RECOMMENDATION: Approve the purchase of the code enforcement administrative adjudication software from Da- cra of Des Plaines, Illinois in the amount of$40,000. BACKGROUND The city adopted an ordinance in 2009 allowing the prosecution of city ordinance violations to be taken out of the Kane County judicial system and brought into a local administrative adjudi- cation hearing process. Administrative adjudication allows city ordinance violations to be heard by an independent, city-appointed hearing officer rather than a judge in the circuit court. The proceedings are generally less formal than those in the state court, but still provide for funda- mental fairness and due process of law in every case. Fines collected as part of the administra- tive adjudication proceedings are retained by the city and not shared with the circuit court. This system began with parking violations and in October 2009 and later expanded to include other police-related offenses. In June of 2010,the code enforcement department began testing administrative adjudication to prosecute property code violations relating to overgrown weeds. Over the past several months, the types of property code violation cases being heard through administration adjudication has expanded to include the "no notice" violations. The table below demonstrates the significant efficiencies gained through prosecution under the administrative adjudication system: Case Prosecution 12 months 3-4 weeks Approximate Staff Hours 25 hours 2 hours 1 Expanding the range of code violations for enforcement under administrative adjudication has been limited because of insufficient software designed for code enforcement prosecutions. Code enforcement prosecutions are unique in that property cases are comprised of multiple violations linked to multiple owners or respondents. In contrast, police enforcement cases are managed with a single violator and a single offense. While this differentiation may appear sub- tle, it requires an entirely different approach to software design. In order to effectively manage the code enforcement property violation process, an appropriate software solution must be procured. This software should accomplish the following: • Blend with current administrative hearing management software • Interact with current collections system • Allow for the issuance of property maintenance citations in the field • Allow for the ability to query reports system-wide OPERATIONAL ANALYSIS Dacra provides the software that is being utilized by the overwhelming majority of Chicago-area municipalities operating administrative adjudication programs. Dacra's existing software within the city has exceeded performance expectations; it provides an off-the-shelf-system that can be customized to the city's business practices. It provides the added benefit of communicating with police department and finance department software systems. Most important, Dacra de- veloped the current software that is utilized to manage the entire administrative adjudication system with proven courtroom success. For these reasons, the city's preferred vendor is Dacra. Dacra was originally chosen to develop the police administrative adjudication software system due to its in-depth understanding and experience with developing this type of software. The ability Dacra has to customize software and provide enhanced modules has continued to pro- vide efficiencies that have allowed administrative adjudication to expand without significantly increasing staff time dedicated to these tasks. It is expected that this software system will sig- nificantly reduce citizen complaint response time and increase the compliance rate. This will be accomplished as two significant efficiencies that will be gained: • A field-based ticketing system will allow code officers to issue a simple citation im- mediately on the street, reducing the lag-time between observing the violation and the cumbersome case management process currently in existence • The reduction of follow up needed, as cases are immediately brought to an adminis- trative hearing. The quick turnaround from citation to courtroom demonstrates the importance the city places on resolving code violations and gaining compliance. 2 INTERESTED PERSONS CONTACTED Code, finance and the administrative adjudication staff have worked closely together in the de- velopment of this software. FINANCIAL ANALYSIS The total purchase price of this software system from Dacra will be $40,000. Existing staff will be utilized to manage the proposed software system and allow them to be more efficient and ultimately tasked with additional responsibilities. Also, the city will retain all revenues realized from the prosecution of code violations rather than receiving only a share of the proceeds. BUDGET IMPACT FUND(S) ACCOUNT(S) PROJECT#(S) AMOUNT AMOUNT BUDGETED AVAILABLE Riverboat 275-0000-791.92-50 398578 $40,000 $40,000 LEGAL IMPACT The proposed agreement would require an exception to the procurement ordinance. Excep- tions to the procurement ordinance require the affirmative vote of two-thirds of the members of the city council. ALTERNATIVES The city council may elect not to authorize the purchase. NEXT STEPS 1. Authorize the purchase. 2. Complete development and installation of the upgraded software package. The cost of the complaint/ticket/adjudication software is $40,000; this price includes 100 hours of customization (reports, screens, processes, as well as attachment of any current software for the purpose of transporting existing files into this new program and/or drawing payments from the current financial software of the city). Any hours above 100 will be billed at$125/hour. There are no additional licensing or maintenance fees. The program will include an inspection/service call/complaint tracking module as well as a community service module. A major anticipated revision to the base software will be the ability to produce multiple tickets from one service request; this is still in discussion. Another major change to the existing package would be actions associated with individual violations as opposed to one set of actions for an entire service request. The ability to time stamp and annotate evidence links will be included. These anticipated revisions can be accomplished within the 100 hours of included customization. Attached to this proposal are screenshots demonstrating the Code Enforcement Administrative Adjudication system that was installed for the Village of Mt. Prospect. This system incorporates both a service call module and an adjudication module. It is important to emphasize that this is just a model customized for the Village of Mt. Prospect. Each program is customized to the governmental body that commissions it. All our code enforcement and parking programs are built upon an administrative adjudication base, but each is different. Everything seen here can be customized to your municipality's needs, including reports and screens and processes. Dacra has created various programs (including Code Enforcement, Parking, Human Services, Animal Licensing, Housing, Police Reports, Personnel, etc.) at the following cities: Elgin, Des Plaines, Mount Prospect, Highland Park, Morton Grove, Skokie, Evanston, Freeport, Berwyn, Lombard, Mt. Prospect, Oak Park, Rock Island, St. Charles, Crystal Lake, Algonquin, Elk Grove Village, and Palatine. In addition we have created and continue to create and maintain software for Cook County and various private clients in the Chicago area and nationally. Our services include systems analysis to determine what the current business processes are and how they could be improved by automation, design and implementation of databases, training of personnel, and maintenance. 3 1 P a g e Dacra •• cIacraOcomcast.net (847) 298-2207 (office) (847) 298-2206 (fax) (847) 840-1071 (cell) Attached are references with phone numbers for current and recent clients (both governmental and private); there are many other clients whose systems have long been finished or whose businesses have relocated, so they are not detailed here.
