COUNCIL- MANAGER FORM OF GOVERNMENT
REGULAR MEETING
A regular meeting of the Council of the City of Elgin, Illinois, was held on October 10,
1990 at 8:00 p.m., in the Council Chambers. The meeting was called to order by Mayor
VanDeVoorde. The Invocation was given by The Reverend George Schiffmayer and the
Pledge of Allegiance led by Councilwoman Popple.
ROLL CALL
Roll call was answered by Councilmen Fox, Gilliam, Moylan, Popple, Walters, Yearman
and Mayor VanDeVoorde. Absent: None.
MINUTES OF THE SEPTEMBER 26, 1990
COUNCIL MEETING APPROVED AS PUBLISHED
Councilwoman Popple made a motion, seconded by Councilman Walters, to approve the
September 26, 1990 Council Minutes. Yeas: Councilmen Fox, Gilliam, Moylan, Popple,
Walters, Yearman and Mayor VanDeVoorde. Nays: None.
BID AWARDED FOR POWDERED ACTIVATED CARBON
Councilwoman Moylan made a motion, seconded by Councilwoman Yearman, to award
this bid to the low bidder, American Norit Company, at a unit price of $.358 /pound for
the first year and $.357 /pound for the second year. Yeas: Councilmen Fox, Gilliam,
Moylan, Popple, Walters, Yearman and Mayor VanDeVoorde. Nays: None.
BID AWARDED FOR LORD'S PARK PAVILION STABILIZATION
Councilman Fox made a motion, seconded by Councilman Gilliam, to award this bid to
the low bidder, Elgin Builders Inc., for a total price of $9,723.00. Yeas: Councilmen
Fox, Gilliam, Moylan, Popple, Walters, Yearman and Mayor VanDeVoorde. Nays: None.
BID AWARDED FOR ADDITIONAL IMPROVEMENTS TO THE WOOLWORTH BUILDING
Councilwoman Popple made a motion, seconded by Councilwoman Moylan, to award this
bid to the low bidders as follows:
Decono Construction for a total net price of $21,400.00 for the installation
of the suspended ceiling and the lighting improvements.
Revere Electric Supply for a total net price of $5,498.95 for the purchase
of the lighting fixtures.
Ackemann's for a total net price of $13,042.00 for the installation of floor
covering.
Yeas: Councilmen Fox, Gilliam, Moylan, Popple, Walters, Yearman and Mayor
VanDeVoorde. Nays: None.

Councilwoman Yearman made a motion, seconded by Councilman Walters, to approve
Petition 38 -90 subject to the recommendations of the Land Use Committee. Yeas:
Councilmen Fox, Gilliam, Moylan, Popple, Walters, Yearman and Mayor VanDeVoorde.
Nays: None.
Attorney Edward Graham appeared on behalf of the petitioner to address the unresolved
issue of parking stalls and vehicle stacking line for the car wash. Attorney Graham
requested permission to withdraw Petition 42-90.
Councilman Fox made a motion, seconded by Councilman Gilliam, to allow the petitioner
to withdraw Petition 42 -90.
Councilman Fox asked if it was the intent of the petitioner to apply for a liquor license
to which Attorney Graham responded that the petitioner would not seek a liquor license.
Yeas: Councilmen Fox, Gilliam, Moylan, Popple, Walters, Yearman and Mayor
VanDeVoorde. Nays: None.
Councilman Fox made a motion, seconded by Councilman Gilliam, to continue the
aforementioned public hearing to November 14, 1990. Yeas: Councilmen Fox, Gilliam,
Moylan, Popple, Walters, Yearman and Mayor VanDeVoorde. Nays: None.

Ordinance No. G50 -90
AN ORDINANCE
AMENDING CHAPTER 6.06 OF THE ELGIN MUNICIPAL CODE REGARDING
EXTERIOR SALES PERMITS
WHEREAS, the City Council of the City of Elgin had previously adopted an
ordinance on February 24, 1986 (Ordinance No. G14 -86) which provided for the
establishment of Extended Hour Permits and Exterior Sales Permits; and
WHEREAS, on June 14, 1989 the City Council passed on ordinance to eliminate
Extended Hour Permits (Ordinance No. G54 -89); and
WHEREAS, Ordinance No. G54 -89 inadvertently also eliminated exterior sales
permits; and
WHEREAS, the local liquor control commission has continued to issue exterior sales
permits and the City Council has determined that it is desirable to authorize such
permits.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
ELGIN, ILLINOIS:
Section I. That Section 6.06.055 of the Elgin Municipal Code, 1976, as amended,
be and is hereby further amended to read as follows:
"6.06.055 Exterior Sales Permit
There is hereby established an exterior sales permit to allow the
retail sale of alcoholic liquor for consumption on and within any beer
garden, patio area or any similar outside or unroofed or unenclosed areas
(hereafter referred to as exterior sales areas) adjoining and utilized in
conjunction with a principal establishment for which there is a then
currently issued and valid Class A, AA, C, D, E or J license. No alcoholic
liquor may be sold, served or consumed in any exterior sales area without
first obtaining a permit as provided herein.
I. No exterior sales permit shall be issued to any licensee whose
establishment is located 100 feet or closer to any residential zone as
measured from the boundary line of such residential zone to the exterior
sales area. Provided further, the foregoing limitation on the issuance of
exterior sales permits shall not apply to otherwise qualified establishments
located 100 feet or closer to a residential zone, for which an exterior sales
area had been established prior to March 10, 1986. Such otherwise
qualified establishments shall be permitted to apply for, obtain and renew
an exterior sales permit and to continue sales in the previously established
exterior sales area until such sales are abandoned, discontinued or the
exterior sales area is relocated or until the exterior sales permit expires
and is not renewed, whichever occurs first. Provided, the foregoing
notwithstanding, all exterior sales area shall be in conformance with the
foregoing distance limitation no later than March 10, 2001 and no exterior
sales permit shall be issued or effective after such date for any exterior
sales area not in conformance with such distance limitation.

2. Qualified applicants for exterior sales permits shall pay an
annual fee of five hundred dollars. Provided no fee shall be required for
permits issued for exterior sales areas which are engaged in the regular
service of food with alcoholic liquor and which have a total seating
capacity of not more than 20 and which are not covered by a roof or
enclosed by a fence or wall exceeding four feet or contained within or
under a tent."
Section 2. That all exterior sales permits heretofore issued shall be deemed valid
and shall be governed by the provisions of this ordinance.
Section 3. That all ordinances or parts of ordinances in conflict with the provi-
sions of this ordinance be and are hereby repealed.
Section 4. That this ordinance shall be in full force and effect from and after its
passage and publication in the manner provided by law.

AN ORDINANCE
DELETING AND REPEALING THE CLASS K LICENSE FOR
SPECIAL EVENTS /SALES BY APPLICANT
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS:
Section I. That Section 6.06.040(L) of Chapter 6.06 entitled "Alcoholic Liquor
Dealers" of the Elgin Municipal Code, 1976, as amended, be and is hereby deleted and
repealed.
Section 2. That Section 6.06.070(C) of Chapter 6.06 entitled "Alcoholic Liquor
Dealers" of the Elgin Municipal Code, 1976, as amended, be and is hereby deleted and
repealed.
Section 3. That Sections 6.06.080(A) and '0.06.080(8) of Chapter 6.06 entitled
"Alcoholic Liquor Dealers" of the Elgin Municipal Code, 1976, as amended, be and are
hereby amended to read as follows:
"6.06.080 License —Fee Payment -- Renewal
A. Except for Class G and I licenses, all license fees shall be due
and payable on or before May Ist of each year. The requisite fee shall
accompany all original or renewal applications. Class G and I license fees
shall be due and payable upon application.
B. All licenses, other than Class G and I licenses, shall expire on
April 30th, next after the date of issue. Class G and I licenses shall expire
at the end of the period for which any such license has issued."
Section 4. That all ordinances or parts of ordinances in conflict with the provi-
sions of this ordinance be and are hereby repealed.
Section 5. That this ordinance shall be in full force and effect from and after its
passage and publication in the manner provided by law.

amended, be and is hereby further amended by adding to the list of streets where parking
is prohibited under Section 1 I.60.050P the following:

Lyle Avenue to Creekside Circle, from November Ist to April Ist.

that it hereby accepts a Grant of Easement for a sanitary sewer along Shady Oaks Drive
and Summit Street for the property legally described as follows:
That part of the Southwest 1/4 of the Southeast 1/4 of Section 7,
Township 41 North, Range 9 East of the Third Principal Meridian, described
as follows: Beginning at the intersection of the North line of the Southwest
1/4 of the Southeast 114 of said Section 7 with the westerly Tine of Shady
Oaks Drive in Cobbler's Crossing Unit 2, being a subdivision in the South

RESOLUTION
AUTHORIZING EXECUTION OF AN ANNEXATION AGREEMENT
(Oak Grove)
WHEREAS, the owners of record of certain territory described in Exhibit A,
attached hereto and made a part hereof by reference, desire annexation of said territory
to the C##annex said territory upon certain terms and conditions; and
WHEREAS, a proposed annexation agreement has been filed with the City Clerk
and a public hearing has been held after due notice as required by law and all persons
appearing and wishing to testify concerning the proposed annexation agreement have
been heard; and
WHEREAS, it is the considered opinion of the corporate authorities of the City of
Elgin that it is in the best interests of the City of Elgin to enter into said annexation
agreement as proposed.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
ELGIN, ILLINOIS:
Section I. That the Mayor and City Clerk of the City of Elgin be and are hereby
authorized and directed to execute on behalf of the City of Elgin an annexation
agreement in the form attached hereto as Exhibit A and incorporated herein by
reference.
Section 2. That this resolution shall be effective from and after its passage as
provided by law.

COUNCIL- MANAGER FORM OF GOVERNMENT
REGULAR MEETING
A regular meeting of the Council of the City of Elgin,
Illinois, was held on October 24, 1990, at 8 p.m., in the
Council Chambers. Meeting was called to order by Mayor
VanDeVoorde. The Invocation was given by Reverend Martin
Balzer and the Pledge of Allegiance led by Councilman Walters.
ROLL CALL

Councilman Walters made a motion, seconded by Councilwoman
Popple, to approve the October 10, 1990, Council Minutes.

Officer Mike Turner stated that these individuals are
responsible for 18 felony arrests, 11 misdemeanor arrests, the
formation of The Elgin Chapter of Mothers Against Gangs,
production of Gang Awareness videotape, donation of over $400
in merchandise, and countless hours of volunteer service to
the Police and Community.
The Mayor and Council expressed their appreciation and
congratulations.
Councilman Walters made a motion, seconded by Councilwoman
Yearman, to award this bid for the Linden Avenue sidewalk to
Pride, Inc. in the amount of $10,115. Yeas: Councilmembers
Fox, Gilliam, Moylan, Popple, Walters, Yearman, and Mayor
VanDeVoorde. Nays: None.
BID AWARDED FOR ECC /FOUNTAIN S DARE PLAZA STORM SEWER
Councilwoman Moylan made a motion, seconded by Councilman Fox,
to award this contract to Gluth Brothers, Inc. in an amount
not to exceed $8,932. Yeas: Councilmembers Fox, Gilliam,
Moylan, Popple, Walters, Yearman, and Mayor VanDeVoorde.
Nays: None.
Councilman Gilliam made a motion, seconded by Councilman
Walters, to close the public hearing on Petition 39 -90.
Yeas: Councilmembers Fox, Gilliam, Moylan, Popple, Walters,

Councilman Gilliam made a motion, seconded by Councilwoman
Moylan, to approve Petition 39 -90 subject to the following
conditions: 1) That the annexation agreement provide that a

open space; and 2) That the fence behind the commercial area

RESOLUTION
DETERMINING THAT AMOUNTS OF MONEY ESTIMATED TO BE NECESSARY
TO BE RAISED BY TAXATION UPON TAXABLE PROPERTY IN THE
CITY OF ELGIN AND PROVIDING FOR NOTICE AND A
PUBLIC HEARING THEREON
WHEREAS, the Trust in Taxation Act provides that if the
ad valorem property tax levy for the current year is estimated
to exceed 105% of the extension for the prior year, a public
hearing shall be held after notice in the ,manner required by
the Act; and
WHEREAS, it is necessary and desirable to determine
whether the proposed 1990 tax levy is less than 1058 of the
1989 property tax levy as proposed.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF ELGIN, ILLINOIS:
1. That it hereby finds and determines that the 1989 ad
valorem property tax levy excluding debt services as extended
was $8,383,798 against taxable property in the City of Elgin.
2. That it hereby finds and determines that the amounts
of money extended estimated to be necessary to be raised by ad
valorem taxation upon taxable property in the City of Elgin
for the year 1989 is $9,541,297.
3. That it hereby finds and determines that the amounts
of money estimated to be necessary to be raised by taxation
upon taxable property for the year 1990 is in excess of 1058
of the amount of ad valorem property tax extended for the year
1989 against taxable property in the City of Elgin.
4. That a public hearing shall be held on November 14,
1990 at 8 :00 p.m. in the City Council Chambers, 150 Dexter
Court, Elgin, Illinois concerning the 1990 property tax levy.
5. That the City Clerk shall cause publication of a
notice of said public hearing to be made in a newspaper of
general circulation published in the City of Elgin in the
manner provided by law.

RESOLUTION
AUTHORIZING EXECUTION OF AN ANNEXATION AGREEMENT
(Safety Kleen Corp.)
WHEREAS, the owners of record of certain territory
described in Exhibit A, attached hereto and made a part hereof
by reference, desire annexation of said territory to the City
of Elgin; and
WHEREAS, said territory is contiguous to the City of
Elgin and is not a part of any other municipality; and
WHEREAS, no electors reside on the subject territory; and
WHEREAS, the corporate authorities of the City of Elgin
desire to annex said territory upon certain terms and
conditions; and
WHEREAS, a proposed annexation agreement has been filed
with the City Clerk and a public hearing has been held after
due notice as required by law and all persons appearing and
wishing to testify concerning the proposed annexation
agreement have been heard; and
WHEREAS, it is the considered opinion of the corporate
authorities of the City of Elgin that it is in the best
interests of the City of Elgin to enter into said annexation
agreement as proposed.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF ELGIN, ILLINOIS:
Section 1. That the Mayor and City Clerk of the City of
Elgin be and are hereby authorized and directed to execute on
behalf of the City of Elgin an annexation agreement in the
form attached hereto as Exhibit A and incorporated herein by
reference.

RESOLUTION
RATIFYING AND AUTHORIZING EXECUTION OF AGREEMENT WITH
LOCAL #330 GENERAL CHAUFFEURS, SALESDRIVERS AND HELPERS,
INTERNATIONAL BROTHERHOOD OF TEAMSTERS
WHEREAS, representatives of the City of Elgin and
representatives of Local #330 General Chauffeurs, Salesdrivers
and Helpers, International Brotherhood of Teamsters have met
and discussed wages, fringe benefits and other working
conditions; and
WHEREAS, said representatives have submitted for review
and approval by the City Council an agreement pertaining to
such matters; and
WHEREAS, the City Council has reviewed said agreement and
finds that it is fair and equitable for the City of Elgin and
employees covered by it.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF ELGIN, ILLINOIS, that it hereby ratifies and approves
the proposed agreement between the City of Elgin and Local
#330 General Chauffeurs, Salesdrivers and Helpers,
International Brotherhood of Teamsters, a copy of which is
attached hereto and made a part hereof by reference; the
ratification and approval by the City of Elgin is expressly
subject to review and approval by Pace, the Suburban Bus
Division of the Regional Transportation Authority.
BE IT FURTHER RESOLVED that Larry L. Rice, City Manager,
and Dolonna Mecum, City Clerk, be and are hereby authorized
and directed to execute said agreement on behalf of the City
of Elgin.

WHEREAS, written application has been made to classify

the Land Use Committee conducted a public hearing concerning
said application and has submitted its written findings and
recommendation; and
WHEREAS, the City Council of the City of Elgin, Illinois,
has reviewed the findings and recommendations of the Land Use
Committee and concurs in its recommendation.

3. U.S. Army Corps of Engineers and Illinois
Department of Water Resources approval of

accordance with city specifications, prior to final
plat approval.
4. Payment of school site, park site and water
system contributions prior to final plat approval.
5. Compliance with all applicable codes and
ordinances.
Section 3. That the special use granted herein shall
expire if not established within one year from the date of
passage of this ordinance.
Section 4. That this ordinance shall be in full force
and effect from and after its passage and approval in the
manner provided by law and shall be published in pamphlet form

BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ELGIN,
ILLINOIS:
Section 1. That Title 11, Chapter 11.60 of the Elgin
Municipal Code, 1976, as amended, be and is hereby further
amended by deleting from the list of thirty - minute parking
zones under Section 11.60.082 the following:
East Chicago Street, south side thereof, from
one hundred twenty -nine feet east of the Chicago and
Northwestern Railroad tracks westerly to one hundred
eighty -nine feet east of the Chicago and
Northwestern Railroad tracks.
Section 2. That Title 11, Chapter 11.60 of the Elgin
Municipal Code, 1976, as amended, be and is hereby further
amended by adding to the list of thirty- minute parking zones
under Section 11.60.082 the following:
East Chicago Street, south side thereof, from
106 feet east of the Chicago and Northwestern
Railroad tracks westerly to 198 feet east of the
Chicago and Northwestern Railroad tracks.
Section 3. That all ordinances or parts of ordinances in
conflict with the provisions of this ordinance be and are

AMENDING THE PROVISIONS OF THE MUNICIPAL CODE
RELATING TO THE BOARD OF FIRE AND POLICE COMMISSIONERS
WHEREAS, the City of Elgin is a home rule unit within
the meaning of the 1970 Constitution of the State of Illinois;
and
WHEREAS, a home rule unit may exercise any power and
perform any function pertaining to its government and affairs;
and
WHEREAS, the authority of the Board of Fire and Police
Commissioners is a matter pertaining to the government and
affairs of the City of Elgin.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ELGIN,
ILLINOIS:
Section 1. That Section 3.08.020 (B) and (C) of Chapter
3.08 of the Elgin Municipal Code, 1976 as amended, is hereby
amended to read as follows:
B. The fire chief, deputy chiefs, the
supervisor of training, superintendent of the bureau
of inspection services for the fire department and
the chief and deputy chiefs of the police department
shall be appointed by the city manager and shall be
subject to removal by the city manager.

nor be appointed by the Board to any position in the

ILLINOIS, that the public street known as Bel Air Court from
Annandale Drive to Annandale Drive be and the same is hereby
redesignated and renamed Aberdeen Court.
BE IT FURTHER RESOLVED that all city signs and maps shall
be altered to read Aberdeen Court at the aforesaid places.
BE IT FURTHER RESOLVED that the City Clerk is hereby
authorized and directed to give written notice to the election
authorities having jurisdiction in the area in which the
street name is hereby changed and to the post office branch
serving that area by certified or registered mail.
BE IT FURTHER RESOLVED that the resolution shall be in
effect thirty days after notice is given to the election
authorities and the post office as provided herein.
