• Thirty three food handling establishments opened and thirty five closed. One
daycare center opened. Twenty one food service establishment and retail food
store plans were reviewed.
• The Public Health Coordinator and Sanitarian investigated 71 food service
establishment and retail food store complaints, 25 of which were suspected food-
borne illness complaints.
• Thirty five other complaints were investigated regarding various health code
violations such as air, water, light and noise pollution, insect or rodent infestation,
indoor smoking, and stagnant residential swimming pools.
• The Health Division temporarily suspended 12 food service establishment
licenses. In addition, approximately 1,390 pounds of food were discarded from
food service establishments on 33 separate occasions due to temperature
violations or spoilage. In addition, nearly the entire food inventory at Dino's
Food was discarded due to a fire.
• The Health Division conducted food worker training on 3 occasions to help
establishments comply with the new food service worker requirement. Starting in
2011, the Elgin Food Safety Code requires that all food service workers must
complete a food service worker's sanitation course and pass a test within 90 days
of employment.
• The Health Division worked in conjunction with Clarke to provide
environmentally sound mosquito larvae control in the Kane County portion of
Elgin through complete inspections of potential mosquito breeding sites, pre-
hatch applications of active sites, larval control of mosquitoes with insect growth
regulators, and larval control treatment of the 5,500 public catch basins.

The Elgin Health Division licenses and inspects 390 food handling establishments, more
than twice as many establishments as twenty years ago. The increase of over 120 food
handling establishments since 2000 is attributed to retail development in Elgin, as well as
the licensing of soup kettle kitchens, school cafeterias, and daycare centers.
A food handling license is required for all food service establishments and retail food
stores. This includes full service restaurants, fast food restaurants, catering operations,
school cafeterias, nursing home kitchen facilities, daycare centers, workplace cafeterias,
grocery stores, bakeries, meat markets, taverns and convenience stores. Each type of
establishment is assigned a category of high, moderate or low relative risk of causing a
food borne illness, and inspection frequencies are assigned accordingly.
High risk establishments are inspected at least two or three times per year. In general,
full service restaurants, nursing homes, and catering operations are classified as relatively
high risk because their food is usually:
• cooked, cooled and reheated for later use;
• prepared for off-site service(such as catering);
• prepared hot or cold and held more than 12 hours in advance of service;
• prepared requiring complex or extensive handling; or
• served to immunocompromised individuals.
Moderate risk establishments are normally inspected annually. Fast food facilities,
grocery stores, bakeries, meat markets, and convenience stores are generally designated
as moderate risk since they serve food that is held for short periods of time, or with no
cooling and reheating.
Low risk establishments have a relatively low risk of causing food-borne illness and are
inspected annually. Taverns, liquor stores, and retail food stores selling only
prepackaged foods are examples of low risk establishments.

The Elgin Health Division issued a total of 481 temporary and seasonal food licenses the
past four years. Temporary food licenses are food service establishments that operate at a
fixed location for less than 14 consecutive days in conjunction with a single event or
celebration. Seasonal food licenses are issued to businesses with multiple temporary
events within the City. The increase in temporary food licenses is due to the growth in
the number of festivals, farmers markets, and other special events. Each establishment is
inspected and approved before it is allowed to sell food to the public.
The Elgin Health Division has annually inspected an average of 68 scavenger trucks the
past 10 years. The number of licenses issued has steadily increased with the number of
businesses requiring waste removal in Elgin. Scavenger trucks are vehicles that haul,
collect, or dispose of garbage, trash, ashes, animal, human or vegetable refuse, or offal
within the City limits. Trucks are inspected annually for proof of title, proof of liability
and property damage insurance, a valid license plate, a valid state or federal safety
number, and safety and sanitation concerns.
The Elgin Health Division conducted 188 inspections of public swimming facilities in
2011. Public swimming pools are pools within the City open to the public and include
swimming pools operated by the City of Elgin, the YMCA, hotels, schools, apartment
complexes, and townhouse or homeowner associations. Swimming pools are inspected at
least biannually. Water samples are taken annually at each pool and tested for coliform
bacteria. Since 2003, the Health Division has inspected spas to ensure they met Illinois
Department of Public Health requirements, which has increased the time spent at several
swimming facilities.
The Elgin Health Division inspected 55 vending machine locations in 2011. Vending
machines are inspected annually to ensure cold food machines are holding potentially
hazardous food at 41°F or less and cupped beverage machines are sanitary.

The Elgin Board of Health quarterly meeting was held on Monday, January 9, 2012 in the
Community Development Conference room at City Hall. The meeting began at 7:30 p.m.

Approval of Minutes: Dr. Hirsch moved to approve the minutes from the April 11,
2011 Elgin Board of Health quarterly meeting as submitted. Ms. Courtney seconded the
motion. The motion was adopted by a vote of five yes, and zero no.

Health quarterly meeting as submitted. Mr. Whitcomb seconded the motion. The motion

REVIEW OF THE FOURTH QUARTER OF 2011
Mercado Aurora #2, Grove Central Station, Poleteria Y Neveria Michoana, Feeding
Greater Elgin, and Dunkin Donuts on Dundee Avenue opened, and the Salvation Army
opened a Golden Diners at Judson University. Walmart and Subway opened at their new
location on South Randall Road and closed their North Randall Road business.
Candlewood Suites is now licensed to sell potentially hazardous food. Grove Central
Station was issued a temporary occupancy and opened in September, but failed to make
the necessary repairs to their elevator. Their temporary occupancy therefore expired in
December and they closed. El Comitan closed and reopened as Express Bakery.
During the past three months New Taste, Trefon's Family Restaurant, Deals on Randall
Road, Paleteria Juanita's, and the Hotdog Joint closed. The Blockbuster on Larkin
Avenue no longer sells potentially hazardous food.
The Public Health Division discarded food from the following establishments due to
temperature violations: 4 pounds from Ramiro's Restaurant, 5 pounds from Taqueria Los
Comales, and 10 pounds from Taqueria La Chapala. In addition, nearly the entire food
inventory from Dino's Food was discarded due to a fire in September. Dino's Food has
not yet reopened.

REVIEW OF THE YEAREND REPORT
The yearend report was reviewed. The Public health Coordinator noted an increase of
over 200 routine health inspections and 200 follow up inspections from 2010 to 2011.
This was due to the Health Division having a full staff the entire year, as well as having
two interns help with low risk food, food vending, and swimming facility inspections. In
addition, the Public Health Coordinator noted that Elgin has experienced an increase of
over 120 food handling establishments over the past twenty years due to the growth and
development of the city, as well as the Health Division licensing and inspecting soup
kettles, daycare centers and school cafeterias.
Thirty four food handling establishments opened and 35 closed in 2011. Almost 1,400
pounds of food was discarded on 33 separate occasions due to spoilage or temperature
violations, in addition to the removal of almost the entire food inventory at Dino's Food
due to a fire. The Health Division also issued 125 seasonal and temporary food permits,
41 scavenger licenses, inspected 55 food vending machine sites, and conducted 188
inspections of swimming facilities in 2011.
The Public Health coordinator noted that the Board of Health still has one vacancy and
encouraged current members to look for qualified candidates to apply for this position.

OMA Electronic Training
Effective January 1, 2012, elected or appointed members of a public body subject to OMA must
complete the electronic training once during their term of election or appointment as follows:
• Any person who is an elected or appointed member of a public body subject to the Act on January 1,
2012, must complete the electronic training between January 1, 2012, and January 1, 2013.
• Any person who becomes an elected or appointed member of a public body subject to the Act after
January 1, 2012, must complete the electronic training no later than the 90th day after taking the oath
of office or, if not required to take an oath of office, after otherwise assuming responsibilities as a
member of the public body.
Elected or appointed members need not complete the electronic training on an annual basis thereafter unless
they are also designated to receive training on compliance with the Open Meetings Act.

Subject: New Open Meetings Act Training Requirement
The Illinois General Assembly has adopted Public Act 097-0504 amending the Open Meetings
Act to require Open Meetings Act training for each elected or appointed member of a public
body subject to the Open Meetings Act. A copy of Public Act 097-0504 is attached.
The law which is codified in Section 1.05(b) of the Open Meetings Act (5 ILCS 120/1.05(b))
requires all of those elected and appointed members of a public body who are members of such a
public body on January 1, 2012, take the electronic Freedom of Information Act/Open Meetings
Act training by December 31, 2012. All such members who are elected or appointed after
January 1, 2012, have ninety (90) days to complete the training. The member of the public body
is required to provide the public body with a certificate of completion of the training. City
Boards and Commissions are subject to the requirements of the Open Meetings Act. Your
membership on a City Board or Commission therefore requires you to complete the training as
required by the statute.
The electronic training and curriculum in question is the curriculum developed and administered
by the Public Access Counselor of the Illinois Attorney General's Office. The Illinois Attorney
General's Office has advised that it will be adjusting its electronic training website to include a
training session specifically for public officials. According to the Attorney General's Office,this
new electronic training session will be up and running by January 1,2012.
Human Resources Director Gail Cohen and City Clerk Kim Dewis will be contacting you to
provide you assistance in arranging for this electronic training. As noted above, the training
must be completed by December 31,2012.

AN ACT concerning government.
Be it enacted by the People of the State of Illinois,
represented in the General Assembly:
Section 5. The Open Meetings Act is amended by changing
Sections 1.05 and 4 as follows:

Sec. 1.05. Training.

officers, or members to the Public Access Counselor. Within 6
months after the effective date of this amendatory Act of the
96th General Assembly, the designated employees, officers, and
members must successfully complete an electronic training
curriculum, developed and administered by the Public Access
Counselor, and thereafter must successfully complete an annual
training program. Thereafter, whenever a public body
designates an additional employee, officer, or member to
receive this training, that person must successfully complete
the electronic training curriculum within 30 days after that
designation.
(b) Except as otherwise provided in this Section, each
elected or appointed member of a public body subiect to this
Act who is such a member on the effective date of this
amendatory Act of the 97th General Assembly must successfully
complete the electronic training curriculum developed and
administered by the Public Access Counselor. For these members,
the training must be completed within one Year after the
effective date of this amendatory Act.
Except as otherwise provided in this Section, each elected
or appointed member of a public body subiect to this Act who
becomes such a member after the effective date of this
amendatory Act of the 97th General Assembly shall successfully
complete the electronic training curriculum developed and
administered by the Public Access Counselor. For these members,
the training must be completed not later than the 90th day
after the date the member:
(1) takes the oath of office, if the member is required
to take an oath of office to assume the person's duties as
a member of the public body: or
(2) otherwise assumes responsibilities as a member of
the public body, if the member is not required to take an
oath of office to assume the person's duties as a member of
the governmental body.
Each member successfully completing the electronic
training curriculum shall file a copy of the certificate of
completion with the public body.
Completing the required training as a member of the public
body satisfies the requirements of this Section with regard to

the member's service on a committee or subcommittee of the
public body and the member's ex officio service on any other
public body.
The failure of one or more members of a public body to
complete the training required by this Section does not affect
the validity of an action taken by the public body.
An elected or appointed member of a public body subject to
this Act who has successfully completed the training required
under this subsection (b) and filed a copy of the certificate
of completion with the public body is not required to
subsequently complete the training required under this
subsection (b) .
(c) An elected school board member may satisfy the training
requirements of this Section by participating in a course of
training sponsored or conducted by an organization created
under Article 23 of the School Code. The course of training
shall include, but not be limited to, instruction in:
(1) the general background of the legal requirements
for open meetings;
(2) the applicability of this Act to public bodies;
(3) procedures and requirements regarding quorums,
notice, and record-keeping under this Act;
(4) procedures and requirements for holding an open
meeting and for holding a closed meeting under this Act;
and
(5) penalties and other consequences for failing to
comply with this Act.
If an organization created under Article 23 of the School
Code provides a course of training under this subsection (c) ,
it must provide a certificate of course completion to each
school board member who successfully completes that course of
training.

MINUTES OF MEETING
October 8,2012
The Elgin Board of Health quarterly meeting was held on Monday, October 8, 2012 in
the Community Development Conference room at City Hall. Joni Courtney nominated
Dr. Franz Stockman to act as chair pro tem. The motion passed four yes and zero no.
The meeting was called to order by Dr. Stockman at 7:37 p.m.
Members Present: Joni Courtney, Dr. Franz Stockman, Dr. Dorothea Poulos,
Cynthia Applehoff-Siedsma
Members Absent: Jeanine Seitz-Partridge, Edward Whitcomb
Staff Present: Brad Bohner, Public Health Coordinator
Two new Board of Health members were introduced,Dr. Dorothy Poulos, and Cynthia
Applehoff-Seidsma.
Approval of Minutes: Dr. Stockman moved to approve the minutes from the January 9,
2012 Elgin Board of Health quarterly meeting as submitted. Ms. Courtney seconded the
motion. The motion was adopted by a vote of two yes, zero no, and two abstention.
REVIEW OF THE FIRST, SECOND AND THIRD QUARTERS OF 2012
Little Panda, Maedas Firepit, Prairie Rock Grill, San Luis Bakery, Mercado La Fiesta,
Charles Fast Food #5, Elgin Community College library coffee shop, Elgin Pancake
House, Veggie Place, Royal Liquors, McGruders Pub, Sam's Club, Politeria Y Neveria
La Michiocana, Erencia De Mis Padres, and Children Love to Learn Daycare Center
opened the first nine months of 2012. Swizzle Inn closed and reopened as 1 for the Road,
and Fox Valley Discount Market restaurant closed and reopened as El Rey de Huarache.
Walgreens moved from 955 to 589 North McLean Boulevard. Elgin Fresh Market
licensed their bakery with a separate owner as Azteca Bakery, Hampton Inn licensed their
breakfast area, Salon Couture obtained a liquor license, and McDonalds on Summit Street
reopened after a complete teardown and rebuild.
During the first nine months of 2012 Dulceria Yannely and Mariscos Los Canoas closed
at the El Mesias Mall. La Victoria, Babylon Kebob, Arvatis Pizza and Hotfast Pizza also
closed. Holsum Bakery no longer sells potentially hazardous food. Camaroncito Loco
was closed for 24 hours by the Health Department due to no running water.

The Public Health Division discarded food from the following establishments due to
temperature violations: 86 pounds from Stop N Shop, 4 pounds from Chicago Pizza
Authority, 2 pounds from Crave Deli, 5 pounds from Papa Savario, 10 pounds from El
Paraiso on Villa Street on two separate occasions, 10 pounds from the Islamic Institute of
Education cafeteria, 5 pounds from Gee N Jays, 15 pounds from Mercado Aurora#2, 10
pounds from White Pearl, 16 pounds from Chicago Gourmet Café, 20 pounds from
Arvatis Pizza, 27 pounds from Charles Fast Food, 3 pounds from Taqueria La Rosa, and
15 pounds from Colonial Café. Three pounds of food was discarded at Los Girasoles due
to cross contamination. In addition, approximately $34,000 of food from Meijer was
discarded due to temperature violations from a power loss, and 80 pounds of food was
discarded from La Casa de Polio Asado due to water and smoke damage from a fire in
the upstairs apartment.
The following swimming facilities were closed for at least 24 hours due to improper
disinfection levels: Comfort Suite spa, Holiday Inn spa, Garden Quarter Townhomes
swimming pool, Buena Vista swimming pool, and Highland Woods lap pool. Hunters
Ridge swimming pool was closed for 4 days due to turbidity. Buena Vista Swimming
pool was closed for 24 hours due to an inoperable pump. Garden Quarter Apartments
swimming pool was closed by the Illinois Department of Public Health for
noncompliance with the Virginia Graeme Baker Pool and Spa Safety Act.
REVIEW OF THE MOSQUITO CONTROL SEASON
This spring the City of Elgin Health Department obtained the required General National
Pollutant Discharge Elimination System Permit for Pesticide Point Source Discharges
which allows the Health Department staff to continue treating standing water on public
and private property for mosquito larvae. In August the Health Department disseminated
information to citizens regarding the symptoms of West Nile Virus and mosquito control
on private property. This was accomplished through door hangers, posters in public
establishments, an announcement at a City Council meeting, and posting notifications on
facebook, television, and water bills.
Additionally, the Health Department recently received bids for the 2013 mosquito control
contract from Clarke and Vector Disease Control International (VDCI). Both contracts
are similar in their approach to mosquito control. Mr. Bohner stated that he contacted
VDCI to discuss their proposal, and he also contacted their references and the Illinois
Department of Public Health. Since VDCI has a lower bid, Mr. Bohner will present their
contract to the City Council for approval.
MISCELLANEOUS
Several citations were issued to La Quebrada for allowing grease from their dumpster to
leak onto the city sidewalk on Division Street. Mr. Bohner has attended several
6 adjudication hearings to require the owner to correct this violation.

Mr. Bohner reminded the Board of Health that they must complete their electronic
training of the Open Meetings Act by December 31, 2012. All necessary links and
requirements were attached in the Board of Health packet.
Adjournment: There being no further items to discuss, the meeting was adjourned at
8:29 p.m.
