DESIGN SPECIFICATIONS 1. The Recipient shall prepare design specifications (Design) for the construction of stormwater best management practices (BMPs) to reduce stormwater volume and nonpoint source pollution to the Fox River from the Lord Street CSO basin area in Elgin, Illinois. The Design shall include the construction of 1) between twenty-four to thirty-eight bio-retention basins with a minimum combined total area of 11,400 square feet, 2) ten precast bio-retention units to be installed where traditional bio-retention basins are impractical, and 3) the replacement of one to two existing asphalt alleys with 10,400 square feet of porous pavement (permeable interlocking concrete pavement) constructed over a layer of open-graded stone that will serve as the structural base as well as provide temporary storage of runoff before it infiltrates into the sub-grade or slowly drains via perforated pipe in the stone base. The BMPs shall be designed to filter runoff so as to remove suspended sediment, heavy metals, oil and grease, nutrients, and other suspended and soluble nonpoint source pollutants as well as reduce runoff volume and velocity while providing other beneficial hydrologic functions. The BMPs shall be designed so as to retain smaller rain events. The Design shall identify the type and location of selected BMPs, describe the environmental problems associated with the sites and the criteria used to select each practices, and provide a detailed blueprint for their cost, advantages and disadvantages, location, design, maintenance, installation and construction, and materials used including Agreement No. IGIG1102 plant species. The Design shall also include an estimate of pollutant removal efficiency calculated using the Illinois EPA's Estimating Pollutant Load Reductions for Nonpoint Source Pollution Control BMPs workbook. The Design shall meet the requirements of the Illinois Urban Manual and the Native Plant Guide for Streams and Stormwater Facilities in Northeastern Illinois. The Design must be certified by a registered professional engineer or NRCS staff unless the Recipient obtains a waiver of this certification requirement from the Illinois EPA. Two (2) copies of the draft Design and "IGIG BMP Application Form" shall be completed and submitted by the Recipient to the Illinois EPA by May 1, 2013. Two (2) paper copies and one (1) electronic copy of the final Design and IGIG BMP Application Form" shall be completed and submitted by the Recipient to the Illinois EPA by July 1, 2013. PERMITS & LANDOWNERS AGREEMENTS 2. The Recipient shall secure all necessary permits prior to the implementation of the Design developed under Item 1 of this Agreement. The Recipient shall enter into appropriate legally binding arrangements with participating landowners to ensure that the BMPs are maintained as designed and that the operation and maintenance procedures are implemented for at least ten (10) years from the implementation of the BMPs. The Recipient shall submit a draft of the arrangement to the Illinois EPA by May 1, 2013. The Recipient shall submit a copy of the executed arrangement to the Illinois EPA by July 1, 2013. DESIGN IMPLEMENTATION 3. The Recipient shall implement the Design developed under Item 1 of this Agreement. The A1,1011.1of Recipient shall complete the installation and construction of the BMPs by-M 1, 2011. Photographic images, including before and after shots of the BMP location, documenting AC— Design implementation shall be completed and submitted by the Recipient to the Illinois EPA by October 1, 2014. PROJECT EVALUATION AND REPORT 4. The Recipient shall prepare a report explaining the execution of the Lord Street Basin CSO Green Infrastructure Retrofit Project (i.e., pre and post conditions, type and location of practices, practice design, methods of practice installation) and evaluating the project's success, including but not limited to improvements in water quality and stormwater runoff reductions. The report shall document the project tasks and summarize the findings of the project, including a discussion of the cost-effectiveness of selected practices in relationship to alternative management strategies. Two (2) copies of the draft report shall be completed and submitted by the Recipient to the Illinois EPA by August 1, 2014. The final report shall be completed and three (3) paper copies and one (1) electronic copy submitted by the Recipient to the Illinois EPA by October 1, 2014. OTHER DIRECTED ACTIVITIES 5. The Recipient shall be available for coordination and progress briefings. The dates and locations of these briefings will be specified by the Illinois EPA in consultation with the Recipient during the course of the project. 6. The Recipient shall submit a written progress report by the fifteenth (15th) of January, April, July and October occurring during the Agreement Period. Whenever practical reports should be submitted printed two-sided. Page 2 of 6 04/11 Agreement No. IGIG1102 7. All products produced and all work performed by the Recipient under this Agreement shall be subject to review and approval by the Illinois EPA to determine eligibility and acceptability in meeting the terms and intent of this Agreement. 8. The Recipient and the Illinois EPA retain the right to cite, quote, circulate, and reprint all documents and other materials produced under this Agreement. The Recipient will include in any publications for external general circulation (including all press releases, brochures, newsletters, Web sites, and presentation materials) the following phrase: "Funding for this project provided, in part, by the Governor of Illinois and the Illinois Environmental Protection Agency through the Illinois Green Infrastructure Grant Program." 9. At each site where BMPs are installed under this Agreement, the Recipient shall design and erect a sign which acknowledges the participating agencies and identifies the Illinois Green Infrastructure Grant Program for Stormwater Management as a funding source of the project. Sign design must be approved by, and consistent with the specifications of, the Illinois EPA prior to their installation at any site. Designs for all signs shall be completed and submitted by the Recipient to the Illinois EPA by July 1, 2013. The Recipient shall erect the signs approved by the Illinois EPA prior to the installation of the BMPs at its particular site. The signs shall remain in place throughout the installation of the BMPs and for a period thereafter as mutually agreed upon by the Recipient and the Illinois EPA. The Recipient shall complete the installation of all signs approved by the Illinois EPA by M&ch 204^.Alvs+I,10I 10. The Recipient shall develop Operation and Maintenance Plans (0 & M Plan) for the BMPs Ac_ implemented under this Agreement to ensure their long-term viability (at least ten years). The 0 & M Plan shall identify regular inspection needs and appropriate management activities such as sediment and debris removal, replacement of vegetation and hardware, chemical treatment, etc. The 0 & M Plan shall identify both coordinating (i.e., local governments) and participating (i.e., citizen groups, landowners) parties to carry out inspection and management needs and the financial resources necessary for implementation of the 0 & M Plan. A draft of all 0 & M Plans shall be completed and submitted by the Recipient to the Illinois EPA by July 1, 2013. RECOMMENDATION: Approve the Illinois Green Infrastructure Grant Financial Assistance Agreement in the amount of$117,900. BACKGROUND Synopsis At its December 15, 2010 meeting, city council approved a resolution authorizing staff to apply for funds through the Illinois Green Infrastructure Grant (IGIG) program administered by the Illinois Environmental Protection Agency (TEPA). The city applied for three projects. The IEPA re- ceived over 150 applications totaling $50 million in funding requests for the IGIG program. Of the fourteen projects selected, Elgin's was the second largest. To be selected for funding in such a com- petitive environment reinforces the merits of the project. Green infrastructure can not only beauti- fy an area but also helps reduce stormwater runoff, increase groundwater recharge, improve air quality and improve water quality. The funded project consists of installing stormwater best management practices (BMP's) in the Southwest Area Neighborhood (SWAN). The total project cost is $751,900 broken up as follows: $117,900 (city share) and $634,000 (state share). Sufficient funds to cover this match have been identified in the Combined Sewer Separation project funds. IGIG Background The IGIG program launched in 2010 and is designed to reduce stormwater runoff and improve water quality in Illinois. Projects are limited to areas served by separate or combined sewers, with a majority of the funding going to combined sewer areas. The IGIG program is funded at $5 million annually, which for the first year of the program's existence was woefully short of the demand as over$50 million in funding requests were submitted. • • Funded Project Details The city's funded project, currently titled Lord Street Basin CSO Green Infrastructure Retrofit Project consists of the installation of three types of stormwater BMP's in Elgin's SWAN neigh- borhood. The project focuses on sections of the neighborhood that will not see actual com- bined sewer pipe separation for several years. Stormwater BMP's include the installation of 24 to 38 bio-swales located in the parkway, at least three modular bio-retention basins and one- to-two permeable paver alleyways. {• e i °x-., 3 11 k, r d • ti o°t a S ��. .k" e� SSS g, �i.k"• 'T �"' — Bio-Retention Swale Modular Bio-Retention Swale Permeable Paver Alleyway A large determinant of this project's success is effective outreach to SWAN neighbors. Efforts to • ensure property owners agree with the installation of the proposed improvements, actively participate in their installation and maintain them will be vital. The project was applied for utilizing an existing grant writing agreement with Trotter and Asso- ciates. Representatives from this firm assisted staff develop the project and prepare the appli- cation. Pursuant to this agreement (Attachment A), Trotter and Associates will perform the planning, design and construction engineering for the project. OPERATIONAL ANALYSIS To formally accept the grant funds, the city must enter into a grant financial assistance agree- ment with the IEPA. This agreement outlines funding amounts, grant period of performance and details the scope of work to be completed. Project Timeline (2012—October 15, 2014) Between Q4 2011 and Q2 2012, the city will engage in the outreach, design and implementa- tion of a number (yet to be determined) pilot bio-retention swales and modular bio-retention installations. Initial outreach efforts will educate neighbors about the project, the benefits of stormwater BMP's, their maintenance, as well as locate property owners interested in having these improvements installed on their parkway. Volunteers will be sought to have the bio- retention swales installed as pilot installations. These test cases will help "iron out the kinks" in II the design, construction and implementation of the improvements before neighborhood-wide design/installation begins. Neighborhood-wide design would occur throughout Q4 2012 and Q2 2013 with construction on-going between 2Q 2013 and 2Q 2014. A final project evaluation report and operations and maintenance plan will be submitted to the IL EPA in Q4 of 2014. INTERESTED PERSONS CONTACTED Engineer Rob Linke of Trotter and Associates has worked closely with city staff to develop the project, grant proposal and project timeline. Preliminary outreach to SWAN neighborhood rep- resentatives has been met with a positive response. FINANCIAL ANALYSIS The total project cost is $751,900. The city's share of the project is sixteen percent or$117,900. The IGIG is a reimbursement grant. As such, the city is required to pay all design and construc- tion costs upfront and submit for reimbursement from the IL EPA. The grant terms allow for monthly reimbursements of incurred expenditures. Staff will strive to submit for reimburse- ment so that the city's expenditures do not exceed the approved match of$117,900. The Design shall include the construction of 1) between twenty-four to thirty-eight bio-retention basins with a minimum combined total area of 11,400 square feet, 2) ten precast bio-retention units to be installed where traditional bio-retention basins are impractical, and 3) the replacement of one to two existing asphalt alleys with 10,400 square feet of porous pavement (permeable interlocking concrete pavement) constructed over a layer of open-graded stone that will serve as the structural base as well as provide temporary storage of runoff before it infiltrates into the sub-grade or slowly drains via perforated pipe in the stone base. The BMPs shall be designed to filter runoff so as to remove suspended sediment, heavy metals, oil and grease, nutrients, and other suspended and soluble nonpoint source pollutants as well as reduce runoff volume and velocity while providing other beneficial hydrologic functions. The BMPs shall be designed so as to retain smaller rain events. The Design shall identify the type and location of selected BMPs, describe the environmental problems associated with the sites and the criteria used to select each practices, and provide a detailed blueprint for their cost, advantages and disadvantages, location, design, maintenance, installation and construction, and materials used including C Agreement No. IGIG1102 plant species. The Design shall also include an estimate of pollutant removal efficiency 3 calculated using the Illinois EPA's Estimating Pollutant Load Reductions for Nonpoint Source Pollution Control BMPs workbook. The Design shall meet the requirements of the Illinois Urban Manual and the Native Plant Guide for Streams and Stormwater Facilities in Northeastern Illinois. The Design must be certified by a registered professional engineer or NRCS staff unless the Recipient obtains a waiver of this certification requirement from the Illinois EPA. Two (2) copies of the draft Design and "IGIG BMP Application Form" shall be completed and submitted by the Recipient to the Illinois EPA by May 1, 2013. Two (2) paper copies and one (1) electronic copy of the final Design and IGIG BMP Application Form" shall be completed and submitted by the Recipient to the Illinois EPA by July 1, 2013. PERMITS & LANDOWNERS AGREEMENTS 2. The Recipient shall secure all necessary permits prior to the implementation of the Design developed under Item 1 of this Agreement. The Recipient shall enter into appropriate legally binding arrangements with participating landowners to ensure that the BMPs are maintained as designed and that the operation and maintenance procedures are implemented for at least ten (10) years from the implementation of the BMPs. The Recipient shall submit a draft of the arrangement to the Illinois EPA by May 1, 2013. The Recipient shall submit a copy of the executed arrangement to the Illinois EPA by July 1, 2013. DESIGN IMPLEMENTATION 3. The Recipient shall implement the Design developed under Item 1 of this Agreement. The �,t i 2011 Recipient shall complete the installation and construction of the BMPs by-4dlarc� 1, 2011.�1 Photographic images, including before and after shots of the BMP location, documenting Design implementation shall be completed and submitted by the Recipient to the Illinois EPA by October 1,2014. PROJECT EVALUATION AND REPORT 4. The Recipient shall prepare a report explaining the execution of the Lord Street Basin CSO Green Infrastructure Retrofit Project (i.e., pre and post conditions, type and location of practices, practice design, methods of practice installation) and evaluating the project's success, including but not limited to improvements in water quality and stormwater runoff reductions. The report shall document the project tasks and summarize the findings of the project, including a discussion of the cost-effectiveness of selected practices in relationship to alternative management strategies. Two (2) copies of the draft report shall be completed and submitted by the Recipient to the Illinois EPA by August 1, 2014. The final report shall be completed and three (3) paper copies and one (1) electronic copy submitted by the Recipient to the Illinois EPA by October 1, 2014. OTHER DIRECTED ACTIVITIES 5. The Recipient shall be available for coordination and progress briefings. The dates and locations of these briefings will be specified by the Illinois EPA in consultation with the Recipient during the course of the project. 6. The Recipient shall submit a written progress report by the fifteenth (15th) of January, April, July and October occurring during the Agreement Period. All products produced and all work performed by the Recipient under this Agreement shall be subject to review and approval by the Illinois EPA to determine eligibility and acceptability in meeting the terms and intent of this Agreement. 8. The Recipient and the Illinois EPA retain the right to cite, quote, circulate, and reprint all documents and other materials produced under this Agreement. The Recipient will include in any publications for external general circulation (including all press releases, brochures, newsletters, Web sites, and presentation materials) the following phrase: "Funding for this project provided, in part, by the Governor of Illinois and the Illinois Environmental Protection Agency through the Illinois Green Infrastructure Grant Program." 9. At each site where BMPs are installed under this Agreement, the Recipient shall design and erect a sign which acknowledges the participating agencies and identifies the Illinois Green Infrastructure Grant Program for Stormwater Management as a funding source of the project. Sign design must be approved by, and consistent with the specifications of, the Illinois EPA prior to their installation at any site. Designs for all signs shall be completed and submitted by the Recipient to the Illinois EPA by July 1, 2013. The Recipient shall erect the signs approved by the Illinois EPA prior to the installation of the BMPs at its particular site. The signs shall remain in place throughout the installation of the BMPs and for a period thereafter as mutually agreed upon by the Recipient and the Illinois EPA. WHEREAS,the CITY desires to engage the ENGINEER to furnish certain professional services for a grant writer program to apply on behalf of the City of Elgin for grants from various agencies for projects in the City of Elgin's approved five-year capital plan, as well as other programs and services that benefit the CITY(hereinafter referred to as the"PROJECT ); and, WHEREAS.The ENGINEER represents that it is in compliance with Illinois Statutes relating to professional registration of individuals and has the necessary expertise and experience to furnish such services upon the terms and conditions set forth herein below.
