WHEREAS, the Parties have entered into a Ride In Kane New Freed•m/JARC Service Agreement hereinafter referred to as the "RIK NFUJARC Agreement". WHEREAS, the RIK NFI/JARC Agreement provides for the City to •atisfy the local share for the eligible mobility management costs of the project for its registered riders and the local shs re for the eligible operating costs ofthe project at no less than 50 percent of the net cost for its registered riders; WHEREAS, Pace hereby agrees to subsidize the City service under tl e RIK NFI/JARC Agreement by contributing funds in the amount not to exceed $163,621 as long as Pace funds are available. NOW THEREFORE, in consideration of the mutual promises hereina er set forth, the parties agree as follows: TERM-This agreement will be in effect beginning January 1, 20 0 and ending December 31, 2010. PACE SUBSIDY—The maximum subsidy shall be the lesser of the amounts calculated in each of the following way: 1. 75% of the projected Operating Deficit in the A°proved Budget; or 2. 75% of the actual Operating Deficit; or 3. $3.00 multiplied by the number of annual one-w.y passenger trips not to exceed the maximum number of trips in the Approved Budg-t or $163,621 as long as Pace funds are available. BILLING—Pursuant to RIK NFUJARC Agreement, Pace shall bil the City on a monthly basis for 50 percent of the net operating costs of the service and a portion of the mobili management costs that may exceed funding hereunder less the remaining monthly Pace subsidy for its eligible r'ders.The City agrees to make payment to Pace due within thirty days of receipt of billing. Stegall, City Manager/ Steve Damolaris, GIS Planner SUBJECT: Participation in the Ride in Kane Program with Pace PURPOSE The purpose of this memorandum is to provide the Mayor and members of the City Council with information to consider the Ride in Kane Service Agreement with Pace. RECOMMENDATION It is recommended that the City Council approve the Ride in Kane Service Agreement and authorize the City's 2010 local share contribution in the amount of$68,219. rink BACKGROUND Since 1994, the City Council has approved a series of one-year agreements with Pace to provide Dial-a-Ride services to the residents of Elgin and the surrounding area. Through this program, door to door transportation service has been available to senior citizens and persons with disabilities. Service is provided seven days a week, 24 hours a day, with reservations taken 24 hours in advance of the trip. To participate in the Ride in Kane Program, the City of Elgin will pledge its Pace Dial-a-Ride Program budget for 2010 as its local share to leveraged funds. The City of Elgin will fund 14.7% (less fare revenue) of the Ride in Kane Program, while a Pace subsidy and federal matching grant will cover the remaining 85.3 %. The Riverboat Fund, account number 275-0000-791.80-43, project number 039886, Pace Contributions, has sufficient funds budgeted ($68,219) and available ($68,219) for this expenditure. The total Ride in Kane Program cost for 2010 is $538,680, which will be funded by an estimated $75,000 in fare revenue, a $163,621 Pace subsidy, a $231,840 federal matching grant, and Elgin's $68,219 local share. The maximum amount the City will expend for this program is $68,219. L GAL IMPACT one. ALTERNATIVES 1. The City Council may choose to approve the Ride in Kane Service Agreement and authorize$68,219 as the City's 2010 local share contribution. 2.
