELOPMENT
WHEREAS, written application has been made to reclassify
certain property located west of Dover Drive between Maroon
Drive and Villa Street from B -1 Community Business District to
R -3 Two Family Residence District and for a special use for a
residential planned unit development; and
WHEREAS, after due notice in the manner provided by law
the Land Use Committee conducted a public hearing concerning
said application and has submitted its written findings and
recommendation that the subject property be reclassified and a
special use for a residential planned unit development be
granted; and
WHEREAS, the City Council of the City of Elgin, Illinois,
has reviewed the findings and recommendation of the Land Use
Committee and concurs in its recommendation.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF ELGIN, ILLINOIS:
Section 1. That Chapter 19.08, Section
19.08.020 entitled "Zoning District Map" of the Elgin
Municipal Code, 1976, as amended, be and the same is hereby
further amended by adding thereto the following paragraph:
"The boundaries hereinbefore laid out in the
'Zoning District Map', as amended, be and are hereby
altered by excluding from B -1 Community Business
District and including in the R -3 Single Family
Residence District the following described property:
That part of Section 19, Township 41 North,
Range 9 East of the Third Principal Meridian,
described as follows: Beginning at the Northwest
corner of Lot 367 in Summerhill Unit 4, being a

AUTHORIZING EXECUTION OF AN EXTENSION RIDER TO A
LEASE AGREEMENT WITH GREYHOUND LINES, INC.
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ELGIN,
ILLINOIS, that Larry L. Rice, City Manager, be and is hereby
authorized and directed to execute an Extension Rider to a
lease agreement on behalf of the City of Elgin with Greyhound
Lines, Inc. for a single bus lane at the terminal facility at
100 West Chicago Street, Elgin, a copy of which is attached
hereto and made a part hereof by reference.

execute a Purchase of Services agreement on behalf of the City
of Elgin with the Suburban Bus Division of the Regional
Transportation Authority (Pace) for the provision of bus

WHEREAS, the City of Elgin has heretofore entered into a
contract with Donohue and Associates, Inc. for a
transportation study; and
WHEREAS, it is necessary and desirable to modify the
terms of the contract as is described in Change Order No. 1,
attached hereto.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF ELGIN, ILLINOIS, that Larry L. Rice, City Manager, be

WHEREAS, the City Council of the City of Elgin has provided

AMENDING CHAPTER 10.62 OF THE ELGIN
MUNICIPAL CODE REGARDING TRAPPING
AND HUNTING WITHIN THE CORPORATE LIMITS
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ELGIN,
ILLINOIS:
Section 1. That Chapter 10.62 entitled "Trapping" of
the Elgin Municipal Code, 1976, as amended, is repealed and
deleted.
Section 2. That the Elgin Municipal Code, 1976, as
amended, be and is further amended by adding Chapter 10.62
entitled "Hunting /Trapping ", as follows:
"CHAPTER 10.62
HUNTING /TRAPPING
10.62.010 Definitions.
A. "Hunt" means the act or attempt of a person
possessing a weapon or being accompanied by a dog or
a bird of prey to shoot, pursue, chase, track, lure,
kill, destroy, ensnare or harass any mammal or bird.
B. "Trap" means to capture, or attempt to
capture a bird or mammal by setting or placing a leg
hold trap, body - gripping trap, spring trap, cage,
deadfall, pit /trap, live trap, snare or snare -like
device, or other similar device designed or used to
capture, hold or kill.
10.62.020 Unlawful Acts Designated.
It is unlawful for any person, other than a law
enforcement official acting in the line of duty, to
hunt or trap or aid, abet, assist, facilitate or
otherwise allow another to hunt or trap any bird or
mammal within the City of Elgin.

10.62.030 Seizure.
The police shall seize any weapon, or trap
device used in any manner in violation of the
provisions of this chapter. Such weapon or trap
device shall be held by the police department
pending disposition of any court proceedings arising
out of such violations.
10.62.040 Penalty.
A. Any person violating any provisions of this
chapter shall be fined not less than $200.00 nor
more than $1,000.00.
B. In addition to any fine that may be imposed
upon conviction of violating any provision of this
chapter, the court may transfer the weapon or trap
device to the City of Elgin Police Department which
shall dispose of the weapon in the manner provided
by law."
Section 3. That all ordinances or parts thereof in
conflict with this ordinance are repealed.
Section 4. That this ordinance shall be in full force

RECOGNIZE PERSONS PRESENT

A number of residents of Parkwood Farms Summerhill
subdivision (west of Shales Parkway and south of Route 19)
were present at the meeting. Wanda Urban of 605
Thoreau,Elgin, spokesperson for the group, addressed the
Council with reference to their concerns about School District
U -46's plans to construct a bus barn adjacent to their
property. Various other Parkwood residents addressed the
Council with reference to this matter. They are very
concerned about the effect this will have on traffic, noise,
pollution, and property values. They came to the Council
because they did not feel that their concerns were being
addressed by U -46 officials. They were told that although the
school district must meet certain state standards, it is not
required to meet the city's standards, and the city really has
no authority over the school district. However, City Manager,
Larry Rice, informed the Parkwood residents that the city
staff would contact U -46 in an attempt to assist with
responding to their concerns.
Various other Parkwood residents addressed the Council with
reference to this matter.

Mayor VanDeVoorde made announcements relative to forthcoming
meetings.

SYNCOR ADMINISTRATIVE SERVICES, INC

BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ELGIN,
ILLINOIS, that Larry L. Rice, City Manager, be and is hereby
authorized and directed to execute an agreement on behalf of
the City of Elgin with Syncor Administrative Services, Inc.
for the preferred provider organization plan, a copy of which
is attached hereto and made a part hereof by reference.
