RESOLUTION
ACCEPTING FOR OWNERSHIP AND MAINTENANCE CERTAIN PUBLIC
IMPROVEMENTS IN UNITS 1 AND 2 OF THE TALL OAKS SUBDIVISION
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ELGIN,ILLINOIS,that
the City of Elgin hereby accepts, subject to the terms of the Acceptance Agreement with the
Developer,for ownership and maintenance in the Tall Oaks Subdivision Units 1 and 2 the following
public improvements: the public streets, street lighting, street signage, storm sewers, water mains,
sanitary sewers and their related appurtenances. Acceptance of these improvements will add
approximately 14,599 lineal feet of 8-inch water main, 2,665 lineal feet of 12-inch water main,
1,085 lineal feet of 16-inch water main, 1,196 lineal feet of 24-inch water main,thirty-five 8-inch
valves in 4-foot vaults,six 12-inch valves in 5-foot vaults,three 16-inch valves in 6-foot vaults,one
24-inch valve in a 6-foot vault, 55 fire hydrants, 13,773 lineal feet of 8-inch sanitary sewer, 2,061
lineal feet of 10-inch sanitary sewer,83 sanitary manholes,7,230 lineal feet of 12-inch storm sewer,
2,922 lineal feet of 15-inch storm sewer,2,400 lineal feet of 18-inch storm sewer, 1,717 lineal feet of
21-inch storm sewer,2,315 lineal feet of 24-inch storm sewer, 56 lineal feet of 27-inch storm sewer,
1,577 lineal feet of 30-inch storm sewer, 1,039 lineal feet of 48-inch storm sewer,308 lineal feet of
54-inch storm sewer, 153 catch basins/inlets, 100 storm manholes, 93 street lights, 86 street signs,
20,535 lineal feet of improved street,41,070 lineal feet of curb and gutter,and their appurtenances to
the city maintained facilities
Notwithstanding the foregoing,and for the purposes of clarification,improvements not being
accepted at this time include the park, sidewalks, detention facilities, bike paths, parkway
improvements including trees,mulch,black dirt and sod along with four street lights along the north
side of Gansett Parkway that were installed but not connected by ComEd.

Acceptance of Public Improvements within the Tall Oaks Subdivision, Units 1 and 2
($114,076 estimated five-year maintenance cost)
OBJECTIVE:
Fulfill the city's obligation to maintain reliable infrastructure for serving businesses and resi-
dents.
RECOMMENDATION:
Approve the acceptance of the public improvements for ownership and maintenance in the Tall
Oaks Subdivision, Units 1 and 2.
BACKGROUND
Wyndham Deerpoint Homes is the developer of the Tall Oaks Subdivision, Units 1 and 2, which
includes the construction of public improvements associated with the development of 228 sin-
gle-family residential lots. The subdivision is located south of US Route 20 and west of Nesler
Road. Access to the subdivision from US Route 20 is provided via Plank Road to Russell Road
and access to Nesler Road is provided via Gansett Parkway. A location map is attached as Exhi-
bit A.
The city council adopted Resolution Number 05-305 approving the final plat for Tall Oaks Sub-
division Unit 1 at the October 26, 2005 city council meeting and recorded on November 18,
2005. The city council adopted Resolution Number 06-254 approving the final plat for Tall Oaks
Subdivision Unit 2 at the October 11, 2006 city council meeting and recorded on October 20,
2006.
Wyndham Deerpoint Homes requested that the city accept the public improvements of the
subdivision for ownership and maintenance via an acceptance agreement that was approved by
the city as Resolution No. 10-112 on June 6, 2010. The acceptance agreement provided for the
acceptance of certain improvements which the engineering department has inspected along
with the assistance of a stormwater consultant for the stormwater related components of the
development.

The public improvements to be accepted at this time include the public streets, street lighting,
street signage, storm sewers, water mains, sanitary sewers and their related appurtenances.
Improvements not being accepted at this time include the park, sidewalks, detention facilities,
bike paths, parkway improvements including trees, mulch, black dirt and sod along with four
street lights along the north side of Gansett Parkway that were installed but not connected by
ComEd. The four street lights will be accepted by the city when they are operational, which is
expected upon completion of Tall Oaks Subdivision Unit 3 public improvements.
Wyndham Deerpoint Homes has turned over for ownership and maintenance fourteen com-
mon parcels and certain sections of the storm sewer system to the homeowners association.
The private storm sewer exhibit was attached to and recorded with the final plats.
OPERATIONAL ANALYSIS
Acceptance of the public improvements will add approximately 14,599 lineal feet of 8-inch wa-
ter main, 2,665 lineal feet of 12-inch water main, 1,085 lineal feet of 16-inch water main, 1,196
lineal feet of 24-inch water main, thirty-five 8-inch valves in 4-foot vaults, six 12-inch valves in
5-foot vaults, three 16-inch valves in 6-foot vaults, one 24-inch valve in a 6-foot vault, 55 fire
hydrants, 13,773 lineal feet of 8-inch sanitary sewer, 2,061 lineal feet of 10-inch sanitary sewer,
83 sanitary manholes, 7,230 lineal feet of 12-inch storm sewer, 2,922 lineal feet of 15-inch
storm sewer, 2,400 lineal feet of 18-inch storm sewer, 1,717 lineal feet of 21-inch storm sewer,
2,315 lineal feet of 24-inch storm sewer, 56 lineal feet of 27-inch storm sewer, 1,577 lineal feet
of 30-inch storm sewer, 1,039 lineal feet of 48-inch storm sewer, 308 lineal feet of 54-inch
storm sewer, 153 catch basins/inlets, 100 storm manholes, 93 street lights, 86 street signs,
20,535 lineal feet of improved street, 41,070 lineal feet of curb and gutter, and their appurten-
ances to the city maintained facilities.
The city's acceptance of the public improvements will ensure proper snow removal and general
maintenance, providing residents and visitors with reliable infrastructure for business and lei-
sure activities.
As part of the development of Units 1 and 2 in the Tall Oaks Subdivision, Wyndham Deerpoint
Homes was required to provide stormwater management facilities to meet the city's stormwa-
ter ordinance. The design of the stormwater management facilities in Units 1 and 2 included
using additional facilities within the future Tall Oaks Subdivision Unit 3. Due to the current
economic conditions, the developer has not moved forward with the subdivision of Unit 3.
However, there are existing stormwater management facilities constructed within this Unit 3
that are required for Units 1 and 2. Because the plat for Tall Oaks Subdivision Unit 3 has not yet
been recorded, there are no easements or provisions identifying the responsibilities for the
ownership and maintenance of the stormwater facilities in Unit 3. A storm sewer and stormwa-
ter management easement has been prepared which identifies the obligation of maintenance
of the stormwater facilities to be Tall Oaks Investments, LLC, or its successors, and assigns hold-
ing title to the property subject to the easement. The proposed storm sewer and stormwater
management easement also allows the city the right to perform the necessary maintenance

work at no cost to the city. It is necessary to proceed with this additional storm sewer and
stormwater management easement concurrently with the city's proposed acceptance of the
improvements in Units 1 and 2 of the Tall Oaks Subdivision. Upon the recording of the final plat
for Unit 3,this easement will expire.
INTERESTED PERSONS CONTACTED
Staff made contact with Wyndham Deerpoint Homes to insure all requirements were met.
FINANCIAL ANALYSIS
There are no direct, immediate costs associated with this acceptance. However, maintenance
and operating costs for the water main, the sanitary sewer main, the storm sewer system,
pavement, streets lights, street signs and their appurtenances will increase over time and will
be included as part of the annual budgeting process. The estimated five year maintenance cost
is $114,076.
There are also no direct costs associated with the acceptance of the proposed storm sewer and
stormwater management easement over the future Unit 3. Maintenance and operating costs
associated with the storm sewer and stormwater management facilities and their appurten-
ances within the easements are the responsibility of Tall Oaks Investment, LLC. A recording fee
will be collected from the developer and will be utilized to pay the cost of recording the ease-
ment.

NEXT STEPS
1. Request sureties per the acceptance agreement for improvements against defects
caused by faulty workmanship or inferior materials.
2. Record the storm sewer and stormwater management easement plat covering the fu-
ture Unit 3.
3. If no defects are found within one year after city council's acceptance of certain public
improvements, return the surety documents to Wyndham Deerpoint Homes.
